NGHỊ QUYẾT

QUY ĐỊNH MỘT SỐ ĐIỂM THI HÀNH HIẾN PHÁP NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM

Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam;

Theo đề nghị của Ủy ban thường vụ Quốc hội;

QUYẾT NGHỊ:

Điều 1.

Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam được Quốc hội khóa XIII, kỳ họp thứ 6 thông qua ngày 28 tháng 11 năm 2013, được công bố chậm nhất là mười lăm ngày, kể từ ngày thông qua.

Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam có hiệu lực từ ngày 01 tháng 01 năm 2014.

Điều 2.

1. Quốc hội và các cơ quan của Quốc hội khóa XIII tiếp tục hoạt động cho đến khi Quốc hội khóa XIV họp kỳ thứ nhất.

Chủ tịch nước, Chính phủ, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước tiếp tục hoạt động cho đến khi Quốc hội khóa XIV bầu ra các cơ quan mới theo quy định của Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam.

Hội đồng nhân dân, Ủy ban nhân dân tiếp tục hoạt động cho đến khi Hội đồng nhân dân, Ủy ban nhân dân được thành lập theo quy định của Luật tổ chức chính quyền địa phương phù hợp với Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam.

2. Các cơ quan nhà nước quy định tại khoản 1 Điều này thực hiện chức năng, nhiệm vụ, quyền hạn của mình được quy định trong Hiến pháp, kể từ ngày Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam có hiệu lực.

Những công việc đang được cơ quan nhà nước giải quyết theo quy định của Hiến pháp năm 1992 mà thẩm quyền này được giao cho cơ quan nhà nước khác thực hiện theo quy định của Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam thì phải chuyển giao cho cơ quan nhà nước đó để tiếp tục giải quyết, kể từ ngày Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam có hiệu lực.

Điều 3.

1. Các luật, pháp lệnh và các văn bản quy phạm pháp luật khác được ban hành trước ngày Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam có hiệu lực phải được rà soát lại để sửa đổi, bổ sung hoặc ban hành mới phù hợp với Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam.

2. Việc sửa đổi, bổ sung Luật tổ chức Quốc hội, Luật tổ chức Chính phủ, Luật tổ chức Tòa án nhân dân, Luật tổ chức Viện kiểm sát nhân dân, Luật Kiểm toán nhà nước, Luật bầu cử đại biểu Quốc hội, Luật bầu cử Hội đồng nhân dân và ban hành mới Luật tổ chức chính quyền địa phương phải được trình Quốc hội xem xét, thông qua chậm nhất vào kỳ họp thứ 10 (tháng 10 năm 2015).

Điều 4.

1. Ủy ban thường vụ Quốc hội, Chủ tịch nước, Chính phủ, Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước và các cơ quan hữu quan khác của Nhà nước trong phạm vi chức năng, nhiệm vụ, quyền hạn của mình có trách nhiệm tổ chức thi hành Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam; kịp thời sửa đổi, bãi bỏ các văn bản trái với Hiến pháp; điều chỉnh lại cơ cấu tổ chức, chức năng, nhiệm vụ, quyền hạn phù hợp với quy định của Hiến pháp; triển khai các biện pháp cần thiết nhằm đảm bảo thi hành Hiến pháp.

2. Các cơ quan nhà nước ở trung ương và địa phương, Mặt trận Tổ quốc Việt Nam, các tổ chức thành viên của Mặt trận và các cơ quan, tổ chức hữu quan khác có trách nhiệm tổ chức tuyên truyền, phổ biến sâu rộng nội dung của Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam tại cơ quan, tổ chức và địa phương mình, nâng cao nhận thức về Hiến pháp và ý thức chấp hành Hiến pháp, bảo đảm Hiến pháp được tuân thủ và nghiêm chỉnh chấp hành trong tất cả các lĩnh vực của đời sống xã hội.

Nghị quyết này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XIII, kỳ họp thứ 6 thông qua ngày 28 tháng 11 năm 2013.

RESOLUTION

ON THE IMPLEMENTATION OF THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM

Pursuant to the Constitution of the Socialist Republic of Vietnam;

At the proposal of the National Assembly Standing Committee,

RESOLVES:

Article 1.

The Constitution of the Socialist Republic of Vietnam which was passed on November 28, 2013, by the XIII^th National Assembly, at its 6th session shall be promulgated within 15 days after its passage.

Article 2.

1. The XIII^th National Assembly and its agencies shall continue operating until the XIV^th National Assembly holds its 1^st session.

The President, the Government, the Supreme People’s Court, the Supreme People’s Procurary and the State Audit Office shall continue operating until the XIV^th National Assembly elects new agencies under the Constitution of the Socialist Republic of Vietnam.

The People’s Councils and the People’s Committees shall continue operating until new ones are established under the Law on Organization of Local Administrations in conformity with the Constitution of the Socialist Republic of Vietnam.

2. The state agencies specified in Clause 1 of this Article shall perform the functions and tasks and exercise the powers defined in the Constitution from the effective day of the Constitution of the Socialist Republic of Vietnam.

For affairs that are currently settled by a state agency according to its competence prescribed in the 1992 Constitution but this competence is assigned to another state agency under the Constitution of the Socialist Republic of Vietnam, these affairs must be transferred to the latter for continued settlement from the effective day of the Constitution of the Socialist Republic of Vietnam.

Article 3.

1. Laws, ordinances and other legal documents which have been promulgated before the Constitution of the Socialist Republic of Vietnam takes effect must be reviewed for amendment, supplementation, or promulgation of new ones in conformity with the Constitution of the Socialist Republic of Vietnam.

2. Amendments and supplements to the Law on Organization of the National Assembly, the Law on Organization of the Government, the Law on Organization of the People’s Courts, the Law on Organization of the People’s Procuracies, the Law on the State Audit, the Law on Election of Deputies to the National Assembly and the Law on Election of Deputies to the People’s Councils, and the new Law on Organization of Local Administrations must be submitted to the XIII^th National Assembly for consideration and approval at its 10^th session at the latest (October 2015).

1. The National Assembly Standing Committee, the President, the Government, the Supreme People’s Court, the Supreme People’s Procurary, the State Audit Office and other concerned state agencies shall, within the scope of their functions, tasks and powers, organize the implementation of the Constitution of the Socialist Republic of Vietnam; timely revise or annul documents which are contrary to the Constitution; adjust their organizational structure, functions, tasks and powers in conformity with the Constitution; and take necessary measures to ensure the implementation of the Constitution.

2. Central and local state agencies, the Vietnam Fatherland Front and its member organizations and other concerned agencies and organizations shall widely disseminate the contents of the Constitution of the Socialist Republic of Vietnam at their agencies or organizations or in their localities for raising awareness of the Constitution and the sense of observance of the Constitution, ensuring that the Constitution is obeyed and strictly implemented in all fields of social life.

This Resolution was adopted on November 28, 2013, by the XIII^th Assembly of the Socialist Republic of Vietnam.-
