NGHỊ ĐỊNH

QUY ĐỊNH VỀ ỨNG DỤNG KHOA HỌC, CÔNG NGHỆ VÀ PHÁT TRIỂN CÔNG NGHIỆP CHẾ TẠO TRONG LĨNH VỰC ĐIỆN LỰC

Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;

Căn cứ Luật Điện lực số 61/2024/QH15;

Căn cứ Luật Khoa học, công nghệ và đổi mới sáng tạo số 93/2025/QH15;

Căn cứ Luật Thuế Thu nhập doanh nghiệp số 69/2025/QH15;

Căn cứ Nghị quyết số 198/2025/QH15 của Quốc hội về một số cơ chế, chính sách đặc biệt phát triển kinh tế tư nhân;

Căn cứ Nghị quyết số 253/2025/QH15 của Quốc hội về các cơ chế, chính sách phát triển năng lượng quốc gia giai đoạn 2026-2030;

Theo đề nghị của Bộ trưởng Bộ Công Thương;

Chính phủ ban hành Nghị định quy định về ứng dụng khoa học, công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực.

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Nghị định này quy định chi tiết và các biện pháp để tổ chức hướng dẫn thi hành Điều 8 Luật Điện lực về ứng dụng khoa học, công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực, gồm:

1. Danh mục các hạng mục, thiết bị và dịch vụ tư vấn quan trọng nhằm duy trì cung cấp điện liên tục, bảo đảm an ninh năng lượng quốc gia được ưu tiên sản xuất, cung cấp trong nước.

2. Hoạt động nghiên cứu, ứng dụng và phát triển khoa học, công nghệ; công nghiệp chế tạo thiết bị điện và dịch vụ năng lượng trong lĩnh vực điện lực.

3. Cơ chế khuyến khích và hỗ trợ phát triển nghiên cứu khoa học, công nghệ; công nghiệp thiết kế, chế tạo, lắp đặt thiết bị điện và cung ứng dịch vụ trong lĩnh vực điện lực.

4. Ưu tiên phát triển các ngành công nghiệp chế tạo thiết bị điện và dịch vụ điện; thực hiện các yêu cầu, chỉ tiêu về tỷ lệ nội địa hóa trong công nghiệp điện; khuyến khích phát triển doanh nghiệp trong nước có quy mô lớn, trình độ công nghệ tiên tiến, có khả năng thực hiện các dự án phức tạp, yêu cầu kỹ thuật cao trong lĩnh vực điện lực, đáp ứng các tiêu chuẩn chất lượng quốc tế.

5. Tổ hợp công nghiệp, dịch vụ năng lượng.

Điều 2. Đối tượng áp dụng

Nghị định này áp dụng với các cơ quan, tổ chức, cá nhân có liên quan đến hoạt động ứng dụng khoa học, công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực.

Điều 3. Giải thích từ ngữ

Trong Nghị định này, các từ ngữ dưới đây được hiểu như sau:

1. Sản xuất thiết bị điện là việc sản xuất, chế tạo sản phẩm, phương tiện, máy móc, thiết bị, cơ khí điện cung ứng cho các công trình điện lực.

2. Tổ hợp công nghiệp, dịch vụ năng lượng là khu chức năng tích hợp các hoạt động nghiên cứu, chế tạo thử nghiệm, sản xuất thiết bị điện; cung cấp các dịch vụ xây dựng, lắp đặt, vận hành, bảo trì các dự án điện và dịch vụ liên quan khác phục vụ trong lĩnh vực điện lực.

3. Chương trình phát triển công nghệ, công nghiệp chế tạo thiết bị điện và dịch vụ năng lượng là tập hợp các nhiệm vụ có mục tiêu chung để giải quyết các vấn đề trong hoạt động điện lực, duy trì cung cấp điện liên tục, bảo đảm an ninh năng lượng quốc gia, thực hiện các yêu cầu chỉ tiêu về tỷ lệ nội địa hóa trong công nghiệp điện, sử dụng điện nhằm tiết kiệm, nâng cao hiệu quả sử dụng các nguồn năng lượng, bảo vệ môi trường, bảo vệ hành lang bảo vệ công trình điện lực, an toàn điện và an toàn đập, hồ chứa thủy điện.

Chương II

HẠNG MỤC, THIẾT BỊ, DỊCH VỤ VÀ CHƯƠNG TRÌNH ỨNG DỤNG, NGHIÊN CỨU CHẾ TẠO SẢN XUẤT THIẾT BỊ ĐIỆN VÀ DỊCH VỤ ĐIỆN TRONG NƯỚC

Điều 4. Xác định các hạng mục, thiết bị và dịch vụ quan trọng để duy trì cung cấp điện liên tục, bảo đảm an ninh năng lượng quốc gia

1. Hạng mục, thiết bị và dịch vụ tư vấn quan trọng trong lĩnh vực điện lực phải được phát triển, sản xuất, cung cấp trong nước ở một số công đoạn, đáp ứng một trong các tiêu chí sau:

a) Ảnh hưởng trực tiếp và mang tính quyết định đến việc bảo đảm an ninh năng lượng quốc gia, bao gồm: duy trì ổn định cung cấp điện, nâng cao độ tin cậy hệ thống truyền tải, vận hành ổn định và an toàn cho hệ thống điện; bảo mật dữ liệu; tránh phụ thuộc sản phẩm công nghệ có nguy cơ gây mất kiểm soát hệ thống;

b) Tư vấn đầu tư dự án nguồn điện mới, phức tạp, đòi hỏi kỹ thuật cao trong lĩnh vực điện lực, đáp ứng các tiêu chuẩn chất lượng quốc tế;

c) Dịch vụ vận hành, bảo trì nhà máy điện, lưới điện và các công trình điện lực quan trọng nhằm bảo đảm vận hành hệ thống điện an toàn, ổn định, liên tục và bảo đảm an ninh năng lượng quốc gia;

d) Dịch vụ công nghệ, giải pháp bảo mật và an ninh cho hệ thống điều khiển và vận hành lưới điện, bảo đảm an toàn vận hành lưới điện, bảo đảm cung cấp điện ổn định.

2. Theo từng thời kỳ phù hợp với khả năng làm chủ công nghệ, sản xuất trong nước và tình hình phát triển kinh tế - xã hội, Bộ Công Thương trình Thủ tướng Chính phủ ban hành:

a) Danh mục hạng mục, thiết bị và dịch vụ tư vấn quan trọng để duy trì cung cấp điện liên tục, bảo đảm an ninh năng lượng quốc gia phải được sản xuất và cung cấp trong nước ở một số công đoạn;

b) Danh mục hạng mục, thiết bị và dịch vụ tư vấn trong lĩnh vực điện lực khuyến khích sản xuất và cung ứng trong nước.

Điều 5. Chương trình ứng dụng, phát triển công nghệ, công nghiệp chế tạo thiết bị điện và dịch vụ năng lượng

1. Nguyên tắc xây dựng chương trình ứng dụng, phát triển công nghệ, công nghiệp chế tạo thiết bị điện và dịch vụ năng lượng

a) Phù hợp với đường lối, chủ trương của Đảng, chính sách, pháp luật của Nhà nước; gắn với chiến lược phát triển kinh tế - xã hội, chiến lược phát triển ngành điện lực;

b) Có tính thực tiễn, bảo đảm kết quả nghiên cứu, ứng dụng chế tạo sản xuất thiết bị điện vào thực tế, mang lại hiệu quả kinh tế và kỹ thuật; áp dụng tiến bộ khoa học và công nghệ trong hoạt động điện lực, sử dụng điện nhằm tiết kiệm, nâng cao hiệu quả sử dụng các nguồn năng lượng, bảo vệ môi trường, bảo vệ hành lang bảo vệ công trình điện lực, an toàn điện và an toàn đập, hồ chứa thủy điện;

c) Nâng cao tỷ lệ giá trị thiết bị chế tạo do các doanh nghiệp cơ khí trong nước thực hiện trong các dự án điện lực;

d) Việc ứng dụng, nghiên cứu và làm chủ các công nghệ để sản xuất các thiết bị điện quan trọng, đặc biệt là những công nghệ đảm bảo an ninh năng lượng quốc gia, năng lượng tái tạo, năng lượng mới, lưới điện thông minh;

đ) Các lĩnh vực có lợi thế cạnh tranh, hoặc những thiết bị điện có nhu cầu lớn trong nước như thiết bị truyền tải, phân phối điện và công nghệ năng lượng tái tạo;

e) Chương trình tập trung vào công nghệ cao, công nghệ chiến lược, công nghệ mới, công nghệ phục vụ dự án quan trọng quốc gia, dự án trọng điểm, công nghệ phục vụ quốc phòng, an ninh có tiềm năng tạo đột phá về năng suất, chất lượng, đổi mới mô hình tăng trưởng, năng lực cạnh tranh quốc gia và chủ động tham gia chuỗi giá trị toàn cầu;

g) Khuyến khích sự tham gia chủ động của doanh nghiệp, tổ chức khoa học và công nghệ, viện, trường; thúc đẩy hình thành và phát triển hệ sinh thái đổi mới sáng tạo quốc gia, khu vực, ngành và địa phương; tăng cường khả năng thương mại hóa kết quả;

h) Hỗ trợ phát triển công nghiệp chế tạo và dịch vụ phục vụ ngành năng lượng theo hướng tăng cường nội lực, hướng đến xuất khẩu; ưu tiên phát triển các ngành chế tạo máy, thiết bị điện;

i) Đáp ứng một hoặc một số tiêu chí được quy định tại Điều 25 Nghị định số 267/2025/NĐ-CP ngày 14 tháng 10 năm 2025 của Chính phủ quy định chi tiết và hướng dẫn một số điều của Luật Khoa học, Công nghệ và Đổi mới sáng tạo về chương trình, nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo và một số quy định về thúc đẩy hoạt động nghiên cứu khoa học, phát triển công nghệ và đổi mới sáng tạo.

2. Nội dung chủ yếu chương trình ứng dụng, phát triển công nghệ, công nghiệp chế tạo thiết bị điện và dịch vụ năng lượng, bao gồm:

a) Tên, mục tiêu, nội dung chương trình;

b) Nội dung, yêu cầu đối với sản phẩm, các chỉ tiêu đánh giá;

c) Cơ quan chủ trì quản lý chương trình;

d) Thời gian thực hiện chương trình;

đ) Dự kiến tổng kinh phí thực hiện, cơ cấu nguồn vốn (ngân sách nhà nước, vốn đối ứng, xã hội hóa);

e) Đề xuất cơ chế quản lý, cơ chế tài chính đặc thù của chương trình;

g) Hợp tác quốc tế (nếu có);

h) Dự kiến kết quả, hiệu quả và tác động của chương trình.

3. Bộ Công Thương có trách nhiệm xây dựng chương trình ứng dụng, phát triển công nghệ, công nghiệp chế tạo thiết bị điện và dịch vụ năng lượng cho từng giai đoạn, bảo đảm sự phối hợp hiệu quả giữa ngành, lĩnh vực và địa phương trình Thủ tướng Chính phủ phê duyệt.

Chương III

CHÍNH SÁCH ƯU ĐÃI, HỖ TRỢ CHO CÔNG NGHIỆP CHẾ TẠO PHỤC VỤ NGÀNH ĐIỆN LỰC

Điều 6. Ưu đãi chung cho các doanh nghiệp sản xuất thiết bị điện trong lĩnh vực điện lực

1. Doanh nghiệp sản xuất thiết bị điện thuộc Danh mục tại khoản 2 Điều 4 Nghị định này được hưởng các ưu đãi của ngành nghề sản xuất sản phẩm cơ khí trọng điểm theo quy định của pháp luật về đầu tư, thuế, đất đai, chế độ kế toán và pháp luật có liên quan khác.

2. Doanh nghiệp khi thực hiện Dự án đầu tư sản xuất thiết bị điện thuộc Danh mục tại khoản 2 Điều 4 Nghị định này có quy mô vốn đầu tư, tiến độ giải ngân theo quy định của Chính phủ, đáp ứng các tiêu chí về công nghệ cao, chuyển giao công nghệ; doanh nghiệp Việt Nam tham gia chuỗi giá trị sản xuất trong nước theo quy định của Thủ tướng Chính phủ được hưởng các hình thức ưu đãi và hỗ trợ đầu tư đặc biệt theo quy định tại pháp luật đầu tư và quy định khác của pháp luật có liên quan.

3. Doanh nghiệp sản xuất sản phẩm, thiết bị điện và linh kiện, phụ tùng, vật liệu phục vụ sản xuất thiết bị điện trong Danh mục tại khoản 2 Điều 4 Nghị định này thuộc diện khuyến khích, hỗ trợ phát triển được hưởng các ưu đãi, hỗ trợ:

a) Đối với sản phẩm, thiết bị điện thuộc danh mục sản phẩm cơ khí trọng điểm được hưởng các ưu đãi, hỗ trợ theo quy định của pháp luật về phát triển sản phẩm cơ khí trọng điểm;

b) Đối với linh kiện, phụ tùng và vật liệu phục vụ sản xuất thiết bị điện thuộc danh mục sản phẩm công nghiệp hỗ trợ ưu tiên phát triển, được hưởng các ưu đãi, hỗ trợ theo quy định của pháp luật về phát triển công nghiệp hỗ trợ;

c) Đối với sản phẩm, thiết bị điện thuộc Danh mục công nghệ chiến lược và sản phẩm công nghệ chiến lược do Thủ tướng Chính phủ ban hành được hưởng các ưu đãi, hỗ trợ theo quy định của pháp luật về công nghệ cao.

Điều 7. Cơ chế sử dụng hạng mục, thiết bị và dịch vụ tư vấn quan trọng trong lĩnh vực điện lực

1. Các hạng mục, thiết bị và dịch vụ tư vấn thuộc Danh mục quy định tại điểm a khoản 2 Điều 4 của Nghị định này được đặt hàng theo quy định của pháp luật về đấu thầu đối với trường hợp lần đầu được sản xuất, cung cấp trong nước.

2. Tổ chức, doanh nghiệp, cá nhân có hạng mục, thiết bị và dịch vụ thuộc Danh mục quy định tại điểm a khoản 2 Điều 4 Nghị định này có trách nhiệm thông tin, chào hàng để phục vụ việc đặt hàng, cung ứng, sử dụng trong nước.

Điều 8. Cơ chế đặt hàng và ưu đãi đối với sản phẩm thiết bị điện

1. Xem xét giao thực hiện theo cơ chế đặt hàng cho tổ chức, doanh nghiệp, cá nhân có hạng mục, sản phẩm thiết bị và dịch vụ thuộc trường hợp quy định tại khoản 1 Điều 7 Nghị định này khi đáp ứng một trong các tiêu chí sau:

a) Sản xuất, chế tạo trong nước được đánh giá, thử nghiệm, kiểm định đạt tiêu chuẩn, quy chuẩn kỹ thuật, an toàn, bảo vệ môi trường theo quy định;

b) Hình thành từ kết quả nghiên cứu, phát triển công nghệ hoặc đổi mới sáng tạo đáp ứng các điều kiện về tiêu chuẩn, quy chuẩn kỹ thuật, an toàn, bảo vệ môi trường và các điều kiện khác theo quy định của pháp luật có liên quan.

2. Giá và khối lượng đặt hàng được xác định trên cơ sở chi phí sản xuất, cung ứng hợp lý, hợp lệ, cộng với một khoản lợi nhuận hợp lý theo quy định của pháp luật về giá. Nhà cung cấp có trách nhiệm hạch toán, theo dõi riêng các chi phí này và thực hiện kiểm toán độc lập đối với giá đặt hàng theo quy định.

3. Nhà cung cấp nhận đặt hàng được hưởng các cơ chế sau đây:

a) Được ưu đãi về giá (không quá 10% so với giá thành sản phẩm nhập khẩu tương tự) khi tính giá đặt hàng đối với sản phẩm nhận đặt hàng;

b) Được miễn các yêu cầu, điều kiện về kinh nghiệm khi tham gia đặt hàng;

c) Được loại trừ trách nhiệm hành chính, miễn trách nhiệm dân sự, loại trừ trách nhiệm hình sự nếu đã tuân thủ đầy đủ quy trình, quy định về nghiên cứu khoa học, công nghệ, về đặt hàng và không có mục đích vụ lợi, không có hành vi gian lận hay cố ý vi phạm pháp luật trong trường hợp gây thiệt hại cho Nhà nước.

Điều 9. Cung ứng hạng mục, thiết bị và dịch vụ được sản xuất trong nước

1. Các hạng mục, thiết bị và dịch vụ tư vấn thuộc danh mục tại điểm a khoản 2 Điều 4 Nghị định này đã được sản xuất, chế tạo trong nước, đáp ứng tiêu chuẩn kỹ thuật, an toàn, chất lượng theo quy định của pháp luật phải được cung ứng, sử dụng trong công trình điện lực.

2. Nhà thầu cung cấp sản phẩm, thiết bị điện quy định tại khoản 1 Điều này:

a) Được hưởng các cơ chế hỗ trợ và ưu đãi phù hợp theo quy định pháp luật;

b) Được tiếp cận các chương trình hỗ trợ đổi mới công nghệ, cải tiến công nghệ, kỹ thuật và mở rộng quy mô sản xuất từ Quỹ phát triển khoa học và công nghệ quốc gia, Quỹ đổi mới công nghệ quốc gia, Quỹ phát triển khoa học và công nghệ và đổi mới sáng tạo của bộ, cơ quan ngang bộ, cơ quan khác ở trung ương, Ủy ban nhân dân cấp tỉnh.

3. Sản phẩm thiết bị điện sử dụng công nghệ đảm bảo an ninh năng lượng quốc gia được đặt hàng, hưởng các cơ chế hỗ trợ và ưu đãi quy định của pháp luật liên quan và quy định tại Điều 8 Nghị định này.

Điều 10. Hỗ trợ thử nghiệm, đánh giá và chứng nhận sản phẩm

Tổ chức, doanh nghiệp nghiên cứu công nghệ, phát triển các hạng mục, thiết bị, dịch vụ tư vấn quan trọng quy định tại điểm a khoản 2 Điều 4 Nghị định này được hỗ trợ 50% kinh phí sử dụng phòng thí nghiệm, phòng thử nghiệm, phòng hỗ trợ thiết kế và thiết bị nghiên cứu dùng chung, trung tâm thử nghiệm, đo lường, kiểm định, giám định của Nhà nước để phát triển sản phẩm.

Điều 11. Hỗ trợ nghiên cứu, ứng dụng khoa học, công nghệ và chuyển đổi số trong lĩnh vực điện lực

1. Tổ chức, doanh nghiệp tiến hành các hoạt động ứng dụng khoa học, công nghệ trong công nghiệp chế tạo phục vụ ngành điện lực được hưởng các hỗ trợ theo quy định của pháp luật về khoa học, công nghệ và đổi mới sáng tạo, pháp luật về chuyển đổi số.

2. Nhà nước hỗ trợ thành lập các Tổ hợp công nghiệp, dịch vụ năng lượng để hình thành hệ sinh thái nghiên cứu và phát triển, ứng dụng khoa học, công nghệ, thương mại hóa các sản phẩm công nghiệp chế tạo và cung ứng các dịch vụ phụ trợ cho ngành điện lực.

Điều 12. Hỗ trợ về nguồn nhân lực chất lượng cao

Doanh nghiệp sản xuất thiết bị điện được hỗ trợ không vượt quá 70% kinh phí thuê chuyên gia, nhà khoa học phục vụ nghiên cứu, thiết kế, chế tạo, sản xuất các hạng mục, thiết bị, công nghệ và dịch vụ tư vấn thuộc danh mục quy định tại khoản 2 Điều 4 Nghị định này, trên cơ sở khả năng cân đối nguồn lực, theo chương trình, đề án được cấp có thẩm quyền phê duyệt và phù hợp với quy định của pháp luật về ngân sách nhà nước và pháp luật có liên quan, để duy trì cung cấp điện liên tục, bảo đảm an ninh năng lượng quốc gia.

Điều 13. Hỗ trợ từ ngân sách nhà nước

Doanh nghiệp sản xuất thiết bị điện được hưởng các hỗ trợ tín dụng như sau:

1. Được hỗ trợ vay vốn tín dụng đầu tư theo quy định của pháp luật về tín dụng đầu tư của Nhà nước trong danh mục theo khoản 2 Điều 4.

2. Được ưu tiên vay từ các quỹ hỗ trợ đầu tư theo quy định của pháp luật về đầu tư, quỹ hỗ trợ về khoa học và công nghệ theo quy định của pháp luật về khoa học, công nghệ và đổi mới sáng tạo để thực hiện các dự án nghiên cứu và phát triển, chế tạo thử nghiệm sản phẩm thiết bị điện.

Chương IV

TỔ HỢP CÔNG NGHIỆP, DỊCH VỤ NĂNG LƯỢNG

Điều 14. Chức năng của Tổ hợp công nghiệp, dịch vụ năng lượng

1. Triển khai các chương trình, nhiệm vụ, đề án, dự án về nghiên cứu ứng dụng, đổi mới sáng tạo và phát triển công nghệ năng lượng, trọng tâm là nghiên cứu chế tạo thiết bị điện và ứng dụng các dạng năng lượng tái tạo, năng lượng mới, năng lượng thông minh, các giải pháp tiết kiệm năng lượng.

2. Cung cấp các dịch vụ xây dựng, lắp đặt, vận hành và bảo trì các dự án điện.

3. Cung cấp các dịch vụ, giải pháp chuyển đổi số, quản lý vận hành hệ thống thông tin, dữ liệu và các nội dung ứng dụng khoa học, công nghệ khác trong lĩnh vực điện lực.

4. Đào tạo, chuyển giao công nghệ trong lĩnh vực điện lực.

5. Các hoạt động khác phù hợp với quy định của pháp luật về điện lực.

Điều 15. Tiêu chí lựa chọn địa điểm thành lập Tổ hợp công nghiệp, dịch vụ năng lượng

1. Vị trí địa lý thuận lợi, gần các vùng có tiềm năng phát triển các dự án điện lớn, giảm chi phí vận chuyển, lắp đặt các cấu kiện siêu trường, siêu trọng.

2. Có khả năng kết nối hoặc xây dựng mới cảng nước sâu, bến cảng chuyên dùng đáp ứng yêu cầu tiếp nhận tàu trọng tải lớn, bốc xếp, lưu trữ và vận chuyển các thiết bị điện có kích thước và khối lượng lớn.

3. Có đủ quỹ đất để xây dựng các nhà máy sản xuất, lắp ráp sản phẩm, thiết bị; các cơ sở công nghiệp hỗ trợ; trung tâm đổi mới sáng tạo trong lĩnh vực điện lực; khu thử nghiệm, nghiên cứu và phát triển; và các công trình hạ tầng kỹ thuật đồng bộ khác.

4. Khả năng kết nối thuận tiện với hệ thống giao thông đường bộ, đường sắt và đường thủy nội địa.

5. Có nguồn nhân lực tại chỗ hoặc có khả năng thu hút nguồn nhân lực chất lượng cao phục vụ cho hoạt động của Tổ hợp.

6. Đảm bảo các yêu cầu về bảo vệ môi trường, quốc phòng, an ninh và phù hợp với các quy hoạch phát triển kinh tế - xã hội của địa phương và quốc gia.

7. Có tiềm năng hình thành các cụm liên kết ngành, thu hút đầu tư từ các nhà sản xuất thiết bị gốc (OEM) hàng đầu thế giới và các nhà cung cấp trong chuỗi giá trị điện gió ngoài khơi.

Điều 16. Thành lập Tổ hợp công nghiệp, dịch vụ năng lượng

1. Khu chức năng được công nhận là Tổ hợp công nghiệp, dịch vụ năng lượng khi đáp ứng các tiêu chí sau đây:

a) Đáp ứng các tiêu chí quy định tại Điều 15 của Nghị định này;

b) Phù hợp với chính sách, chiến lược, quy hoạch của Nhà nước về phát triển điện lực, phát triển ngành cơ khí;

c) Phù hợp với định hướng, mục tiêu của quy hoạch vùng, quy hoạch tỉnh và quy hoạch sử dụng đất của địa phương.

2. Việc thành lập Tổ hợp công nghiệp, dịch vụ năng lượng được thực hiện thông qua lập dự án đầu tư xây dựng và kinh doanh kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng theo các phương thức:

a) Sử dụng ngân sách nhà nước theo quy định của pháp luật về đầu tư công;

b) Đầu tư theo phương thức đối tác công tư;

c) Sử dụng vốn doanh nghiệp.

3. Trình tự, thủ tục lập dự án đầu tư xây dựng và kinh doanh kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng:

a) Dự án đầu tư sử dụng ngân sách nhà nước thực hiện theo quy định của pháp luật về đầu tư công, pháp luật về ngân sách nhà nước và pháp luật khác có liên quan;

b) Dự án đầu tư theo phương thức đối tác công tư thực hiện theo quy định pháp luật về đầu tư theo phương thức đối tác công tư;

c) Dự án đầu tư sử dụng vốn doanh nghiệp thực hiện theo quy định của pháp luật về đầu tư.

4. Tổ hợp công nghiệp, dịch vụ năng lượng được xác định là đã được hình thành kể từ ngày cấp có thẩm quyền:

a) Phê duyệt chủ trương đầu tư dự án đầu tư xây dựng và kinh doanh kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng đối với dự án sử dụng vốn đầu tư công quy định tại điểm a khoản 3 Điều này;

b) Quyết định chủ trương đầu tư hoặc quyết định phê duyệt dự án (đối với dự án không thuộc trường hợp quyết định chủ trương đầu tư) đầu tư xây dựng và kinh doanh kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng đối với dự án thực hiện theo phương thức đối tác công tư quy định tại điểm b khoản 3 Điều này;

c) Chấp thuận chủ trương đầu tư đồng thời chấp thuận nhà đầu tư hoặc chấp thuận nhà đầu tư hoặc phê duyệt kết quả lựa chọn nhà thầu thực hiện dự án đầu tư xây dựng và kinh doanh kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng đối với dự án sử dụng vốn doanh nghiệp quy định tại điểm c khoản 3 Điều này.

Điều 17. Chính sách ưu đãi, hỗ trợ cho việc đầu tư, xây dựng và vận hành Tổ hợp công nghiệp, dịch vụ năng lượng

1. Các dự án đầu tư xây dựng và kinh doanh kết cấu hạ tầng kỹ thuật Tổ hợp công nghiệp, dịch vụ năng lượng, bao gồm cảng biển chuyên dùng, đường giao thông nội khu, hệ thống cấp điện, cấp thoát nước, xử lý chất thải và các công trình hạ tầng thiết yếu khác, được hưởng các chính sách ưu đãi, hỗ trợ đầu tư theo quy định của pháp luật về đầu tư và các pháp luật có liên quan, căn cứ vào ngành, nghề, địa bàn và điều kiện cụ thể của từng dự án.

2. Nhà nước ưu tiên bố trí vốn đầu tư công, vốn ODA hoặc áp dụng các mô hình PPP để hỗ trợ đầu tư xây dựng các hạng mục hạ tầng kỹ thuật dùng chung có vai trò quan trọng, mang tính kết nối và lan tỏa trong Tổ hợp mà khó thu hút vốn đầu tư tư nhân.

3. Các dự án đầu tư sản xuất thiết bị điện và các dự án công nghiệp hỗ trợ, dịch vụ logistics chuyên dụng, trung tâm đổi mới sáng tạo trong lĩnh vực điện lực trong Tổ hợp công nghiệp, dịch vụ năng lượng được hưởng các ưu đãi, hỗ trợ sau:

a) Được Nhà nước cho thuê đất thu tiền thuê đất một lần cho cả thời gian thuê;

b) Ưu đãi về thuế thu nhập doanh nghiệp, thuế nhập khẩu đối với máy móc, thiết bị, nguyên liệu, vật tư, linh kiện phục vụ sản xuất theo quy định của pháp luật về thuế, hải quan;

c) Miễn, giảm tiền thuê đất, tiền sử dụng đất theo quy định của pháp luật về đất đai;

d) Hỗ trợ chi phí đào tạo và phát triển nguồn nhân lực chất lượng cao, bao gồm cả việc gửi chuyên gia đi đào tạo ở nước ngoài và mời chuyên gia nước ngoài về giảng dạy, chuyển giao công nghệ;

đ) Hỗ trợ chi phí nghiên cứu phát triển, đổi mới công nghệ, ứng dụng các tiêu chuẩn kỹ thuật quốc tế.

Điều 18. Phát triển chuỗi cung ứng và dịch vụ phụ trợ nội địa cho Tổ hợp công nghiệp, dịch vụ năng lượng

1. Nhà nước có chính sách khuyến khích và hỗ trợ các doanh nghiệp trong nước tham gia vào chuỗi cung ứng cho các nhà máy sản xuất thiết bị điện trong các Tổ hợp công nghiệp, dịch vụ năng lượng.

2. Tổ chức các chương trình kết nối kinh doanh, xúc tiến đầu tư giữa các nhà sản xuất thiết bị gốc (OEM) với các nhà cung cấp tiềm năng trong nước để hình thành mạng lưới công nghiệp hỗ trợ.

3. Hỗ trợ các doanh nghiệp công nghiệp hỗ trợ trong nước nâng cao năng lực quản lý, công nghệ, chất lượng sản phẩm để đáp ứng các yêu cầu kỹ thuật và tiêu chuẩn của ngành công nghiệp chế tạo phục vụ ngành điện lực.

4. Phát triển các dịch vụ logistics chuyên dụng (như vận tải siêu trường siêu trọng; lắp đặt ngoài khơi, bảo trì bảo dưỡng tua bin gió; xây dựng, lắp đặt các hạng mục, thiết bị nhà máy điện...) và các dịch vụ kỹ thuật khác phục vụ cho hoạt động của các Tổ hợp công nghiệp, dịch vụ năng lượng và các dự án điện, ưu tiên phát triển năng lực của các doanh nghiệp dịch vụ trong nước.

Điều 19. Quản lý, vận hành, sử dụng và khai thác tài sản kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng

1. Kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng bao gồm:

a) Cơ sở nghiên cứu, thiết kế, chế tạo, đo kiểm, sản xuất thử nghiệm; phòng thí nghiệm;

b) Công trình, cơ sở vật chất phục vụ đào tạo, thực hành, thực tập;

c) Hệ thống thông tin, trung tâm dữ liệu;

d) Hệ thống logistics phục vụ các doanh nghiệp, đơn vị;

đ) Các tòa nhà, nhà xưởng sản xuất;

e) Hệ thống hạ tầng kỹ thuật gồm đường giao thông, điện, nước sạch, cấp nước, thoát nước, thu gom và xử lý nước thải, chất thải rắn và hệ thống hạ tầng kỹ thuật khác;

g) Các công trình khác phục vụ hoạt động của Tổ hợp.

2. Kết cấu hạ tầng Tổ hợp công nghiệp, dịch vụ năng lượng được đầu tư bằng nguồn vốn ngân sách nhà nước được xác định là tài sản kết cấu hạ tầng, việc quản lý, sử dụng và khai thác thực hiện theo quy định của pháp luật về quản lý, sử dụng tài sản công và pháp luật khác có liên quan.

3. Đơn vị quản lý, vận hành và khai thác Tổ hợp công nghiệp, dịch vụ năng lượng là tổ chức được thành lập hoặc được giao nhiệm vụ để thực hiện công tác quản lý, vận hành và khai thác Tổ hợp; cung ứng dịch vụ phục vụ cho hoạt động đầu tư, nghiên cứu, sản xuất, kinh doanh sản phẩm công nghiệp chế tạo phục vụ ngành điện lực và các hoạt động khác có liên quan của doanh nghiệp, đơn vị trong Tổ hợp.

Chương V

TỔ CHỨC THỰC HIỆN

Điều 20. Trách nhiệm của các cơ quan trung ương

1. Bộ Công Thương:

a) Chủ trì, phối hợp với các bộ, ngành liên quan xây dựng, trình Chính phủ, Thủ tướng Chính phủ ban hành hoặc ban hành theo thẩm quyền các văn bản quy phạm pháp luật, chiến lược, quy hoạch, kế hoạch, chương trình, đề án, cơ chế, chính sách về phát triển công nghiệp chế tạo thiết bị điện, dịch vụ phụ trợ trong lĩnh vực điện lực;

b) Xác định các định hướng ưu tiên nghiên cứu khoa học và phát triển công nghệ trong lĩnh vực điện lực; đặt hàng các nhiệm vụ khoa học công nghệ theo quy định pháp luật về khoa học, công nghệ và đổi mới sáng tạo;

c) Tổ chức các hoạt động xúc tiến thương mại, đầu tư, kết nối thị trường cho các sản phẩm thiết bị điện và dịch vụ phụ trợ sản xuất trong nước;

d) Chủ trì, phối hợp với các cơ quan, tổ chức liên quan thực hiện công tác kiểm tra, quản lý nhà nước theo quy định Nghị định này.

2. Bộ Khoa học và Công nghệ:

a) Chủ trì, phối hợp với Bộ Công Thương và các bộ, ngành liên quan xây dựng và tổ chức thực hiện các chiến lược, quy hoạch, kế hoạch, chương trình quốc gia về phát triển khoa học, công nghệ và đổi mới sáng tạo, trong đó có các nội dung liên quan đến lĩnh vực điện lực;

b) Hướng dẫn, hỗ trợ phát triển hạ tầng khoa học công nghệ, các trung tâm nghiên cứu, phòng thí nghiệm, tổ chức ươm tạo công nghệ, ươm tạo doanh nghiệp công nghệ cao trong lĩnh vực điện lực;

c) Hướng dẫn cơ chế quản lý tài chính đối với các quỹ phát triển khoa học và công nghệ của doanh nghiệp, các chương trình, dự án sử dụng ngân sách nhà nước.

3. Bộ Tài chính:

a) Chủ trì, phối hợp với các bộ, ngành liên quan cân đối, bố trí nguồn vốn đầu tư phát triển từ ngân sách nhà nước để thực hiện các chương trình, dự án ưu tiên về ứng dụng khoa học công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực theo quy định của pháp luật về đầu tư công;

b) Lồng ghép các mục tiêu, định hướng phát triển công nghiệp chế tạo thiết bị điện và ứng dụng khoa học công nghệ trong ngành điện vào các chiến lược, quy hoạch, kế hoạch phát triển kinh tế - xã hội quốc gia, vùng và các quy hoạch ngành quốc gia có liên quan;

c) Chủ trì, phối hợp với các bộ, ngành liên quan xây dựng và hoàn thiện chính sách thu hút đầu tư trong và ngoài nước vào lĩnh vực nghiên cứu, phát triển, sản xuất thiết bị điện công nghệ cao, năng lượng tái tạo và các dịch vụ phụ trợ;

d) Hướng dẫn, giám sát việc thực hiện các quy định của pháp luật về đầu tư đối với các dự án trong lĩnh vực thuộc phạm vi điều chỉnh của Nghị định này;

đ) Chủ trì, phối hợp với các bộ, ngành liên quan xây dựng, trình cấp có thẩm quyền ban hành hoặc ban hành theo thẩm quyền các chính sách ưu đãi về thuế, phí, lệ phí và các chính sách tài chính khác nhằm khuyến khích ứng dụng khoa học công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực theo quy định của Nghị định này và pháp luật có liên quan;

e) Bố trí kinh phí sự nghiệp từ ngân sách nhà nước hàng năm cho các hoạt động thuộc phạm vi điều chỉnh của Nghị định này theo quy định của pháp luật về ngân sách nhà nước.

4. Các bộ, ngành liên quan khác:

a) Bộ Giáo dục và Đào tạo chủ trì, phối hợp với Bộ Công Thương, Bộ Khoa học và Công nghệ định hướng, hướng dẫn các cơ sở giáo dục đại học xây dựng, đổi mới chương trình, giáo trình đào tạo các ngành, chuyên ngành liên quan đến kỹ thuật điện, tự động hóa, năng lượng tái tạo, quản lý năng lượng và các lĩnh vực công nghệ mới trong ngành điện, đáp ứng nhu cầu nhân lực chất lượng cao; định hướng, khuyến khích, hướng dẫn, hỗ trợ các cơ sở giáo dục đại học, cơ sở giáo dục nghề nghiệp cập nhật chương trình, chuẩn đầu ra, nội dung thực hành, thực tập, bồi dưỡng kỹ năng nghề đáp ứng nhu cầu nhân lực ngành điện;

b) Bộ Nông nghiệp và Môi trường chủ trì, phối hợp với các bộ, ngành, địa phương hướng dẫn, kiểm tra việc thực hiện các quy định của pháp luật về bảo vệ môi trường, đất đai đối với các dự án đầu tư xây dựng nhà máy sản xuất thiết bị điện, các Tổ hợp công nghiệp điện gió ngoài khơi và các công trình điện lực;

c) Các bộ, cơ quan ngang bộ khác trong phạm vi chức năng, nhiệm vụ của mình, có trách nhiệm phối hợp với Bộ Công Thương và các bộ, ngành liên quan tổ chức thực hiện theo quy định của Nghị định này.

Điều 21. Trách nhiệm của Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương

1. Tổ chức triển khai thực hiện Nghị định này và các chiến lược, quy hoạch, kế hoạch, chương trình, đề án, cơ chế, chính sách về ứng dụng khoa học công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực trên địa bàn quản lý.

2. Xây dựng và ban hành theo thẩm quyền hoặc trình cấp có thẩm quyền ban hành các chính sách, kế hoạch cụ thể của địa phương nhằm khuyến khích, hỗ trợ các doanh nghiệp trên địa bàn đầu tư vào nghiên cứu, ứng dụng khoa học công nghệ, sản xuất thiết bị điện và cung cấp dịch vụ phụ trợ.

3. Chủ trì hoặc phối hợp với các bộ, ngành trong việc quy hoạch, bố trí quỹ đất, đầu tư xây dựng hạ tầng kỹ thuật cho các dự án sản xuất thiết bị điện, các Tổ hợp công nghiệp, dịch vụ năng lượng trên địa bàn.

4. Tạo điều kiện thuận lợi về thủ tục hành chính, môi trường đầu tư cho các doanh nghiệp triển khai dự án; hỗ trợ doanh nghiệp trong công tác đào tạo nhân lực, xúc tiến thương mại, kết nối thị trường.

5. Chỉ đạo các cơ quan chuyên môn của địa phương thực hiện công tác quản lý nhà nước, thanh tra, kiểm tra việc tuân thủ các quy định của pháp luật đối với các hoạt động thuộc phạm vi điều chỉnh của Nghị định này trên địa bàn.

6. Định kỳ báo cáo Bộ Công Thương và các bộ, ngành liên quan về tình hình thực hiện Nghị định này tại địa phương.

7. Xây dựng cơ sở dữ liệu về năng lực khoa học và công nghệ, sản xuất thiết bị trong lĩnh vực điện lực; định kỳ báo cáo Bộ Công Thương và các bộ, ngành liên quan.

Điều 22. Quyền và nghĩa vụ của doanh nghiệp sản xuất thiết bị điện

1. Doanh nghiệp sản xuất thiết bị điện có các quyền sau đây:

a) Được hưởng ưu đãi về thuế, đất đai, tín dụng, nghiên cứu khoa học, đổi mới công nghệ và các chính sách hỗ trợ khác theo quy định;

b) Được hỗ trợ nghiên cứu khoa học, đổi mới công nghệ, tín dụng ưu đãi và các nguồn vốn đầu tư theo quy định;

c) Được ưu tiên xem xét trong việc lựa chọn cung cấp thiết bị cho các dự án điện lực trên cơ sở đáp ứng yêu cầu về kỹ thuật, chất lượng, an toàn, tiến độ và hiệu quả kinh tế theo quy định của pháp luật;

d) Được tiếp cận các phòng thí nghiệm, trung tâm thử nghiệm, quỹ khoa học và công nghệ để phát triển, thử nghiệm sản phẩm;

đ) Được đăng ký, bảo vệ quyền sở hữu trí tuệ đối với sản phẩm, công nghệ do mình tạo ra;

e) Quyền khác theo quy định của Nghị định này và pháp luật có liên quan.

2. Doanh nghiệp sản xuất thiết bị điện có các nghĩa vụ sau đây:

a) Bảo đảm sản phẩm, thiết bị sản xuất đáp ứng tiêu chuẩn kỹ thuật, an toàn, bảo vệ môi trường theo quy định của pháp luật;

b) Duy trì và nâng cao tỷ lệ nội địa hóa trong sản xuất thiết bị điện; nghiên cứu, đổi mới công nghệ, chuyển đổi số;

c) Công khai, minh bạch về chi phí sản xuất, giá thành sản phẩm, bảo đảm cạnh tranh lành mạnh;

d) Thực hiện trách nhiệm bảo hành, bảo trì, bảo dưỡng thiết bị điện do mình sản xuất, cung cấp;

đ) Tham gia đào tạo, phát triển nguồn nhân lực, hợp tác với viện nghiên cứu, trường đại học và doanh nghiệp trong chuỗi cung ứng;

e) Chịu chế tài xử lý theo quy định của pháp luật trong trường hợp cung cấp sản phẩm kém chất lượng, gian lận thương mại hoặc không thực hiện đúng cam kết nội địa hóa;

g) Chịu sự kiểm tra, giám sát của cơ quan nhà nước theo quy định;

h) Nghĩa vụ khác theo quy định của Nghị định này và pháp luật có liên quan.

Điều 23. Cơ chế giám sát, quản lý và chế tài thực hiện Nghị định

1. Nguyên tắc giám sát, quản lý.

a) Việc quản lý, vận hành dự án điện lực phải bảo đảm ổn định, an toàn, hiệu quả theo thiết kế được phê duyệt, gắn liền với yêu cầu bảo đảm quốc phòng, an ninh quốc gia;

b) Bảo đảm công khai, minh bạch, trách nhiệm giải trình trong toàn bộ quá trình triển khai ứng dụng khoa học, công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực;

c) Hoạt động giám sát gắn với việc thực hiện các mục tiêu: nội địa hóa, đổi mới công nghệ, phát triển chuỗi cung ứng trong nước và bảo đảm an ninh năng lượng quốc gia;

d) Các cơ chế ưu đãi, hỗ trợ phải được kiểm tra, đánh giá định kỳ.

2. Trách nhiệm quản lý

a) Bộ Công Thương chịu trách nhiệm quản lý tiến độ đầu tư, giám sát vận hành an toàn hệ thống điện, an toàn điện; theo dõi việc thực hiện cam kết về tỷ lệ nội địa hóa, chuyển giao công nghệ và sử dụng sản phẩm, dịch vụ trong nước theo quy định của Nghị định này;

b) Ủy ban nhân dân cấp tỉnh, thành phố trực thuộc trung ương có trách nhiệm phối hợp với các bộ, cơ quan ngang bộ trong quản lý, giám sát dự án; tổ chức quản lý hoạt động của tổ chức, cá nhân liên quan tại địa phương theo thẩm quyền;

c) Quản lý các dự án điện lực, ứng dụng khoa học, công nghệ và phát triển công nghiệp chế tạo trong lĩnh vực điện lực thực hiện theo quy định của pháp luật về xây dựng, đầu tư, điện lực, khoa học, công nghệ và đổi mới sáng tạo và các quy định pháp luật khác có liên quan.

3. Chế tài xử lý vi phạm

Tổ chức, cá nhân vi phạm quy định của Nghị định này hoặc không thực hiện đúng cam kết khi được hưởng ưu đãi, hỗ trợ thì bị thu hồi, truy thu các khoản ưu đãi, hỗ trợ đã được hưởng không đúng quy định; trường hợp có hành vi vi phạm hành chính thì bị xử phạt theo quy định của pháp luật về xử lý vi phạm hành chính trong lĩnh vực đầu tư, điện lực, môi trường và pháp luật có liên quan.

Điều 24. Điều khoản thi hành

1. Nghị định này có hiệu lực thi hành kể từ ngày 20 tháng 10 năm 2026.

2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này.

The Government of Vietnam hereby promulgates the Decree on the application of science and technology and development of the manufacturing industry in the electric power sector.

Chapter I

GENERAL PROVISIONS

Article 1. Scope

This Decree provides elaborations on and measures for the implementation of Article 8 of the Law on Electricity regarding the application of science and technology and the development of the manufacturing industry in the electric power sector, including:

1. The list of important items, equipment, and consulting services that are prioritized for domestic production and provision to maintain a continuous electricity supply and ensure national energy security.

2. Activities involving the research, application, and development of science and technology; the electrical equipment manufacturing industry; and energy services in the electric power sector.

3. Mechanisms for encouraging and supporting the development of scientific and technological research; the design, manufacturing, and installation of electrical equipment; and the provision of services in the electric power sector.

4. Prioritizing the development of the electrical equipment manufacturing industry and electrical services; fulfilling requirements and targets regarding the localization rate in the electric power industry; and encouraging the development of large-scale domestic enterprises with advanced technological capabilities that are capable of implementing complex and technically demanding projects in the electric power sector and meeting international quality standards.

Article 2. Regulated entities

This Decree applies to agencies, organizations, and individuals involved in the application of science and technology and the development of the manufacturing industry in the electric power sector.

Article 3. Interpretation of terms

For the purpose of this Decree, the following terms shall be construed as follows:

1. Manufacture of electrical equipment means the production and manufacture of products, means, machinery, equipment, and electromechanical equipment for supply to electricity works.

2. Energy industry and service complex means a functional zone integrating activities involving research, pilot manufacturing, and the manufacture of electrical equipment; and the provision of construction, installation, operation, and maintenance services for power projects and other related services serving the electric power sector.

3. Program for technology development, the electrical equipment manufacturing industry, and energy services means a set of tasks sharing common objectives of addressing issues arising from electricity activities; maintaining a continuous electricity supply; ensuring national energy security; fulfilling requirements and targets regarding the localization rate in the electric power industry; and ensuring economical electricity use, improving the efficiency of energy resource utilization, protecting the environment and safety corridors of electricity works, and ensuring electrical safety and the safety of dams and hydropower reservoirs.

Chapter II

1. Important items, equipment, and consulting services in the electric power sector shall be developed, manufactured, or provided domestically at certain stages and shall satisfy one of the following criteria:

a) Directly and decisively affecting the assurance of national energy security, including maintaining a stable electricity supply; improving the reliability of the transmission system; ensuring the stable and safe operation of the power system; ensuring data security; and avoiding dependence on technological products that pose a risk of loss of system control;

b) Providing investment consultancy for new, complex, and technically demanding power generation projects in the electric power sector that meet international quality standards;

c) Providing operation and maintenance services for power plants, power grids, and important electricity works to ensure the safe, stable, and continuous operation of the power system and national energy security;

d) Providing technological services and security solutions for power grid control and operation systems to ensure the safe operation of the power grid and a stable electricity supply.

2. In each period, taking into account domestic technological mastery and production capabilities and the socio-economic development situation, the Ministry of Industry and Trade of Vietnam shall submit the following lists to the Prime Minister of Vietnam for promulgation:

a) The list of important items, equipment, and consulting services that must be manufactured and provided domestically at certain stages to maintain a continuous electricity supply and ensure national energy security;

b) The list of items, equipment, and consulting services in the electric power sector encouraged for domestic manufacture and provision.

Article 5. Program for application and development of technologies, electrical equipment manufacturing industry, and energy services

a) Conformity with the guidelines and policies of the CPV and the policies and laws of the State, and alignment with the socio-economic development strategy and the electric power sector development strategy;

b) Practicality and assurance that the results of research, application, manufacture, and production of electrical equipment are applied in practice and deliver economic and technical efficiency; application of scientific and technological advances in electricity activities and electricity use to ensure economical electricity use, improve the efficiency of energy resource utilization, protect the environment and safety corridors of electric power works, and ensure electrical safety and the safety of dams and hydropower reservoirs;

c) Increasing the proportion of the value of manufactured equipment produced by domestic mechanical engineering enterprises in power projects;

d) Applying, researching, and mastering technologies for the manufacture of important electrical equipment, particularly technologies that ensure national energy security, renewable energy technologies, new energy technologies, and smart grid technologies;

dd) Focusing on fields with competitive advantages or electrical equipment for which there is high domestic demand, such as electricity transmission and distribution equipment and renewable energy technologies;

e) Focusing the Program on high technologies, strategic technologies, new technologies, technologies serving projects of national importance and key projects, and technologies serving national defense and security that have the potential to achieve breakthroughs in productivity, quality, growth model innovation, and national competitiveness and to facilitate proactive participation in global value chains;

g) Encouraging the proactive participation of enterprises, science and technology organizations, research institutes, and educational institutions; promoting the formation and development of national, regional, sectoral, and local innovation ecosystems; and enhancing the commercialization of results;

h) Supporting the development of the manufacturing industry and services serving the energy sector with a view to strengthening domestic capabilities and promoting exports, with priority given to the development of the machinery and electrical equipment manufacturing industries;

i) Satisfying one or more of the criteria specified in Article 25 of Decree No. 267/2025/ND-CP dated October 14, 2025 of the Government of Vietnam.

a) The name, objectives, and contents of the Program;

b) Contents and requirements applicable to products and assessment indicators;

c) The agency in charge of managing the Program;

d) The implementation period of the Program;

dd) The estimated total implementation funding and funding structure, including the state budget, counterpart funds, and mobilized non-state resources;

e) Proposed special management and financial mechanisms for the Program;

g) International cooperation, if any;

h) Expected results, effectiveness, and impacts of the Program.

3. The Ministry of Industry and Trade of Vietnam shall formulate a program for the application and development of technologies, the electrical equipment manufacturing industry, and energy services for each period, ensuring effective cooperation among sectors, fields, and local areas, and submit it to the Prime Minister of Vietnam for approval.

INCENTIVE AND SUPPORT POLICIES FOR MANUFACTURING INDUSTRY SERVING ELECTRIC POWER SECTOR

Article 6. General incentives for enterprises manufacturing electrical equipment in electric power sector

1. Enterprises manufacturing electrical equipment included in the Lists specified in Clause 2 Article 4 of this Decree shall be entitled to the incentives applicable to the business line of manufacturing key mechanical engineering products in accordance with the laws on investment, taxation, land, and accounting, and other relevant laws.

2. Enterprises implementing investment projects for the manufacture of electrical equipment included in the Lists specified in Clause 2 Article 4 of this Decree that have an investment capital scale and disbursement schedule as prescribed by the Government of Vietnam, satisfy the criteria regarding high technologies and technology transfer, and involve Vietnamese enterprises in domestic production value chains in accordance with regulations of the Prime Minister of Vietnam shall be entitled to special investment incentives and support in accordance with the law on investment and other relevant laws.

3. Enterprises manufacturing electrical products and equipment, and components, spare parts, and materials used for the manufacture of electrical equipment, that are included in the Lists specified in Clause 2 Article 4 of this Decree and are eligible for encouragement and development support shall be entitled to the following incentives and support:

a) Electrical products and equipment included in the list of key mechanical engineering products shall be entitled to incentives and support in accordance with the law on the development of key mechanical engineering products;

b) Components, spare parts, and materials used for the manufacture of electrical equipment that are included in the list of supporting industry products prioritized for development shall be entitled to incentives and support in accordance with the law on supporting industry development;

c) Electrical products and equipment included in the List of Strategic Technologies and Strategic Technology Products promulgated by the Prime Minister of Vietnam shall be entitled to incentives and support in accordance with the law on high technologies.

Article 7. Mechanism for using important items, equipment, and consulting services in electric power sector

2. Organizations, enterprises, and individuals having items, equipment, and services included in the List specified in Point a Clause 2 Article 4 of this Decree shall provide information and submit offers to facilitate their order placement, supply, and use in Vietnam.

Article 8. Order placement mechanism and incentives for electrical equipment products

1. Organizations, enterprises, and individuals having items, electrical equipment products, and services specified in Clause 1 Article 7 of this Decree may be considered for assignment under the order placement mechanism if they satisfy one of the following criteria:

a) Their domestically manufactured products have been assessed, tested, and inspected and found compliant with applicable standards and technical regulations and requirements concerning safety and environmental protection;

b) Their products are created from the results of research, technological development, or innovation and satisfy applicable standards and technical regulations, requirements concerning safety and environmental protection, and other conditions prescribed by relevant laws.

2. Order prices and quantities shall be determined on the basis of reasonable and valid production and supply costs plus a reasonable profit in accordance with the law on prices. Suppliers shall separately account for and monitor such costs and arrange an independent audit of order prices in accordance with regulations.

3. Suppliers receiving orders shall be entitled to the following mechanisms:

a) A price preference of no more than 10% compared with the price of similar imported products when the order price of ordered products is calculated;

b) Exemption from experience-related requirements and conditions when participating in the order placement process;

Article 9. Supply of domestically manufactured items, equipment, and services

1. The items, equipment, and consulting services included in the List specified in Point a Clause 2 Article 4 of this Decree that have been manufactured domestically and satisfy the technical, safety, and quality standards prescribed by law shall be supplied and used in electricity works.

2. Contractors supplying the electrical products and equipment specified in Clause 1 of this Article:

a) Shall be entitled to appropriate support mechanisms and incentives in accordance with the law;

b) Shall be eligible to access programs supporting technological innovation, technological and technical improvement, and production-scale expansion funded by the National Foundation for Science and Technology Development, the National Technology Innovation Fund, and science, technology, and innovation development funds of ministries, ministerial agencies, other central authorities, and provincial People’s Committees.

3. Electrical equipment products employing technologies that ensure national energy security shall be subject to order placement and entitled to the support mechanisms and incentives prescribed by relevant laws and Article 8 of this Decree.

Article 10. Support for product testing, assessment, and certification

Organizations and enterprises conducting technological research and developing the important items, equipment, and consulting services specified in Point a Clause 2 Article 4 of this Decree shall receive support equal to 50% of the costs of using laboratories, testing laboratories, design support facilities, and shared-use research equipment, as well as State-owned testing, measurement, inspection, and assessment centers for product development.

2. The State shall support the establishment of energy industry and service complexes to develop ecosystems for research and development, application of science and technology, commercialization of manufactured industrial products, and provision of auxiliary services for the electric power sector.

Article 12. Support for high-quality human resources

Enterprises manufacturing electrical equipment shall receive support not exceeding 70% of the costs of hiring experts and scientists to conduct research into, design, manufacture, and produce the items, equipment, and technologies and provide the consulting services included in the Lists specified in Clause 2 Article 4 of this Decree to maintain a continuous electricity supply and ensure national energy security. Such support shall be subject to the capacity to balance available resources, provided under programs and schemes approved by competent authorities, and compliant with the law on the state budget and other relevant laws.

Article 13. Support from state budget

Enterprises manufacturing electrical equipment shall be entitled to the following credit support:

1. Eligibility for investment credit loans in accordance with the law on State investment credit for products included in the Lists specified in Clause 2 Article 4 of this Decree.

2. Priority access to loans from investment support funds in accordance with the law on investment and science and technology support funds in accordance with the law on science, technology, and innovation for implementing research and development projects and conducting pilot manufacture of electrical equipment products.

ENERGY INDUSTRY AND SERVICE COMPLEXES

1. Implementing programs, tasks, schemes, and projects involving applied research, innovation, and the development of energy technologies, with a focus on research into and manufacture of electrical equipment; application of renewable, new, and smart forms of energy; and energy-saving solutions.

2. Providing construction, installation, operation, and maintenance services for power projects.

3. Providing digital transformation services and solutions; managing and operating information systems and data; and carrying out other activities involving the application of science and technology in the electric power sector.

4. Providing training and technology transfer in the electric power sector.

5. Conducting other activities in accordance with the law on electricity.

Article 15. Criteria for selecting locations for establishing energy industry and service complexes

1. Having a favorable geographical location near areas with potential for the development of large-scale power projects, thereby reducing the costs of transporting and installing oversized and overweight components.

2. Being capable of connecting to an existing deep-water port or constructing a new deep-water port or specialized port capable of receiving large-capacity vessels and accommodating the loading, unloading, storage, and transportation of electrical equipment of substantial dimensions and weight.

3. Having a sufficient land reserve for constructing product and equipment manufacturing and assembly plants; supporting industry facilities; innovation centers in the electric power sector; testing, research, and development zones; and other synchronized technical infrastructure works.

5. Having an available local workforce or the capacity to attract high-quality human resources to serve the Complex’s operations.

6. Satisfying environmental protection, national defense, and security requirements and conforming to local and national socio-economic development plannings.

7. Having the potential to form industry linkage clusters and attract investment from the world’s leading original equipment manufacturers (OEMs) and suppliers in the offshore wind power value chain.

Article 16. Establishment of energy industry and service complexes

1. A functional zone shall be recognized as an energy industry and service complex if it satisfies the following criteria:

a) Satisfying the criteria specified in Article 15 of this Decree;

b) Conforming to the State’s policies, strategies, and planning for electric power development and mechanical engineering industry development;

c) Conforming to the orientations and objectives of the relevant regional planning, provincial planning, and local land-use planning.

2. An energy industry and service complex shall be established through the formulation of an investment project on the construction and commercial operation of its infrastructure using one of the following methods:

b) Investment in the form of a public-private partnership;

c) Using enterprise capital.

3. The procedures for formulating an investment project on the construction and commercial operation of the infrastructure of an energy industry and service complex are as follows:

a) An investment project using the state budget shall be implemented in accordance with the law on public investment, the law on the state budget, and other relevant laws;

b) An investment project implemented in the form of a public-private partnership shall be implemented in accordance with the law on public-private partnership investment;

c) An investment project using enterprise capital shall be implemented in accordance with the law on investment.

4. An energy industry and service complex shall be deemed established from the date on which the competent authority:

a) Approves the investment policy for the investment project on the construction and commercial operation of the infrastructure of the energy industry and service complex, in the case of a project using public investment capital specified in Point a Clause 3 of this Article;

b) Issues a decision on the investment policy or a decision approving the project, in the case of a project not subject to an investment policy decision, for the investment project on the construction and commercial operation of the infrastructure of the energy industry and service complex implemented in the form of a public-private partnership as specified in Point b Clause 3 of this Article;

Article 17. Incentive and support policies for investment in, construction, and operation of energy industry and service complexes

1. Investment projects on the construction and commercial operation of the technical infrastructure of energy industry and service complexes, including specialized seaports, internal roads, electricity supply systems, water supply and drainage systems, waste treatment systems, and other essential infrastructure works, shall be entitled to investment incentives and support in accordance with the law on investment and other relevant laws, based on the relevant business lines, geographical areas, and specific conditions of each project.

2. The State shall prioritize the allocation of public investment capital and official development assistance (ODA) or the application of public-private partnership (PPP) models to support investment in the construction of important shared technical infrastructure facilities that provide connectivity and generate spillover effects within a Complex but are unlikely to attract private investment.

3. Investment projects on the manufacture of electrical equipment, supporting industry projects, specialized logistics services, and innovation centers in the electric power sector within an energy industry and service complex shall be entitled to the following incentives and support:

a) Lease of land from the State with a one-off rental payment for the entire lease term;

b) Incentives regarding corporate income tax and import duty on machinery, equipment, raw materials, supplies, and components used for production in accordance with taxation and customs laws;

c) Exemption from or reduction of land rentals and land use levies in accordance with the law on land;

d) Support for the costs of training and developing high-quality human resources, including sending experts abroad for training and inviting foreign experts to provide instruction and transfer technologies;

dd) Support for research and development costs, technological innovation, and the application of international technical standards.

1. The State shall adopt policies to encourage and support domestic enterprises in participating in supply chains for electrical equipment manufacturing plants within energy industry and service complexes.

2. Business matching and investment promotion programs shall be organized between original equipment manufacturers (OEMs) and potential domestic suppliers to establish supporting industry networks.

3. Domestic supporting industry enterprises shall be supported in improving their management and technological capabilities and product quality to satisfy the technical requirements and standards of the manufacturing industry serving the electric power sector.

4. Specialized logistics services, such as oversized and overweight transportation; offshore installation and wind turbine servicing and maintenance; and the construction and installation of power plant items and equipment, and other technical services shall be developed to serve the operations of energy industry and service complexes and power projects, with priority given to developing the capacity of domestic service enterprises.

Article 19. Management, operation, use, and utilization of infrastructure assets of energy industry and service complexes

1. The infrastructure of an energy industry and service complex includes:

a) Research, design, manufacturing, measurement and testing, and pilot production facilities; laboratories;

b) Works and physical facilities serving training, practical exercises, and internships;

c) Information systems and data centers;

dd) Buildings and manufacturing workshops;

e) Technical infrastructure systems, including roads, electricity systems, clean water systems, water supply and drainage systems, wastewater and solid waste collection and treatment systems, and other technical infrastructure systems;

g) Other works serving the operations of the Complex.

2. The infrastructure of an energy industry and service complex financed by the state budget shall be classified as infrastructure assets and shall be managed, used, and utilized in accordance with the law on the management and use of public property and other relevant laws.

3. The entity managing, operating, and utilizing an energy industry and service complex shall be an organization established or assigned to manage, operate, and utilize the Complex and provide services supporting investment, research, production, and trading activities involving manufactured industrial products serving the electric power sector and other related activities of enterprises and entities within the Complex.

Chapter V

IMPLEMENTATION

Article 20. Responsibilities of central authorities

1. The Ministry of Industry and Trade of Vietnam shall:

b) Determine priority orientations for scientific research and technological development in the electric power sector and place orders for science and technology tasks in accordance with the law on science, technology, and innovation;

c) Organize trade and investment promotion and market linkage activities for domestically manufactured electrical equipment products and domestically provided auxiliary services;

d) Take charge and cooperate with relevant agencies and organizations in conducting inspections and performing state management in accordance with this Decree.

2. The Ministry of Science and Technology of Vietnam shall:

a) Take charge and cooperate with the Ministry of Industry and Trade of Vietnam and relevant ministries and central authorities in formulating and implementing national strategies, planning, plans, and programs for the development of science, technology, and innovation, including contents related to the electric power sector;

b) Provide guidance and support for the development of science and technology infrastructure, research centers, laboratories, technology incubators, and high-tech enterprise incubators in the electric power sector;

c) Provide guidance on financial management mechanisms applicable to enterprises’ science and technology development funds, as well as programs and projects financed by the state budget.

3. The Ministry of Finance of Vietnam shall:

a) Take charge and cooperate with relevant ministries and central authorities in balancing and allocating development investment capital from the state budget for implementing priority programs and projects concerning the application of science and technology and development of the manufacturing industry in the electric power sector in accordance with the law on public investment;

c) Take charge and cooperate with relevant ministries and central authorities in formulating and improving policies to attract domestic and foreign investment in research into, development, and manufacture of high-tech electrical equipment and renewable energy equipment and the provision of auxiliary services;

d) Provide guidance and supervision regarding compliance with the law on investment by projects in the fields governed by this Decree;

dd) Take charge and cooperate with relevant ministries and central authorities in formulating and submitting to competent authorities for promulgation, or promulgating within its competence, policies on tax, fee, and charge incentives and other financial policies to encourage the application of science and technology and development of the manufacturing industry in the electric power sector in accordance with this Decree and relevant laws;

e) Allocate annual public funding from the state budget for activities governed by this Decree in accordance with the law on the state budget.

4. Other relevant ministries and central authorities:

a) The Ministry of Education and Training of Vietnam shall take charge and cooperate with the Ministry of Industry and Trade of Vietnam and the Ministry of Science and Technology of Vietnam in providing orientations and guidance to higher education institutions on developing and updating training programs and curricula for disciplines and majors related to electrical engineering, automation, renewable energy, energy management, and emerging technological fields in the electric power sector to meet the demand for high-quality human resources; and shall provide orientations, encouragement, guidance, and support to higher education institutions and vocational education institutions in updating their training programs, learning outcome standards, practical and internship contents, and occupational skills training to meet the electric power sector’s workforce demands;

b) The Ministry of Agriculture and Environment of Vietnam shall take charge and cooperate with ministries, central authorities, and local authorities in providing guidance and conducting inspections regarding compliance with environmental protection and land laws by investment projects on the construction of electrical equipment manufacturing plants, offshore wind power industry complexes, and electricity works;

c) Other ministries and ministerial agencies shall, within the scope of their functions and duties, cooperate with the Ministry of Industry and Trade of Vietnam and relevant ministries and central authorities in organizing the implementation of this Decree.

Article 21. Responsibilities of People’s Committees of provinces and centrally affiliated cities

2. Formulate and promulgate within their competence, or submit to competent authorities for promulgation, specific local policies and plans to encourage and support enterprises within their respective jurisdictions in investing in scientific and technological research and application, the manufacture of electrical equipment, and the provision of auxiliary services.

3. Take charge and cooperate with ministries and central authorities in planning and allocating land reserves and investing in the construction of technical infrastructure for electrical equipment manufacturing projects and energy industry and service complexes within their respective jurisdictions.

4. Facilitate administrative procedures and a favorable investment environment for enterprises implementing projects, and support enterprises in workforce training, trade promotion, and market linkage activities.

5. Direct local specialized agencies to perform state management and conduct inspections and examinations of compliance with the law by activities governed by this Decree within their respective jurisdictions.

6. Periodically report to the Ministry of Industry and Trade of Vietnam and relevant ministries and central authorities on the local implementation of this Decree.

7. Develop databases on scientific and technological capabilities and electrical equipment manufacturing capacity in the electric power sector, and periodically report to the Ministry of Industry and Trade of Vietnam and relevant ministries and central authorities.

Article 22. Rights and obligations of enterprises manufacturing electrical equipment

1. An enterprise manufacturing electrical equipment shall have the following rights:

a) To receive incentives relating to taxation, land, credit, scientific research and technological innovation, and other support policies in accordance with regulations;

c) To be given priority consideration in the selection of equipment suppliers for power projects, provided that it satisfies technical, quality, safety, schedule, and economic efficiency requirements in accordance with the law;

d) To access laboratories, testing centers, and science and technology funds for product development and testing;

dd) To register and protect intellectual property rights to products and technologies that it has created;

e) To exercise other rights prescribed by this Decree and relevant laws.

2. An enterprise manufacturing electrical equipment shall have the following obligations:

a) To ensure that its manufactured products and equipment satisfy the technical, safety, and environmental protection standards prescribed by law;

b) To maintain and increase the localization rate in electrical equipment manufacturing and conduct research, technological innovation, and digital transformation;

c) To ensure publicity and transparency regarding production costs and product costs and ensure fair competition;

d) To fulfill its responsibilities for providing warranties and servicing and maintaining the electrical equipment that it manufactures and supplies;

e) To be subject to sanctions prescribed by law if it supplies substandard products, commits trade fraud, or fails to properly fulfill its localization commitments;

g) To be subject to inspection and supervision by state authorities in accordance with regulations;

h) To fulfill other obligations prescribed by this Decree and relevant laws.

Article 23. Mechanisms for supervision and management and sanctions for implementing this Decree

1. Principles of supervision and management

a) The management and operation of power projects shall ensure stability, safety, and efficiency in accordance with approved designs and be associated with the requirements for ensuring national defense and national security;

b) Publicity, transparency, and accountability shall be ensured throughout the process of applying science and technology and developing the manufacturing industry in the electric power sector;

c) Supervision activities shall be associated with the achievement of the objectives of localization, technological innovation, development of domestic supply chains, and assurance of national energy security;

d) Incentive and support mechanisms shall be periodically inspected and evaluated.

a) The Ministry of Industry and Trade of Vietnam shall manage investment progress; supervise the safe operation of the power system and electrical safety; and monitor the fulfillment of commitments regarding localization rates, technology transfer, and the use of domestic products and services in accordance with this Decree;

b) People’s Committees of provinces and centrally affiliated cities shall cooperate with ministries and ministerial agencies in managing and supervising projects and shall, within their competence, manage the activities of relevant local organizations and individuals;

c) Power projects and activities involving the application of science and technology and the development of the manufacturing industry in the electric power sector shall be managed in accordance with construction, investment, electricity, science, technology, and innovation laws and other relevant laws.

3. Sanctions for violations

Organizations and individuals that violate this Decree or fail to properly fulfill their commitments after receiving incentives or support shall have any improperly received incentives or support revoked and recovered. If they commit administrative violations, they shall be subject to penalties in accordance with the law on the handling of administrative violations in the fields of investment, electricity, and environmental protection and other relevant laws.

Article 24. Implementation provisions

1. This Decree comes into force as of October 20, 2026.
