BAN HÀNH DANH MỤC LĨNH VỰC, NGÀNH SẢN XUẤT, CHẾ BIẾN CÓ NƯỚC THẢI CHỨA KIM LOẠI NẶNG PHỤC VỤ TÍNH PHÍ BẢO VỆ MÔI TRƯỜNG ĐỐI VỚI NƯỚC THẢI

Căn cứ Luật Bảo vệ môi trường ngày 29 tháng 11 năm 2005;

Căn cứ Nghị định số 21/2013/NĐ-CP ngày 04 tháng 3 năm 2013 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài nguyên và Môi trường;

Căn cứ Nghị định số 25/2013/NĐ-CP ngày 29 tháng 3 năm 2013 của Chính phủ về phí bảo vệ môi trường đối với nước thải;

Xét đề nghị của Tổng cục trưởng Tổng cục Môi trường, Vụ trưởng Vụ Pháp chế;

Bộ trưởng Bộ Tài nguyên và Môi trường ban hành Danh mục lĩnh vực, ngành sản xuất, chế biến có nước thải chứa kim loại nặng phục vụ tính phí bảo vệ môi trường đối với nước thải,

Điều 1. Ban hành Danh mục lĩnh vực, ngành sản xuất, chế biến có nước thải chứa kim loại nặng

1. Thuộc da, tái chế da;

2. Khai thác than; khai thác, chế biến khoáng sản kim loại;

3. Nhuộm vải, sợi;

4. Sản xuất hóa chất;

5. Cơ khí, luyện kim, gia công kim loại, chế tạo máy, phụ tùng;

6. Sản xuất linh kiện, thiết bị, điện, điện tử;

7. Tái chế kim loại; tái chế chất thải luyện kim, chất thải công nghiệp khác;

8. Phá dỡ tàu cũ, vệ sinh súc rửa tàu;

9. Hệ thống xử lý nước thải công nghiệp tập trung (có tiếp nhận nước thải từ cơ sở thuộc lĩnh vực, ngành sản xuất, chế biến nằm trong Danh mục này).

Điều 2. Tổ chức thực hiện

1. Thông tư này có hiệu lực thi hành kể từ ngày 01 tháng 7 năm 2013.

2. Bộ Tài nguyên và Môi trường giao Tổng cục Môi trường hướng dẫn, kiểm tra, theo dõi, đôn đốc việc thực hiện Thông tư này;

3. Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các cấp và tổ chức, cá nhân có liên quan chịu trách nhiệm thực hiện Thông tư này.

4. Trong quá trình thực hiện, nếu có vướng mắc phát sinh, đề nghị các cơ quan, tổ chức, cá nhân kịp thời phản ánh về Bộ Tài nguyên và Môi trường để xem xét, hướng dẫn, sửa đổi và bổ sung cho phù hợp./.

CIRCULAR

PROMULGATING LIST OF FIELDS AND SECTORS IN PRODUCTION AND PROCESSING HAVING SEWAGE CONTAINING HEAVY METALS IN SERVE OF THE CALCULATING THE ENVIRONMENTAL PROTECTION CHARGES FOR SEWAGE

Pursuant to the Law on Environment protection dated November 29, 2005;

Pursuant to the Government’s Decree No. 21/2013/ND-CP dated March 04, 2013, defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to the Government’s Decree No. 25/2013/ND-CP dated March 29, 2013 on environmental protection charges for sewage;

At the proposal of General Director of Vietnam Environment Administration, Director of the Legal Affair Department;

The Minister of the Ministry of Natural Resources and Environment promulgates the list of fields and sectors in production and processing having sewage containing heavy metals in serve of the calculating the environmental protection charges for sewage,

Article 1. To promulgate the List of fields and sectors in production and processing having sewage containing heavy metal

2. Coal exploiting; mining and processing metal minerals;

3. Dyeing fabric and fiber;

4. Chemical production;

5. Mechanical engineering, metallurgy, metal processing, manufacture of machine and spare parts;

6. Production of components, equipment, electric, electronics;

7. Reprocessing metal, reprocessing waste of metallurgy, other industrial waste;

8. Destroying old vessels, cleaning, washing vessels;

9. The concentrated industrial sewage treatment system (including receipt of sewage from facilities in fields and sectors in production and processing in this list).

2. The Ministry of Natural Resources and Environment assigns the Vietnam Environment Administration in guiding, examining, monitoring, urging implemetation of this Circular.

3. Ministries, Ministerial-level agencies, Government-attached agencies, People’s Committees at all levels and relevant organizations and individuals shall implement this Circular.

4. In the course of implementation, any arising problems should be reported timely to the Ministry of Natural Resources and Environment for consideration, guidance as well as conformable amendment and supplementation.
