DECREE

AMENDMENTS TO DECREE NO. 116/2020/ND-CP DATED SEPTEMBER 25, 2020 OF THE GOVERNMENT OF VIETNAM ON TUITION SUPPORT AND LIVING ALLOWANCES GRANTED TO PEDAGOGICAL STUDENTS

Pursuant to the Law on Government Organization dated February 18, 2025;  

Pursuant to the Law on Local Government Organization dated February 19, 2025;  

Pursuant to the Law on Education of Vietnam dated June 14, 2019;

Pursuant to the Law on Higher Education dated June 18, 2012; the Law on Amendments to a number of articles of the Law on Education dated November 19, 2018;

Pursuant to the Law on Public Employees dated November 15, 2010; Law on Amendments to the Law on Officials and the Law on Public Employees dated November 25, 2019;

Pursuant to the Law on State Budget dated June 25, 2015;

The Government of Vietnam hereby promulgates the Decree on amendments to Decree No. 116/2020/ND-CP dated September 25, 2020 of the Government of Vietnam on tuition support and living allowances granted to pedagogical students.

Article 1. Amendments to Decree no. 116/2020/ND-CP dated September 25, 2020 of the Government of Vietnam on tuition support and living allowances granted to pedagogical students (hereinafter referred to as “Decree 116”):

1. Amendments to Clause 1 Article 1:

“1. This Decree provides for tuition support and living allowances granted to students attending teacher training majors at universities, academies, colleges, and junior colleges permitted to provide teacher training majors (hereinafter referred to as “teacher training institutions”).”

2. Amendments to Point b Clause 2 Article 1:

“b) People’s Committees of provinces and centrally affiliated cities (hereinafter referred to as “provincial People’s Committees”), teacher training institutions, and relevant agencies, organizations, and individuals.”

3. Amendments to Article 3: 

“Article 3. Determination of teacher training needs and methods for supporting pedagogical students

b) Before June 30 every year, based on the local teacher recruitment needs by levels, learning levels, and training majors and the conditions for ensuring the training quality and capacity of teacher training institutions, the Ministry of Education and Training of Vietnam shall determine and announce the enrolment targets of the following year to teacher training institutions;

c) Before July 5 every year, teacher training institutions shall, based on the targets announced by the Ministry of Education and Training of Vietnam, announce the targets on the web portal of the Ministry of Education and Training of Vietnam and their websites.

2. Methods for supporting pedagogical students

a) Ministries and central and local authorities shall, based on the announced targets of teacher training institutions, grant tuition support and living allowances to pedagogical students by assigning estimates by budget decentralization. Where the local authorities’ needs for teacher sources require commissioning or ordering, commission affiliated teacher training institutions to provide teacher training services or order teacher training services from specific teacher training institutions;

b) Commissioning decisions or teacher training contracts between commissioning or ordering agencies and teacher training institutions must be made based on the needs and plans for teacher training by each year, conformable with the schedule specified in local education and training development plans or local annual and long-term teacher training plans;

c) Unit prices of teacher training services to be commissioned or ordered, determined under Article 4 of Decree 116;

d) Other regulations on commissioning and ordering unprescribed in Decree 116 and this Decree shall comply with Decree No. 32/2019/ND-CP dated April 10, 2019 of the Government of Vietnam.”

4. Amendments to Article 5: 

“Article 5. Estimate preparation, funding sources, and payment of support policies for pedagogical students

a) Funding from the state budget for granting tuition support and living allowances to pedagogical students shall comply with the Law on State Budget, documents guiding the Law on State Budget, relevant laws, and this Decree;

b) Annually, teacher training institutions shall, based on the number of their pedagogical students receiving tuition support and living allowances and the enrolment targets of the Ministry of Education and Training of Vietnam announced for the following year (after deducting the number of commissioning and ordering targets), prepare estimates and send them to superior bodies for summary and report to financial agencies competent to allocate estimates according to the Law on State Budget;

c) Annually, commissioning and ordering agencies shall, based on the support levels prescribed in Article 4 of Article 116, prepare estimates of the training funding for pedagogical students at the same time as the preparation of budget estimates and include them in their budget estimates and submit reports to competent authorities for approval for the funding for payment of tuition support and living allowances granted to pedagogical students through teacher training institutions.

2. Funding sources and payment of support policies for pedagogical students

a) Funding for tuition support and living allowances granted to pedagogical students shall be allocated in the annual state budget estimates for expenditures on education and training at ministries and central and local authorities according to regulations and provided for teacher training institutions through estimate assignment as per regulation;

Where local authorities carry out the commissioning or ordering pedagogical student training, such local authorities shall allocate funding from the local budget to make payments for teacher training institutions’ funding for tuition support and living allowances granted to pedagogical students;

b) After receiving the support funding from competent authorities, teacher training institutions shall pay the living allowances to the deposit accounts at the banks of pedagogical students before the 15th of every month.

3. Compliance with estimates and settlement of funding for tuition support and living allowances granted to pedagogical students prescribed in this Decree shall comply with the Law on State Budget and its guiding documents.

4. Funding for the implementation of policies in this Decree shall be balanced in the estimate of annual state budget expenditures by the current management decentralization.  The central budget shall provide support for the local budget to implement policies under the principles of objective-based support from the central budget to the local budget for the implementation of policies on social security promulgated by competent authorities and applied to each specific period.”

“c) Graduated pedagogical students who are accepted for work in the education sector, continue to be appointed to receive teacher training at a higher level by recruitment agencies, and continue to work in the education sector for a prescribed period according to Point a Clause 2 Article 6 of Decree 116.”

6. Amendments to Clauses 1 and 6 Article 7:

“1. Annually, teacher training institutions shall, based on the targets announced by the Ministry of Education and Training of Vietnam, issue notices to candidates admitted to teacher training majors for them to register for tuition support and living allowances; announce the number and list of admitted students on the web portal of the Ministry of Education and Training of Vietnam and their websites for local authorities to register pedagogical student training commissioning or ordering.

6. The list of pedagogical students receiving tuition support and living allowances and the list of pedagogical students who are local commissioning and ordering subjects shall be announced on the local web portals and websites of teacher training institutions within 5 days after completing the assessment for submission to commissioning and ordering agencies for implementation; such lists shall also be sent to superior bodies for monitoring at the same time.”

7. Amendments to Article 9: 

“Article 9. Recovery of support funding

1. Annually, teacher training institutions shall, based on the training and learning results of pedagogical students, notify the list of students specified in Point c Clause 1 Article 6 to provincial People’s Committees where such students reside or to the commissioning and ordering agencies to notify the recovery of the supported funding to pedagogical students according to Clause 2 Article 8 of Decree 116.

2. Regarding pedagogical students receiving support funding by estimate assignment who are required to reimburse the funding according to Clause 1 Article 6 of Decree 116, provincial People’s Committees where such students reside shall, based on the written confirmations of working time in the education sector following Form No. 02 in the Appendix enclosed with Decree 116 of the pedagogical students, review, monitor, instruct, and notify the recovery of support funding for pedagogical students to sufficiently return the amount subject to reimbursement according to Article 8 of Decree 116 and this Decree before December 30 every year.

3. Regarding pedagogical students receiving funding support by commissioning and ordering who are required to reimburse the funding according to Clause 1 Article 6 of Decree 116, commissioning and ordering agencies shall monitor, instruct, and notify the recovery of support funding for pedagogical students to sufficiently return the amounts subject to reimbursement according to Article 8 of Decree 116 and this Decree.

The time limit for carrying out the obligation to reimburse the support funding is up to 4 years from the receipt of notices of funding reimbursement.

Within the time limit mentioned above, students shall submit the amounts subject to reimbursement to teacher training institutions or commissioning and ordering agencies (regarding students subject to commissioning and ordering) as per regulation.

Where students fail to carry out the reimbursement obligation after the time limit, they shall bear the maximum interest rate applicable to demand deposits prescribed by the State Bank of Vietnam for the deferred payment of the amounts subject to reimbursement.  Where the State Bank of Vietnam does not stipulate any maximum interest rate applicable to demand deposits, students shall bear the interest rate applicable to demand deposits of the Vietnam Joint Stock Commercial Bank for Industry and Trade when carrying out the reimbursement obligation.

5. If pedagogical students required to reimburse the funding according to Clause 1 Article 6 of Decree 116 suffer from at least 61% work capacity reduction as confirmed by competent authorities or die, they shall be exempted from funding reimbursement; if the mentioned pedagogical students are beneficiaries of policies on tuition fee exemption or reduction according to regulations of the Government of Vietnam, they shall be eligible for an exemption from or reduction in the corresponding support funding for tuition fees subject to reimbursement.  Provincial People’s Committees where pedagogical students reside shall, based on the specific conditions of such students, decide on the exemption, reduction, or cancellation of the funding subject to reimbursement for pedagogical students who are policy beneficiaries.

6. Within 5 working days after receiving the amounts subject to funding reimbursement from pedagogical students, teacher training institutions or commissioning and ordering agencies shall return the funding to the state budget according to Decree No. 11/2020/ND-CP dated January 1, 2020 of the Government of Vietnam.

7. Authorities competent to monitor, instruct, and issue notices of funding recovery may file lawsuits against pedagogical students who fail to carry out the reimbursement obligation to the Courts according to the law.”

8. Addition of Clause 3 to Article 10:

“Ministry of Finance of Vietnam shall:

Summarize and request authorities competent to allocate funding to implement policies on tuition fees and living allowances granted to pedagogical students according to this Decree and the budget management decentralization.”

“Article 11. Responsibilities of provincial People’s Committees

1. Allocate budget for the implementation of policies on tuition support and living allowances promptly for pedagogical students according to Decree 116 and this Decree; develop criteria for pedagogical student selection in conformity with their needs.

2. Announce the teacher training needs, commissioning, ordering results with teacher training institutions, recruitment plans, and arrangement of job positions in educational institutions.

3. Pay the funding for the implementation of commissioning decisions and teacher training contracts with teacher training institutions according to Article 4 of Decree 116.

4. Direct and instruct the local implementation of policies on support for pedagogical students according to Decree 116 and this Decree; inspect and supervise the implementation and submit annual reports on the implementation to the Ministry of Education and Training of Vietnam and the Ministry of Finance of Vietnam.

5. Implement or decentralize implementation of the recruitment of graduated pedagogical students and arrange job positions conformable with their training majors in educational institutions according to current regulations on public employee recruitment and use.

6. Provide guidelines on the procedures for monitoring, urging, and issuing notices of the recovery of the funding (subject to reimbursement) for tuition support and living allowances granted to pedagogical students residing in their areas specified in Clause 1 Article 6 of Decree 116 following Form No. 04 in the Appendix enclosed with this Decree and handle cases where reimbursement is not carried out according to the law.

7. Before January 31 every year, prepare reports on the figures of the preceding year concerning the funding for tuition support and living allowances granted to pedagogical students and the funding subject to reimbursement of pedagogical students according to Clause 1 Article 6 of Decree 116 following Form No. 05 in the Appendix enclosed with this Decree and submit them to the Ministry of Education and Training of Vietnam and the Ministry of Finance of Vietnam in person or through postal services.  Reporting figures shall be finalized from January 1 to December 31 of the preceding year.

8. Develop estimates of funding for the implementation of support policies prescribed in this Decree and Decree 116 and include them in annual local budget plans for submission to the Ministry of Finance of Vietnam for summary and presentation to competent authorities for approval.

10. Amendments to Clause 3; addition of Clause 8 to Article 12:

“3. Annually issue notices to provincial People’s Committees where students reside and agencies commissioning and ordering pedagogical student training of the learning and training results and graduation time of pedagogical students, list of graduated students, list of current students subject to reimbursement of funding for tuition support and living allowances due to violations as specified in Clause 1 Article 6 of Decree 116, sources of funding for payment, support amounts, and amounts of reimbursed funding for tuition support and living allowances granted to each student.

8. Transfer the reimbursed funding to the State Treasury for pedagogical students who are required to reimburse funding by budget estimate assignment.”

11. Amendments to Article 13:

“Article 13. Responsibilities of beneficiaries of policies on tuition support and living allowances

1. Comply with the law and intramural regulations and regulations of teacher training institutions; complete training programs as per regulation.

2. After the issuance of graduation recognition decisions, annually, before December 31 of the following year until the year when it is sufficient for eligibility for not having to carry out the obligation to reimburse support funding prescribed in Point a Clause 2 Article 6 of Decree 116, submit reports on their employment status following Form No. 02 in the Appendix enclosed with Decree 116 to provincial People’s Committees (agencies competent to monitor, instruct, and issue notices of funding recovery) where students reside or commissioning and ordering agencies regarding students subject to commissioning and ordering to notify the cancelation or recovery of the support funding.

3. Pedagogical students specified in Clause 1 Article 6 of Decree 116 shall return the supported funding under this Decree to teacher training institutions or commissioning and ordering agencies (regarding students subject to commissioning or ordering) for transfer to the state budget through the State Treasury.

4. Pedagogical students registering tuition support and living allowances shall submit applications for receipt and commitments to reimburse the tuition support and living allowances to teacher training institutions or commissioning and ordering agencies following Form No. 01 in the Appendix enclosed with this Decree.

12. Amendments to specific Forms of the Appendix:

a) Amendments to Form No. 01 of the Appendix;

b) Addition of Forms No. 03, 04, and 05 to after Form No. 02 of the Appendix.

Article 2. Transitional provisions

1. The central budget shall provide support for the local budget to implement policies on support for pedagogical students from the 2021-2022 academic year until the end of the 2024-2025 academic year under the principles of objective-based support from the central budget to the local budget for the implementation of policies on social security promulgated by competent authorities and applied to each specific period.

2. Local authorities that have concluded contracts with training institutions to implement pedagogical student training through bidding shall continue to comply with the concluded contracts.

3. The phrase “hoặc đấu thầu” (or bidding) shall be annulled in Clauses 3, 4, and 5 Article 7 and Clause 4 Article 12 of Decree No. 116/2020/ND-CP dated September 25, 2020 of the Government of Vietnam.

Article 3. Implementation provisions

1. This Decree comes into force as of April 20, 2025 and is applicable from the 2025-2026 academic year.
