VIỆC ĐIỀU CHỈNH TỶ LỆ DỰ TRỮ BẮT BUỘC ĐỐI VỚI CÁC TỔ CHỨC TÍN DỤNG
THỐNG ĐỐC NGÂN HÀNG NHÀ NƯỚC
Căn cứ Luật Ngân hàng Nhà nước
Việt Nam năm 1997; Luật sửa đổi, bổ sung một số điều của Luật Ngân hàng Nhà nước
Việt Nam năm 2003;
Căn cứ Luật Các tổ chức tín dụng năm 1997; Luật sửa đổi, bổ sung một số điều của
Luật Các tổ chức tín dụng năm 2004;
Căn cứ Nghị định số 96/2008/NĐ-CP ngày 26 tháng 8 năm 2008 của Chính phủ quy định
chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Ngân hàng Nhà nước Việt
Nam;
Theo đề nghị của Vụ trưởng Vụ Chính sách tiền tệ,
QUYẾT ĐỊNH
Điều 1.
Tỷ lệ dự trữ bắt buộc đối với tiền gửi bằng đồng Việt Nam áp dụng cho các tổ chức
tín dụng như sau:
1. Tỷ lệ dự trữ bắt buộc đối với
tiền gửi không kỳ hạn và có kỳ hạn dưới 12 tháng bằng đồng Việt Nam áp dụng như
sau:
a. Các ngân hàng thương mại Nhà
nước (không bao gồm Ngân hàng Nông nghiệp và phát triển nông thôn), Ngân hàng
thương mại cổ phần Ngoại thương Việt Nam, ngân hàng thương mại cổ phần đô thị,
ngân hàng liên doanh, chi nhánh ngân hàng nước ngoài, công ty tài chính là 6%
trên tổng số dư tiền gửi phải dự trữ bắt buộc.
b. Ngân hàng Nông nghiệp và phát
triển nông thôn là 3% trên tổng số dư tiền gửi phải dự trữ bắt buộc.
c. Ngân hàng thương mại cổ phần
nông thôn, Quỹ tín dụng nhân dân trung ương, ngân hàng hợp tác là 1% trên tổng
số dư tiền gửi phải dự trữ bắt buộc.
2. Tỷ lệ dự trữ bắt buộc đối với
tiền gửi từ 12 tháng trở lên bằng đồng Việt Nam áp dụng như sau:
a. Các ngân hàng thương mại Nhà
nước (không bao gồm Ngân hàng Nông nghiệp và phát triển nông thôn), Ngân hàng
thương mại cổ phần Ngoại thương Việt Nam, ngân hàng thương mại cổ phần đô thị,
ngân hàng liên doanh, chi nhánh ngân hàng nước ngoài, công ty tài chính, công
ty cho thuê tài chính là 2% trên tổng số dư tiền gửi phải dự trữ bắt buộc.
b. Ngân hàng Nông nghiệp và phát
triển nông thôn, Ngân hàng thương mại cổ phần nông thôn, Quỹ tín dụng nhân dân
trung ương, ngân hàng hợp tác là 1% trên tổng số dư tiền gửi phải dự trữ bắt buộc.
Điều 2.
Tỷ lệ dự trữ bắt buộc đối với tiền gửi bằng ngoại tệ áp dụng cho các tổ chức
tín dụng như sau:
1. Tỷ lệ dự trữ bắt buộc đối với
tiền gửi không kỳ hạn và có kỳ hạn dưới 12 tháng bằng ngoại tệ áp dụng như sau:
a. Các ngân hàng thương mại Nhà
nước (không bao gồm Ngân hàng Nông nghiệp và phát triển nông thôn), Ngân hàng
thương mại cổ phần Ngoại thương Việt Nam, ngân hàng thương mại cổ phần đô thị,
ngân hàng liên doanh, chi nhánh ngân hàng nước ngoài, công ty tài chính là 7%
trên tổng số dư tiền gửi bằng ngoại tệ phải dự trữ bắt buộc.
b. Ngân hàng Nông nghiệp và phát
triển nông thôn, Ngân hàng thương mại cổ phần nông thôn, Quỹ tín dụng nhân dân
trung ương, ngân hàng hợp tác là 6% trên tổng số dư tiền gửi phải dự trữ bắt buộc.
2. Tỷ lệ dự trữ bắt buộc đối với
tiền gửi từ 12 tháng trở lên bằng ngoại tệ áp dụng như sau:
a. Các ngân hàng thương mại Nhà
nước (không bao gồm Ngân hàng Nông nghiệp và phát triển nông thôn), Ngân hàng
thương mại cổ phần Ngoại thương Việt Nam, ngân hàng thương mại cổ phần đô thị,
ngân hàng liên doanh, chi nhánh ngân hàng nước ngoài, công ty tài chính, công
ty cho thuê tài chính là 3% trên tổng số dư tiền gửi bằng ngoại tệ phải dự trữ
bắt buộc.
b. Ngân hàng Nông nghiệp và phát
triển nông thôn, Ngân hàng thương mại cổ phần nông thôn, Quỹ tín dụng nhân dân
trung ương, ngân hàng hợp tác là 2% trên tổng số dư tiền gửi phải dự trữ bắt buộc.
Điều 3.
Quyết định này có hiệu lực thi hành kể từ kỳ duy trì dự
trữ bắt buộc tháng 12 năm 2008 và thay thế Quyết định số 2811/QĐ-NHNN ngày 20
tháng 11 năm 2008 và Điều 2 Quyết định số 2560/QĐ-NHNN ngày 03 tháng 11 năm 2008 của Thống đốc Ngân hàng Nhà
nước.
Điều 4. Chánh Văn phòng,
Vụ trưởng Vụ Chính sách tiền tệ, Thủ trưởng các đơn vị thuộc Ngân hàng Nhà nước,
Giám đốc Ngân hàng Nhà nước Chi nhánh tỉnh, thành phố, Tổng giám đốc (Giám đốc)
các tổ chức tín dụng chịu trách nhiệm thi hành quyết định này.

DECISION ON THE ADJUSTMENT OF REQUIRED
RESERVE RATIO FOR VIETNAMESE DONG DEPOSIT OF CREDIT INSTITUTIONS THE GOVERNOR OF THE STATE BANK - Pursuant to the Law on the State Bank of Vietnam issued in
1997; the Law on amendment, supplement of several articles of the Law on the
State Bank of Vietnam issued in 2003
- Pursuant to the Law on the Credit Institutions issued in 1997; the Law on
amendment, supplement of several articles of the Law on the Credit Institutions
issued in 2004;
- Pursuant to the Decree No. 96/2008/ND-CP dated 26 August 2008 of the
Government providing for the functions, duties, authorities and organizational
structure of the State Bank of Vietnam;
- Upon the proposal of the Director of the Monetary Policy Department, DECIDES: Article 1. Required reserve ratios applicable to Vietnamese Dong
Deposit of credit institutions shall be as follows: 1. Required reserve ratios applicable to demand VND deposit
and VND deposit with the term of less than 12 months shall be as follows: a. For State owned commercial banks (Bank for agriculture
and rural development excluded), Bank for foreign trade of Vietnam, urban
commercial joint stock banks, joint venture banks, foreign banks branches,
finance companies, the ratio shall be 6% over the total deposit balances

Peoples Credit Fund, cooperative banks, the ratio shall be 1% over the total
deposit balances subject to required reserve. 2. Required reserve ratios applicable to VND deposit with
the term of 12 months and more shall be as follows: a. For State owned commercial banks (Bank for agriculture
and rural development excluded), Bank for foreign trade of Vietnam, urban
commercial joint stock banks, joint venture banks, foreign banks branches,
finance companies and finance leasing companies, the ratio shall be 2% over the
total deposit balances subject to required reserve. b. In respect of the Bank for agriculture and rural
development, rural commercial joint stock banks, Central Peoples credit Fund,
cooperative banks, the ratio shall be 1% over the total deposit balances
subject to required reserve. Article 2. Required reserve ratios applicable to foreign currency deposit
of credit institutions shall be as follows: 1. Required reserve ratios applicable to demand foreign
currency deposit and foreign currency deposit with the term of less than 12
months shall be as follows: a. For State owned commercial banks (Bank for agriculture
and rural development excluded), Bank for foreign trade of Vietnam, urban
commercial joint stock banks, joint venture banks, foreign banks branches,
finance companies, the ratio shall be 7% over the total foreign currency
deposit balances subject to required reserve. b. In respect of the Bank for agriculture and rural
development, rural commercial joint stock banks, Central Peoples credit Fund,
cooperative banks, the ratio shall be 6% over the total deposit balances
subject to required reserve. 2. The required reserve ratios applicable to foreign

subject to required reserve. Article 3. This Decision shall be effective for the implementation of
the required reserve maintenance period of December 2008 and replace the
Decision No. 2811/QD-NHNN dated 20 November 2008 and Article 2 of the Decision
No. 2560/QD-NHNN dated 3 November 2008 of the State Banks Governor. Article 4. The Director of the Administrative Department, the
Director of Monetary Policy Department, Heads of units of the State Bank of
Vietnam, General Managers of State Bank branches in provinces, cities, General
Directors (Directors) of credit institutions shall be responsible for the
