CHO PHÉP NGÀNH Y TẾ THU PHÍ KIỂM NGHIỆM MẪU THUỐC, NGUYÊN LIỆU LÀM THUỐC VÀ TRANG THIẾT BỊ Y TẾ

Căn cứ Luật Tổ chức Chính phủ ngày 30 tháng 9 năm 1992;
Căn cứ Luật Bảo vệ sức khoẻ nhân dân ngày 30 tháng 6 năm 1989;
Theo đề nghị của Bộ trưởng Bộ Y tế,

QUYẾT ĐỊNH:

Điều 1. Cho phép các cơ sở kiêm nghiệm thuộc ngành Y tế được thu phí kiểm nghiệm các mẫu thuốc, nguyên liệu làm thuốc và trang thiết bị y tế do các tổ chức, cá nhân trong nước và nước ngoài đưa đến kiểm nghiệm. Bộ Y tế và Bộ Tài chính cần bàn thống nhất đề ra quyết định và chịu trách nhiệm trước Thủ tướng Chính phủ về mức thu phí.

Điều 2. Số tiền thu phí kiểm nghiệm phải được quản lý và sử dụng theo chế độ quản lý tài chính đối với đơn vị sự nghiệp có thu do Bộ Tài chính quy định.

Điều 3. Quyết định này có hiệu lực thi hành từ ngày 1 tháng 10 năm 1994.

Điều 4. Bộ trưởng Bộ Tài chính và Bộ trưởng Bộ Y tế có trách nhiệm hướng dẫn thi hành Quyết định này.

Điều 5.Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Quyết định này.

DECISION

ALLOWING THE HEALTH SERVICE TO TAKE FEES ON INSPECTING DRUG SAMPLES, MEDICINAL MATERIALS AND HEALTH EQUIPMENT

THE PRIME MINISTER

Pursuant to the Law of Organization of the Government on the 30th of September, 1994;
Proceeding from the Law on Protection of People's Health on the 30th of June, 1989;
At the proposal of the Minister of Health,

DECIDES:

Article 1.- To allow the inspecting facilities of the Health Service to take fees for the service they offer in the inspection of drug samples, medicinal materials and health equipment at the request of domestic and foreign organizations and individuals. The Ministry of Health and the Ministry of Finance shall work together to decide on the fees and take responsibility for them before the Prime Minister.

Article 2.- The fees collected from this service shall be managed and spent in accordance with the provisions on financial management at profit-making administrative units set by the Ministry of Finance.

Article 3.- This Decision shall take effect as from the 1st of October, 1994.

Article 5.- The Cabinet ministers, the heads of the agencies of ministerial level and the agencies attached to the Government, and the presidents of the People's Committees in provinces and cities directly under the Central Government shall be responsible for the implementation of the Decision.
