DECISION
APPROVING THE
ADJUSTMENTS AND SUPPLEMENTS TO THE THI VAI-VUNG TAU PORT SYSTEM PLANNING
THE PRIME MINISTER
Pursuant
to the Law on Organization of the Government of September 30, 1992;
At the proposal of the Ministry of Communications and Transport (in Official
Dispatch No.1911/KHDT of September 3, 1997), and considering the opinions of
the People's Committee of Ba Ria-Vung Tau province (in Official Dispatch
No.760/CV-UBT of November 11, 1997) and the evaluation by the Ministry of
Planning and Investment (in Official Dispatch No.6807/BKH-VPTD of October 27,
1997),
DECIDES:
Article 1.-
To approve the adjustments and supplements to the Thi Vai-Vung Tau port system
planning (already ratified by Decision No.55-TTg of November 5, 1992 of the
Prime Minister) with the following principal contents:
1. The location planning of port areas:
The Thi Vai-Vung Tau port system is planned into
5 areas with the following scales and functions:

b) Phuoc An port area (on the right bank of Thi
Vai river): for multi-purpose commercial ports and container ports for ships
with a tonnage of up to 30,000 DWT.
c) Phu My port area (from Muong canal to
upstream area of Ban Thach canal): for multi-purpose commercial ports and
specialized ports for ships with a tonnage of up to 30,000 DWT.
In this area, Thi Vai multi-purpose port of
2,000 m long is planned into a national port and managed by the Ministry of
Communication and Transport, which shall prepare the investment therein.
d) Cai Mep port area shall encompass:
- Upstream area of Nga Tu canal: for food ports,
oil product ports, multi-purpose commercial ports and container ports.
- Downstream area of Nga Tu canal (which is
about 2,000 m long): shall be the only area of the Thi Vai - Vung Tau port
system capable of harboring ships of large tonnage (of from 60,000 to 70,000
DWT), where priority shall be given to the building of a large-scale commercial
port for large ships, including container ships of modern generation and with a
large tonnage (of up to 60,000 DWT).
e) Vung Tau port area shall encompass:
- Ben Dinh-Sao Mai area: for Vung Tau
international port (already granted BOT investment license by the State), the existing
Vietsovpetro ports and petroleum technical service ports (of the Petroleum
Technical Service Company).
- Song Dinh area: for multi-purpose commercial
ports, specialized ports and maritime service projects for ships with a tonnage
of up to 10,000 DWT.

2. Issues related to the planning and investment
management
The Thi Vai - Vung Tau area is an area endowed
with particular advantages for building and developing a sea-port system
(especially deep-water ports for ships of large tonnage), that requires the
strict management of the planning and investment execution. The ports must be
built in a rational manner in terms of tonnage and capacity so as to make the
fullest use of existing natural potentials as well as water depth and river
bank.
The fund of land along the river banks within an
area of 300-500 meters wide from the river edge backward shall be used with
priority given to the building of ports, first of all a multi-purpose
commercial port with a large quantity of goods flow, a container port with a
high loading-unloading technology, then a specialized port.
In parallel with the building of ports, it is
necessary to develop infrastructure systems including land roads, railways,
water supply and drainage, electricity supply, information and
communications..., so as to meet the needs of the port system's operation and
conform to the socio-economic development plans, urban development plans and
communication plans of the Southern key economic region and of the locality.
Apart from the source of State budget capital,
the locality and domestic units shall be entitled to invest their own capital
or enter into joint ventures with foreign countries to carry out the
construction investment under the planning and in accordance with the current
regulations. The projects using domestic capital sources and mobilizing idle
capital from the people shall be specially encouraged.
3. Organization of implementation
The Ministry of Communications and Transport
shall enhance and raise the efficiency of the operation of the Management Board
of the Thi Vai - Vung Tau port system planning established by decision of the
Minister of Communication and Transport, and at the same time assume the prime
responsibility and coordinate with the People's Committees of Dong Nai and Ba
Ria-Vung Tau provinces and the concerned agencies in managing and supervising
the implementation of this planning in accordance with the current regulations.
Article 2.-
This Decision takes effect 15 days after its signing. The stipulations of
Decision No.55-TTg of November 5, 1992 of the Prime Minister which are contrary
to this Decision are now annulled.
Article 3.-
The concerned ministers, the heads of the ministerial-level agencies, the heads
of the agencies attached to the Government, and the presidents of the People's
Committees of Ba Ria - Vung Tau and Dong Nai provinces shall have to implement
this Decision.
