NGHỊ ĐỊNH

CỦA CHÍNH PHỦ SỐ 09-CP NGÀY 30 THÁNG 01 NĂM 1997 VỀ VIỆC SỬA ĐỔI ĐIỀU 7 QUY CHẾ CHO NGƯỜI NƯỚC NGOÀI, NGƯỜI VIỆT NAM ĐỊNH CƯ Ở NƯỚC NGOÀI THUÊ NHÀ TẠI VIỆT NAM

Căn cứ Luật Tổ chức Chính phủ ngày 30 tháng 9 năm 1992;
Theo đề nghị của Bộ trưởng Bộ Tài chính và Bộ trưởng Bộ Xây dựng,

NGHỊ ĐỊNH:

Điều 1.- Sửa đổi Điều 7 của Quy chế cho người nước ngoài, người Việt Nam định cư ở nước ngoài thuê nhà tại Việt Nam ban hành kèm theo Nghị định số 56/CP ngày 18 tháng 9 năm 1995 như sau:

Giá thuê nhà do hai bên thoả thuận. Các khoản trích nộp vào ngân sách Nhà nước của bên cho thuê nhà phải căn cứ vào giá ghi trong hợp đồng thuê nhà nhưng không được thấp hơn mức giá tính thuế áp dụng tại địa phương do Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương quy định. Trong trường hợp giá nhà cho thuê tại địa phương có biến động (±10%) thì Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương điều chỉnh lại giá tính thuế cho phù hợp với giá thực tế.

Điều 2.- Nghị định này có hiệu lực từ ngày 01 tháng 2 năm 1997. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ và Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này.

DECREE

AMENDING ARTICLE 7 OF THE REGULATION ON HOUSE RENTING IN VIETNAM BY FOREIGN NATIONALS AND OVERSEAS VIETNAMESE

THE GOVERNMENT

Pursuant to the Law on Organization of the Government of September 30, 1992;
At the proposals of the Minister of Finance and the Minister of Construction,

DECREES:

Article 1.- To amend Article 7 of the Regulation on House Renting in Vietnam by Foreign Nationals and Overseas Vietnamese which was issued together with Decree No.56-CP of September 18, 1995, as follows:

The renting price shall be agreed upon by the two parties. The remittance to the State Budget by the renting party shall be based on the price written in the renting contract which shall not be lower than the taxable price applied in the locality by decision of the President of the People’s Committee of the province or city directly under the Central Government. In case the house-renting price in the locality is fluctuating at around 10%, the President of the People’s Committee of the province or city directly under the Central Government shall make adjustment to the taxable price in accordance with the actual price.

Article 2.- This Decree takes effect on February 1, 1997. The Ministers, the Heads of the ministerial-level agencies and agencies attached to the Government, and the Presidents of the People’s Committees of the provinces and cities directly under the Central Government, are responsible for the implementation of this Decree.
