NGHỊ ĐỊNH

CỦA CHÍNH PHỦ SỐ 120/2003/NĐ-CP NGÀY 20 THÁNG 10 NĂM 2003 VỀ VIỆC SỬA ĐỔI ĐIỀU 9 CỦA NGHỊ ĐỊNH SỐ 30/2002/NĐ-CP NGÀY 26 THÁNG 3 NĂM 2002 CỦA CHÍNH PHỦ QUY ĐỊNH VÀ HƯỚNG DẪN THI HÀNH MỘT SỐ ĐIỀU CỦA PHÁP LỆNH NGƯỜI CAO TUỔI

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Căn cứ Pháp lệnh Người cao tuổi ngày 28 tháng 4 năm 2000;
Theo đề nghị của Bộ trưởng Bộ Lao động - Thương binh và Xã hội,

NGHỊ ĐỊNH:

Điều 1. Sửa đổi Điều 9 của Nghị định số 30/2002/NĐ-CP ngày 26 tháng 3 năm 2002 quy định và hướng dẫn thi hành một số điều của Pháp lệnh Người cao tuổi như sau:

"Điều 9. Người cao tuổi được chăm sóc sức khoẻ theo quy định của Luật Bảo vệ sức khoẻ nhân dân ngày 11 tháng 8 năm 1989.

Người cao tuổi được hưởng dịch vụ ưu tiên khi khám, chữa bệnh tại các cơ sở y tế theo Nghị định số 23/HĐBT ngày 24 tháng 01 năm 1991 của Hội đồng Bộ trưởng (nay là Chính phủ) về Điều lệ khám, chữa bệnh và phục hồi chức năng.

Người cao tuổi từ 90 tuổi trở lên được cấp miễn phí thẻ bảo hiểm y tế".

Điều 2. Nghị định này có hiệu lực sau 15 ngày, kể từ ngày đăng Công báo. Các quy định của Nghị định này thay thế quy định tại Điều 9 Nghị định số 30/2002/NĐ-CP ngày 26 tháng 3 năm 2002.

Điều 3. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Uỷ ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

AMENDING ARTICLE 9 OF THE GOVERNMENT'S DECREE No. 30/2002/ND-CP OF MARCH 26, 2002 PRESCRIBING AND GUIDING THE IMPLEMENTATION OF SOME ARTICLES OF THE ORDINANCE ON ELDERLY PEOPLE

THE GOVERNMENT

Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to April 28, 2000 Ordinance on Elderly People;
At the proposal of the Minister of Labor, War Invalids and Social Affairs,

DECREES:

Article 1.- To amend Article 9 of Decree No. 30/2002/ND-CP of March 26, 2002 prescribing and guiding the implementation of a number of articles of the Ordinance on Elderly People as follows:

"Article 9.- Elderly people shall be given healthcare as prescribed in the Law on Protection of People's Health of July 11, 1989.

Elderly people shall enjoy priority services when taking medical examination and treatment at medical establishments according to Decree No. 23/HDBT of the Council of Ministers (now the Government) of January 24, 1991 on the Regulation on medical examination and treatment as well as functional rehabilitation.

Article 2.- This Decree takes effect 15 days after its publication in the Official Gazette. The provisions in this Decree shall replace the provisions in Article 9 of Decree No. 30/2002/ND-CP of March 26, 2002.

Article 3.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the provincial/municipal People's Committees shall have to implement this Decree.
