NGHỊ ĐỊNH

CỦA CHÍNH PHỦ SỐ 133/2003/NĐ-CP NGÀY 06 THÁNG 11 NĂM 2003 BỔ SUNG MỘT SỐ CHẤT VÀO DANH MỤC CÁC CHẤT MA TUÝ VÀ TIỀN CHẤT BAN HÀNH KÈM THEO NGHỊ ĐỊNH SỐ 67/2001/NĐ-CP NGÀY 01 THÁNG 10 NĂM 2001 CỦA CHÍNH PHỦ

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Căn cứ Luật Phòng, chống ma tuý ngày 09 tháng 12 năm 2000;
Xét đề nghị của Bộ trưởng Bộ Công an, Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Công nghiệp, Bộ trưởng Bộ Khoa học và Công nghệ,

NGHỊ ĐỊNH:

Điều 1.

1. Bổ sung chất Ketamine vào Danh mục III "Các chất ma tuý độc dược được dùng trong phân tích, kiểm nghiệm, nghiên cứu khoa học, điều tra tội phạm hoặc trong lĩnh vực y tế theo yêu cầu điều trị" ban hành kèm theo Nghị định số 67/2001/NĐ-CP ngày 01 tháng 10 năm 2001 của Chính phủ.

2. Bổ sung vào Danh mục IV "Các hoá chất không thể thiếu trong quá trình sản xuất, điều chế chất ma tuý" ban hành kèm theo Nghị định số 67/2001/NĐ-CP ngày 01 tháng 10 năm 2001 của Chính phủ các chất sau đây:

Điều 2. Việc nghiên cứu, giám định, sản xuất, vận chuyển, bảo quản, tàng trữ, mua bán, phân phối, sử dụng, xử lý, trao đổi, nhập khẩu, xuất khẩu, quá cảnh các chất quy định tại Điều 1 của Nghị định này phải tuân thủ các quy định của Luật Phòng, chống ma tuý và các quy định pháp luật khác có liên quan.

Điều 3. Bộ Công nghiệp, Bộ Y tế, Bộ Công an trong phạm vi chức năng, nhiệm vụ của mình có trách nhiệm quy định cụ thể và tổ chức quản lý các chất quy định tại Điều 1 Nghị định này cho phù hợp với yêu cầu y tế, sản xuất, kinh doanh.

Điều 4. Nghị định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo.

Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Uỷ ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

ADDING A NUMBER OF SUBSTANCES TO THE LIST OF NARCOTICS AND PRE-SUBSTANCES, ISSUED TOGETHER WITH THE GOVERNMENTS DECREE NO. 67/2001/ND-CP OF OCTOBER 1, 2001

THE GOVERNMENT

Pursuant to December 25, 2001 Law on Organization of the Government;
Pursuant to December 9, 2000 Law on Drug Prevention and Combat;
At the proposals of the Minister of Public Security; the Minister of Health; the Minister of Industry and the Minister of Science and Technology,

DECREES:

Article 1.- To add ketamine substance to List III Toxic narcotic pharmaceuticals which are permitted for use in analysis, test, scientific research and criminal investigation or in medical field according to therapeutic requirements, issued together with the Governments Decree No. 67/2001/ND-CP of October 1, 2001.

2. To add the following substances to List IV Chemicals which are indispensable in the process of narcotic production and preparation, issued together with the Governments Decree No. 67/2001/ND-CP of October 1, 2001:

Article 2.- The research into, expertise, production, transportation, preservation, storage, sale, purchase, distribution, use, handling, exchange, importation, exportation and transit of, substances prescribed in Article 1 of this Decree must comply with the provisions of the Law on Drug Prevention and Combat as well as other relevant law provisions.

Article 3.- The Ministry of Industry, the Ministry of Health and the Ministry of Public Security shall, within the scope of their functions and tasks, have to specify and organize the management of substances prescribed in Article 1 of this Decree in accordance with healthcare, production and business requirements.

Article 4.- This Decree takes effect 15 days after its publication in the Official Gazette.

The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the provincial/municipal Peoples Committees shall have to implement this Decree.
