ON
AMENDMENTS TO A NUMBER OF ARTICLES OF DECREE NO. 20/2021/ND-GOVERNMENT DATED
MARCH 15, 2021 OF GOVERNMENT OF VIETNAM ON SOCIAL SUPPORT POLICIES FOR SOCIAL
PROTECTION BENEFICIARIES
Pursuant to Law on Governmental Organization
dated June 19, 2015; Law on amendments to Law on Government Organization and
Law on Local Governmental Organization dated November 22, 2019;
Pursuant to Law on Prevention of virus infection
causing acquired immunodeficiency syndrome (HIV/AIDS) dated June 29, 2006;
Pursuant to Law on Persons with Disabilities
dated June 17, 2010;
Pursuant to Law on Persons with Disabilities
dated June 17, 2010;
Pursuant to Law on natural disaster management
dated June 19, 2013; Law on amendments to the law on natural disaster
management and law on dikes dated June 17, 2020;
Pursuant to Law on State Budget of Vietnam dated

Pursuant to Resolution No. 142/2024/QH15 dated
June 29, 2024 of National Assembly on the 7th Session, 15th National Assembly;
At the request of Minister of Labor, War
Invalids and Social Affairs;
Government issues a Decree on amendments to a
number of articles of Decree No. 20/2021/ND-CP dated March 15, 2021 of
Government on social support policies for social protection beneficiaries.
Article 1. Amendments to a
number of articles of Decree No. 20/2021/ND-CP dated March 15, 2021 of
Government on social support policies for social protection beneficiaries
1. Amendments to clause 2 of Article 4:
“2. The standard social support amount applicable
from July 1, 2021 is VND 500.000/month.
Depending on balancing capacity of budget,
increasing rate of consumption rates, and living conditions of social
protection beneficiaries, competent authorities shall consider and increase the
standard social support amount accordingly; guarantee relation with policies on
other beneficiaries.
2. Amendments to clause 3 of Article 4:
“3. If the socio-economic conditions in local
administrative divisions allow, People’s Committees of provinces shall request
People's Councils of provinces to decide that:

b) Other individuals with disadvantaged conditions
that are not specified under this Decree shall be eligible for social support
policies.”.
Article 2. Implementation
1. This Circular comes into force from July 07,
2024.
2. Social support policies specified in Clause 1 of
Article 6, Clause 2 of Article 11, Clause 1 of Article 13, Clauses 1 and 2 of
Article 14, Clause 1 of Article 19, Clauses 1 and 2 of Article 20, Clauses 1
and 3 of Article 25, and other relevant provisions prescribed in Decree No.
20/2021/ND-CP dated March 15, 2021 of the Government on social support policies
for social protection beneficiaries shall apply the standard social support
amount specified in Clause 1 of Article 1 of this Decree from July 1, 2024.
3. Beneficiaries of social support policies specified
in Decree No. 20/2021/ND-CP dated March 15, 2021 of the Government on social
support policies for social protection beneficiaries shall apply the standard
social support amount specified in Clause 1, Article 1 of this Decree from July
1, 2024.
4. The Chairmen of the District-level People's
Committees shall direct the competent authorities in reviewing the list of
beneficiaries and deciding on payment for policies according to the standard
amount specified in this Decree from July 1, 2024.
5. The heads of the social support facilities or
social housing shall compile a report to the competent authority to ensure
expenditures and organize the implementation of the policies on care and
nurture in accordance with the standard social support amount specified in this
Decree from July 1, 2024.
Article 3. Responsibility for
implementation
Minister of Labor, War Invalids and Social Affairs,
Ministers, Heads of ministerial agencies, Heads of Governmental agencies,
Presidents of People’s Committees of provinces and centrally affiliated cities
are responsible for the implementation of this Decree./.
