QUY ĐỊNH TIÊU CHÍ XÁC ĐỊNH CƠ SỞ GÂY Ô NHIỄM MÔI TRƯỜNG, GÂY Ô NHIỄM MÔI TRƯỜNG NGHIÊM TRỌNG

Căn cứ Luật Bảo vệ môi trường ngày 29 tháng 11 năm 2005;

Căn cứ Nghị định số 117/2009/NĐ-CP ngày 31 tháng 12 năm 2009 của Chính phủ về xử lý vi phạm pháp luật trong lĩnh vực bảo vệ môi trường;

Căn cứ Nghị định số 25/2008/NĐ-CP ngày 04 tháng 3 năm 2008 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Tài nguyên và Môi trường, đã được sửa đổi, bổ sung tại Nghị định số 19/2010/NĐ-CP ngày 05 tháng 3 năm 2010 của Chính phủ và Nghị định số 89/2010/NĐ-CP ngày 16 tháng 8 năm 2010 của Chính phủ;

Xét đề nghị của Tổng Cục trưởng Tổng cục Môi trường và Vụ trưởng Vụ Pháp chế;

Bộ trưởng Bộ Tài nguyên và Môi trường ban hành Thông tư quy định tiêu chí xác định cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng.

Điều 1. Phạm vi điều chỉnh và đối tượng áp dụng

1. Thông tư này quy định tiêu chí xác định làm căn cứ phân loại cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng.

2. Thông tư này áp dụng đối với các cơ sở sản xuất, kinh doanh, dịch vụ có hoạt động phát sinh chất thải trên lãnh thổ nước Cộng hòa xã hội chủ nghĩa Việt Nam (sau đây gọi chung là cơ sở) và các cơ quan, tổ chức có liên quan đến các hoạt động xác định cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng.

Điều 2. Nguyên tắc và căn cứ xác định cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng

1. Việc xác định cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng phải được tiến hành khách quan, công bằng, đúng pháp luật và các quy định về tiêu chuẩn, quy chuẩn kỹ thuật về môi trường; mức độ vi phạm của các hành vi gây ô nhiễm môi trường, bao gồm:

a) Hành vi xả nước thải, khí thải, bụi vượt quy chuẩn kỹ thuật về môi trường;

b) Hành vi gây tiếng ồn, độ rung vượt quy chuẩn kỹ thuật về môi trường;

c) Hành vi chôn lấp, thải vào đất, môi trường nước các chất gây ô nhiễm ở thể rắn, bùn làm ô nhiễm môi trường đất, nước, không khí vượt quy chuẩn kỹ thuật về môi trường.

2. Xác định mức độ vi phạm của hành vi gây ô nhiễm môi trường

a) Đối với hành vi quy định tại điểm a khoản 1 Điều này, mức độ vi phạm được xác định trên cơ sở thải lượng nước thải, lưu lượng khí thải và số lần vượt quy chuẩn kỹ thuật về môi trường của các thông số môi trường đặc trưng có trong nước thải, khí thải, bụi của cơ sở;

b) Đối với hành vi quy định tại điểm b khoản 1 Điều này, mức độ vi phạm được xác định trên cơ sở số lần vượt quy chuẩn kỹ thuật về tiếng ồn, độ rung, đối tượng chịu tác động và thời điểm diễn ra hành vi;

c) Đối với hành vi quy định tại điểm c khoản 1 Điều này, mức độ vi phạm được xác định trên cơ sở số lần vượt quy chuẩn kỹ thuật về chất lượng nước mặt, nước ngầm, không khí xung quanh và môi trường đất của các thông số môi trường do các hành vi này gây ra.

3. Thông số môi trường vượt quy chuẩn kỹ thuật về môi trường được xác định trên cơ sở kết quả quan trắc, giám sát thông số môi trường đó đối chiếu với quy chuẩn kỹ thuật về môi trường tương ứng.

Điều 3. Thông số môi trường đặc trưng về nước thải, khí thải, bụi, tiếng ồn, độ rung

1. Thông số môi trường đặc trưng về nước thải, khí thải, bụi, tiếng ồn, độ rung của cơ sở được xác định như sau:

a) Các thông số môi trường về nước thải, khí thải, bụi, tiếng ồn, độ rung được quy định phải quan trắc, giám sát định kỳ trong báo cáo đánh giá tác động môi trường, bản đăng ký đạt tiêu chuẩn môi trường, bản cam kết bảo vệ môi trường, đề án bảo vệ môi trường, đề án bảo vệ môi trường chi tiết, đề án bảo vệ môi trường đơn giản của cơ sở đã được cơ quan nhà nước có thẩm quyền phê duyệt hoặc xác nhận;

b) Đối với các cơ sở không có các thông số môi trường quy định tại điểm a khoản này, cơ quan nhà nước có thẩm quyền căn cứ vào tính chất và loại hình hoạt động của cơ sở hoặc từng bộ phận của cơ sở, quyết định thông số môi trường đặc trưng về nước thải, khí thải của cơ sở theo quy định tại Phụ lục ban hành kèm theo Thông tư này.

2. Cơ quan nhà nước có thẩm quyền quy định tại điểm b khoản 1 Điều này và khoản 3 Điều 9 Thông tư này là cơ quan, tổ chức được giao nhiệm vụ xác định, phân loại cơ sở gây ô nhiễm môi trường, gây ô nhiễm môi trường nghiêm trọng.

Điều 4. Tiêu chí xác định cơ sở gây ô nhiễm môi trường

Cơ sở gây ô nhiễm môi trường là cơ sở có 01 (một) thông số môi trường trở lên về nước thải, khí thải, bụi, tiếng ồn, độ rung vượt quy chuẩn kỹ thuật về môi trường nhưng không thuộc đối tượng quy định tại Điều 5, 6, 7, 8 và Điều 9 Thông tư này.

Điều 5. Tiêu chí xác định cơ sở gây ô nhiễm môi trường nghiêm trọng về nước thải

Cơ sở gây ô nhiễm môi trường nghiêm trọng là cơ sở vi phạm một trong các tiêu chí sau:

1. Có hành vi xả nước thải vượt quy chuẩn kỹ thuật về môi trường từ 2 lần đến dưới 5 lần và thuộc một trong các trường hợp sau:

a) Có 2 hoặc 3 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 500 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất nguy hại hoặc thải lượng từ 1.000 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

b) Có 4 hoặc 5 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 200 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất nguy hại hoặc thải lượng từ 500 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

c) Có từ 6 thông số trở lên vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 100 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất nguy hại hoặc thải lượng từ 200 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại.

2. Có hành vi xả nước thải vượt quy chuẩn kỹ thuật về môi trường từ 5 lần đến dưới 10 lần và thuộc một trong các trường hợp sau:

a) Có 2 hoặc 3 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 200 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất thải nguy hại hoặc thải lượng từ 500 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

b) Có 4 hoặc 5 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 100 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất thải nguy hại hoặc thải lượng từ 200m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

c) Có từ 6 thông số trở lên vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 50m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất thải nguy hại hoặc thải lượng từ 100m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại.

3. Có hành vi xả nước thải vượt quy chuẩn kỹ thuật về môi trường từ 10 lần đến dưới 50 lần và thuộc một trong các trường hợp sau:

a) Có 2 hoặc 3 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 100m³/ngày (24 giờ) trong trường hợp có chứa chất thải nguy hại trở lên hoặc thải lượng từ 200 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

b) Có 4 hoặc 5 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 50 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất thải nguy hại hoặc thải lượng từ 100 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

c) Có từ 6 thông số trở lên vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 10 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất thải nguy hại hoặc thải lượng từ 50 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại.

4. Có hành vi xả nước thải vượt quy chuẩn kỹ thuật về môi trường từ 50 lần trở lên và thuộc một trong các trường hợp sau:

a) Có 1 đến 3 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 50 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất thải nguy hại hoặc thải lượng từ 100 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

b) Có 4 hoặc 5 thông số vượt quy chuẩn kỹ thuật về chất thải với thải lượng từ 10 m³/ngày (24 giờ) trở lên trong trường hợp có chứa chất thải nguy hại hoặc thải lượng từ 50 m³/ngày (24 giờ) trở lên trong trường hợp không chứa chất nguy hại;

c) Có từ 6 thông số trở lên vượt quy chuẩn kỹ thuật về chất thải.

5. Có hành vi xả nước thải có chứa chất phóng xạ gây nhiễm xạ môi trường vượt tiêu chuẩn, quy chuẩn kỹ thuật.

6. Có hành vi xả nước thải có pH bằng hoặc nhỏ hơn 2 (hai) hoặc lớn hơn 12,5 (mười hai phẩy năm).

Điều 6. Tiêu chí xác định cơ sở gây ô nhiễm môi trường nghiêm trọng về khí thải, bụi

Cơ sở gây ô nhiễm môi trường nghiêm trọng là cơ sở vi phạm một trong các tiêu chí sau:

1. Có hành vi thải khí, bụi vượt quy chuẩn kỹ thuật về môi trường từ 2 lần đến dưới 5 lần và thuộc một trong các trường hợp sau:

a) Có 1 hoặc 2 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 2.000 m³/giờ trở lên;

b) Có 3 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 1.000 m³/giờ trở lên;

c) Có từ 4 thông số trở lên vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 500 m³/giờ trở lên.

2. Có hành vi thải khí, bụi vượt quy chuẩn kỹ thuật về môi trường từ 5 lần đến dưới 10 lần và thuộc một trong các trường hợp sau:

a) Có 1 hoặc 2 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 1.000 m³/giờ trở lên;

b) Có 3 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 500 m³/giờ trở lên;

c) Có từ 4 thông số trở lên vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 100 m³/giờ trở lên.

3. Có hành vi thải khí, bụi vượt quy chuẩn kỹ thuật về môi trường từ 10 lần đến dưới 50 lần và thuộc một trong các trường hợp sau:

a) Có 1 hoặc 2 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 500 m³/giờ trở lên;

b) Có 3 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 100 m³/giờ trở lên;

c) Có từ 4 thông số trở lên vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 5 0m³/giờ trở lên.

4. Có hành vi thải khí, bụi vượt quy chuẩn kỹ thuật về môi trường từ 50 lần trở lên và thuộc một trong các trường hợp sau:

a) Có 1 hoặc 2 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 100 m³/giờ trở lên;

b) Có 3 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 50 m³/giờ trở lên;

c) Có từ 4 thông số vượt quy chuẩn kỹ thuật về chất thải trong trường hợp lưu lượng khí thải từ 10 m³/giờ trở lên.

5. Thải khí, bụi có chứa chất phóng xạ gây nhiễm xạ môi trường vượt tiêu chuẩn, quy chuẩn kỹ thuật.

Điều 7. Tiêu chí xác định cơ sở gây ô nhiễm môi trường nghiêm trọng về tiếng ồn

Cơ sở gây ô nhiễm môi trường nghiêm trọng là cơ sở có hành vi gây ô nhiễm tiếng ồn có tính chất thường xuyên, liên tục thuộc một trong các trường hợp sau đây:

1. Phát sinh tiếng ồn từ 65dBA trở lên tại khu vực cần đặc biệt yên tĩnh, bệnh viện, thư viện, nhà điều dưỡng hoặc từ 80dBA trở lên tại khu vực dân cư, khách sạn, nhà ở, cơ quan hành chính và thời điểm diễn ra hành vi trong khoảng thời gian từ 21 giờ ngày hôm trước đến 6 giờ sáng ngày hôm sau.

2. Phát sinh tiếng ồn từ 75dBA trở lên tại khu vực cần đặc biệt yên tĩnh, bệnh viện, thư viện, nhà điều dưỡng, nhà trẻ, trường học hoặc từ 90 dBA trở lên tại khu vực dân cư, khách sạn, nhà ở, cơ quan hành chính và thời điểm diễn ra hành vi trong khoảng thời gian từ 6 giờ đến 21 giờ.

Điều 8. Tiêu chí xác định cơ sở gây ô nhiễm môi trường nghiêm trọng về độ rung

Cơ sở gây ô nhiễm môi trường nghiêm trọng là cơ sở có hành vi gây ô nhiễm độ rung có tính chất thường xuyên, liên tục thuộc một trong các trường hợp sau đây:

1. Phát sinh độ rung vượt quy chuẩn kỹ thuật về độ rung từ 1,5 lần trở lên và thời điểm diễn ra hành vi trong thời gian từ 21 giờ ngày hôm trước đến 6 giờ sáng ngày hôm sau đối với các khu vực cần có môi trường đặc biệt yên tĩnh, khu dân cư, khách sạn, nhà nghỉ, khu dân cư xen kẽ trong khu thương mại, dịch vụ và sản xuất.

2. Phát sinh độ rung vượt quy chuẩn kỹ thuật về độ rung từ 2 lần trở lên và thời điểm diễn ra hành vi trong khoảng thời gian từ 6 giờ đến 21 giờ đối với khu vực cần có môi trường đặc biệt yên tĩnh, khu dân cư, khách sạn, nhà nghỉ, cơ quan hành chính xen kẽ trong khu thương mại, dịch vụ và sản xuất.

Điều 9. Tiêu chí xác định cơ sở gây ô nhiễm môi trường nghiêm trọng về chất thải rắn

1. Cơ sở gây ô nhiễm môi trường nghiêm trọng về chất thải rắn là cơ sở có hành vi chôn lấp, thải vào đất, môi trường nước các chất gây ô nhiễm ở thể rắn, bùn, làm ít nhất 01 (một) thông số môi trường của khu vực tiếp nhận chất thải rắn (môi trường đất, nước, không khí) về hóa chất, kim loại nặng vượt quy chuẩn kỹ thuật về môi trường từ 03 lần trở lên hoặc làm ít nhất 01 (một) thông số môi trường khác của khu vực tiếp nhận chất thải rắn vượt quy chuẩn kỹ thuật về môi trường từ 05 lần trở lên.

2. Quy chuẩn kỹ thuật về môi trường quy định tại khoản 1 Điều này thực hiện theo quy định tại điểm c khoản 2 Điều 2 Thông tư này.

3. Cơ quan nhà nước có thẩm quyền căn cứ vào tính chất, thành phần của chất gây ô nhiễm ở thể rắn, bùn để xác định thông số môi trường của khu vực tiếp nhận chất thải nhằm xác định, phân loại cơ sở gây ô nhiễm môi trường nghiêm trọng theo quy định tại khoản 1 Điều này.

Điều 10. Điều khoản thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 25 tháng 6 năm 2012. Các quy định tại Mục I, II Thông tư số 07/2007/TT-BTNMT ngày 03 tháng 7 năm 2007 của Bộ Tài nguyên và Môi trường hướng dẫn phân loại và quyết định danh mục cơ sở gây ô nhiễm môi trường cần phải xử lý hết hiệu lực thi hành kể từ ngày Thông tư này có hiệu lực thi hành.

2. Trong quá trình thực hiện nếu có vướng mắc, các Bộ, ngành, địa phương, tổ chức, cá nhân phản ánh về Bộ Tài nguyên và Môi trường để nghiên cứu, giải quyết./.

CIRCULAR

SPECIFYING CRITERIA TO DETERMINE THE FACILITY CAUSING ENVIRONMENTAL POLLUTION, SEVERE ENVIRONMENTAL POLLUTION

Pursuant to the Law on Environmental Protection dated November 29, 2005;

Pursuant to Decree No. 117/2009/ND-CP dated December 31, 2009 of the Government on handling the legal violations in the field of environmental protection;

Pursuant to Decree No. 25/2008/ND-CP dated March 04, 2008 of the Government stipulating the functions, duties, powers and organizational structure of the Ministry of Natural Resources and Environment, amended and supplemented in Decree No. 19/2010/ND-CP dated March 05, 2010 of the Government and Decree No. 89/2010/ND-CP dated August 16, 2010 of the Government;

At the proposal of the General Director of the General Department of Environment and Director of Department of Legal Affairs;

The Minister of Natural Resources and Environment promulgates the Circular specifies the criteria to determine the facility causing environmental pollution, severe environmental pollution.

2. This Circular is applicable to the facilities of production, trading and services with activities generating wastage in the territory of the Socialist Republic of Vietnam (hereinafter referred to as facility) and the agencies, organizations relating to the activities identifying facility causing environmental pollution and severe environmental pollution.

Article 2. Principles and basis for identifying the facility causing environmental pollution, and severe environmental pollution.

1. The determination of facility causing environmental pollution and serious environmental pollution must be conducted objectively, fairly and in accordance with law and regulations on standards, technical regulations on environment; the degree of the acts of violation causing environmental pollution including:

a) Act of discharging waste water, waste gas and dust beyond technical regulations on environment;

b) Act of causing noise or vibration in excess of technical regulations on environment;

c) Acts of burying and discharging in the soil and water environment the contaminants in solid and sludge modeling contaminating soil, water and air beyond technical regulations on the environment.

2. Determining the degree of the act of violation which causes environmental pollution

a) For acts specified at Point a, Clause 1 of this Article, the degree of violation is determined on the basis of the discharged water volume, flow of waste gas and frequency of excess of technical regulations on the environment of the specific environmental parameters in waste water, waste gas, dust of the facility;

b) For acts specified at Point b, Clause 1 of this Article, the degree of violation is determined on the basis of the frequency of excess of technical regulations on noise, vibration, affected subjects and time the act takes place;

3. Environmental parameters exceeding the technical regulations on the environment are determined on the basis of the result of monitoring and supervising the environmental parameters and comparing them with the corresponding technical regulations of the environment.

Article 3. Specific environmental parameters on waste water, waste gas, dust, noise and vibration;

1. The specific environmental parameters of waste water, waste gas, dust, noise and vibration are determined as follows:

a) The environmental parameters of waste water, waste gas, dust, noise and vibration are specified to be monitored and supervised periodically in the report on environmental impact assessment, the written registration of environmental standards meeting, the written commitment of environmental protection, environmental protection project, detailed environmental protection project, simple environmental protection project of the facility approved or certified by the competent State agency;

b) For facilities having no environmental parameters specified at Point a of this clause, the competent State agency will base on the nature and operation type of facility or each part of the facility to decide the specific environmental parameters of waste water and waste gas of the establishment as prescribed in the Annex attached to this Circular.

2. The competent State agency as prescribed at Point b, Clause 1 of this Clause 3 of Article 9 of this Circular is an agency or organization assigned the task of identifying and classifying the facilities causing environmental pollution and severe environmental pollution.

Article 4. Criteria for identifying the facility causing environmental pollution

The facility causing environmental pollution is the one having 01 (one) environmental parameter or more on waste water, waste gas, dust, noise or vibration in excess of the technical regulations on the environment but not subject to regulations in Article 5, 6, 7, 8 and 9 of this Circular.

Article 5. Criteria for identifying the facility causing severe environmental pollution on waste water.

1. Having acts of discharging waste water exceeding technical regulations on the environment from 2 times to 5 times and under one of the following cases:

a) Having 2 or 3 parameters exceeding the technical regulations on waste with the amount of waste from 500 m³/day (24 hours) or more in case of containing hazardous substances or the amount of waste from 1,000 m³/day (24 hours) or more in case of absence of hazardous substances containing;

b) Having 4 or 5 parameters exceeding the technical regulations on waste with the amount of waste from 200 m³/day (24 hours) or more in case of hazardous substances containing or the amount of waste from 500 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

c) Having 6 or more parameters exceeding the technical regulations on waste with the amount of waste from 100 m³/ day (24 hours) or more in case of hazardous substances containing or the amount of waste from 200 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

2. Having acts of discharging waste water exceeding the technical regulations on the environment from 5 times to less than 10 times and under one of the following cases:

a) Having 2 or 3 parameters exceeding the technical regulations on waste with the amount of waste from 200 m³/ day (24 hours) or more in case of hazardous substances containing or the amount of waste from 500 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

b) Having 4 or 5 parameters exceeding the technical regulations on waste with the amount of waste from 100 m³/ day (24 hours) or more in case of hazardous substances containing or the amount of waste from 200 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

c) Having 6 or more parameters exceeding the technical regulations on waste with the amount of waste from 500 m³ / day (24 hours) or more in case of hazardous substances containing or the amount of waste from 100 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

3. Having acts of discharging waste water exceeding the technical regulations on the environment from 10 times to less than 50 times and under one of the following cases:

b) Having 4 or 5 parameters exceeding the technical regulations on waste with the amount of waste from 50 m³ / day (24 hours) or more in case of hazardous substances containing or the amount of waste from 100 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

c) Having 6 or more parameters exceeding the technical regulations on waste with the amount of waste from 10 m³/ day (24 hours) or more in case of hazardous substances containing or the amount of waste from 50 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

4. Having acts of discharging waste water exceeding the technical regulations on the environment from 50 times or more and under one of the following cases:

a) Having 1 to 3 parameters exceeding the technical regulations on waste with the amount of waste from 50 m³ / day (24 hours) or more in case of hazardous substances containing or the amount of waste from 100 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

b) Having 4 or 5 parameters exceeding the technical regulations on waste with the amount of waste from 10 m³ / day (24 hours) or more in case of hazardous substances containing or the amount of waste from 50 m³/ day (24 hours) or more in case of absence of hazardous substances containing;

c) Having from 6 parameters or more exceeding the technical regulations on waste.

5. Having acts of discharging waste water containing radioactive substances causing radioactive contamination exceeding the standards, technical regulations

6. Having acts of discharging waste water with pH equal to or less than 2 (two) or greater than 12.5 (twelve point five).

Article 6. Criteria for identifying the facility causing severe environmental pollution on waste gas and dust.

1. Having acts of discharging waste gas and dust exceeding the technical regulations on the environment from 2 times to less than 5 times and under one of the following cases:

a) Having 1 or 2 parameters exceeding the technical regulations on waste in case the waste gas flow is from 2,000 m³/hour or more;

b) Having 3 parameters exceeding the technical regulations on waste in case the waste gas flow is from 1,000 m³/hour or more;

c) Having 4 parameters or more exceeding the technical regulations on waste in case the waste gas flow is from 500 m³/hour or more;

2. Having acts of discharging waste gas and dust exceeding the technical regulations on the environment from 5 times to less than 10 times and under one of the following cases:

a) Having 1 or 2 parameters exceeding the technical regulations on waste in case the waste gas flow is from 1,000 m³/hour or more;

b) Having 3 parameters exceeding the technical regulations on waste in case the waste gas flow is from 500 m³/hour or more;

c) Having 4 parameters or more exceeding the technical regulations on waste in case the waste gas flow is from 100 m³/hour or more;

3. Having acts of discharging waste gas and dust exceeding the technical regulations on the environment from 10 times to less than 50 times and under one of the following cases:

b) Having 3 parameters exceeding the technical regulations on waste in case the waste gas flow is from 100 m³/hour or more;

c) Having 4 parameters exceeding the technical regulations on waste in case the waste gas flow is from 50 m³/hour or more;

4. Having acts of discharging waste gas and dust exceeding the technical regulations on the environment from 50 times or more and under one of the following cases:

a) Having 1 or 2 parameters exceeding the technical regulations on waste in case the waste gas flow is from 100 m³/hour or more;

b) Having 3 parameters exceeding the technical regulations on waste in case the waste gas flow is from 50 m³/hour or more;

c) Having 4 parameters exceeding the technical regulations on waste in case the waste gas flow is from 10 m³/hour or more;

5. Discharging waste gas and dust containing radioactive substances causing environmental radioactive contamination exceeding technical regulations and standards.

Article 7. Criteria for identifying the facility causing severe environmental pollution on noise

The facility that causes severe environmental pollution is the one having acts of causing noise pollution frequently and continuously under one of the following cases:

2. Generating noise from 75dBA or more in areas required special quietness, hospitals, libraries, nursing homes, kindergartens, schools or from 90dBA or more in residential areas, hotels, houses, administrative agencies and the time the acts take place is during the period from 6 o’clock AM to 21 o’clock PM.

Article 8. Criteria for identifying the facility causing severe environmental pollution on vibration.

The facility that causes severe environmental pollution is the one having acts of causing vibration pollution frequently and continuously under one of the following cases:

1. Generating vibration in excess of technical regulations on vibration from 1.5 times or more and the time the acts take place is from 21 o’clock PM of the previous day to 6 o’clock AM of the following day for areas required special quietness, residential areas, hotels, motels, residential areas intermingled with commercial areas, areas of services and production.

2. Generating vibration in excess of technical regulations on vibration from 2 times or more and the time the acts take place is from 6 o’clock AM to 21 o’clock AM for areas required special quietness, residential areas, hotels, motels, administractive agencies intermingled with commercial areas, areas of services and production.

Article 9. Criteria for identifying the facility causing severe environmental pollution on solid waste.

1. Facility causing serious environmental pollution on solid waste is the one having acts of burying and discharging in the soil and water environment the contaminants in solid and sludge modeling that make at least 01 (one) environmental parameter of the area receiving solid waste (soil, water and air environment) on chemicals, heavy metals exceeding the technical regulations on the environment from 03 times or more or make at least 01 (one) other environmental parameter of the area receiving the solid waste exceeding the technical regulations on the environment from 05 times or more.

2. The technical regulations on the environment as prescribed in clause 1 of this Article will comply with regulations at Point c, clause 2 of this Circular.

3. The competent State agencies will base on the nature and composition of the pollutants in solid and sludge modeling to determine environmental parameters of the area that receives the solid waste in order to identify and classify the facility causing severe environmental pollution as specified in Clause 1 of this Article.

1. This Circular will take effect on June 25, 2012. Other provisions in Section I, II of Circular No. 07/2007/TT-BTNMT dated July 03, 2007 of the Ministry of Natural Resources and Environment guiding the classification and deciding on the list of facilities causing environmental pollution required to be handled will be invalid from the date this Circular takes effect.

2. Any problem arising in the course of implementation should be promptly reported to the Ministry of Natural Resources and Environment for consideration and settlement.
