CIRCULAR
ON DRIVING TESTS, ISSUANCE OF DRIVING LICENSES; ISSUANCE AND
USE OF INTERNATIONAL DRIVING PERMITS
Pursuant to the Law on Road
Traffic Order and Safety dated June 27, 2024;
Pursuant to Resolution No.
190/2025/QH15 dated February 19, 2025 of the National Assembly on handling some
issues related to the reorganization of organizational structure of the State;
Pursuant to the Decree No.
02/2025/ND-CP dated February 18, 2025 of the Government on functions,
responsibilities, jurisdiction and organizational structure of the Ministry of
Public Security;
At the request of the
Director General of the Department of Traffic Police;
The Minister of Public
Security promulgates the Circular on driving tests, issuance of driving
licenses; issuance and use of international driving permits.

Article 1.
Scope
1. This Circular promulgates regulations on
driving tests, issuance, renewal, re-issuance, revocation, and use of driving
licenses; issuance and use of international driving permits; template of driving
licenses and international driving permits.
2. This Circular does not adjust regulations on
driving tests, issuance, renewal, re-issuance, and revocation of driving
licenses of military forces and police forces in the performance of national
defense and security duties.
Article 2. Regulated
entities
This Circular applies to organizations,
individuals related to driving tests, issuance, renewal, re-issuance,
revocation, and use of driving licenses; issuance and use of international
driving permits.
Article 3. Definitions
For the purposes of this Circular, the terms
below shall be construed as follows:
1. Driving license template number is the
number printed on the back of the driving licenses by the manufacturer
including 02 letters and a string of numbers.
2. Electronic driving license (eDL) is a
driving license presented in the form of data messages, which is integrated
into the electronic data system and an electronic identification account.

5. International driving permit is a type
of driving license (hereinafter referred to as "IDP").
6. National driving license is a driving
license issued by competent authorities of each country and valid within the
territory of that country.
7. Electronic dossier of international
driving permits is a collection of electronic documents related to IDP.
8. The information system on driving tests,
issuance of driving licenses is a combination of hardware, transmission
lines, and software used to manage information on driving tests, issuance,
renewal, re-issuance of the driving licenses (also known as the database on
driving tests and issuance of driving licenses), including:
a) Information system on driving tests at the
driving test centers, Divisions of Traffic Police of provinces and
central-affiliated cities (hereinafter referred to as "Divisions of
Traffic Police"), and Department of Traffic Police;
b) Information system on driving licenses at the
Department of Traffic Police, Divisions of Traffic Police under province-level
Public Security, and police forces in communes, wards, towns, police stations
in the areas where the commune-level police forces are not established
(hereinafter referred to as "commune-level police forces") of the
locations of receipt of driving licenses.
Chapter II
DRIVING TEST
Article 4. Forms, content
and procedures for driving tests

a) Theory test includes questions related to
regulations of the law on road traffic order and safety; driving skills;
information related to the common structure and repairs (for learners of
category B1, category B, and above); driver morale, traffic etiquette, and
prevention and control of harmful effects of alcoholic beverages in road
traffic; skills for fire prevention, firefighting, human rescue, property
rescue (for learners of categories B and above).
Driving examinees of categories A1 and A, who
have unexpired automobile driving licenses, are exempt from the theory test;
b) The theory test is carried out on the
computers, except in cases prescribed in clause 2 Article 5 of this Circular.
2. Practical test on driving training yard
a) Regarding categories A1 and A
The tests shall be graded directly with support
of the automatic marking device, except for cases prescribed in clause 2
Article 5 of this Circular. Driving examinees shall operate the motorcycle
through 04 tests: driving through 8-shape diagrams, through a straight line,
through roads with marks of obstacles, through rough roads;
b) Regarding category B1
The tests shall be graded directly. Examiners
shall not sit on the testing vehicle. Examinees shall operate the vehicle
forward and backward in a zigzag;
c) Regarding categories B, C1, C, D1, D2, D

Examinees shall operate the vehicle through the
tests arranged in the driving test centers including departing, giving way for
pedestrians, stopping and starting the vehicle on the slope, running on a tire
track, turning in a 90-degree corner, driving though cross-roads with traffic
lights, driving through winding roads, pulling over at a parking lot (vertical
parking for categories B and C1; parallel parking for categories B, C, D1, D2
and D), making a temporary stop at intersection with railway, handling dangerous
situations, shifting on flat roads, ending;
d) Regarding categories BE, D1E, D2E, DE
The tests shall be graded directly. Examiners
shall not sit on the testing vehicle. Examinees shall drive through 05 standard
cones in a zig zag twice;
dd) Regarding category C1E, CE
The tests shall be graded directly. Examiners
shall not sit on the testing vehicle. Examinees shall operate the vehicle
through 02 tests: driving through 05 standard cones in a zig zag twice;
performing a vertical parking.
3. Practical test on roads
a) Regarding categories B, C1, C, D1, D2, D
The tests shall be graded directly with support
of the automatic marking device with an examiner sitting on the testing
vehicle. Examinees shall operate the testing vehicle, handle situations on the
roads and take orders from the examiner;
b) Regarding categories BE, C1E, CE, D1E, D2E,
DE

4. Regarding driving simulation tests for
categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE, examinees shall
recognize potential traffic safety risks by observing simulated situations on
the computer and handle those situations.
5. Procedures for driving test
a) Testing for categories A1 and A shall be in
accordance with the Appendix II attached to this Circular;
b) Testing for categories B1 shall be in
accordance with the Appendix III attached to this Circular;
c) Testing for categories B, C1, C, D1, D2, D;
categories BE, D1E, D2E, DE; categories C1E, CE shall be in accordance with
Appendix IV; Appendix V; Appendix VI attached to this Circular, respectively.
Article 5. Technical
standards for the driving training yard for motorcycles
1. Regarding driving test centers equipped with
computers for theory tests and automatic marking device for practical tests on
driving training yard
The yard must include following facilities in
accordance with the National Technical Regulations on driving test centers:
pictures of tests, testing vehicles, equipment for theory and practical tests,
waiting room, room for theory tests, control room for marking device for
practical test on driving training yard.
2. Regarding driving test centers conducting
paper-based theory tests and grading practical tests on driving training yard

Article 6. Testing Council
1. Testing council is established in accordance
with the decision on organization of driving test issued by the Directors of
the Police Departments of provinces and central-affiliated cities (hereinafter
referred to as "Directors of the Police Departments") including:
a) The president of the council is the head of
Divisions of Traffic Police;
b) The deputy president of the council is the
person in command of the Divisions of Traffic Police;
c) Members of the council are heads of the
driving test centers;
d) Examiners;
dd) Secretary of the council is the official of
the Divisions of Traffic Police;
2. When the council works, at least 2/3 of the
members must participate and under the majority rule; if an agreement cannot be
reached, the decision shall be made by the President of the council. The
council shall be dissolved at the end of the testing.
3. When implementing the duties, the Deputy
President, secretary, examiners must hold unexpired examiner cards, and
positive-score and unexpired driving licenses.

a) Direct, inspect and request the completion of
the requirements for organizing the testing;
b) Assign and make a plan for the testing;
c) Disseminate, instruct regulations, internal
regulations on testing and essential regulations for examiners and examinees;
d) Inspect testing vehicles, marking devices,
testing yard, methods for assurance of safety for the tests;
dd) Organize the tests in accordance with the
law;
e) Make records of violations for handling
within their jurisdiction, or report, request the competent authorities to
handle the violations in accordance with the law;
g) Request the examinees to compensate for the
damages if accidents occur due to the fault of candidates during the tests;
h) Consolidate the testing results and sign the
minutes;
i) Retain documents, records of the testing.

Article 7. Standards for
examiners, secretary of the Testing council
1. Standards for examiners who are in the
People's Public Security force
a) Examiners must be officers of the People's
Public Security;
b) Examiners must have been holding driving
licenses of the corresponding categories for at least 03 years. The licenses
must have positive scores and be unexpired;
c) Examiners must have been trained by the
Department of Traffic Police in testing procedures, have passed the
requirements, and been granted the examiner cards. The examiner cards are valid
for a maximum of 3 years and below the validity period of the examiners'
driving licenses of the corresponding categories that they are in charge.
2. Standards for secretaries: Secretaries are
officers of the People's Public Security force working in the field of testing
and issuance of driving licenses, and holding examiner cards.
Article 8. Training,
inspection, and issuance, renewal, re-issuance and revocation of examiner cards
of the People's Public Security force
1. Implementation of training
a) The Department of Traffic Police shall
organize trainings for issuance of examiner cards based on the actual situation
or at the request of the Divisions of Traffic Police.

The Department of Traffic Police shall receive,
make decision on organization of trainings attached to the list of eligible
officials, and organize the trainings
2. Content of the training
a) Training on theory and professional
The conduct of examiners when performing their
duties and communicating.
The system of legislative documents, standards,
regulations, procedures, professional guidelines related to driving tests
including duties and powers of the Testing council and examiners; procedures
for theory tests, simulation, practical tests on driving training yard and
roads.
General knowledge on components, operation
principles of automatic marking devices and methods for checking testing
equipment including: testing vehicles, supporting equipment, automatic marking
devices; methods for assurance of safety for the tests; guidelines for using
the software related to automatic marking devices; methods for grading tests
for different vehicle categories by multiple-choice and automatic format,
grading for ethnic minorities who are not literate in Vietnamese; methods for
assisting examinees in steering during practical test on roads;
b) Practical training at the driving test
centers
Trainees shall participate in the following
content of professional training for examiners at driving test centers:
checking supporting equipment and automatic marking device; practicing duties
of examiners during theory tests, simulation tests, practical tests on driving
training yard and roads; practicing driving skills and assisting steering wheel
skills during practical test on roads; handling hypothetical scenarios for
technical issues during the tests.

4. Methods for training and examination:
large-scale training and examination.
5. Instructors of the training and examination
are officials of the Department of Traffic Police in charge of driving tests
and issuance of driving licenses.
6. Issuance of examiner cards: Trainees passing
all required examinations are eligible for issuance of examiner cards; in the
case where a trainee does not meet the requirements in one of the examinations,
they must participate in the next training session to retake the examination
and obtain the examiner card.
7. Examiner cards are eligible for renewal when
the information on the cards is wrong, invalid, or damaged.
8. Examiner cards are eligible for re-issuance
when they are lost.
9. Examiner cards are revoked when they are
issued to ineligible entities or ultra vires.
Article 9. Preparation for
driving tests
1. Receipt of dossier
a) Dossier of examinees proposed by driving
training facilities shall be sent to the Divisions of Traffic Police at least
07 working days before the testing;

2. Review of dossier
a) When receiving the dossiers for driving tests
for issuance of driving licenses, the Divisions of Traffic Police shall review,
compare the conditions of examinees in accordance with Articles 15 and 16 of
this Circular; approve the dossiers of examinees, make records on review of
dossiers in accordance with Form No. 01 in Appendix VIII attached to this
Circular, and notify the testing time and locations to the applicants; report
to the Directors of the Police Departments for issuance of decision on
organization of driving test; notify and instruct applicants to complete the
dossiers in case of ineligible dossiers in accordance with the law;
b) If the examinees participating in driving
test for categories A1 driving licenses are ethnic minorities and not literate
in Vietnamese, the dossiers for driving test must include a confirmation
thereof from the People's Committees of communes;
c) If the examinees fail and want to retake the
tests, the Divisions of Traffic Police shall review, compare to the record of
absent and failed examinees from the previous Testing council. If examinees'
names are not on the record, they are not eligible for retake the tests.
3. The Divisions of Traffic Police shall review
and propose the list of examinees based on the number of examinees.
4. The Divisions of Traffic Police shall report
to the Directors of the Police Departments for issuance of issuance of decision
on organization of driving test in accordance with Form No. 04 in Appendix VIII
attached with the list of examinees for issuance of driving licenses in
accordance with Form No. 06 in Appendix VIII, the list of examinees with
invalid driving licenses for issuance driving licenses in accordance with Form
No. 05 in Appendix VIII attached to this Circular.
5. At least 02 working days before the testing,
the Divisions of Traffic Police shall notify the Department of Traffic Police,
driver training facilities, driving test centers, examinees on decision on
organization of the testing via Public service portal, electronic
identification accounts, or other suitable methods.
Article 10. Procedures for
organization of driving tests
1. Meeting of the Testing council and opening
ceremony of the testing

b) Organize the opening ceremony of the testing
to announce the decision on organization of the testing and inform relevant
information to the examinees.
2. Organization of the testing in accordance
with forms, content and procedures for driving tests prescribed in Article 4
and Appendices II, III, IV, V and VI attached to this Circular.
3. Ending of the testing
The President of the Testing council shall organize
a meeting of the council, the supervising team (if any), secretary of the
council to report on the result of the testing. Based on the record on
consolidation of the results of the testing of members of the Testing council,
the President shall approve, sign and affix seal on the records on
consolidation of the results of the testing of examinees in accordance with
Appendix IX attached to this Circular;
The record on consolidation of the results of
the testing of examinee is the original document and sent to the successful
examinees for self-preservation. The Divisions of Traffic Police shall
integrate the record on consolidation of the results of the testing of
examinees to the information system on driver tests, issuance of driving
licenses
Article 11. Supervision of
the driving tests
1. Based on the actual situation, the Department
of Traffic Police shall establish a supervising team to supervise the testing.
2. Components of the supervising team:
a) Officials of the Department of Traffic Police
in charge of management of driving tests, issuance of driving licenses, holding
valid rank-B examiners, having at least 03 years of experience in driving test,
issuance of driving licenses;

c) The minimum number of supervisors for
motorcycle driving tests is 02 people, and for automobile driving tests is 03
people
3. When supervising the tests, supervising officials
shall wear People's Public Security uniform.
4. Duties of the supervising team during the
testing
a) Supervise the implementation of testing
content and procedures of the Testing council to ensure transparency,
objectivity, and clarity of the testing;
b) Supervise the identification check of
examinees before they enter the room for theory test, or perform practical
tests on driving training yard or on roads; prevent anyone without duties to
enter the room for theory test;
c) Supervise the organization of practical test
on roads, the standards of the road where the testing takes place;
d) Work independently without assuming the
responsibilities of the examiners;
dd) Supervise the preparation of question papers
for theory test in accordance with the law, ensure that there is no cheating
during the practical tests on driving training yard as prescribed in clause 2
Article 5 of this Circular.
5. Powers of the supervising team

b) In cases of serious violations related to the
content, procedures of testing, and results, the supervising team must prepare
a record and report to the Director General of the Department of Traffic Police
to request the Directors of the Police Departments of provinces for
consideration and handling.
6. At the end of the testing, the supervising
team shall report the results of supervision in writing to the Director General
of the Department of Traffic Police.
Article 12. Recognition of
driving test results
c) Examinees who pass one of
the tests may reserve their qualified results within 01 year from the date on
which they pass the test. If they wish to retake the remaining tests, they must
have their names included in the record of absent and failed examinees of the
previous Testing council, an unexpired health certificate, or have their names
included in the information system for driving tests.
2. Recognition of results of examinees of
categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE
a) Examinees are recognized as qualified when
they pass all of the following tests: theory test, traffic situation simulation
test, practical tests on driving training yard and on roads;
b) Examinees who pass one of the following
tests: theory test, traffic situation simulation test, practical tests on
driving training yard and on roads may reserve their qualified results within
01 year from the date on which they pass the tests. If they wish to retake the
remaining tests, they must have an unexpired health certificate, have their
names included in the record of absent and failed examinees of the previous
Testing council, or have their names included in the information system for
driving tests;
c) If an examinee fails one of the tests
prescribed in point a of this clause, he/she is allowed to participate in the
remaining tests.
3. Within 02 working days from the end of the testing,
the Divisions of Traffic Police shall review, consolidate the results, send
information of qualified examinees to the Department of Traffic Police for
issuance of driving licenses, and report the results of the testing to the
Directors of the Police Departments.

5. Examinees who fails the testing may register
for retaking at the authorities as prescribed in point b clause 1 Article 9 of
this Circular.
Article 13. Driving tests
for people with disabilities
1. Testing for issuance of category A1 driving
licenses for operating motorized tricycles
a) Examinees shall participate in theory and
practical test on driving training yard in accordance with content and
procedures in clauses 1 and 2 Article 4 and Appendix III attached to this
Circular. They shall take the tests at driving test centers or qualified
motorcycle driving training yards under the direct grading of two examiners;
b) Testing diagrams in accordance with the
National technical regulation on road motor vehicles driving test center.
2. Testing for issuance of category B driving
licenses for operating automobiles with automatic transmissions
a) Testing for issuance of category B driving
licenses for operating automobiles with automatic transmissions for people with
disabilities in their right foot, right hand, or left hand: Examinees shall
fully participate in tests in accordance with content and procedures in Article
4 of this Circular. They shall take the tests at driving test centers. There
are two examiners sitting on testing vehicles to directly grade practical tests
on driving training yard and on roads;
b) Testing for issuance of category B driving
licenses for operating automobiles with automatic transmissions for people with
other disabilities: Examinees shall fully participate in tests in accordance
with content and procedures in Article 4 of this Circular and take the tests at
driving test centers.
Article 14. Testing for
issuance of category A1 driving licenses for ethnic minorities who are not
literate in Vietnamese

2. The testing is organized separately. The
theory test shall be conducted in an oral question-and-answer format combined
with multiple-choice paper tests. The exam time is 30 minutes. 02 examiners
shall perform the duties and examine each examinee in turn. Each examinee shall
pick 01 random set of questions. 01 examiner shall read the question and
supervise the examinees while the other one shall tick in the boxes of
corresponding answers of examinees. The examiners shall grade, sign in the theory
tests and record on consolidation of testing results, and notify the results to
the examinees. If the testing is conducted through a interpreter, the
interpreter shall translate accurately translate all examiners' questions and
the examinees' answers. The interpreter might be hired by the driver training
facilities or the examinees.
3. 3. Examinees shall sign or put their
fingerprints in the record on consolidation of testing result, theory test
paper, and the record on practical test on driving training yard.
Article 15. Examinees
1. 1. Examinees must satisfy age requirements
(as the date of the driving test) and health requirements in accordance with
clauses 1 and 2 Article 59 of the Law on Road Traffic Order and Safety.
2. 2. The driver training facilities shall
recognize the completion of driver training course, or issue preliminary
certificates or training certificates to the examinees.
Article 16. Dossier for
driving test
1. The dossier for driving test submitted by the
driver training facilities includes a request for organization of testing
according to Form No. 02 of Appendix VIII attached with the list of examinees
according to Form No. 03 of Appendix VIII attached to this Circular, and
dossiers for driving test of individuals in accordance with points b, c and d,
clause 2 of this Article.
2. Dossier for driver test submitted by
individuals to the Divisions of Traffic Police
a) Request for driver test for issuance of
driving licenses in accordance with Appendix I attached to this Circular;

c) Unexpired health certificate issued by a
medical facility that complies with the law on medical examination and
treatment;
d) Copies, certified electrical copies, copies
issued from the original documents of one of the following papers: permanent
residence card, temporary residence card, diplomacy identification, public
affair identification (for foreigners).
3. Dossier for driver test in following cases:
expired driving licenses, and lost and expired driving licenses submitted by
individuals at the Divisions of Traffic Police
a) Request for driver test for issuance of
driving licenses in accordance with Appendix I attached to this Circular;
b) Copies, certified electrical copies, copies
issued from the original documents of one of the following papers: permanent
residence card, temporary residence card, diplomacy identification, public
affair identification (for foreigners).
c) Military driving licenses issued by the
Ministry of National Defense or certification of issued authorities in case of
lost driving licenses (for military driving licenses issued by the Ministry of
National Defense)
d) Unexpired health certificate issued by a
medical facility that complies with the law on medical examination and
treatment;
dd) Copies of proof of discharge from the People's
military forces, People's Public Security forces (for military driving licenses
issued by the Ministry of National Defense or driving licenses of People's
Public Security forces)
Article 17. Storage of
dossiers of testing results

a) Decision on organization of driving test;
b) List of examinees;
c) Record on review of examinees' dossiers;
d) Report, proposal of organization of driver
test attached with the list of examinees; Report on review and proposal of the
list of examiners;
dd) Record on assignment of duties of the
Testing council;
e) Record on consolidation of the results of the
testing;
g) The list of passed, absent, failed examinees
of all tests.
2. The driver training facilities having the
training yard used for motorcycle testing shall store data on supervising the
testing; results of theory test and practical test on driving training yard in
03 years, except for cases prescribed in clause 2 Article 5 of this Circular.
3. The driving test centers shall store the
following dossiers of the testing:

b) Data on supervising the testing; results of
theory test, practical test on driving training yard, practical test on roads,
and data of traffic situation simulation software;
c) List and results of traffic situation
simulation test.
4. 4. The examinees shall self-preserve the
record on consolidation of testing results.
5. Time limit for storing dossiers
a) 05 years for documents prescribed in clause 1
of this Article;
a) 02 years for documents prescribed in point b
clause 3 of this Article;
6. The Department of Traffic Police shall
instruct the Divisions of Traffic Police to implement digitalize and store
dossiers of testing results.
Chapter III
ISSUANCE, RENEWAL,
RE-ISSUANCE, AND REVOCATION OF DRIVING LICENSES

1. The Department of Traffic Police shall manage
the issuance, renewal, re-issuance of driving licenses nationwide; provide
template, materials for printing driving licenses for the Divisions of Traffic
Police. The Divisions of Traffic Police shall print and issue driving licenses
according to the template prescribed in Appendix X attached to this Circular.
2. The driving license made of PET material
(hereinafter referred to as "PET driving license") is issued to each
individual with a unique management number, which is used for both the
unlimited and limited-term driving licenses.
3. If anyone wishes to integrate data of
unlimited-term driving license with unlimited driving license, they shall
register for renewal of driving licenses as prescribed in Appendix XII attached
to this Circular, carry out procedures for driving licenses as prescribed in
Articles 21, 22 and 23 of this Circular.
4. Holders of driving licenses are only allowed
to operate categories of vehicles prescribed in the driving licenses.
5. When upgrading driving licenses, the
Divisions of Traffic Police shall collect old driving licenses and destroy them
in accordance with the law on storage.
6. Holders of category B driving licenses are
not allowed to operate manual transmission automobiles
7. If foreigners or Vietnamese residing overseas
wishes to operate vehicles in Vietnam, they shall implement as follows:
a) If they have national driving license, they
shall apply for transfer to the corresponding driving licenses of Vietnam
b) In cases where an international agreement on
driving license to which Vietnam is a signatory prescribes otherwise, such
international agreement shall be applied.

Article 19. Issuance of
driving licenses
1. The Department of Traffic Police shall issue
driving licenses for qualified examinees within 07 working days from the last
day of the testing. eDL is integrated into the information system, eID within
03 working days from the last day of the testing.
2. Issuance of driving licenses for holders of
expired automobile driving licenses of all categories; lost and expired
automobile driving licenses including military driving licenses issued by the
Ministry of National Defense and driving licenses of People's Public Security
of people who are no longer performing national defense and security duties
shall be implemented as follows:
a) Holders of driving licenses prescribed above
must have their names included in the information system on driving licenses of
the Department of Traffic Police or the list of people issued with driving
licenses. If military driving licenses issued by the Ministry of National
Defense are lost with certification of issued authorities, holders must
participate in the following tests:
If the driving license has been expired less
than 01 month but the holder is not able to apply for renewal of the license
due to sickness, natural disasters, epidemic, the holder are exempt from the
theory test. If the driving license has been expired less than 01 year, the
holder must take the theory test as prescribed in point a clause 1 Article 4 of
this Circular.
If the driving license has been expired more
than 01 year, the holder must take the theory test, practical tests on driving
training yard and on roads as prescribed in clauses 1, 2, 3, Article 4 of this
Circular.
The dossier for driving test shall be in
accordance with clause 3 Article 16 of this Circular;
b) If holders of driving licenses prescribed in
point a of this clause wish to review the knowledge, they may register at the
driver training facilities or driving test centers;
b) If holders of driving licenses prescribed in
point a of this clause fail the tests, they may register at the Divisions of
Traffic Police for a retake;

Article 20. Re-issuance of
driving licenses
1. Holders of lost but unexpired driving
licenses are allowed to apply for re-issuance of driving licenses. Re-issuance
of lost driving licenses shall be in accordance with clauses 2, 3, 4, Article
21 of this Circular.
2. Driving licenses shall not be re-issued in
the following cases: the information of driving licenses are not on the
information system on driving licenses of the Department of Traffic Police or
the list of people issued with driving licenses; people who have violated road
traffic order and safety regulations and have not resolved and handled
administrative violations in the field of road traffic order and safety as
required by competent authorities.
Article 21. Renewal of
driving licenses
1. Requirements for renewal of driving licenses
a) Vietnamese, foreigners taking driving tests
for issuance of driving licenses in Vietnam;
b) Holders of damaged driving licenses, which
are no longer usable;
c) Vietnamese, foreigners who have permanent
residence card in Vietnam and Vietnamese driving licenses transferred from
foreign driving licenses, wish to renew driving licenses when they are expired;
d) If the date of birth, full name, nationality,
place of birth, and residence address on the driving license do not match the
information on the citizen identification card or ID card, the competent
authority shall proceed to replace a new driving license with information
matching with the citizen identification card or ID card.

Driving licenses shall not be renewed in the
following cases: the holders are not holding issued driving licenses, the
information of driving licenses are not on the information system on driving
licenses of the Department of Traffic Police or the list of people issued with

medical facility that complies with the law on medical examination and treatment
(except for holders of categories A1, A, B1 driving licenses);
c) Unexpired passport (for foreigners and
Vietnamese residing overseas);
d) Other documents as prescribed in points d
clause 1 of this Article;
3. Implementation procedures
a) Individuals prepare a set of dossier as
prescribed in clause 2 of this Article, and directly submit to the
commune-level police forces of the locations of receipt of driving licenses, or
submit to the Divisions of Traffic Police, or submit via public services portal.
If the applicant submit the dossier directly,
he/she shall take portrait photo at the place of receipt of driving license and
pay the fee after the dossier is received.

b) The Divisions of Traffic Police or
commune-level police forces shall review the dossiers and search information
about the driving licenses from the information system on driving licenses. In
cases where there is no existing information, a written request for
verification of the issued driving license must be submitted using Form No. 01
in Appendix XI issued with this Circular (the request will not be processed
until the verification results for the driving license are obtained); search the
database on road traffic order and safety, or violations of drivers by eIDs.
If the driving license is ineligible for
renewal, the applicant shall be notified. If the dossier does not comply with
the regulations, the applicant shall be instructed to supplement or amend the
dossier within 02 working days from the receipt of dossier.
The Divisions of Traffic Police or commune-level
police forces shall input the information into the computer; print the
appointment slip, or send appointment information about returning the results
through public services portal;
c) Within 01 working days from the receipt of
valid dossier, the Divisions of Traffic Police shall transfer the data to the
Department of Traffic Police for management. The Department of Traffic Police
shall issue driving licenses, and integrate information on the driving licenses
into the database and eID within 03 working days from the receipt of valid
dossier. The Divisions of Traffic Police shall print and return the driving
licenses within 05 working days from the receipt of valid dossier;
d) The return of driving license shall be
carried out at the Divisions of Traffic Police or commune-level police forces
or via postal service as requested by the applicants. If the applicants apply
via the public services portal, the driving licenses shall be returned to the
correct applicant. When receiving the driving licenses, the holders shall
return the previous driving licenses to the issuing agencies for destruction in
accordance with the law, except in cases of renewal of driving licenses for
drivers with integrated driving licenses whose driving licenses are currently
suspended.
4. If the holders wish to degrade their driving
licenses, they shall declare according to the Appendix XII attached to this
Circular and take responsibility for the declaration.
Article 22. Replacement of
military driving licenses issued by the Ministry of National Defense
1. 1. Requirements for replacement of military driving
licenses issued by the Ministry of National Defense when a person is discharged
from the military
Holders of unexpired military driving licenses,
damaged but unexpired driving licenses issued by the Ministry of National
Defense wish to replace the driving licenses;

c) Military driving licenses of which
information is erased are not eligible for replacement; people who have
violated road traffic order and safety regulations and have not resolved and
handled administrative violations in the field of road traffic order and
safety.
2. Dossier includes:
a) A request for renewal of driving licenses in
accordance with Appendix XII attached to this Circular;
b) Copies of proof of discharge from the
People's military forces;
c) Unexpired health certificate issued by a
medical facility that complies with the law on medical examination and
treatment;
d) Copies, certified electrical copies,
electrical copies issued from the master register of the unexpired military
driving license.
3. Implementation procedures
a) Individuals prepare a set of dossier as
prescribed in clause 2 of this Article, and directly submit to the Divisions of
Traffic Police or commune-level police forces; he/she shall take portrait photo
at the place of receipt of driving license, present the original of documents
prescribed in point b clause 2 of this Article for comparison, and pay the fee
after the dossier is received.
b) The Divisions of Traffic Police or
commune-level police forces shall review the dossiers, search the database on
road traffic order and safety, or violations of drivers by eIDs. In case of
suspicion, the Divisions of Traffic Police shall issue a written request to the
competent authority under the Ministry of National Defense to verify the
driving license issued in accordance with Form No. 01 in Appendix XI attached
to this Circular. If there is no verification result of the driving license or
if the verification result shows that the driving license was not issued by the
Ministry of National Defense, the driving license shall not be replaced.

requested by the applicants. When receiving the driving licenses, the holders
shall return the previous driving licenses to the issuing authorities for
destruction in accordance with the law.
4. If the holders wish to degrade their driving
licenses, they shall declare in the request for replacement or re-issuance of
driving licenses prescribed in Appendix XII attached to this Circular and take
responsibility for the declaration.

driving licenses is the original dossier including documents prescribed in
clause 2 of this Article and preserved by the holder.
Article 23. Replacement of
military driving licenses of People's Public Security
1. 1. Requirements for replacement of military
driving licenses of People's Public Security when a person is discharged from
the force
a) Holders of unexpired military driving
licenses, damaged but unexpired driving licenses of which information is
included in the information system on driving licenses of the Department of
Traffic Police or the list of people issued with driving licenses wish to
replace the driving licenses;
b) Holders of paper-based driving licenses,
which are not damaged and contain complete information, wish to replace the
driving licenses;

2. Dossier for replacement of driving licenses

a) A request for replacement of driving licenses
in accordance with Appendix XII attached to this Circular;
b) A copy of the driving license in cases where
the information of the driving license is not included in the information

people issued with driving licenses; a commitment in case the driving license
is lost.
c) Copies of proof of discharge from the
People's Public Security forces;
d) Unexpired health certificate issued by a
medical facility that complies with the law on medical examination and
treatment;

a) Individuals prepare a set of dossier as
prescribed in clause 2 of this Article, and directly submit to the Divisions of

Article 24. Replacement of
driving licenses of foreign countries
1. Requirements for replacement of driving
licenses of foreign countries
a) Foreigners residing, studying, working in
Vietnam, who have unexpired national driving licenses and have one of the
following papers: diplomacy identification, public affair identification,
permanent residence card or temporary residence card with duration of more than
03 months, are eligible for replacement of corresponding driving licenses in
Vietnam;
b) Vietnamese people (people holding Vietnamese
nationality), who are issued with national driving licenses during the time
they reside, study, work abroad, are eligible for replacement of corresponding
driving licenses in Vietnam if their national driving licenses are unexpired.
c) Temporary driving licenses of foreign
countries are not eligible for replacement; IDP; expired, erased, damaged
driving licenses of foreign countries of which information is missing for
replacement of driving licenses, or there are discrepancies in identification;
driving licenses of foreign countries not issued by competent authorities;
Vietnamese people with foreign driving licenses who have resided abroad for
less than 03 months and their residency period does not align with the driver
training period of the country that issued the driving licenses.

a) A request for replacement of driving licenses
(Vietnamese and foreigner shall use the Forms prescribed in Appendix XII and
XIII attached to this Circular, respectively);
b) The translation of the foreign driving
license into Vietnamese certified for translation quality by a notary office in
Vietnam, the overseas representative missions of Vietnam where the translator
works, and affixed with a seal on adjoining edges of pages of the translation
and the copy of the driving license;
c) Unexpired health certificate issued by a
medical facility that complies with the law on medical examination and
treatment (except for foreigners who replace their driving license according to
the validity period in their visa or temporary residence card);
d) Copies, certified electrical copies,
electrical copies issued from the master register of one of the following
documents: diplomacy identification, public affair identification, permanent
residence card or temporary residence card with duration of more than 03
months.
3. Implementation procedures
a) Individuals prepare a set of dossier as
prescribed in clause 2 of this Article, and directly submit to the Divisions of
Traffic Police or commune-level police forces; he/she shall take portrait photo
at the place of receipt of driving license, present the original of prescribed
documents (except for the original documents that have been submitted) for
comparison, and pay the fee after the dossier is received;
b) In case there are suspicions regarding the
entry and residence of foreigners in Vietnam, the driving license issuing
authority will submit a written request to the Ministry of Foreign Affairs, the
Immigration Departments, or the Immigration Offices under the Police
Departments of provinces to verify the information.
c) If the dossier is valid, the Divisions of Traffic
Police or commune-level police forces shall input the information into the
computer, and print the appointment slip. If the driving license is not
eligible for replacement, a written respond stating the reason must be
provided;
Within 01 working day from the receipt of valid
dossier including the verification result of the driving license in case of
suspicion, the Divisions of Traffic Police shall transfer data to the
Department of Traffic Police for management. The Department of Traffic Police
shall issue driving licenses, integrate driving licenses into the information
system and the eIDs within 03 working from the receipt of valid dossier.

4. The dossier for replacement of military
driving licenses is the original dossier including documents prescribed in
clause 2 of this Article and foreign driving licenses, and preserved by the
holders.
5. Validity period and categories of vehicles
allowed to operate
a) The validity period of the replaced
Vietnamese driving license for foreigners shall comply with the validity period
stated in one of the prescribed documents in point a clause 1 of this Article.
This validity period shall be in accordance with the validity period of the
foreign driving license but it shall not exceed the validity period specified
in the Vietnamese driving license;
b) The national driving license issued to a
person who holds multiple categories shall be replaced to a Vietnamese driving
license to operate the corresponding categories of vehicles.
Article 25. Revocation of
driving licenses
1. Competent authorities responsible for
issuance of driving licenses shall implement following procedures for
revocation of driving licenses:
a) Within 03 working days from the date of
discovering that a holder of a driving license falling under one of the cases
specified in clause 5 Article 62 of the Law on Road Traffic Order and Safety,
the Director General of the Department of Traffic Police shall issue a decision
to revoke and cancel the driving license including the reasons for revocation
and cancellation, and cancel the integration of the driving license into the
information system and eID.
d) Within 05 working days from the receipt of
decision on revocation of the driving license, the holder shall submit the
revoked license to the Divisions of Traffic Police. The Department of Traffic
Police shall receive and destroy the revoked license in accordance with the
law.
2. Handling cases of revocation of driving
licenses

b) The driving license revoked as prescribed in
point c clause 5 Article 62 of the Law on Road Traffic Order and Safety has no
validity. The authorities managing driving licenses shall update data on the
violation on the information system on driving licenses at the Department of
Traffic Police from the date of discovering of the violation. In addition, it
is not allowed to issue driving licenses to the violator in 05 years from the
date of discovering of the violation. After 05 years from the date of
discovering of the violation, if that person wishes to have his/her driving
license re-issued, he/she shall study and take the tests as in the case of
obtaining a driving license for the first time.
Chapter IV
ISSUANCE AND USE OF
INTERNATIONAL DRIVING PERMITS
Article 26. Template of the
IDP
1. IDP is a booklet with the dimensions of A6
(148 mm x 105 mm), which has security markings, a gray cover, and white pages
inside as prescribed in Appendix XV attached to this Circular.
2. Page 1 (cover page) contains basic
information of the IDP printed in Vietnamese and English; page 2 specifies the
scope of use of the IDP in Vietnamese and English; page 3 contains the driving
information and classification of the IDP in Vietnamese; page 4 is left blank;
page 5 specifies the holder's information and classification of the IDP in
English; page 6 specifies the driver's information and classification of the
IDP in Russian; page 7 specifies the driver's information and classification of
the IDP in Spanish; page 8 specifies the driver's information and
classification of the IDP in French; page 9 specifies the vehicle category in
French.
3. The IDP number consists of the distinguishing
country code for Vietnam in international traffic, which is "VN",
followed by 12 digits representing the national driving license number.
Article 27. Vehicle
categories of the IDP
The vehicle categories of the IDP correspond to
the vehicle categories specified in the national driving license issued by
Vietnam as prescribed in Appendix attached to this Circular.

1. Vietnamese and foreigners holding permanent residence
card and temporary residence card in Vietnam, who have unexpired PET driving
licenses issued by Vietnam, shall implement as follows:
a) Dossier for issuance of the IDP: a) A request
for issuance of the IDP in accordance with Appendix XVI attached to this
Circular and a 3 x 4 cm portrait photo;
b) Procedures for issuance of IDP:
Applicant shall directly send the request to the
Department of Traffic Police or the Divisions of Traffic Police or via public
services portal.
If the applicant directly submit the dossier,
the shall present the original national driving licenses issued by Vietnam,
passport (for foreigners) for authorities to review the accuracy and legality
of the IDP issuance, and pay the fee after the dossier is received. If the
applicant submit the dossier via public services portal, he/she shall declare
information as in the guidelines, take responsibilities for the accuracy and
legality of the declared information and fully pay the fee for via the online
public service payment function and other additional fees based on individual
needs;
The receiving authorities shall input the
information in the computer, print the appointment slip for return of results
after 05 working days from the receipt of valid dossier, or send appointment
information about returning the results through public services portal, take
responsibility to notify directly or in writing or via public services portal
on amendments to the dossiers within 02 working days from the receipt of valid
dossier;
c) Within 01 working day from the receipt of
valid dossier including the verification result of the eID via the system of
identification and electronic authentication, the Divisions of Traffic Police
shall transfer data to the Department of Traffic Police for management and
issuance of driving licenses;
d) The printing and return of driving license
shall be carried out at the Department of Traffic Police or the Divisions of
Traffic Police or via postal service as requested by the applicants.
2. Vietnamese and foreigners holding permanent
residence card and temporary residence card in Vietnam, who have unexpired
driving licenses issued by signatories of international agreement on driving
license to which the Socialist Republic of Vietnam is a signatory, shall
implement as follows:

b) Procedures for issuance of IDP:
The applicant shall directly submit a dossier as
prescribed in point a of this clause to the Department of Traffic Police or the
Divisions of Traffic Police, present the original of the following papers:
national driving licenses issued by signatories of international agreements on
driving license to which the Socialist Republic of Vietnam is a signatory,
passport, temporary residence card or permanent residence card (for foreigners)
for review, pay the fee after the dossier is received.
The receiving authorities shall input the
information in the computer, print the appointment slip for return of results
after 05 working days from the receipt of valid dossier, take responsibility to
notify directly or in writing on amendments to the dossiers within 02 working
days from the receipt of valid dossier;
c) IDP shall be issued within 05 working days
from the receipt of valid dossier. Data shall be transferred to the Department
of Traffic Police for management and issuance of IDP;
d) The printing and return of driving license
shall be carried out at the Department of Traffic Police or the Divisions of
Traffic Police or via postal service as requested by the applicants.
3. IDP shall not be issued in the following
cases:
a) The national driving licenses have been
erased that the necessary information is missing, or have discrepancies in
identification;
b) The national driving licenses are not issued
by the competent authorities in accordance with the law.

2. The IDP recognized by international
agreements to which the Socialist Republic of Vietnam is a signatory shall be
implemented in accordance with those international agreements.

INFORMATION SYSTEM ON
DRIVER TEST, ISSUANCE OF DRIVING LICENSES
Article 30. Requirements
for the information system on driver test, issuance of driving licenses
1. The information system on driver tests at the
driving test centers
a) Manage the following information: the tests,
examinees, data on supervising the tests, results of the tests;
b) Receive information on the tests, eligible
examinees for the tests from the information system on driver test of the
Divisions of Traffic Police;
c) Transfer the results of the tests to the
information system on driver test of the Divisions of Traffic Police and the Department
of Traffic Police;
d) Share the data on supervising the tests with
the information system on driver test of the Divisions of Traffic Police and
the Department of Traffic Police;

e) Ensure regulations on cybersecurity in

2. The information system on driver tests at the
Divisions of Traffic Police
a) Manage the following information: The results
of approving the list of eligible examinees for the tests; tests; examinees
participating in the driving test; data on supervising the tests; test results;
driving license numbers; confirmations of completion of training course; full
names; personal identification numbers; date of birth; nationality; place of
residence; driver training facilities; vehicle categories; training courses;
date of passing the tests; testing agencies; testing locations (driving test
centers or driving training yards used for testing); date of issuance, renewal,
re-issuance of driving license; issuing authorities; driving license
categories; expiry date; driving license template numbers;
b) Create the tests, update information on the
tests and the list of examinees participating in the tests, transfer these
information to the information system of the driving test centers;
c) Be able to receive the data on supervising
the tests from the information system of the driving test centers, be able to
be remotely connected by competent authorities; receive information on
qualified examinees from the information system on driver tests of the
Divisions of Traffic Police, receive the information from the information
system on driving licenses of the commune-level police forces;
d) Be able to transfer information prescribed in
point a of this clause to the information system on driving licenses of the
Department of Traffic Police;
dd) Has the function for issuance, renewal,
re-issuance, revocation of driving licenses; issuance, replacement of military
driving licenses issued by the Ministry of National Defense and driving
licenses of the People's Public Security forces; replacement of driving
licenses of foreigners or Vietnamese residing abroad;
e) Fully and accurately store managed
information, connect, share the data with other relevant information systems;
g) Ensure regulations on cybersecurity in
accordance with the law.

d) Be able to connect, share data with national
public services portal, public services portal of provinces, central-affiliated
cities and other relevant information system for implementation of
administrative procedures related to management of driving licenses and IDP;
dd) Ensure regulations on cybersecurity in accordance
with the law.
4. The information system on driving licenses at
the commune-level police forces
a) Manage the following information: Driving
license numbers; full names; personal identification numbers; date of birth;
nationality; place of residence; date of issuance, renewal, re-issuance of
driving license; issuing authorities; driving license categories; expiry date;
driving license template numbers;
b) Be able to transfer information prescribed in
point a of this clause to the information system on driving licenses of the
Divisions of Traffic Police;
c) Be able to receive information prescribed in
point a of this clause from the applicant for renewal of driving licenses;

Article 31. Principles and
methods for using the data on the information system on driver tests, issuance
of driving licenses
1. Principles for using the data
a) The use of data on driver tests, issuance of
driving licenses shall be in accordance with the laws on information technology
and cybersecurity;
b) Authorities in charge of management of the
information system on driving licenses as prescribed in Articles 35 and 36 of
this Circular and the commune-level police forces are responsible to protect
information, personal information in the database on driving licenses on the
Internet in accordance with the law on information technology;
c) The services for use of data on driving
licenses are provided to authorities, organizations, individuals on the
Internet in accordance with the laws on information technology and
cybersecurity.
2. Methods for using the data
a) Direct method: Authorities, organizations,
individuals are allowed to directly use the data on driving licenses on the
website on driving licenses in accordance with regulations on security levels
and decentralization of rights for using data on driving licenses;
a) Indirect method: Authorities, organizations,
individuals who need to use data on driving licenses are provided with
information extracted from the database on driver licenses including the
information on the driving licenses. In cases where required by the competent
authorities, in addition to the information on the driving licenses, additional
information about training, testing, and traffic law violations may also be
provided.

Heads of the authorities and organizations shall
direct the implementation of management of storage of electrical documents as
follows:
1. 1. The time limit for storing data on driver
tests at the driving test centers is at least 05 years.
2. 2. The time limit for storing data on driver
tests, issuance, renewal, re-issuance, revocation of driving licenses at the
Divisions of Traffic Police is at least 50 years.
3. 2. The time limit for storing data on driver
tests, issuance, renewal, re-issuance, revocation of driving licenses at the
Department of Traffic Police is at least 70 years.
Article 33. Procedures for
using data on the information system on issuance of driving licenses
1. Regarding issuance of driving licenses
a) The Divisions of Traffic Police shall use the
data on requesting for driver tests on the information system on driver
training to approve the list of examinees eligible for the tests; create the
list of eligible examinees to participate in the tests based on the decision on
organization of the tests, and send to the driving test centers and driving
training yards used for motorcycle tests in order to cooperate in organization
of the tests; receive the results of the tests transferred by the driving test
centers and driving training yards used for motorcycle tests on the information
system to make a list of examinees qualified for issuance of driving licenses;
a) The driving test centers and driving training
yards used for motorcycle tests equipped with information system for driver
tests shall receive the list of examinees synchronized on the information
system by the Divisions of Traffic Police, and implement procedures for driver
tests on the information system; synchronize the results of the tests into the
information system on driver tests;
c) The Department of Traffic Police shall
receive the data on driving licenses synchronized on the information system by
the Divisions of Traffic Police for management and use of data in accordance
with the law.

b) The commune-level police forces shall receive
the dossiers, review, update, authenticate the dossiers on the information
system on driving licenses, and synchronize the data into the information
system on driving licenses of the Divisions of Traffic Police;
b) The Divisions of Traffic Police shall receive
the dossiers and implement procedures on renewal of driving licenses on the
information system on driving licenses; review, update, authenticate the
dossiers on the information system on driving licenses, and synchronize the
data into the information system on driving licenses of the Department of
Traffic Police;
c) The Department of Traffic Police shall
receive the synchronized data on the driving licenses on the information system
of the Department of Traffic Police for management and use of data in
accordance with the law.
Article 34. Procedures for
using data on the information system on issuance, management of IDP
1. The Divisions of Traffic Police shall receive
the dossiers and implement procedures for issuance of IDP on the information
system on the driving licenses of the Divisions of Traffic Police; review,
update, authenticate the dossiers on the information system on driving licenses
of the Divisions of Traffic Police, and print IDP; review the quality of the
IDP after printed and synchronize the data into the information system on
driving licenses of the Department of Traffic Police.
2. The Department of Traffic Police shall:
a) Receive the data on IDP synchronized on the
information system on driving licenses of the Department of Traffic Police by
the Divisions of Traffic Police for management and use of data in accordance
with the law;
b) If an individual apply for issuance of IDP,
the procedures shall be in accordance with clause 1 of this Article 1.

Article 35.
Responsibilities of the Department of Traffic Police
1. Regarding driver tests
a) Provide professional instructions on
construction of driving test centers and driver tests to ensure nationwide
implementation;
b) Formulate questions; information system on
driver tests, issuance of driving licenses; software for theory tests; software
for traffic situation simulation for driver tests, guidelines for nationwide
implementation, and transfer to the Divisions of Traffic Police and driving
test centers;
c) Formulate the programs, direct, organize
trainings, issue examiner cards nationwide, and store the profile of examiners
in accordance with the law;
d) Announce and update the list of driving test centers
that have been issued or have had their testing licenses revoked on the
website.
2. Regarding issuance, renewal, re-issuance, and
revocation of driving licenses
a) Provide professional instructions on
issuance, renewal, re-issuance, revocation of driving licenses to ensure
nationwide implementation;
b) Provide guidelines and management of the use
of templates of driving licenses;

3. Regarding issuance of IDP
a) Provide professional instructions on issuance
of IDP to ensure nationwide implementation;
b) Provide guidelines and management of the use
of IDP within jurisdiction;
c) Announce, update the list of countries
participating in Vienna Convention annually according to the official announcement
of the United Nations on the website of the Department of Traffic Police;
d) Implement public services on issuance of IDP;
dd) Conduct centralized management of data,
issue driving licenses.
4. Regarding management of the information
system
a) Formulate, upgrade and maintain operations of
the information system on driver tests and issuance of driving licenses of the
Department of Traffic Police; the wholly online public services for renewal of
driving licenses on national public services portal; online public services for
IDP; integrate, share the data on driving licenses at the request of competent
authorities; apply digital transformation for driver tests and issuance of
driving licenses;
b) Provide accounts for the commune-level police
forces and the Divisions of Traffic Police to log in, transfer and use data on
the information system;

5. Regarding inspection
a) Conduct periodic and unexpected inspection on
management of driver tests, issuance, renewal, re-issuance, revocation of
driving licenses, and store dossiers at the local police authorities;
b) Conduct periodic and unexpected inspection on
implementation of driver tests at the driving test centers, handle or report
the competent authorities to handle violations in accordance with the law.
6. The Department of Traffic Police takes
charge, cooperates with the Security Industry Department to design,
manufacture, print general information on the templates of driving licenses and
IDP, and send to the local police authorities.
Article 36.
Responsibilities of the Divisions of Traffic Police
1. Regarding driver tests
a) Deploy networking with local driving test
centers and the Department of Traffic Police;
b) Provide accounts on the information on
supervision of driver tests for the Department of Traffic Police, the Divisions
of Traffic Police sending students to take tests at driving test centers their
jurisdiction, the driving test centers to log in, transfer and use the data.
The data on results of driver tests on the information system is consolidated
in according to the form in Appendix XVII attached to this Circular;
c) Announce the expected schedule, location for
organization of driver test of the next month before the 20th of this month on
the website and national public services portal;

2. Regarding issuance, renewal, re-issuance, and
revocation of driving licenses
a) Receive the dossiers for issuance, renewal,
re-issuance of driving licenses, transfer the data to the Department of Traffic
Police; print and return driving licenses;
b) Provide instructions for the commune-level
police forces to receive the dossiers for renewal, re-issuance of driving
licenses, and transfer the data to the Divisions of Traffic Police;
c) Revoke and cancel the driving licenses when
there is a decision on revocation of driving licenses of the Department of
Traffic Police.
3. Receive dossiers for issuance of IDP,
transfer the data to the Department of Traffic Police; print and return IDP.
4. Regarding management of the information
system
a) Invest, maintain, upgrade the hardware,
software, and data transmission network of the information system on driver
tests and issuance of driving licenses;
b) Operate the information system on driver
tests and issuance of driving licenses;
c) Receive, organize implementation and take
responsibility for the professional applications on the information system on
driver tests and information system on driving licenses;

dd) Use applications on the information system
on the driving licenses to update, handle, use, authenticate, synchronize, and
manage driving licenses;
e) Use data on the information system installed
at the Divisions of Traffic Police and the driving test centers to inspect,
review and provide information to functional units.
5. Conduct periodic and unexpected inspection on
receipt of dossiers for issuance, re-issuance of the driving licenses at the
commune-level police forces.
Article 37.
Responsibilities of the driving test centers
1. Regarding management of driver tests
a) Maintain the infrastructure, testing
equipment, and grading in accordance with the law to conduct accurate and
objective testing; report to the Divisions of Traffic Police, the Department of
Traffic Police when the testing equipment and vehicles are not functioning
properly or are unstable, or when there are changes in the testing equipment and
vehicles to handle promptly.
b) Cooperate and create all necessary conditions
for students to review and for the Testing council to conduct driver tests
conveniently and on schedule;
c) Comply with and coordinate with the competent
authorities in inspecting driving test centers;
d) Announce the fee for driver tests and price
of other services on the websites of the driving test centers.

e) Announce the schedule on the websites of the
driving test centers, store the results of the driver tests in accordance with
clause 3 Article 17 of this Circular;
g) Transfer, share the data on supervision of
driver tests to the Divisions of Traffic Police, the Department of Traffic
Police, store and take responsibility on the accuracy, completeness, and
integrity of the data on supervision of driver tests; ensure safety of
cybersecurity; secure the usernames, passwords, and software access for the
information system on supervision of driver tests of the Divisions of Traffic
Police, the Department of Traffic Police; promptly and accurately provide
information, data on supervision of driver tests to the competent authorities;
h) Receive, use the application for driver
tests, application for traffic situation simulation transferred by the
Department of Traffic Police for driver tests, and application for professional
management transferred by the Department of Traffic Police for implementation
of driver tests.
2. Regarding management of the information
system
a) Invest, maintain, upgrade the hardware,
software, and data transmission network of the information system on driver
tests at the driving test centers;
b) Receive, install, use applications transferred
by the Department of Traffic Police; prohibit interference, installation of
devices, installation of applications that may affect the testing process or
lead to inaccurate results of driver tests.

2. If students register for driver tests at
local police authorities lacking necessary information infrastructure to
implement regulations in clause 5 Article 12 and clause 2 Article 16 of this
Circular, they shall register for retake at the same unit when they fail the
tests. The dossiers of the examinees shall be sent to the Divisions of Traffic
Police by the training facilities. By January 01, 2026, it is required to unify
and comply with the regulations in clause 5 Article 12 and clause 2 Article 16
of this Circular.
3. Examinees who were absent or failed in tests
before the effective date of this Circular may retain the results of their passed
tests in order to register for driver tests after the effective date of this
Circular. They will be issued driving licenses according to the categories of
renewed, re-issued driving licenses as prescribed in clause 3 Article 89 of the
Law on Road Traffic Order and Safety.
Article 39. Implementation
1. The Director General of the Department of
Traffic Police are responsible for monitoring, urging, inspecting, instructing
the implementation of this Circular.
2. Heads of units affiliated to ministerial agencies,
the Directors of the Police Departments of provinces and central-affiliated
cities, and relevant organizations, individuals are responsible for
implementing this Circular.
If there are any difficulties or obstacles
during the implementation of this Circular, police authorities, local
authorities, relevant organizations, individuals shall report to the Ministry
of Public Security (through the Department of Traffic Police) for timely
guidance
