NGHỊ ĐỊNH

SỬA ĐỔI, BỔ SUNG MỘT SỐ ĐIỀU NGHỊ ĐỊNH SỐ 162/2013/NĐ-CP NGÀY 12 THÁNG 11 NĂM 2013 CỦA CHÍNH PHỦ QUY ĐỊNH XỬ PHẠT VI PHẠM HÀNH CHÍNH TRÊN CÁC VÙNG BIỂN, ĐẢO VÀ THỀM LỤC ĐỊA CỦA NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM ĐÃ ĐƯỢC SỬA ĐỔI, BỔ SUNG BỞI NGHỊ ĐỊNH SỐ 23/2017/NĐ-CP VÀ NGHỊ ĐỊNH SỐ 37/2022/NĐ-CP

Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;

Căn cứ Luật Xử lý vi phạm hành chính số 15/2012/QH13 được sửa đổi, bổ sung bởi Luật số 67/2020/QH14, Luật số 88/2025/QH15;

Căn cứ Luật Biển Việt Nam số 18/2012/QH13;

Căn cứ Luật Tài nguyên, môi trường biển và hải đảo số 82/2015/QH13;

Căn cứ Bộ luật Hàng hải Việt Nam số 95/2015/QH13;

Căn cứ Luật sửa đổi, bổ sung một số điều của 37 Luật có liên quan đến quy hoạch số 35/2018/QH14;

Theo đề nghị của Bộ trưởng Bộ Quốc phòng;

Chính phủ ban hành Nghị định sửa đổi, bổ sung một số điều của Nghị định số 162/2013/NĐ-CP ngày 12 tháng 11 năm 2013 của Chính phủ quy định xử phạt vi phạm hành chính trên các vùng biển, đảo và thềm lục địa của nước Cộng hòa xã hội chủ nghĩa Việt Nam đã được sửa đổi, bổ sung bởi Nghị định số 23/2017/NĐ-CP và Nghị định số 37/2022/NĐ-CP.

Điều 1. Sửa đổi tên Điều 3, bổ sung khoản 1a và khoản 1b vào sau khoản 1 Điều 3 như sau:

1. Sửa đổi tên Điều 3 như sau:

“Điều 3. Hình thức xử phạt, mức phạt tiền, thẩm quyền phạt tiền và nguyên tắc xử phạt”.

2. Bổ sung khoản 1a và khoản 1b vào sau khoản 1 như sau:

“1a. Các hình thức xử phạt chính quy định tại Nghị định này bao gồm:

a) Phạt cảnh cáo;

b) Phạt tiền.

1b. Các hình thức xử phạt bổ sung quy định tại Nghị định này bao gồm:

a) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

b) Đình chỉ hoạt động có thời hạn;

c) Tịch thu tang vật vi phạm hành chính, phương tiện được sử dụng để vi phạm hành chính (sau đây gọi chung là tang vật, phương tiện vi phạm hành chính);

d) Trục xuất.”.

Điều 2. Bổ sung khoản 6 và khoản 7 vào sau khoản 5 Điều 4 như sau:

“6. Buộc nộp lại giấy chứng nhận của tàu thuyền, tài liệu của tàu thuyền, chứng chỉ hành nghề, chứng chỉ chuyên môn, sổ thuyền viên, hộ chiếu bị tẩy xóa, sửa chữa làm sai lệch nội dung cho cơ quan, người có thẩm quyền đã cấp giấy tờ đó.

7. Buộc xử lý đối với tang vật là chất thải nguy hại”.

Điều 3. Sửa đổi khoản 2, bổ sung khoản 3 vào sau khoản 2 Điều 8a như sau:

1. Sửa đổi khoản 2 như sau:

“2. Hình thức xử phạt bổ sung: Tịch thu tang vật, phương tiện vi phạm hành chính đối với các hành vi vi phạm quy định tại điểm i khoản 1 Điều này”.

2. Bổ sung khoản 3 vào sau khoản 2 như sau:

“3. Biện pháp khắc phục hậu quả: Buộc nộp lại số tiền bằng với giá trị tang vật, phương tiện vi phạm hành chính trong trường hợp tang vật, phương tiện vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại điểm i khoản 1 Điều này.”.

Điều 4. Bổ sung điểm c vào sau điểm b khoản 9 Điều 8b như sau:

“c) Buộc nộp lại số tiền bằng với giá trị tang vật, phương tiện vi phạm hành chính trong trường hợp tang vật, phương tiện vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại khoản 5 Điều này.”.

Điều 5. Sửa đổi khoản 3, bổ sung khoản 4 vào sau khoản 3 Điều 15 như sau:

1. Sửa đổi khoản 3 như sau:

“3. Hình thức xử phạt bổ sung: Tịch thu tang vật vi phạm hành chính đối với hành vi vi phạm quy định tại điểm a và c khoản 1 và khoản 2 Điều này.”.

2. Bổ sung khoản 4 vào sau khoản 3 như sau:

“4. Biện pháp khắc phục hậu quả: Buộc nộp lại số tiền bằng với giá trị tang vật vi phạm hành chính trong trường hợp tang vật vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại điểm a và c khoản 1 và khoản 2 Điều này.”.

Điều 6. Sửa đổi khoản 7, bổ sung khoản 8 vào sau khoản 7 Điều 16 như sau:

1. Sửa đổi khoản 7 như sau:

“7. Hình thức xử phạt bổ sung: Tước quyền sử dụng Giấy chứng nhận khả năng chuyên môn của thuyền trưởng có thời hạn từ 01 tháng đến 06 tháng đối với hành vi vi phạm quy định tại khoản 2 Điều này;”.

2. Bổ sung khoản 8 vào sau khoản 7 như sau:

“8. Biện pháp khắc phục hậu quả: Buộc nộp lại cho cơ quan, người có thẩm quyền các loại giấy chứng nhận, tài liệu của tàu thuyền cho cơ quan, người có thẩm quyền đã cấp giấy tờ đó đối với hành vi quy định tại khoản 4 Điều này.”.

Điều 7. Sửa đổi khoản 4, bổ sung khoản 5 vào sau khoản 4 Điều 17 như sau:

1. Sửa đổi khoản 4 như sau:

“4. Hình thức xử phạt bổ sung: Tịch thu chứng chỉ chuyên môn, sổ thuyền viên, hộ chiếu giả mạo đối với hành vi vi phạm quy định tại khoản 3 Điều này.”.

2. Bổ sung khoản 5 vào sau khoản 4 như sau:

“5. Biện pháp khắc phục hậu quả: Buộc nộp lại chứng chỉ chuyên môn, sổ thuyền viên, hộ chiếu đã bị sửa chữa, tẩy xóa làm sai lệch nội dung cho cơ quan, người có thẩm quyền đã cấp giấy tờ đó đối với hành vi vi phạm quy định tại khoản 2 và khoản 3 Điều này.”

Điều 8. Bổ sung khoản 6 vào sau khoản 5 Điều 23 như sau:

“6. Buộc nộp lại số tiền bằng với giá trị tang vật, phương tiện vi phạm hành chính trong trường hợp tang vật, phương tiện vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại điểm c và điểm d khoản 2 Điều này.”.

Điều 9. Bổ sung điểm c và điểm d vào sau điểm b khoản 10 Điều 26 như sau:

“c) Buộc nộp lại số tiền bằng với giá trị phương tiện vi phạm hành chính trong trường hợp phương tiện vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại khoản 7 và khoản 8 Điều này.

d) Buộc xử lý đối với tang vật là chất thải nguy hại đối với hành vi vi phạm quy định tại khoản 7 và khoản 8 Điều này.”.

Điều 10. Bổ sung điểm c vào sau điểm b khoản 7 Điều 26c như sau:

“c) Buộc nộp lại số tiền bằng với giá trị phương tiện vi phạm hành chính trong trường hợp phương tiện vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại điểm e khoản 5 Điều này.”.

Điều 11. Sửa đổi khoản 5 Điều 27 như sau:

“5. Biện pháp khắc phục hậu quả:

a) Buộc thực hiện biện pháp khắc phục tình trạng ô nhiễm môi trường theo quy định đối với các hành vi vi phạm tại Điều này;

b) Buộc nộp lại số tiền bằng với giá trị tang vật, phương tiện vi phạm hành chính trong trường hợp tang vật, phương tiện vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại điểm b khoản 3 Điều này.”.

Điều 12. Sửa đổi, bổ sung Điều 28 như sau:

“Điều 28. Thẩm quyền xử phạt của Cảnh sát biển Việt Nam

Các chức danh quy định tại Điều này có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại Chương II, trừ các hành vi vi phạm của cá nhân nước ngoài quy định tại các điểm a, e và g khoản 7 Điều 8b Nghị định này như sau:

1. Cảnh sát viên Cảnh sát biển đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 50.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

2. Tổ trưởng Tổ nghiệp vụ Cảnh sát biển có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 100.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

3. Đội trưởng Đội nghiệp vụ Cảnh sát biển, Trạm trưởng Trạm Cảnh sát biển có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 200.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c và e khoản 1 Điều 28 Luật Xử lý vi phạm hành chính và các khoản 2, 3, 4, 5, 6 và 7 Điều 4 Nghị định này.

4. Hải đội trưởng Hải đội Cảnh sát biển có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 300.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c, d, e và i khoản 1 Điều 28 Luật Xử lý vi phạm hành chính và các khoản 2, 3, 4, 5, 6 và 7 Điều 4 Nghị định này.

5. Hải đoàn trưởng Hải đoàn Cảnh sát biển; Đoàn trưởng Đoàn Trinh sát, Đoàn trưởng Đoàn đặc nhiệm phòng chống tội phạm ma túy thuộc Cảnh sát biển Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c, d, e và i khoản 1 Điều 28 Luật Xử lý vi phạm hành chính và các khoản 2, 3, 4, 5, 6 và 7 Điều 4 Nghị định này.

6. Tư lệnh Vùng Cảnh sát biển, Cục trưởng Cục Nghiệp vụ và Pháp luật thuộc Cảnh sát biển Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 800.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

7. Tư lệnh Cảnh sát biển Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.”.

Điều 13. Sửa đổi, bổ sung Điều 29 như sau:

“Điều 29. Thẩm quyền xử phạt của Bộ đội Biên phòng

Các chức danh quy định tại Điều này có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại Chương II, trừ các hành vi vi phạm của cá nhân nước ngoài quy định tại các điểm a, e và g khoản 7 Điều 8b Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Chiến sĩ Bộ đội Biên phòng đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 50.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

2. Trạm trưởng, Đội trưởng của Chiến sĩ Biên phòng đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 100.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c và e khoản 1 Điều 28 của Luật Xử lý vi phạm hành chính.

3. Đội trưởng Đội đặc nhiệm phòng chống ma túy và tội phạm thuộc Đoàn đặc nhiệm phòng chống ma túy và tội phạm có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 150.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c và e khoản 1 Điều 28 của Luật Xử lý vi phạm hành chính.

4. Đồn trưởng Đồn Biên phòng, Hải đội trưởng Hải đội Biên phòng, Chỉ huy trưởng Ban Chỉ huy Biên phòng Cửa khẩu cảng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 300.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

5. Đoàn trưởng Đoàn đặc nhiệm phòng chống ma túy và tội phạm thuộc Cục Phòng chống ma túy và tội phạm thuộc Bộ Tư lệnh Bộ đội Biên phòng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

6. Chỉ huy trưởng Ban Chỉ huy Bộ đội Biên phòng; Hải đoàn trưởng Hải đoàn Biên phòng, Cục trưởng Cục Phòng chống ma túy và tội phạm thuộc Bộ Tư lệnh Bộ đội Biên phòng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.”.

Điều 14. Sửa đổi, bổ sung Điều 29a như sau:

“Điều 29a. Thẩm quyền xử phạt của Công an nhân dân

Các chức danh quy định tại Điều này có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại Chương II Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Chiến sĩ Công an nhân dân đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 100.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

2. Thủ trưởng đơn vị Cảnh sát cơ động cấp đại đội có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 200.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c và e khoản 1 Điều 28 của Luật Xử lý vi phạm hành chính.

3. Trưởng đồn Công an, Thủ trưởng đơn vị Cảnh sát cơ động cấp tiểu đoàn, Thủy đội trưởng, Trưởng trạm, Đội trưởng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 300.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c và e khoản 1 Điều 28 của Luật Xử lý vi phạm hành chính.

4. Trưởng Công an cấp xã có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

5. Trưởng phòng nghiệp vụ thuộc: Cục An ninh kinh tế, Cục Cảnh sát điều tra tội phạm về trật tự xã hội, Cục Cảnh sát điều tra tội phạm về ma túy, Cục Cảnh sát giao thông, Cục Cảnh sát phòng cháy, chữa cháy và cứu nạn, cứu hộ, Cục Cảnh sát phòng, chống tội phạm về môi trường, Cục An ninh mạng và phòng, chống tội phạm sử dụng công nghệ cao, Cục Quản lý xuất nhập cảnh, Thủ trưởng đơn vị Cảnh sát cơ động cấp trung đoàn; Trưởng phòng Công an cấp tỉnh gồm: Trưởng phòng An ninh kinh tế, Trưởng phòng Cảnh sát điều tra tội phạm về trật tự xã hội, Trưởng phòng Cảnh sát điều tra tội phạm về tham nhũng, kinh tế, buôn lậu, môi trường, Trưởng phòng Cảnh sát điều tra tội phạm về ma túy, Trưởng phòng Cảnh sát giao thông, Trưởng phòng Cảnh sát cơ động, Trưởng phòng Cảnh sát phòng cháy, chữa cháy và cứu nạn, cứu hộ, Trưởng phòng An ninh đối ngoại, Trưởng phòng An ninh mạng và phòng, chống tội phạm sử dụng công nghệ cao có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 800.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

6. Trưởng phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh có thẩm quyền xử phạt theo quy định tại khoản 5 Điều này và có quyền quyết định áp dụng hình thức xử phạt trục xuất.

7. Giám đốc Công an cấp tỉnh có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng hình thức xử phạt trục xuất;

e) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

8. Cục trưởng Cục An ninh kinh tế, Cục trưởng Cục Cảnh sát điều tra tội phạm về trật tự xã hội, Cục trưởng Cục Cảnh sát điều tra tội phạm về ma túy, Cục trưởng Cục Cảnh sát điều tra tội phạm về tham nhũng, kinh tế, buôn lậu, Cục trưởng Cục Cảnh sát giao thông, Cục trưởng Cục Cảnh sát phòng cháy, chữa cháy và cứu nạn, cứu hộ, Cục trưởng Cục Cảnh sát phòng, chống tội phạm về môi trường, Tư lệnh Cảnh sát cơ động, Cục trưởng Cục An ninh mạng và phòng, chống tội phạm sử dụng công nghệ cao có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

9. Cục trưởng Cục Quản lý xuất nhập cảnh có thẩm quyền xử phạt theo quy định tại khoản 8 Điều này và có quyền quyết định áp dụng hình thức xử phạt trục xuất.”.

Điều 15. Sửa đổi, bổ sung Điều 30 như sau:

“Điều 30. Thẩm quyền xử phạt của Hải quan

Các chức danh quy định tại Điều này có quyền xử phạt đối với các hành vi vi phạm quy định tại các Điều 5, Điều 15 và Điều 17 Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Công chức Hải quan đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 50.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

2. Đội trưởng Hải quan cửa khẩu/ngoài cửa khẩu, Đội trưởng Đội Phúc tập và Kiểm tra sau thông quan, Đội trưởng Đội Thông quan, Đội trưởng Đội Kiểm soát hải quan thuộc Chi cục Hải quan khu vực, Đội trưởng Đội Kiểm soát chống buôn lậu thuộc Chi cục Điều tra chống buôn lậu; Đội trưởng Đội Kiểm tra sau thông quan khu vực thuộc Chi cục Kiểm tra sau thông quan có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 300.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 2 và khoản 6 Điều 4 Nghị định này.

3. Chi cục trưởng Chi cục Điều tra chống buôn lậu, Chi cục trưởng Chi cục Kiểm tra sau thông quan, Chi cục trưởng Chi cục Hải quan khu vực có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 2 và khoản 6 Điều 4 Nghị định này.

4. Cục trưởng Cục Hải quan có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 2 và khoản 6 Điều 4 Nghị định này.”.

Điều 16. Sửa đổi, bổ sung Điều 31 như sau:

“Điều 31. Thẩm quyền xử phạt của Cục Hàng hải và Đường thủy Việt Nam

Các chức danh quy định tại Điều này có quyền xử phạt đối với hành vi vi phạm được quy định tại các Điều 16, Điều 17, Điều 18, Điều 19, Điều 20, Điều 21, Điều 22, Điều 23, Điều 24 và Điều 25 Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Trưởng đại diện Cảng vụ Hàng hải có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 250.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

2. Chi cục trưởng Chi cục Hàng hải và Đường thủy phía Bắc, Chi cục trưởng Chi cục Hàng hải và Đường thủy phía Nam, Giám đốc Cảng vụ hàng hải có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

3. Cục trưởng Cục Hàng hải và Đường thủy Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.”.

Điều 17. Sửa đổi, bổ sung Điều 31a như sau:

“Điều 31a. Thẩm quyền xử phạt của Quản lý thị trường

Các chức danh quy định tại Điều này có quyền xử phạt đối với hành vi vi phạm hành chính quy định tại Điều 15 Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Kiểm soát viên thị trường đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 100.000.000 đồng;

c) Tịch thu tang vật vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

2. Đội trưởng Đội Quản lý thị trường thuộc Chi cục Quản lý thị trường thuộc Sở Công thương có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 300.000.000 đồng;

c) Tịch thu tang vật vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

3. Chi cục trưởng Chi cục Quản lý thị trường, Trưởng phòng Nghiệp vụ Quản lý thị trường thuộc Cục Quản lý và Phát triển thị trường trong nước có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

4. Cục trưởng Cục Quản lý và Phát triển thị trường trong nước có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.”

Điều 18. Sửa đổi, bổ sung Điều 31b như sau:

“Điều 31b. Thẩm quyền xử phạt của Chủ tịch Ủy ban nhân dân

Chủ tịch Ủy ban nhân dân các cấp có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc phạm vi lĩnh vực quản lý của địa phương mình như sau:

1. Chủ tịch Ủy ban nhân dân cấp xã, phường, đặc khu có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

2. Chủ tịch Ủy ban nhân dân cấp tỉnh, thành phố có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.”

Điều 19. Sửa đổi, bổ sung Điều 32 như sau:

“Điều 32. Thẩm quyền xử phạt của Kiểm ngư

Các chức danh quy định tại Điều này có quyền xử phạt đối với hành vi vi phạm quy định tại các Điều 7, Điều 10, Điều 11, khoản 1 Điều 12, Điều 15, Điều 19, khoản 1 Điều 20, khoản 1 và điểm a khoản 3 Điều 21 Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Kiểm ngư viên đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 50.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

2. Trạm trưởng Trạm Kiểm ngư thuộc Chi cục Kiểm ngư vùng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 200.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, b, e và i khoản 1 Điều 28 của Luật Xử lý vi phạm hành chính và các khoản 2, 3, 4, 5 và 6 Điều 4 Nghị định này.

3. Chi cục trưởng Chi cục Kiểm ngư vùng thuộc Cục Thủy sản và Kiểm ngư; Chi cục trưởng Chi cục về lĩnh vực thủy sản, kiểm ngư thuộc Sở Nông nghiệp và Môi trường có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

4. Cục trưởng Cục Thủy sản và Kiểm ngư có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 1.000.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.”

Điều 20. Sửa đổi, bổ sung Điều 32a như sau:

“Điều 32a. Thẩm quyền xử phạt của Thanh tra Hàng hải Việt Nam

Các chức danh quy định tại Điều này có quyền xử phạt đối với hành vi vi phạm liên quan trực tiếp đến nội dung thanh tra, lĩnh vực quản lý của mình được quy định tại Chương II Nghị định này theo chức năng, nhiệm vụ, quyền hạn được giao như sau:

1. Thanh tra viên của Thanh tra Hàng hải Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 100.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 02 lần mức tiền phạt được quy định tại điểm b khoản này.

2. Trưởng đoàn thanh tra của Thanh tra Hàng hải Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 500.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.

3. Chánh Thanh tra Hàng hải Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 800.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn hoặc đình chỉ hoạt động có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại Điều 4 Nghị định này.”

Điều 21. Sửa đổi Điều 33 như sau:

“Điều 33. Thẩm quyền lập biên bản vi phạm hành chính

1. Người có thẩm quyền xử phạt vi phạm hành chính của cơ quan, lực lượng quy định tại các Điều 28, Điều 29, Điều 29a, Điều 30, Điều 31, Điều 31a, Điều 31b, Điều 32 và Điều 32a Nghị định này đang thi hành công vụ, nhiệm vụ có thẩm quyền lập biên bản vi phạm hành chính thuộc lĩnh vực, phạm vi địa bàn quản lý của mình.

2. Chiến sỹ Cảnh sát biển đang thi hành công vụ, nhiệm vụ có thẩm quyền lập biên bản đối với hành vi vi phạm hành chính quy định tại Nghị định này.

3. Chiến sỹ Công an nhân dân đang thi hành công vụ, nhiệm vụ có thẩm quyền lập biên bản đối với hành vi vi phạm hành chính thuộc lĩnh vực, phạm vi địa bàn quản lý của mình.

4. Người thuộc lực lượng Quân đội nhân dân, Công an nhân dân, công chức, viên chức thuộc cơ quan quy định tại các Điều 28, Điều 29, Điều 29a, Điều 30, Điều 31, Điều 31a, Điều 31b, Điều 32 và Điều 32a Nghị định này đang thi hành công vụ, nhiệm vụ có thẩm quyền lập biên bản đối với hành vi phạm hành chính thuộc lĩnh vực, phạm vi địa bàn quản lý của mình.”

Điều 22. Bổ sung Điều 33b và Điều 33c vào sau Điều 33a như sau:

“Điều 33b. Xử phạt vi phạm hành chính trên môi trường điện tử

Việc xử lý vi phạm hành chính theo quy định tại Nghị định này trên môi trường điện tử được áp dụng theo quy định tại Điều 28a và Điều 28b Nghị định số 118/2021/NĐ-CP ngày 23 tháng 12 năm 2021 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật Xử lý vi phạm hành chính (được sửa đổi, bổ sung bởi Nghị định số 190/2025/NĐ-CP ngày 01 tháng 7 năm 2025 của Chính phủ).

Điều 33c. Xử phạt đối với những hành vi vi phạm hành chính tại Nghị định này đồng thời được quy định trong Bộ luật Hình sự

Khi xem xét vụ việc để quyết định xử phạt vi phạm hành chính, nếu xét thấy hành vi vi phạm quy định tại điểm b khoản 2 Điều 14, khoản 2 Điều 15, khoản 3 Điều 17, khoản 7 và khoản 8 Điều 26, điểm e khoản 5 Điều 26c và các hành vi vi phạm khác quy định tại Nghị định này mà có dấu hiệu tội phạm, thì người có thẩm quyền đang thụ lý vụ việc phải chuyển hồ sơ vụ vi phạm đến cơ quan có thẩm quyền tiến hành tố tụng hình sự để truy cứu trách nhiệm hình sự theo quy định tại các khoản 1,2 và 4 Điều 62 Luật Xử lý vi phạm hành chính.”.

Điều 23. Bãi bỏ, thay thế một số cụm từ tại Nghị định số 162/2013/NĐ-CP ngày 12 tháng 11 năm 2013 của Chính phủ quy định xử phạt vi phạm hành chính trên các vùng biển, đảo và thềm lục địa của nước Cộng hoà xã hội chủ nghĩa Việt Nam đã được sửa đổi, bổ sung bởi Nghị định số 23/2017/NĐ-CP và Nghị định số 37/2022/NĐ-CP

1. Bãi bỏ khoản 2 Điều 27a Nghị định này.

2. Thay thế cụm từ “Bộ Tài nguyên và Môi trường” bằng cụm từ “Bộ Nông nghiệp và Môi trường” tại Điều 8b và Điều 8c Nghị định này.

3. Thay thế cụm từ “hộ chiếu thuyền viên” bằng cụm từ “hộ chiếu” tại Điều 17 Nghị định này.

Điều 24. Hiệu lực và trách nhiệm thi hành

1. Nghị định có hiệu lực thi hành từ ngày 04 tháng 5 năm 2026.

2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương và các cơ quan, tổ chức có liên quan chịu trách nhiệm thi hành Nghị định này.

The Government promulgates a Decree providing amendments to the Government’s Decree No.162/2013/ND-CP dated November 12, 2013 prescribing penalties for administrative violations committed within territorial waters, islands and continental shelf of the Socialist Republic of Vietnam, as amended by the Decree No. 23/2017/ND-CP and the Decree No. 37/2022/ND-CP.

Article 1. Amendment of heading of Article 3, addition of clauses 1a and 1b following clause 1 Article 3

1. Heading of Article 3 is amended as follows:

“Article 3. Penalties, fines, power to impose fines, and penalty imposition rules”.

2. Clauses 1a and 1b are added following clause 1 as follows:

“1a. Primary penalties to be imposed under this Decree include:

a) Warning;

b) Fine.

1b. Additional penalties to be imposed under this Decree include:

Article 2. Addition of clauses 6 and 7 following clause 5 Article 4

“6. Enforced return of ship certifications/documents, practicing certificates, certificates of competency, discharge books or passports which have been erased or altered to issuing authorities or officers.

7. Enforced treatment of exhibits which are hazardous waste”.

Article 3. Amendment of clause 2, addition of clause 3 following clause 2 Article 8a

1. Clause 2 is amended as follows:

“2. Additional penalties: Confiscate the exhibits and/or instrumentalities used for committing the violation in point i clause 1 of this Article.”

“4. Remedial measures: Enforced payment of an amount equivalent to the value of the exhibits/instrumentalities which have been sold, liquidated, hidden or destroyed inconsistently with the law, if any of the violations in points a and c clause 1 and clause 2 of this Article is committed.”.

“7. Additional penalties: Suspend the master's certificate of competency for 01 - 06 months, if the violation prescribed in clause 2 of this Article is committed;”.

“8. Remedial measures: Enforced return of ship certificates and documents to their issuing authorities or officers, if the violation prescribed in clause 4 of this Article is committed.”.

Article 7. Amendment of clause 4, addition of clause 5 following clause 4 Article 17

1. Clause 4 is amended as follows:

“4. Additional penalties: Confiscate any forced certificates of competency, discharge books and passports, if the violation prescribed in clause 3 of this Article is committed.”.

2. Clause 5 is added following clause 4 as follows:

“5. Remedial measures: Enforced return of erased or altered certificates of competency, discharge books and passports to their issuing authorities or officers, if any of the violations in clauses 2 and 3 of this Article is committed.”.

Article 9. Addition of points c and d following point b clause 10 Article 26

“c) Enforced payment of an amount equivalent to the value of the exhibits/instrumentalities which have been sold, liquidated, hidden or destroyed inconsistently with the law, if any of the violations in clauses 7 and 8 of this Article is committed.

d) Enforced treatment of the exhibits which are hazardous waste, if any of the violations in clauses 7 and 8 of this Article is committed.”.

Article 10. Addition of point c following point b clause 7 Article 26c

Article 11. Amendments to clause 5 Article 27

“5. Remedial measures:

a) Enforced application of environmental pollution control measures as prescribed, if any of the violations in this Article is committed;

b) Enforced payment of an amount equivalent to the value of the exhibits/instrumentalities which have been sold, liquidated, hidden or destroyed inconsistently with the law, if the violation in point b clause 3 of this Article is committed.”.

“Article 28. Power to impose penalties of Vietnam Coast Guard Forces

The title holders specified in this Article shall have the power to impose penalties for the administrative violations prescribed in Chapter II, except those committed by foreigners as prescribed in points a, e and g clause 7 Article 8b of this Decree. To be specific:

1. Police Officers on duty of the Coast Guard Forces shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 50.000.000;

c) Confiscate the exhibits/instrumentalities whose value does not exceed twice the fine specified in point b of this clause.

2. Coast Guard Team Leaders shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 100.000.000;

3. Heads of Coast Guard Units or Coast Guard Stations shall have the power to:

d) Impose the remedial measures specified in points a, c and e clause 1 Article 28 of the Law on Handling of Administrative Violations and clauses 2, 3, 4, 5, 6 and 7 Article 4 of this Decree.

5. Captains of Coast Guard Squadrons; Heads of Reconnaissance Commissions, Heads of Task Force Commissions for Drug Crime Prevention and Control under the control of Vietnam Coast Guard shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 500.000.000;

c) Suspend licenses/practicing certificates or operations for fixed periods;

d) Confiscate the exhibits/instrumentalities used for committing administrative violations;

dd) Impose the remedial measures specified in points a, c, d, e and i clause 1 Article 28 of the Law on Handling of Administrative Violations and clauses 2, 3, 4, 5, 6 and 7 Article 4 of this Decree.

6. Regional Coast Guard Commanders, Director General of the Department of Operations and Legislation under the control of Vietnam Coast Guard shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 800.000.000;

7. Vietnam Coast Guard Commander shall have the power to:

d) Confiscate the exhibits/instrumentalities used for committing administrative violations;

dd) Impose the remedial measures specified in Article 4 of this Decree.”.

Article 13. Amendments to Article 29

The title holders specified in this Article shall have the power to impose penalties for the administrative violations prescribed in Chapter II, except those committed by foreigners as prescribed in points a, e and g clause 7 Article 8b of this Decree, in the fields and areas under their management. To be specific:

1. On-duty soldiers of the Border Guard Forces shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 50.000.000;

c) Confiscate the exhibits/instrumentalities whose value does not exceed twice the fine specified in point b of this clause.

2. Station Heads or Team Leaders in charge of managing soldiers of the Border Guard Forces shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 100.000.000;

c) Confiscate the exhibits/instrumentalities whose value does not exceed twice the fine specified in point b of this clause;

3. Leaders of Task Force Teams for Drug and Crime Prevention and Control which are put under the control of Task Force Commissions for Drug and Crime Prevention and Control shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 150.000.000;

c) Confiscate the exhibits/instrumentalities whose value does not exceed twice the fine specified in point b of this clause;

d) Impose the remedial measures specified in points a, c and e clause 1 Article 28 of the Law on Handling of Administrative Violations.

4. Heads of Border Guard Posts, Captains of Naval Border Guard Flotillas, and Commanding Officers of Border Guard Commands at port border checkpoints shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 300.000.000;

c) Confiscate the exhibits/instrumentalities whose value does not exceed twice the fine specified in point b of this clause;

c) Suspend licenses/practicing certificates or operations for fixed periods;

d) Confiscate the exhibits/instrumentalities used for committing administrative violations;

dd) Impose the remedial measures specified in Article 4 of this Decree.

6. Commanding Officers of Border Guard Commands; Captains of Naval Border Guard Squadrons, and Director General of the Drug and Crime Prevention and Control Department affiliated to the Border Guard High Command shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 1.000.000.000;

The title holders specified in this Article shall have the power to impose penalties for the administrative violations prescribed in Chapter II hereof in the fields and areas under their management. To be specific:

1. Soldiers on duty of People’s Public Security Forces shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 100.000.000;

c) Confiscate the exhibits/instrumentalities whose value does not exceed twice the fine specified in point b of this clause.

Heads of professional divisions of the following authorities: the Economic Security Department, the Investigation Police Department for Social Order Crimes, the Counter Narcotics Police Department, the Traffic Police Department, the Fire and Rescue Police Department, the Environment Crime Prevention and Fighting Police Department, the Department of Cybersecurity and Hi-tech Crime Prevention and Control, the Immigration Department, and Commanders of Mobile Police Regiments; Heads of divisions affiliated to Provincial-level Police Departments, including: Economic Security Divisions, Investigation Police Divisions for Social Order Crimes, Police Divisions for Investigation into Corruption, Economy, Smuggling and Environment-related Crimes, Counter Narcotics Police Divisions, Traffic Police Divisions, Mobile Police Divisions, Fire and Rescue Police Divisions, External Security Divisions, and Cybersecurity, and Hi-Tech Crime Prevention and Control Divisions, shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 800.000.000;

b) Impose a fine up to VND 1.000.000.000;

c) Suspend licenses/practicing certificates or operations for fixed periods;

d) Confiscate the exhibits/instrumentalities used for committing administrative violations;

dd) Impose the expulsion penalty;

8. b) Impose a fine up to VND 1.000.000.000;

c) Suspend licenses/practicing certificates or operations for fixed periods;

d) Confiscate the exhibits/instrumentalities used for committing administrative violations;

dd) Impose the remedial measures specified in Article 4 of this Decree.

9. Director General (Director) of the Immigration Department shall have the power to impose penalties as prescribed in clause 8 of this Article, and are entitled to issue expulsion decisions.”.

The title holders specified in this Article shall have the power to impose penalties for the administrative violations directly related to the contents of the inspection, and in the fields under their management as prescribed in Chapter II hereof within the ambit of their assigned functions, tasks and powers. To be specific:

1. Inspectors of Vietnam Maritime Inspectorate shall have the power to:

a) Issue warning;

b) Impose a fine up to VND 100.000.000;

Article 21. Amendments to Article 33

“Article 33. Power to make records of administrative violations

1. The persons having the power to impose administrative penalties of the authorities or forces specified in Articles 28, 29, 29a, 30, 31, 31a, 31b, 32 and 32a hereof shall, during their performance of official duties or tasks, have the power to make records of the administrative violations in the fields and areas under their management.

2. On-duty soldiers of the Coast Guard Forces shall the power to make records of the administrative violations prescribed in this Decree.

3. On-duty soldiers of the People’s Public Security Forces shall the power to make records of the administrative violations in the fields and areas under their management.

4. Persons of the People’s Armed Forces or the People’s Public Security Forces, and civil servants and public employees working at the authorities specified in Articles 28, 29, 29a, 30, 31, 31a, 31b, 32 and 32a hereof shall, during their performance of official duties or tasks, have the power to make records of the administrative violations in the fields and areas under their management.”

Article 33c. Imposition of penalties for administrative violations in this Decree which are also governed by the Criminal Code

When considering a case for the purpose of issuing a penalty imposition decision, if it is determined that any of the violations prescribed in point b clause 2 Article 14, clause 2 Article 15, clause 3 Article 17, clause 7 and clause 8 Article 26, point e clause 5 Article 26c and other violations prescribed in this Decree denotes signs of a crime, the competent person who is handling the case shall transfer the case file to the authority competent to conduct criminal proceedings for initiating criminal prosecution as prescribed in clauses 1, 2 and 4 Article 62 of the Law on Handling of Administrative Violations.”.

Article 23. Abrogation and replacement of some phrases in Government’s Decree No.162/2013/ND-CP dated November 12, 2013 prescribing penalties for administrative violations committed within territorial waters, islands and continental shelf of the Socialist Republic of Vietnam, as amended by Decree No. 23/2017/ND-CP and Decree No. 37/2022/ND-CP

1. Clause 2 Article 27a of this Decree is abrogated.

2. The phrase “Bộ Tài nguyên và Môi trường” (“Ministry of Natural Resources and Environment”) is replaced with the phrase “Bộ Nông nghiệp và Môi trường” (“Ministry of Agriculture and Environment of Vietnam”) in Article 8b and Article 8c of this Decree.

3. The phrase “hộ chiếu thuyền viên” (“seafarer’s passport”) is replaced with the phrase “hộ chiếu” (“passport”) in Article 17 of this Decree.

Article 24. Effect and responsibility for implementation

1. This Decree comes into force from May 04, 2026.

2. Ministers, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces or central-affiliated cities, and relevant authorities and organizations shall be responsible for the implementation of this Decree.
