CIRCULAR
REGARDING
AMENDMENT AND ANNULMENT OF CERTAIN ARTICLES OF CIRCULAR NO. 15/2015/TT-BKHCN
DATED AUGUST 25, 2015 OF THE MINISTER OF SCIENCE AND TECHNOLOGY ON METROLOGY
AND QUALITY STANDARDS IN PETROL ANDF THE MINISTER OF SCIENCE AND TECHNOLOGY OIL
TRADING, WHICH IS AMENDED BY CIRCULAR NO. 08/2018/TT-BKHCN DATED JUNE 15, 2018
OF THE MINISTER OF SCIENCE AND TECHNOLOGY
Pursuant to the Law on Metrology dated November
11, 2011;
Pursuant to Decree No. 83/2014/ND-CP dated
September 3, 2014 of the Government on petrol and oil trading; Decree No.
95/2021/ND-CP dated November 1, 2021 on amendments to Decree No. 83/2014/ND-CP
dated September 3, 2014 on petrol and oil trading; Decree No. 80/2023/ND-CP
dated November 17, 2023 of the Government on amendments to Decree No.
95/2021/ND-CP dated November 1, 2021 and Decree No. 83/2014/ND-CP dated
September 3, 2014 of the Government on petrol and oil trading;
Pursuant to Decree No. 55/2025/ND-CP dated March
2, 2025 on functions, tasks, powers, and organizational structure of the
Ministry of Science and Technology;
At the request of the Chairperson of the
National Commission for the Standards, Metrology and Quality and the Director
of the Legal Department;
The Minister of Science and Technology hereby
promulgates a Circular regarding amendment and annulment of certain articles of
Circular No. 15/2015/TT-BKHCN dated August 25, 2015 of the Minister of Science
and Technology on metrology and quality standards in petrol and oil trading.
Article 1. Amendment and
annulment of certain articles of Circular No. 15/2015/TT-BKHCN dated August 25,
2015 of the Minister of Science and Technology on metrology and quality
standards in petrol and oil trading, which is amended by Circular No.
08/2018/TT-BKHCN dated June 15, 2018

“d) Control switches related to the control
circuit of a fuel dispenser must not be installed outside such fuel dispenser
(except for the switch used for terminating the fuel dispensing as per the
manufacturer’s design). Any peripheral device connected to the fuel dispenser
must not contain any structure or function that alters the main technical and
metrological characteristics of the fuel dispenser compared to the approved
dispenser model.”
2. Clause 6 of Article 6 is amended as follows:
“6. In case the results of dispensing of
petrol and oil amount are found not to meet the requirements specified in
clause 3 of this Article or the fuel dispenser is damaged and any sealed or
lead-sealed part, component, or function (hereinafter referred to as “part”) of
such fuel dispenser must be calibrated, repaired, or replaced (hereinafter
referred to as “repair”). The trader shall take the following remedial
measures:
a) Stop use of the fuel dispenser to repair such
parts;
b) Upon completion of the repair, a repair record
of the fuel dispenser between the trader and the repair facility or
repair-conducting individual must be prepared. Such repair record must specify
name and address of the repair facility or name, address, and ID card number of
the repair-conducting individual; time of repair; model, symbol, serial number
of the repaired fuel dispenser; conducted repairs; condition of the seals or
lead seals of the repaired parts (if there are any changes compared to before
the repair);
c) Conduct post-repair inspection of the fuel
dispenser;
d) The repair record specified in point b and the
certificate of inspection of measuring instruments issued after repair must be
retained for at least twenty-four (24) months at a location convenient for
inspection and audit. Copies of the repair record and the inspection
certificate must be submitted to the Department of Science and Technology or
the Sub-Department of Standards, Metrology and Quality for reporting purposes;
dd) In case the repair results in any change to the
main technical and metrological characteristics of the fuel dispenser compared
to the approved dispenser model, the fuel dispenser must undergo a new model
approval process in accordance with regulations before being put into use.”
3. Clause 7, Article 6 of Circular No.
15/2015/TT-BKHCN is annulled.

“8. Traders shall be legally responsible for
meeting the requirements specified in point d, clause 1 and clause 6, Article 6
hereof.”
5. Article 25 is amended as follows:
“Article 25. Responsibilities of
organizations conducting inspection of measuring instruments
1. Suspend inspection in cases where the fuel
dispenser is found not to meet the requirements specified in points a, b, c,
and d, clause 1, Article 6 hereof or any act suspected to be a violation
against law on metrology and quality is found, then immediately notify the
Department of Science and Technology or the Sub-Department of Standards,
Metrology and Quality of such finding and cooperate with the Department or the
Sub-Department to handle in accordance with applicable laws.
2. Comply with the regulations on the
responsibilities of organizations conducting inspection of measuring
instruments specified in this Circular and other legislative documents on
metrology.”
6. Clause 2 of Article 26 is amended as follows:
“2. Take responsibility for the repair of
fuel dispensers by the repair facility itself or by units or agents authorized
by the repair facility.”
7. Clause 2 of Article 28 is amended as follows:
“2. Approve and implement the plan for
communication, dissemination, and provision of professional guidance on
metrology and quality standards in accordance with this Circular within the
administrative division.”

“3. Preside or direct the Sub-Department of
Standards, Metrology and Quality, within its jurisdiction, to take charge of or
cooperate with relevant agencies and units in conducting state inspections on
petrol and oil metrology and quality standards for general agents, agents,
petrol and oil retail stations, and petrol and oil transport service providers
within the administrative division, and perform other duties as prescribed in
this Circular and other relevant laws.”
Article 2. Implementation
provisions
1. This Circular comes into force from August 1,
2025.
2. Any difficulties that arise during
implementation must be promptly reported to the Ministry of Science and
Technology for consideration and resolution.
