DECISION

ISSUING THE PLAN FOR IMPLEMENTATION OF THE PRIME MINISTER’S DIRECTIVE NO. 33/CT-TTG DATED AUGUST 20, 2020 ON STRENGTHENING OF MANAGEMENT, REUSE, RECYCLING, DISPOSAL AND REDUCTION OF PLASTIC WASTE, AND THE PRIME MINISTER'S DECISION NO. 1746/QD-TTG DATED DECEMBER 4, 2019, ISSUING THE NATIONAL ACTION PLAN FOR MANAGEMENT OF OCEAN PLASTIC WASTE BY 2030

Pursuant to the Government's Decree No. 36/2017/ND-CP dated April 4, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to the Prime Minister’s Directive No. 33/CT-TTg dated August 20, 2020 regarding strengthening of management, reuse, recycling, disposal and reduction of plastic waste;

Pursuant to the Prime Minister’s Decision No. 1746/QD-TTg dated December 4, 2019, issuing the National Action Plan for management of ocean plastic waste by 2030;

Upon the request of the Director of the Department of Legal Affairs,

Article 2. This Decision shall enter into force as of the signature date.

This Decision shall replace the Decision No. 1855/QD-BTNMT dated August 21, 2020 of the Minister of Natural Resources and Environment, issuing the Plan for implementation of the Prime Minister’s Decision No. 1746/QD-TTG dated December 4, 2019, issuing the National Action Plan for management of ocean plastic waste by 2030.

The Chief of the Ministry’s Office, the Director of the Department of Legal Affairs, the Head of the Vietnam Environment Administration, the Head of the Vietnam Administration of Seas and Islands and Heads of the Ministry’s subordinate units shall be responsible for enforcing this Decision./.

1. Objectives

a) Consistently, uniformly and effectively implementing tasks and solutions assigned in the Prime Minister’s Directive No. 33/CT-TTG dated August 20, 2020 on strengthening of management, reuse, recycling, disposal and reduction of plastic waste, and the Prime Minister's Decision No. 1746/QD-TTG dated December 4, 2019, issuing the national action plan for management of ocean plastic waste by 2030.

b) Mobilizing the practical and active participation of agencies, units, public officers, civil servants and employees under the direct control of the Ministry of Natural Resources and Environment in management, reuse, recycling, disposal and reduction of plastic waste through policies, laws, specific activities and actions.

c) Cultivating and spreading the exemplary spirit of combat against plastic waste of affiliated agencies, units, public officers, civil servants and employees of the Ministry of Natural Resources and Environment, and thereby changing the community's awareness of the impacts of environmental pollution due to the use of disposable plastic products and non-biodegradable plastic bags for industrial, commercial and domestic purposes, and proceeding to successfully eliminate the habit of using disposable plastic products, polyethylene plastic bags that are difficult to biodegrade and be replaced by eco-friendly products.

2. Requirements

a) The Plan must be formulated and widely implemented in agencies, units, unions and associations under the control of the Ministry of Natural Resources and Environment, and must have enriched, practical and effective contents and forms;

b) Setting clear and specific criteria suitable to the actual situation of each agency or unit; urging, inspecting, evaluating, making a preliminary and final review of difficulties, issues, shortcomings and weaknesses, and proposing solutions for implementation of the Plan and ensuring fulfillment of the Plan’s objectives;

c) Emphasizing the responsibility, role and exemplary character of heads of agencies and units in directing the implementation of the Plan.

1.1. Vietnam Environment Administration

a) Formulating and improving the regulatory framework for solid waste management in the Law on Environmental Protection (amended) and documents providing detailed instructions for implementation of the Law with a view to deeming waste and plastic waste as resources; reviewing and proposing completion of legislative regulations on plastic waste management.

Implementation period: 2020-2021

b) Proposing legislative regulations on the re-export or return of imported plastic scraps that fail to meet environmental protection requirements.

Completion year: 2021

c) Reviewing and continuing to propose improvement of legislative regulations for human ecology, especially for environmentally friendly plastic bags and plastic products with high recycled content.

Completion year: 2022

d) Reviewing and proposing improvement or cooperating on the formulation of new environmental regulations, standards and technical regulations for products, goods and plastic bags made of recycled plastics, other products and goods containing microplastics and nanoplastics to prevent adverse effects on human health and the environment; proposing regulations and the roadmap for ban on the use of microplastics in the production of cosmetics, garments and fertilizers.

e) Researching and developing regulatory policies and legislative regulations to encourage organizations and individuals to sort plastic waste at source to create favorable conditions for collection and recycling.

Implementation period: 2021-2023

1.2. Department of Legal Affairs

a) Developing detailed regulations of the Law on Environmental Protection (amended) related to the responsibilities of manufacturers (replacing the Prime Minister's Decision No. 16/2015/QD-TTg dated May 22, 2015, prescribing recall and treatment of discarded products).

Completion year: 2021

b) Researching and proposing policies for promotion of models of circular economy, public-private partnership, sharing economy, and initiatives promoting participation of associations, organizations and businesses with the aim of reducing, reusing, recycling and disposing of plastic waste.

2. Propagating and raising awareness, changing behavioral conduct towards plastic products and plastic waste

2.1. Department of Emulation, Commendation and Propaganda

a) Developing and launching emulation movements to strengthen the management, reuse, recycling, disposal and reduction of plastic waste; launching the movement "Officials, civil servants, public employees and workers in the natural resources and environment sector say no to disposable plastic products and non-biodegradable plastic bags".

Implementation period: 2021-2030

b) Developing propaganda orientations throughout the entire natural resources and environment sector towards strengthening of the management, reuse, recycling, treatment and reduction of plastic waste; widely propagating good examples, effective models and initiatives in the management, reuse, recycling, disposal and reduction of plastic waste.

Implementation period: on a yearly basis

2.2. Ministry's affiliates

a) Reducing and minimizing the use of disposable plastic products; avoiding use of banners and placards made of plastics during holidays, anniversaries and other events; banning use of disposable plastic bottles, cups, straws, etc. at workplace and in conferences, seminars and meetings; prioritizing the selection of recycled and environmentally friendly products.

b) Collecting and classifying waste at agencies and offices to serve the collection and recycling of general waste and plastic waste.

Implementation period: on a regular basis

c) Encouraging and launching the movement in which civil servants, public employees and workers in agencies and units set good examples of  the restricted use of plastic bags and other disposable plastic products, and encourage their relatives, families and friends to join in the movement of "Say no to disposable plastic products and non-biodegradable plastic bags".

2.3. Ministry’s office

a) Amending and supplementing the Working Regulations, the Regulations on office culture, the Code of Conduct of officials, public officers, civil servants, public employees and workers of the Ministry of Natural Resources and Environment under which all of the Ministry’s affiliates are required to reduce and limit the use of non-biodegradable disposable plastic products and plastic bags, especially those discharged in meetings, conferences, seminars and other events of the Ministry and their subordinate units.

Completion year: 2021

b) Placing and installing trash bins used for containing and classifying waste at the headquarter of the Ministry to ensure the recovery of waste to serve the collection and recycling activities; providing instructions for the installation of these trash bins at the units under the Ministry’s direct control to ensure consistency and uniformity in terms of their color, design, etc.

a) Designing and publishing technical manuals for classification of waste at source at families and offices.

Completion year: 2021

b) Researching and proposing criteria for reduction, classification and collection of plastic waste in the assessment and ranking of environmental protection performance results of localities.

Implementation period: 2021-2022

2.5. General Department of Vietnam’s Sea and Islands

a) Organizing a campaign to collect garbage and clean up some beaches on a national scale on the basis of determining the priority order and appropriate roadmap, in conjunction with celebrating the World Ocean Day, Vietnam Sea and Island Week.

b) Communicating and scaling up the application of the model of reduction, collection and classification of plastic waste and plastic bags at tourist sites connected to the sea and islands in accordance with local practical conditions.

a) Performing the task of propaganda, creating specialized sections or columns on reduction, classification, collection and recycling of plastic waste; the task of promotion of plastic products and plastic bags with green or ecological labels.

b) Promoting propaganda for application of 5R model (Renew, Refuse, Reduce, Reuse, Recycle) for production, business, service and daily life activities in order to reduce, limit the use of plastic waste and proceed to say no to plastic waste.

2.7. Natural Resource and Environment Communication Center

a) Developing communication content and carrying out communication programs to raise public awareness of the harmful effects of products made from plastics and non-degradable plastic bags to the environment, ocean and human health in order to change the habit of using single-use plastic products and non-biodegradable plastic bags; developing people's awareness of reduction, classification, reuse and recycling of plastic waste.

b) Providing professional training courses on plastic waste communication for journalists and editors specialized in the natural resources and environment sector.

d) Granting environmental awards for models, solutions and initiatives related to reduction, classification, collection, recycling and disposal of plastic waste.

2.8. Educational institutions providing training programs for natural resources and environment officers

Providing training courses on building of capacity to perform the task of solid waste (including plastic waste) management for central or local-level civil servants and public employees in the natural resources and environment sector.

2.9. Hanoi University of Natural Resources and Environment, Ho Chi Minh City University of Natural Resources and Environment

a) Providing students with educational programs about harmful effects cause by using non-biodegradable disposable plastic products and plastic bags to the environment in order to change students' behavior towards plastic products and plastic waste;

3. Proposing, implementing and reviewing strategies, projects and a number of specific tasks

3.1. Vietnam Environment Administration

a) Developing and completing the Project on strengthening plastic waste management in Vietnam with a view to integrating existing projects, programs and actions on plastic waste to ensure consistency, synchronization, efficiency and resource concentration.

Completion year: 2020

b) Reviewing the implementation of the Prime Minister's Decision No. 582/QD-TTg dated April 11, 2013, approving the Project on strengthening of the control of environmental pollution caused by the use of non-biodegradable domestic plastic bags to be carried out by 2020, and proposing solutions for restriction and gradual non-use of non-biodegradable domestic plastic bags which are integrated into the Project on strengthened management of plastic waste in Vietnam.

Completion year: 2020

c) Organizing the effective implementation of the Prime Minister’s Decision No. 491/QD-TTg dated May 7, 2018, approving the adjustment of the National Strategy on integrated solid waste management by 2021 with vision to 2050, and concentration on implementing the goal of using 100% of environmentally friendly plastic bags at commercial centers and supermarkets for domestic purposes as replacement for non-biodegradable plastic bags; restricting and proceeding to end the importation, production and supply of non-biodegradable plastic bags for domestic use as from 2026 at commercial centers and supermarkets.

dd) Organizing investigation, statistics, classification and assessment of sources of plastic waste; building a database of plastic waste which is consistent and agrees with the national database of sources of waste; building a database of registration, declaration and management of the production and use of products generating plastic waste and plastic bags.

Implementation period: 2021-2025

3.2. General Department of Vietnam’s Sea and Islands

a) Building and operating the International Center for Ocean Plastic Waste; building an information system for control of plastic waste discharged from the mainland into the sea and from activities on sea and islands; building a database system for ocean plastic waste.

Completion year: 2025

b) Developing and implementing the project for strengthening of the capacity for surveying, monitoring and analyzing experiments for ocean plastic waste researches.

Implementation period: 2021-2025

c) Conducting surveys, observations and analysis experiments for research and monitoring of ocean plastic waste and control of marine environmental pollution. Organizing investigation, assessment, coordination and management of tasks of investigation and assessment of the current state of ocean plastic waste.

d) Researching and proposing the building of the network for monitoring and observation of plastic waste in 11 main river basins and 12 island districts to serve the annual and 5-year monitoring and evaluation of the current status of plastic waste.

Implementation period: 2022-2025

3.3. Department of Legal Affairs

Researching and proposing the project for setting up the recycling industrial park in accordance with the Government's Decree No. 82/2018/ND-CP dated May 22, 2018 on management of industrial parks and economic zones.

Implementation period: 2021-2023

4. Strengthening international cooperation, scientific research, application, development and transfer of technologies for plastic waste treatment

4.1. International Cooperation Department

a) Maintaining, establishing and developing cooperative relations with foreign countries and international organizations in the control and management of plastic waste: reviewing international cooperation frameworks on plastic waste management and proposing the plan to accede to international treaties on plastic waste management: organizing a mechanism for joint coordination with developed partners on projects and tasks related to prevention and reduction of plastic waste in stages and according to the domestic capacity and level.

4.2. Department of Science and Technology

Instructing relevant units to develop and organize the implementation of researches on the current situation and trends of plastic waste generation: the impacts of plastic waste (especially microplastics) on natural resources, the environment, ecosystems and human health; plastic waste management; inventing, applying and transferring advanced technologies in plastic waste treatment and recycling, developing alternative products and materials, and accelerating circular economy in Vietnam.

Implementation period: on a yearly basis

4.3. General Department of Vietnam’s Sea and Islands

a) Hosting international scientific seminars on ocean plastic waste.

Implementation period: on a yearly basis

b) Presiding over, and cooperating with relevant agencies in, sharing information and data on ocean plastic waste with ASEAN countries, East Asian countries and other worldwide countries.

III. IMPLEMENTATION CLAUSES

1. According to this Plan, the units directly controlled by the Ministry shall develop plans and organize the implementation thereof by 2025 and tailor them to specific years according to their functions and tasks and situations, ensuring practicality, feasibility and efficiency; periodically sending reports on implementation results (before December 15 every year) to the Vietnam Environment Administration for their preparation of the general report sent to the Minister for reporting to the Prime Minister.

2. The Department of Planning – Finance, the Department of Science and Technology shall report to the Minister to receive funds allocated from the state budget (environment, science and technology allocations) for implementation of this Plan.

3. In the course of implementation, if amendments or supplements to specific contents of the Plan are needed, units must promptly report to the Ministry (via Department of Legal Affairs) for its consideration of adjustments to contents of the Plan to ensure the Plan is adaptable to the practical condition./.
