CIRCULAR
ELABORATING THE LAW ON URBAN AND RURAL PLANNING
Pursuant to the Law on Urban
and Rural Planning No. 47/2024/QH15 dated November 26, 2024;
Pursuant to Decree No.
33/2025/ND-CP dated February 25, 2025 of the Government on the functions,
tasks, powers and organizational structure of the Ministry of Construction;
At the request of the
Director of the Department of Planning and Architecture,
The Minister of Construction
hereby issues a Circular elaborating the law on urban and rural planning.
Chapter I
GENERAL PROVISIONS

1. This Circular details Clause
4 of Article 16, Clause 2 of Article 22, Clause 3 of Article 23, Clause 3 of
Article 24, Clause 4 of Article 27, Clause 3 of Article 29, Clause 2 of Article
31, Clause 2 of Article 34, Clause 3 of Article 35, Clause 5 of Article 40,
Point a of Clause 2 and Clause 3 of Article 47, Clauses 4 and 6 of Article 52
of the Law on Urban and Rural Planning.
2. Domestic and foreign
organizations and individuals when preparing or participating in preparing dossiers
on tasks in planning, urban and rural planning in Vietnam must comply with the
regulations herein.
Article 2.
General provisions on the composition of dossiers on tasks in planning, urban
and rural planning
1. The approved dossier on
tasks in planning, urban and rural planning is a paper dossier that has the
confirmation stamp of the competent authority.
2. The electronic dossier
(e-dossier) on urban and rural planning is a collection of related electronic
documents, including:
a) The basic digital database
that includes the drawing and text files printed as part of the paper dossier
with full content specified in Chapter II, Chapter III hereof, excluding
relevant documents and materials;
b) The legal digital database
that includes files digitized, scanned from paper or electronically certified
dossiers, with full components as specified in Chapter II, Chapter III hereof;
c) The digital geographic
information system (GIS) of urban and rural planning that includes files
converted into geographic data from the original database;
d) The e-dossiers on urban and
rural planning that must be prepared simultaneously during the process of
making, appraising and approving the task in planning, urban and rural
planning; ensuring that it meets the requirements for the management and use of
the urban and rural planning database;

3. Documents on collection of
opinions
a) The document on collection
of public opinions includes a summary report; drawings as prescribed, meeting
the requirements for collecting opinions as determined in the tasks in
planning;
b) The document on collection
of opinions from agencies and organizations includes paper documents
(description, drawings in appropriate scale, relevant legal documents) and
e-dossiers specified in Point a, Point b of Clause 2 of this Article.
4. The application for
appraisal
a) Written request for
appraisal of tasks in planning, urban and rural planning;
b) Paper dossier showing the
content and components of the dossier on tasks in planning, urban and rural
planning ensuring compliance with the regulations in Chapter II, Chapter III
hereof;
c) E-dossiers as prescribed in
Clause 2 of this Article.
4. The application for approval
includes:
a) written request for approval
of tasks in planning, urban and rural planning;

c) Report on the appraisal of
tasks in planning, urban and rural planning;
d) E-dossiers as prescribed in
Clause 2 of this Article.
5. Regulations on confirmation
stamps on approved urban and rural planning dossiers.
a) After the urban and rural
planning is approved by the competent authority, the agencies and organizations
that formulate such planning shall completes the dossier according to the
approval decision and sends it to the planning appraisal agency for
confirmation stamp according to the form specified in the Appendix attached
hereto.
b) The appraisal agency shall
use the confirmation stamp to stamp the description and drawings (all copies)
in the dossier on tasks in planning and the planning.
c) Number of dossiers that have
confirmation stamp: 07 sets.
Article 3.
General provisions on the specifications of dossiers on tasks in planning,
urban and rural planning
1. The contents of
descriptions, drawings of tasks and projects in the documents on collection of
opinions and the documents that have been submitted for appraisal and approval
shall be clearly and fully stated for each type and level of planning and
comply with regulations of Chapter II and Appendices hereof.
2. Drawing abbreviations and
symbols of tasks and urban and rural planning shall comply with regulations of
Appendices hereof.

4. All diagrams and maps in the
drawings of the dossiers on tasks and projects on urban and rural planning
shall clearly show the boundaries of planning; the boundaries and names of
administrative divisions within the planning scope; name of administrative unit
adjacent to the perimeter of the planned area.
Chapter
II
TASKS IN URBAN AND RURAL
PLANNING
Article 4.
Regarding Master planning
1. Description:
a) Reasons, necessity and
grounds for master planning; location, planning scope, and scale of planned
area.
b) Overview of natural
characteristics and status quo of the planned area; summary of main problems
encountered during management and development.
c) Orientation to development
in national planning, regional planning and planning options in the provincial
planning and projects in progress that affect the scope of general urban
planning.
c) Identification of
properties, driving force, role and function of planned areas for the country,
region and province; viewpoints and objectives of development; identification
of main problems that must be addressed in planning.

e) Requirement for the level of
survey, collection of documents and data, status quo assessment; requirement
for status quo database (including geographic data);
g) Research requirements on the
contents of the master planning suitable to the type of planning and the case
of planning formulation.
g) Identification of the list
of drawings, descriptions and attached appendices; the quantity and
specifications of the dossiers on master planning; cost estimates; plans and
progress in formulating master planning; determination of requirements for
contents, forms and enquired entities.
2. Written request for approval
of tasks in master planning and draft Decision of competent authority on
approval of such tasks.
3. Relevant documents:
a) Previous approval decisions
of the master planning (if any); Decisions on approval of planning and ongoing
projects affecting the scope of the planning.
b) Directives and instructions
from competent authorities on organizing the master planning formulation.
c) Other relevant documents.

b) Maps showing boundaries and
scope of the master planning.
c) Drawings in the dossier on
tasks in master planning with an suitable scale based on the orientation maps
for the development of the national urban-rural system; development orientation
maps for urban-rural systems; and planning option maps for urban-rural systems.
5. In addition to the above
requirements, the dossier on tasks in master planning must also satisfy the
following:
a) For expanded or new urban area:
must fully justify the basis and grounds for selecting urban development
directions and determining the planning scope and area size.
b) For communes: must determine
requirements for collecting information, documents, and data on status quo and
forecasted development of agricultural production activities; requirements for
assurance of food security in the commune; determine existing areas that have
been developed (according to urban standards) or planned according to urban
standards.
c) For economic zones: must
determine the requirements for collecting information, documents, and data on
the status quo and forecasted development of industry, agriculture, trade,
service, and logistics of relevant regions and provinces, and their impact on
the development objectives of the economic zone.
d) For national tourism zones:
must determine the requirements for collecting information, documents, and data
on status quo and forecasted development based on tourism potential and tourism
demand of the country and relevant regions, and provinces, and their impact on
development objectives of the tourism zone.

Regarding subdivision planning

c) Development orientations in
the provincial planning, higher-level planning, or other technical planning
affecting the subdivision planning; preliminarily identify main problems to be
addressed and requirements for elaborating the approved superior planning;
d) Determination of population
and labor scale, land use demand, and requirements for technical and social
infrastructure for the planned area;
dd) Determination of
requirements for surveys, data collection, analysis, and assessment of the
status quo to ensure full content as prescribed in Chapter III hereof;
requirements for the status quo database;
e) Requirements on the contents
of the subdivision planning;
g) Determination of the list of
drawings, descriptions, attached appendices; quantity and specifications of
subdivision planning dossiers; cost estimates; plans and progress in
formulating subdivision planning;
h) Determination of
requirements on content, form enquired entities, and plan for collecting
opinions on the subdivision planning.

of tasks in subdivision planning and draft Decision of competent authority on
approval of such tasks.

from competent authorities on organizing the subdivision planning formulation.
c) Other relevant documents.
4. Drawings:
a) Location diagram of the
planned area according to the provincial planning, master planning, or other
technical planning;
b) Map identifying the planning
scope and scale of planned area;
c) Drawings in the dossier on
tasks in subdivision planning that are shown in a suitable scale in topographic
status quo map combined with space development orientation map or map of land
use for planning.
5. For subdivision planning for
functional areas based on provincial planning, regional planning, or other
technical planning, in addition to the above requirements, the following must
also be satisfied:
a) Arguments for determining
the location and boundaries of the planned area in cases where the provincial
planning, regional planning, or other technical planning does not specify these
contents;
b) Identification of forecasted
development based on the nature, development potential, and demands of the
country, relevant regions and/or provinces, and their impact on the development
objectives of the functional area. Identification of arising economic, social,
technical, and environmental problems from the establishment of the functional
area according to the provincial planning, regional planning, or other
technical planning.

grounds for detailed planning; location, boundary scope, area, and function of
the detailed planned area; preliminary development orientations in the master
planning and contents of subdivision planning that are approved affecting the
detailed planned area; state management and development investment demands for
the detailed planned area. The detailed planning must be consistent and
synchronous to elaborate the approved master planning or subdivision planning;
b) Assessment of natural
characteristics and status quo; identification of basic problems and contents
to be addressed in the detailed planning and requirements for elaborating the
subdivision planning.
c) Estimated population and
labor scale; basic quotas applied regarding use of land, social infrastructure,
and technical infrastructure based on regulations of the approved subdivision
planning and master planning.
d) Specific requirements for
surveys, data collection, assessment of the status quo; requirements for the
status quo database.
dd) Requirements regarding the
contents of the detailed planning; requirements for intended construction items
within the detailed planned area; determination of requirements for research on
spatial organization, landscape architecture, land use, technical
infrastructure connections, and other requirements.
e) Determination of the list of
drawings, descriptions, attached appendices; quantity and specifications of
detailed planning dossiers; cost estimates; plans and progress in formulating
detailed planning;
g) Determination of
requirements on content, form enquired entities, and plan for collecting
opinions on the detailed planning.
2. Written request for approval
of tasks in detailed planning and draft Decision of competent authority on
approval of such tasks.

content to be satisfied for the separate urban design.
c) Requirements and research
contents regarding spatial organization, landscape architecture, and layout of
works; requirements for research on urban conservation regulations for ancient
or old urban areas (if any); requirements for infrastructure systems and
environment.
2. Written request for approval
of tasks related to separate urban design and draft Decision of competent
authority on approval of such tasks.

a) Decisions on master
planning, subdivision planning (if any).
b) Directives and instructions
from competent authorities on organizing the separate urban design formulation;

Article 8.
Regarding underground space planning for centrally affiliated cities
1. Description:
a) Reasons, necessity and grounds
for underground space planning; location, planning scope, and scale of planned
area. Preliminary development orientations in the general urban planning and
contents of subdivision planning that are approved affecting the underground
space planned area. State management and development investment demands for the
planned area. The underground space planning must be consistent and
synchronized with technical infrastructure planning and elaborate the approved
master planning.
b) General assessment of natural
characteristics and status quo; identification of basic problems and contents
to be addressed in the underground space planning and requirements for
elaborating the approved master planning.
c) Estimated demand for
underground space use; basic quotas applied for use of land, space, and
infrastructure systems in accordance with regulations of the approved master
planning and development requirements;
d) Specific requirements for
surveys, data collection, assessment of the status quo; requirements for the
status quo database.
dd) Requirements regarding the
main contents of the underground space planning; planned underground work items
to be invested in; determination of requirements for research on spatial
organization, architecture, landscape, land use, technical infrastructure
connection, and other requirements;
e) Determination of the list of
drawings, descriptions and attached appendices; the quantity and specifications
of the dossiers on planning; cost estimates; plans and progress in formulating
master planning; determination of requirements for contents, forms and enquired

planned area. State management and development investment demands for the planned
area. The technical planning must be consistent and synchronized with
underground space planning and elaborate the approved master planning.

DOSSIERS ON MASTER URBAN AND RURAL PLANNING
Article
10. Regarding centrally affiliated cities
1. Description:
a) Reasons, necessity and
grounds for master planning for the centrally affiliated city;
b) Analysis of location and
assessment of natural conditions; economic development status quo; status quo
of urban systems and functional areas; current population and distribution of
urban and rural residents; current land use in urban and rural areas of the
entire city (including urban areas, rural areas, functional areas, agricultural
production areas, forestry areas, and other areas according to the city’s
characteristics); current land use in urban areas with population equivalent to
that of Class I cities; current architectural and landscape zoning; status quo
of social infrastructure, housing, technical infrastructure, and environment.

d) Determination of
requirements and contents in accordance with approved national, regional, and
provincial planning for the city’s development orientation.
dd) Determination of
viewpoints, objectives, nature, and premises for development of the city.
e) Forecast of population,
labor, and land area; determination and selection of quotas for technical
infrastructure, social infrastructure, and environment for urban and rural
areas within the city.
g) Determination of principles
and criteria for selecting urban development structure options.
h) Determination of the overall
spatial model and structure of the urban-rural system within the city; scope,
boundaries, and space development orientation of urban and rural areas
consistent with the urban system development option in the provincial planning.
i) Orientation for organization
of space for functional areas; key development areas; areas of national
importance in terms of politics, culture, history, security, and defense (if
any); system of administrative, educational, health, cultural, sports centers,
and other centers at national, regional and city levels.
k) Orientation for zoning of
architecture and landscape; green spaces and water surfaces; gateways; main
spatial corridors; city landmarks; conservation of natural landscapes and
cultural heritage.
l) Orientation for land use of
the whole city by stages, including determination of areas for: urban
development, rural development, development of functional areas, agricultural
production, forestry, security, defense, and other management-required areas;
Determination of land use demands for housing and social housing development.
For urban areas with population equivalent to that of a Class I city, the scale
for land use functions shall be determined in accordance with Appendix I
attached hereto.
m) Orientation for underground
space and technical infrastructure development, including: Orientation for
development of underground space and technical infrastructure planning for the
whole city: Determination of the external transport networks (road, railway,
waterway, airway); locations and scale of airports, seaports, river ports,
railway stations; urban road and railway (overhead, above ground and
underground); locations and scale of external bus stations; reserves, demand,
and supply sources for water and energy; total wastewater and solid waste
volumes; locations, scale, and capacity of headworks and
transmission/distribution lines for water supply, energy, lighting,
telecommunications, drainage; locations and scale of solid waste treatment
sites, cemetery services, and other facilities for urban and other functional
areas of the city;

n) Proposals of environmental
protection solutions within the planning scope: Establishment of protection and
restoration areas affected by construction investment activities; requirements
for waste management and pollution control during construction investment
according to the planning.
o) Arguments and determination
of priority investment programs and projects for each planning phase, ensuring
feasibility of implementation.
2. Written request for approval
of the master planning and draft Decision of competent authority on approval of
such planning.
3. Relevant documents:
a) Decision on approval of
tasks in master planning; directives and instructions from competent
authorities regarding master planning formulation;
b) Approval decisions of the
relevant planning; previous approval decision of master planning (if any).
c) Other relevant documents.
4. Drawings:
a) Diagram of location and
regional relationship including: Location, scale and boundary of the planned area;
relationships regarding natural, socio-economic, urban space development,
technical infrastructure, and environment under national and regional planning
affecting the planned city. Drawings that are shown in a suitable scale in the
map of orientations for the development of the national urban-rural system; map
of orientations for the development of urban-rural systems.

c) Status quo map of urban
areas with population equivalent to that of a Class I city: Status quo of
functional areas according to the Appendix attached to; architecture and
landscape; social infrastructure (education, health, culture, commerce, green
spaces, housing); technical infrastructure (transport, urban electricity supply
and urban lighting, telecommunications, water supply, ground elevation and
rainwater drainage, wastewater drainage; solid waste management, cemetery
services, environment). Drawings are shown in a topographic map at a scale of
1/10.000 or 1/25.000;
d) Map of general assessment of
construction land according to determination of appropriate criteria for
assessment of topography, status quo, hydrogeology; land use (determination of
favorable, less favorable and unfavorable areas for the development of urban
functions...); determination of prohibited and restricted areas for urban
development. Drawings are shown in a topographic map at a scale of 1/25.000 or
1/50.000;
dd) Space development
orientation diagram of the whole city: Determination of boundaries of urban,
rural, functional areas; key development areas; areas of national importance in
politics, culture, history, security, defense (if any); administrative, educational,
health, cultural, sports centers, and other national-level centers.
Determination of spatial axes and urban development corridors of the city.
Drawings are shown in a topographic map at a suitable scale.
e) Technical infrastructure
development orientation diagram of the whole city showing contents specified in
point m of clause 1 of this Article. Drawings are shown in a topographic map at
a suitable scale.
g) Diagram of development
orientations for urban space with population equivalent to that of a Class I
city: urban development structure (including status quo analysis diagrams and
proposed options with description of the criteria for reviewing and selecting
options); determination of framework of main traffic systems; linkages between
main functional areas, central areas, and urban expansion directions;
Determination of the scope and scale of functional areas; repurposed areas;
areas with restricted potentials for development, areas needing embellishment
and renovation, conservation areas; new development areas (determining the
scope and scale of residential areas, functional zones at national, regional
and city levels); conservation areas; no-construction zones; development
reserve zones and security and defense areas. Determination of location and scale
of the systems of administration, trade - services, culture, physical training
and sport centers, green parks and urban open spaces; research, training,
health centers, etc. at national, regional and city levels. Identification of
areas where the underground works are expected to be built. Drawings are shown
in a topographic map at a scale of 1/10.000;
h) Land use orientation diagram
of the whole city: location and scale of urban development, rural development,
functional areas, agricultural production, forestry, defense, and security
areas, and other management-required areas. Drawings are shown in a topographic
map at a scale of 1/25.000 or 50.000;
i) Map of land use for planning
for urban areas with population equivalent to that of a Class I city: Locations
and land use scale of functional areas as regulated in Appendix I attached to;
identification of population scale, quotas of population density and land use
for each urban functional area by development stages. Drawings are shown in a
topographic map at a scale of 1/10.000;
l) Map of orientation for the
development of systems for technical infrastructure of central urban area at a
scale of 1/10.000 or 1/25.000 showing full contents specified in Point m of
clause 1 of this Article;
m) Drawing for urban design:
Showing full contents specified in Point k of clause 1 of this Article at a
suitable scale. Overall perspective drawings and main views simulating suitable
architectural spaces to clarify the research contents.

1. Description:
a) Reasons, necessity, and
grounds for master planning; arguments, identification of planning scope, scale
and scale of planned area;
b) Analysis of location and assessment
of natural conditions; current population, architecture and landscape, social
infrastructure, technical infrastructure, and environment. c) Assessment of
management and implementation according to the approved planning concerning
space development, land use, and technical infrastructure, comparing with the
orientations and quotas set in the approved planning (if any); assessment of
the status quo of the planned area according to urban standards and criteria.
Assessment of existing ongoing construction and development programs and
projects within the city and relevant programs and projects. Identification of
main problems to be addressed.
c) Determination of objectives,
nature, and development drivers; arguments and determination of socio-economic
and technical quotas for the area reserved for urban development.
d) Assessment and forecast of
the impacts of natural conditions, socio-economic factors; national, regional,
provincial, and technical planning that has been approved for urban development
orientation. Forecast of development quotas: urbanization rate, population,
land, social infrastructure, and technical infrastructure for the urban areas
and functional areas within the area reserved for urban development.
d) Determination of principles
and criteria for selection and selection of urban development structure
options;
e) Space development
orientation: Model and direction of urban development; determination of scope
and scale of functional areas within the planning scope; existing areas with
limited potential for development, areas needing embellishment and renovation,
conservation areas; repurposed areas, new development areas; no-construction
zones; development reserve zones; areas planned for underground construction in
the urban center serving as the provincial political-administrative center;

landmarks within the planning scope. Proposal for organization of space for

1. Review of urban and rural planning
to control and assess the implementation according to the approved planning,
serving as one of the bases for making decisions on adjustments to planning.
2. Content of the urban and
rural planning review report includes:
a) Review of preparation and
implementation of relevant planning, investment projects according to the
approved urban and rural planning, and implementation plans of the master
planning;
b) Assessment of achieved
objectives, impacts, and effectiveness of implementation according to the
approved planning;
c) Analysis of new factors
arising during the implementation of urban and rural planning and
socio-economic development in the planned area;
d) Recommendations and
proposals;
dd) The dossier on review of
urban and rural planning, including: the written report, color drawings at
suitable scales, and relevant legal documents.

28. Components and contents of dossiers on adjustment to urban and rural
planning

The components and contents of
the planning task dossier and the General adjustment scheme dossier shall
comply with the regulations in Chapters II and III hereof.
2. For local adjustment to
urban and rural planning, the components and contents of the dossier include:
a) Report from the planning
organization submitted to the competent authority approving the urban and rural
planning, clearly stating: The reasons and necessity for the local adjustment
of urban and rural planning; assessment of the status quo of the area to be
adjusted; contents of the local adjustment; analysis and clarification of the
continuity and consistency of the entire urban and rural planning and the
socio-economic effectiveness of the local adjustment; determination of economic
- technical quotas achieved after the local adjustment, compared with the
quotas approved before the adjustment proposal; assessment of the impact of the
local adjustment on the implementation of the approved planning; proposed
measures to address new issues arising from the local adjustment; Roadmap and
progression of implementation according to the local adjustment after approval
by the competent authority. The report must have relevant legal documents and
materials attached.
b) Drawings presenting:
Location, boundaries, and scale of the area subject to local adjustment;
contents of the local adjustment; determination of economic - technical quotas
achieved after adjustment, compared with previously approved quotas;
c) Related legal documents;
summary report, explanations, and responses to feedback from agencies,
organizations, individuals, and the community regarding the local adjustment to
urban and rural planning.
d) Draft Decision of the
competent authority approving the local adjustment to urban and rural planning.
Chapter IV
MARKING DOSSIERS,
MARKING AND MARKER MANAGEMENT IN ACCORDANCE WITH URBAN AND RURAL PLANNING
Section 1.
PREPARATION OF MARKING DOSSIERS

1. The marking dossier must be
prepared and approved within 30 days from the date the urban and rural planning
is approved in order to implement marking in the field or apply information
technology.
2. Responsibility for
preparation and authority for approval of the marking dossier shall comply with
Clause 2 and Clause 3 of Article 52 of the Law on Urban and Rural Planning. For
planning required approval from the Prime Minister, the provincial People's
Committees shall approve the marking dossiers.
3. The planning appraisal
agency shall appraise and submit the marking dossier for approval. The contents
of the appraisal include:
a) Conformity with the approved
urban and rural planning dossier and management requirements;
b) Types and number of markers;
technical specifications of the markers in accordance with Section 2 of this
Chapter;
c) Estimated cost for marking.
4. Application of information
technology in marking:
a) For master planning, no
on-site marking is carried out; only the marking dossier is prepared and
approved, and boundary markers are managed via an suitable application aligned
with the preparation, appraisal, approval, and management of urban and rural
planning;
b) For no construction areas,
conservation areas of historical and cultural monuments, and other protected areas
where boundaries have been marked according to specialized regulations,
preparation, appraisal, and approval of marking dossiers are not required.
However, information about the installed markers must be transferred, updated,
and managed via an application suitable for the preparation, appraisal,
approval, and management of urban and rural planning;

5. Based on management
requirements and the local urban and rural planning database system, the
People's Committees at all levels shall decide the map scale for marking
dossier preparation within their approval authority in accordance with Articles
34, 35, and 36 hereof.
Article
30. Dossiers on marking in accordance with urban and rural planning
1. Components of the dossiers
on marking in accordance with urban and rural planning include: description,
drawings, cost estimate for marking, relevant legal documents and juridical
person dossiers of the surveying and mapping unit selected to prepare the
dossier and carry out the marking; Written request and draft decision approving
the marking dossier.
2. Description of the marking
dossier:
a) Grounds for preparing the
marking dossier; status quo of the marked area;
b) The contents of the marking
include: types of markers to be installed; number of markers to be installed;
marker positioning plan; distance between markers; reference markers (if any);
c) Organization and plan for marking.
3. Drawings of the marking
dossier:
a) Location diagram and marking
boundary extracted from the approved urban and rural planning at a suitable
scale.

4. Requirements for the marking
dossier and mapping regulations serving the preparation of the dossiers on
marking according to urban and rural planning:
a) The marking dossier must be
prepared on a digital topographic map confirmed by the competent authority; it
must comply and be consistent with the approved urban and rural planning;
b) The surveyed boundary for
preparing the marking dossier depends on management requirements and the
topography of the marked area; the maps in the marking dossier must be prepared
on a map at a suitable scale.

31. Funding for the preparation of dossiers on marking in accordance with urban
and rural planning and on-site marking
1. Funding from the state
budget shall be used for preparing marking dossiers and on-site marking, adding
and restoring markers for master planning, subdivision planning, and detailed
planning that are not part of commercial construction investment projects.
2. Funding from organizations
and individuals shall be used for preparing marking dossiers and on-site
marking within project areas for planning that belong to commercial
construction investment projects.
3. The cost estimate for the
preparation and implementation of marking shall follow the guidelines on
methods for estimation of construction survey cost as specified Circulars of
the Ministry of Construction on guidance on certain contents on cost
determination and management of construction investment

a) Road centerline marker:
Marker determining the coordinates and elevation of intersection points and
turning points of the road centerline; denoted as "TĐ";
b) Red line boundary marker:
Marker defining the boundary line separating the land plot for construction
from the land reserved for traffic roads or technical infrastructure works;
denoted as "CGĐ";
c) Boundary marker of no
construction area: Marker defining the boundary of no construction areas,
conservation areas of historical and cultural monuments, and other protected
areas; denoted as "RG";
d) Reference marker: Marker
used to replace a marker that cannot be installed in the field due to
unfavorable conditions or when installation would affect existing works;
denoted as "MTC".
2. On-site markers shall ensure
a minimum distance of 30 meters between markers, depending on the topography
and geomorphology of the marked area, and must meet management requirements
regarding boundaries and elevation. If the distance between markers is less
than 30 meters, a description and explanation must be included in the marking
dossier.

33. Regulations on markers
1. A marker consists of the buried
foundation, the base, and the shaft, made of reinforced concrete to ensure
durability and easy identification.
2. The base of the marker has
the measure of 40x40x50 cm; the shaft is 90 cm in length. The cross-sectional
shapes of different types of marker shafts are specified as follows:
a) Road centerline marker shaft
has a circular cross-section with a diameter of 15 cm;

c) Boundary marker shaft for
restricted areas has an equilateral triangular cross-section with 15 cm sides;
d) Reference marker shaft has
the same cross-section as the marker it replaces; the reference marker displays
full information for referencing the marker it substitutes.
3. The top surface of the marker
is fitted with a porcelain or iron core, engraved with the marker’s symbol and
identification number.

34. Marking in accordance with master planning for urban and rural areas
applying information technology
1. For centrally affiliated
cities, markers include:
a) Road centerline markers for
main urban streets planned for new construction or renovation within the city;
b) Red line boundary markers
for main urban streets planned for new construction or renovation within the
city;
c) Markers defining boundaries
of no construction areas; conservation areas of historical and cultural
monuments; and other protected areas.
2. For area reserved for urban
development and functional areas, the on-site markers include:

b) Red line boundary markers
for main streets and roads of area planned for new construction or renovation
within urban and functional areas;
c) Markers defining boundaries

dossier, whether to apply information technology in marking (marking on digital
dossiers) instead of on-site marking strictly according to the marking dossier.
However, it must organize public disclosure to relevant agencies,
organizations, and affected individuals, and regularly inspect and supervise
the field to ensure the development does not violate the approved urban and
rural planning.

36. Marking in accordance with the detailed planning for urban and rural areas
1. On-site markers for detailed
planning for urban and rural areas include:
a) Road centerline markers for roads,
alleys planned for new construction or renovation within the planned area;
b) Red line boundary markers
for roads, alleys planned for new construction or renovation within the planned
area; The shaft of the red line boundary marker must clearly display the
specified parameters of the construction line and construction elevation;
c) Markers defining boundaries
of no construction areas, including markers identifying boundary lines of no
construction zones, conservation areas of historical and cultural monuments,
and other protected areas within the planned area.
2. The competent authority
approving the urban and rural planning shall decide, when approving the marking
dossier, whether to apply information technology in marking (marking on digital
dossiers) instead of on-site marking strictly according to the marking dossier.
However, it must organize public disclosure to relevant agencies,
organizations, and affected individuals, and regularly inspect and supervise
the field to ensure the development does not violate the approved urban and
rural planning.

COOPERATION IN ON-SITE IMPLEMENTING, MANAGING MARKER, STORING RECORDS, AND

1. The agency or unit carrying
out on-site marking must send the marking dossier to the relevant
grassroots-level People's Committee before carrying out survey, measurement,
on-site marking
2. The grassroots-level
People's Committee, based on the survey, measurement, and marking plan, shall
cooperate with the marking unit.
3. In case the position of the
on-site marker is adjusted or differ from the approved marking dossier, the
marking unit must report this at the commissioning phase to the urban and rural
planning management agencies for updating the related planning dossiers.
4. After completing the on-site
marking according to the dossier, the agency organizing the marking must
conduct commissioning and hand over the markers to the relevant
grassroots-level People's Committee for marker protection.
Article
38. Responsibilities for marker management and protection
1. The grassroots-level
People's Committee shall manage planning markers within their administrative
boundary. The grassroots-level People's Committee must organize annual
inspections to promptly identify any markers lost or displaced compared to the
approved marking dossier.
2. The grassroots-level
People's Committee shall protect the on-site markers, organize communication
campaigns to encourage the local community to participate in marker protection
and management; in case of displacement or damage to markers, they must
promptly report in writing to the provincial People's Committee and relevant
managing agencies to plan for restoration.

39. Storage of dossiers on marking in accordance with planning
1. Planning management agencies
and land management agencies at all levels shall store marking dossiers
approved by the People's Committee at the same level, and providing documents
and data related to markers to organizations, agencies, and individuals upon
lawful request.

3. The provincial People's
Committee is responsible for making copies of the marking dossiers and handing
them over to the relevant grassroots-level People's Committee for managing
on-site markers.
4. The dossiers on marking in
accordance with urban and rural planning are documents for local authorities to
use in publicizing planning, managing planning, implementing investment
projects, issuing construction permits, land use right certificates, and land
allocation (or lease) as prescribed.
Article
40. Provision of information about marking dossiers to organizations and
individuals upon request
1. Agencies assigned to manage
and store marking dossiers as stipulated in Clause 4 of Article 52 of the Law
on Urban and Rural Planning are responsible for organizing the receipt and
provision of approved marking dossiers upon the request of organizations and
individuals.
2. Agencies may provide
information about marker in writing by providing certified copies of approved
marking dossiers by competent authorities.
Chapter V
DIGITAL GEOGRAPHIC
DATABASE OF URBAN AND RURAL PLANNING

41. Rules for establishing digital geographic database of urban and rural
planning
1. The geographic database for
urban and rural planning must meet the following technical requirements:

b) In cases where there is
insufficient legal basis to precisely determine the location, boundaries, or
alignment of a planned geographic object, symbols representing the expected
location, boundary, and alignment of the geographic object in the geographic
database shall be elaborated in subsequent planning steps or during the
preparation phase of construction investment projects.
2. The content of the
geographic database for urban and rural planning must be consistent and
synchronized with the legal database; correctly and fully represent national
territorial sovereignty; and comply with international treaties to which the
Socialist Republic of Vietnam is a signatory.
3. The prioritization of
geographic objects in the geographic database must follow these principles:
a) Geographic objects related
to the main content of the planning are prioritized over other contents;
b) Priority order in displaying
geographic objects is: point objects, line objects, then area objects.
Article
42. Technical requirements for implementing geographic data of urban and rural
planning
1. Urban and rural planning
diagrams and maps must be established in the national coordinate reference
system according to Prime Minister’s Decision No. 83/2000/QD-TTg dated July 12,
2000, on the application of the VN-2000 coordinate system and the Circular
973/2001/TT-TCDC dated June 20, 2001, guiding the application of the VN-2000
coordinate system, and based on the national topographic map at a scale
corresponding to the scale of the diagrams and maps.
2. The GIS database shall be
packaged in a suitable GIS software format, including Data Groups; each
thematic data group contains data layers. Urban and rural planning data themes
are organized by objects identified in the dossier: planning boundaries; space
organization; urban design; land use; traffic; technical preparation;
electricity supply; other energy systems; communications; water supply;
wastewater and environmental sanitation; urban and rural planning markers.
3. Detailed regulations on the
urban and rural planning database are provided in Appendix II attached hereto.

The development, protection,
administration, processing, and use of digital data; digital products and
services; state management; rights, obligations, and responsibilities of
agencies, organizations, and individuals related to geographic data of urban
and rural planning shall be conducted in accordance with the laws on Data.

urban planning, urban and rural planning of functional areas and rural
planning.
b) Circular No. 10/2016/TT-BXD
dated March 15, 2016 of the Minister of Construction on the planting and
management of boundary markers under construction planning.
c) Circular No. 06/2013/TT-BXD
dated May 13, 2013 of the Minister of Construction on guidance on content of
urban design and Circular No. 16/2013/TT-BXD dated October 16, 2013 Circular
No. 06/2013/TT-BXD.

1. In the process of reviewing
and adjusting approved urban planning and construction planning, the components
and symbols of planning dossiers shall be adjusted in accordance with herewith.
2. For approved urban and
construction planning that has not yet developed or has incomplete electronic
records databases, the People's Committees of provinces and centrally
affiliated cities must plan, allocate funds, and develop additional electronic
records in accordance herewith.
Article
46. Responsibility for implementation
1. Organizations and
individuals participating in the development, appraisal and approval of urban
and rural planning are responsible for implementing this Circular on dossiers
on planning tasks and urban and rural planning dossiers.
2. The Department of Planning -
Architecture, the Department of Technical Infrastructure of the Ministry of
Construction; provincial urban and rural planning agencies are responsible for
providing guidance and inspecting the implementation of the provisions of this
Circular.
