DECREE

ELABORATION ON THE LAW ON EMULATION AND COMMENDATION

Pursuant to the Law on Organization of the Government of Vietnam dated June 19, 2015; the Law on Amendments to the Law on Organization of the Government of Vietnam and the Law on Organization of the Local Government of Vietnam dated November 22, 2019;

Pursuant to the Law on Emulation and Commendation dated June 15, 2022;

At the request of the Minister of Home Affairs of Vietnam;

The Government of Vietnam hereby promulgates a Circular on elaboration on the Law on Emulation and Commendation.

This Decree elaborates on Clause 5 Article 11; Clause 2 Article 12; Clause 2 Article 14; Clause 4 Article 25; Clause 7 Article 34; Clause 6 Article 35; Clause 5 Article 36; Clause 5 Article 37; Clause 5 Article 38; Clause 4 Article 39; Clause 4 Article 40; Clause 4 Article 41; Clause 7 Article 42; Clause 7 Article 43; Clause 7 Article 44; Clause 3 Article 45; Clause 3 Article 46; Clause 3 Article 47; Clause 2 Article 51; Clause 2 Article 53; Clause 5 Article 79; Clause 3 Article 81; Clause 3 Article 82; Clause 7 Article 83; Clause 7 Article 84; Clause 2 Article 85; Clause 5 Article 90; Clause 9 Article 93 of the Law on Emulation and Commendation (hereinafter referred to as "Decree").

Article 2. Regulated entities

This Decree applies to Vietnamese individuals, state authorities, political organizations, socio-political organizations, social-vocational political organizations, social organizations, socio-vocational organizations, enterprises, other economic organizations, people's armed forces, households; Vietnamese individuals and collectives residing abroad; foreign individuals and collectives; foreign agencies, organizations, and international organizations in Vietnam.

Article 3. Interpretation of terms

For the purpose of this Decree, the following terms shall be construed as follows:

1. State commendation forms: Order, Medal, State Honorable Title, Ho Chi Minh Prize, State Award, and Diploma of Merit of the Prime Minister of Vietnam.

2. State emulation titles: Government Emulation Flag and National Emulation Fighter.

3. Irregular achievements refer to achievements gained outside programs, plans, or tasks that relevant individuals or collectives must undertake or are assigned.

4. Irregularly outstanding achievements refer to irregular achievements gained at an outstanding level when bravely saving people, saving property of the People or the State, or in combat or combat services or sectors of social economy, culture, sports, and other sectors in Vietnam, the region, or the world.

Article 4. Principles of assessment for emulation titles and commendation forms

1. Commendation shall be based on conditions, standards, and gained achievements. It is not necessary to have a low-level commendation to receive a commendation at a higher level.

2. Competent authorities shall commend or request superior authorities to award emulation titles and commendation forms to cases with adequate conditions, standards, procedures, and applications as per regulation.

3. Results of irregular achievement commendation and thematic emulation shall not be used for requesting superior authorities to provide commendation.

4. It is mandatory to delay commending or requesting superior authorities to commend individuals or collectives subject to disciplinary action assessment or investigations, inspections, and examinations carried out by relevant authorities due to having signs of violations, being subject to complaints or denunciations, or having issues concerning corruption or negativity specified by the press pending for verification. 

After the disciplinary period of individuals or collectives, if such individuals or collectives gain achievements, commendations shall be provided for achievements gained after the disciplinary period.

5. The maternity leave time of individuals as per regulation shall be determined for assessment for emulation titles and commendation forms.

6. If many individuals or collectives meet the prescribed conditions and standards, female individuals or collectives with a percentage of females of at least 70% shall be selected for commendation assessment.

7. The time of holding a position for assessment for commendation for the contribution processes for female leaders and managers is reduced by 1/3 of the generally prescribed time. If female leaders and managers are eligible for older retirement age, the mentioned time shall comply with the general regulation.

EMULATION TITLES; RECIPIENTS AND STANDARDS OF COMMENDATION FORMS

Section 1. GOVERNMENT EMULATION FLAG

Article 5. Government Emulation Flag

1. The Government Emulation Flag shall be awarded to typically outstanding collectives meeting the standards prescribed in Clause 1 Article 25 of the Law on Emulation and Commendation through emulation clusters and blocks' assessment, comparison, or collection of votes of confidence from their members. Emulation clusters and blocks are organized by ministries, departments, central authorities, or local authorities.

The number of collectives assessed or requested for the Government Emulation Flags as prescribed in Clause 1 of this Article shall not exceed 20% of the total number of collectives leading the emulation clusters and blocks and meeting the standards for emulation flags of ministries, departments, central authorities, and local authorities.

2. Collectives assessed for the award of the Government Emulation Flags under Clause 2 Article 25 of the Law on Emulation and Movement shall meet the following standards:

a) Having outstanding achievement in socio-economic development and assurance of national defense and security;

b) Successfully comply with guidelines of the CPV and policies and laws of the State; developing pure and strong political systems;

c) Successfully carrying out tasks of emulation and commendation.

3. Collectives assessed for the award of the Government Emulation Flags under Clause 3 Article 25 of the Law on Emulation and Movement shall meet the following standards:

a) For the ministerial level: consulting with the Government and Prime Minister of Vietnam on the development of institutions and completion of regulations and policies on the promotion of socio-economic development; innovating contents and forms of the organization of emulation movements and campaigns to mobilize the active participation of relevant union members and members;

b) For the provincial level: gaining outstanding achievements in socio-economic development and maintenance of social security and order; adopting new models and creative ways of doing things with high effectiveness; being the typically outstanding units compared to provinces in emulation clusters organized by the Central Emulation – Commendation Council.

Collectives meeting the standards prescribed in Clause 3 of this Article shall be selected and included in the list to be assessed for commendations by ministries, departments, central authorities, or local authorities; the Ministry of Home Affairs of Vietnam shall receive, summarize, and appraise applications before presenting them to the Prime Minister of Vietnam for assessment and decision. Applications for commendation assessment shall comply with Article 35 of this Decree.

Section 2. RECIPIENTS AND STANDARDS OF COMMENDATION FOR CONTRIBUTION PROCESSES AND HIGH ACHIEVEMENTS

Article 6. General regulation on commendation for contribution processes

1. The working time for assessment for commendation for contribution processes shall be stipulated as follows:

a) Officials participating in revolutionary activities before 1945 refer to people who participated in the revolution before January 1, 1945 and were admitted or re-admitted to the Indochinese Communist Party before August 19, 1945, recognized by competent authorities;

b) Pre-uprising officials refer to people who participated in the revolution from January 1, 1945 to the uprising day in August 1945, recognized by competent authorities

d) Officials operating in the resistance war against French colonialism refer people who continuously participated in the work after the uprising day in August 1945 to July 20, 1954;

dd) Officials operating in the resistance war against American imperialism refer to people who continuously participated in the work in the period after July 20, 1954 to April 30, 1975;

e) People continuously operating on the Southern battlefield refer to people who continuously operated for at least 10 years on battlefields in the South, Laos, and Cambodia. In case of continuous operation on the battlefield from before 1960, the time of continuous operation shall be until January 1973. In case of entering the battlefield from 1964, the time of continuous operation shall be until April 30, 1975;

g) Officials working in the period of Fatherland development and protection refer to people who participated in the work after April 30, 1975;

2. Commendation time and position:

a) Ministries, departments, central authorities, and local authorities shall request the Prime Minister of Vietnam to assess and request the President of Vietnam to commend the contribution processes of individuals who have not been commended for their contribution processes with adequate conditions and standards when there are retirement notifications or decisions (including cases of sacrifice and death). If individuals who have been commended for their contribution processes continue to work and have a time of holding positions of leaders or managers eligible for commendations for contribution processes, they shall continue to be assessed for commendation for their contribution processes for such time and offered other emulation titles and commendation forms as per regulation when they have adequate conditions or standards;

b) An individual with an inadequate time of holding a specific position for eligibility for commendations according to standards prescribed for such a position shall have such time included in the time of holding a lower position adjacent to the mentioned time for assessment for commendation according to the lower position (if the adjacent lower position is included in the standards of commendation for contribution processes);

c) An individual holding many different positions at the same time shall have his/her highest position be the basis for applying commendation standards;

d) Regarding individuals complying with transfer or mobilization requests or organizational arrangements decided by competent authorities that hold lower positions before the transfer, mobilization, or organizational arrangements, during the assessment for commendations, their previous positions and time of holding such positions shall be included in the basis for commendation assessment;

3. Commendation conditions:

a) Commendations shall not be provided for individuals expelled from the CPV or disciplined in the form of dismissal; stripped of titles of military officers or people's public security officers, military ranks of commissioned officers, or professional military ranks. Regarding individuals expelled from the CPV who have rectified their shortcomings, put in effort, and been re-admitted to the CPV, if they meet the prescribed standards, the time and positions after being re-admitted to the CPV shall be used as the basis for commendation assessment;

b) The commendations for individuals expelled from and re-admitted to the CPV and individuals subject to dismissal, demotion, military rank demotion, salary reduction, reprimand, and warning shall be deduced by one level. The form of disciplinary action shall only be applied once to a specific commendation form (following commendations shall not be based on previously imposed disciplinary actions).

4. The Ministry of Home Affairs of Vietnam shall consult with the CPV Organisation Commission and the Inspection Commission of the CPV Central Inspection Commission on officials managed by the Politburo of Vietnam and the Secretariat of Vietnam before requesting the Prime Minister of Vietnam to assess and request the President of Vietnam to provide commendations.

Article 7. Regulation on equivalent titles for assessment for commendation for contribution processes

1. Titles of Minister and equivalents: Official Member of the CPV Central Committee (substitute members shall have their hierarchical positions determined and receive benefits and policies according to their current positions); Heads of CPV Central Authorities; Director of the Ho Chi Minh National Academy of Politics; Editor-in-Chief of the People Newspaper, Editor-in-Chief of the Communist Review; Member of the Standing Committee of the National Assembly of Vietnam (Secretary General, Head of the Office of the National Assembly of Vietnam; President of the Ethnic Council, Heads of Committees of the National Assembly of Vietnam; Head of the Delegates' Working Committee of the National Assembly of Vietnam, Head of the People’s Prayer Committee of the Standing Committee of the National Assembly of Vietnam); Ministers, Heads of ministerial agencies; Head of the Office of the President of Vietnam; Auditor General of the State Audit Office of Vietnam; Heads of central socio-political organizations; Vice President - Secretary General of the Central Committee of the Vietnamese Fatherland Front; Secretaries of provincial committees, central committees, and CPV committees in clusters affiliated to central authorities; Deputy Secretary of the Hanoi Central Committee, Deputy Secretary of the Ho Chi Minh City Central Committee; Presidents of People's Councils and People's Committees of Hanoi City and Ho Chi Minh City; Deputy Head of the Central Inspection Commission; President of the Vietnam Academy of Social Sciences; President of the Vietnam Academy of Science and Technology; President of the Commission for Management of State Capital at Enterprises; Director General of the Vietnam News Agency; Director General of the Voice of Vietnam; Director General of the Vietnam Television.

2. Titles of Deputy Minister and equivalents: Deputy Heads of CPV Central Authorities; Deputy Director of the Ho Chi Minh National Academy of Politics; Deputy Editor-in-Chief of the People Newspaper, Deputy Editor-in-Chief of the Communist Review; Vice President of the Central Committee of the Vietnamese Fatherland Front; Vice President of the Ethnic Council; Deputy Heads of Committees of the National Assembly of Vietnam; Deputy Head of the Office of the National Assembly of Vietnam; Deputy Chief Justice of the Supreme People’s Court of Vietnam; Deputy Head of the Supreme People’s Procuracy of Vietnam; Deputy Ministers and Deputy Heads of ministerial agencies; Deputy Head of the Office of the President of Vietnam; Deputy Auditor General of the State Audit Office of Vietnam; Deputy Heads of central socio-political organizations; Permanent Secretary of the Ho Chi Minh Communist Youth Union Central Committee; Deputy Secretaries of provincial committees, central committees, and CPV committees in clusters affiliated to central authorities; Presidents of People's Councils and Presidents of People's Committees of provinces and centrally affiliated cities; Members of the Central Inspection Commission; Director of the Truth National Political Publishing House; Presidents of mass associations with central-level tasks assigned by the CPV and the State (for organizations with CPV Designated Representations); Assistants of core leaders of the CPV and the State; Permanent Assistant of the Secretariat of Vietnam; Director of the Legislation Research Institute of the Standing Committee of the National Assembly of Vietnam; Director of the Vietnam National University, Hanoi and Director of the Vietnam National University, Ho Chi Minh City; Director General of Vietnam Social Security; Head of the Ho Chi Minh Mausoleum Management Board; President of the National Financial Supervisory Commission; Vice President of the Commission for Management of State Capital at Enterprises; Judges of the Supreme People’s Court of Vietnam and Prosecutors of the Supreme People’s Procuracy of Vietnam.

3. Titles of Director General and equivalents: Director General, Deputy Head of the Delegates' Working Committee, Deputy Head of the People’s Prayer Committee of the Standing Committee of the National Assembly of Vietnam; Vice President of the Vietnam Academy of Social Sciences; Vice President of the Vietnam Academy of Science and Technology; Deputy Director General of the Vietnam News Agency; Secretary of the Ho Chi Minh Communist Youth Union Central Committee; Permanent Members of People's Councils, Permanent Members of Committees of the National Assembly of Vietnam; Permanent Members of Central Sub-Committees for Protection of Internal Politics; Members of the Standing Committees of Hanoi Central Committee and Ho Chi Minh City Central Committee; Full-Time Heads of Delegations of the National Assembly of Vietnam in provinces and centrally affiliated cities; Vice Presidents of People's Councils and People's Committees of Hanoi City and Ho Chi Minh City; Members of the Editorial Board of the People Newspaper; Members of the Editorial Board of the Communist Review; Full-Time Deputy Heads or Full-Time Members of Central Steering Committees and Steering Committees whose Heads are the Prime Minister or Deputy Prime Minister of Vietnam; Assistants of superior leaders of the CPV and the State; Editor-in-Chief of the CPV Online Newspaper; Editor-in-Chief of the People’s Deputies Newspaper; Director of the Vietnam National Assembly Television; Director General of the Government Electronic Information Portal; Deputy Director General of Vietnam Social Security; Deputy Head of the Office of CPV Designated Representation of the Government of Vietnam, Deputy Head of the Office of the CPV Designated Representation of the National Assembly of Vietnam; Full-Time Deputy Secretaries in charge of CPV work in CPV Committees, Office of the CPV Central Committee, Office of the Government of Vietnam, Office of the National Assembly of Vietnam, Ministry of Foreign Affairs of Vietnam, Ho Chi Minh National Academy of Politics, and equivalents according to regulations of committees, CPV organizations, agencies, and units competent to concretize equivalent positions and titles according to management decentralization of officials.

4. Titles of Deputy Director General and equivalents: Deputy Director General; Deputy Director of the Truth National Political Publishing House; Deputy Head of the Legislation Research Institute of the Standing Committee of the National Assembly of Vietnam; Deputy Head of the Ho Chi Minh Mausoleum Management Board; Full-Time Members of the Ethnic Council and Committees of the National Assembly of Vietnam; Members of standing committees of provincial committees, central committees, and CPV committees in clusters affiliated to central authorities; Presidents of Committees of the Vietnamese Fatherland Front in provinces and centrally affiliated cities; Vice Presidents of People’s Councils and People’s Committees of provinces and centrally affiliated cities; Vice President of the National Financial Supervisory Commission; Full-Time Deputy Heads of Delegations of the National Assembly of Vietnam in provinces and centrally affiliated cities; Vice Presidents of mass associations with central-level tasks assigned by the CPV and the State (for organizations with CPV Designated Representations); Presidents of mass associations with central-level tasks assigned by the CPV and the State (for organizations without CPV Designated Representations); Deputy Editor-in-Chief of the CPV Online Newspaper; Deputy Editor-in-Chief of the People’s Deputies Newspaper; Deputy Director of the National Assembly Television; Deputy Director General of the Government Electronic Information Portal; Chief Justice of the Supreme People’s Court of Vietnam; Head of the Supreme People’s Procuracy of Vietnam; Directors of institutes affiliated to the Ho Chi Minh National Academy of Politics and equivalent titles according to regulations of committees, CPV organizations, agencies, and units competent to concretize equivalent positions and titles according to management decentralization of officials.

6. Titles of Deputy Director and equivalents: Deputy Directors, Deputy Heads, and equivalents of CPV departments and agencies; ministries, central authorities, ministerial agencies; Vietnamese Fatherland Front and central socio-political; Deputy Heads of CPV departments and agencies affiliated to provincial committees and central committees; Vice Presidents of Committees of the Vietnamese Fatherland Front in provinces and cities; Secretaries of Members of the CPV Central Committee, ministers and equivalents, and secretaries of provincial committees, central committees, and CPV committees affiliated to central authorities; Deputy Directors and Deputy Heads of agencies, units, and equivalents of governmental agencies; Deputy Directors of departments, Deputy Heads of agencies, divisions, departments, socio-political organizations, and equivalents at the provincial level; Deputy Secretaries of districts, towns, central committees, and CPV committees affiliated to provincial committees and central committees; Presidents of People’s Councils and People’s Committees of districts; Members of committees for inspection of provincial committees and central committees affiliated to central authorities; Deputy Director and equivalents of the Truth National Political Publishing House, deputy heads of agencies and units of the Vietnam National University, Hanoi and the Vietnam National University, Ho Chi Minh City; Deputy Directors and Deputy Heads of agencies and units of general departments and equivalents; Deputy Directors of departments and units of mass associations with central tasks assigned by the CPV and the State (for organizations with CPV Designated Representations); Heads of provincial associations with assigned payrolls.

7. Titles equivalent to members of districts before April 30, 1975 include: Heads of departments and divisions of districts; Deputy Heads of district-level teams; Deputy Secretaries and Deputy Presidents of provincial unions; Members of provincial committees, Members of provincial teams, Members of provincial security forces.

8. Equivalent titles in the People’s Army and People’s Public Security shall comply with the Conclusion of the Politburo of Vietnam on the list of titles and positions of leaders, managers, and commanders in the People’s Army and the People’s Public Security.

Article 8. Gold Star Order

Gold Star Orders shall be awarded or posthumously awarded to individuals satisfying Point a Clause 2 Article 34 of the Law on Emulation and Commendation who do not commit any major defect and meet one of the following standards:

1. Having participated in the revolution from 1935 to before, operated continuously, and assumed one of the following positions: Secretary General of the CPV Central Committee, President of Vietnam, President of the National Assembly of Vietnam, Prime Minister of Vietnam, Member of the Politburo of Vietnam, Secretary of the CPV Central Committee, Vice President of Vietnam, Vice President of the National Assembly of Vietnam, Deputy Prime Minister of Vietnam, President of the Central Committee of the Vietnamese Fatherland Front, Deputy Secretary of the Central Department, Standing Official of the Region-Based Committee, Secretary of the Zone-Based Committee, Head of the CPV Central Department, Minister, and equivalents or having been granted the military rank of Colonel General of the People's Armed Force.

2. Having participated in revolutionary activities before 1945, operated continuously, and assumed one of the following positions: Secretary General of the CPV Central Committee, President of Vietnam, President of the National Assembly of Vietnam, Prime Minister of Vietnam, Member of the Politburo of Vietnam, Secretary of the CPV Central Committee, Vice President of Vietnam, Vice President of the National Assembly of Vietnam, Deputy Prime Minister of Vietnam, President of the Central Committee of the Vietnamese Father Land Front or having been granted the military rank of General in the People’s Armed Force.

3. Having continuously participated in 2 resistance wars against French colonialism and American imperialism and assumed one of the following positions: Secretary General of the CPV Central Committee, President of Vietnam, President of the National Assembly of Vietnam, Prime Minister of Vietnam, or having been granted the military rank of General in the People’s Armed Force before April 30, 1975.

4. Having continuously worked in the resistance war against American imperialism or the period of Fatherland development and protection and assumed one of the following positions: Secretary General; President of Vietnam; Prime Minister of Vietnam; President of the National Assembly of Vietnam, for 2 terms, from 8 to 10 years.

Ho Chi Minh Orders shall be awarded or posthumously awarded to individuals satisfying Point a Clause 1 Article 35 of the Law on Emulation and Commendation who do not commit any major defect and meet one of the following standards:

1. Having participated in the revolution from 1935 to before, operated continuously, and assumed one of the following positions: Secretary or Deputy Secretary of the Provincial Committee, Deputy Head of the CPV Central Department, Deputy Minister or equivalents, or having been granted the military rank of Lieutenant General in the People’s Armed Force.

2. Having participated in revolutionary activities before 1945, operated continuously, and assumed one of the following positions: Head of the CPV Central Department, Member of the Region-Based Committee, Member of the Zone-Based Committee, Minister, or equivalents, or having been granted the military rank of Colonel General in the People’s Armed Force.

3. Having continuously participated in 2 resistance wars against French colonialism and American imperialism and assumed one of the following positions: Member of the Politburo of Vietnam, Secretary of the CPV Central Committee, Vice President of Vietnam, Vice President of the National Assembly of Vietnam, Deputy Prime Minister of Vietnam, President of the Central Committee of the Vietnamese Fatherland Front, or equivalents for 1 term, from 3 to 5 years, or having been granted the military rank of General in the People’s Armed Force.

4. Having continuously worked in the resistance war against American imperialism or the period of Fatherland development and protection and assumed one of the following positions:

Secretary General; President of Vietnam; Prime Minister of Vietnam; President of the National Assembly of Vietnam, for 1 term, from 3 to 5 years.

Permanent Member of the Secretariat of Vietnam; Member of the Politburo of Vietnam; Member of the Secretariat of Vietnam; President of the Vietnamese Fatherland Front; Chief Justice of the Supreme People’s Court of Vietnam; Director of the Supreme People’s Procuracy of Vietnam; Vice President of Vietnam; Deputy Prime Minister of Vietnam; Vice President of the National Assembly of Vietnam for 2 terms, from 8 to 10 years, or having been granted the military rank of General in the People's Armed Force and held it for at least 10 years.

Article 10. First-Class Independence Order

First-Class Independence Orders shall be awarded or posthumously awarded to individuals satisfying Point a Clause 1 Article 36 of the Law on Emulation and Commendation who meet one of the following standards:

2. Having continuously participated in 2 resistance wars against French colonialism and American imperialism and assumed one of the following positions: Head of the CPV Central Department, Minister, or equivalents; Member of the Region-Based Committee, Secretary of the Provincial Committee, Central Committee, or CPV Committee affiliated to central authorities, Member of the Standing Committee of the National Assembly of Vietnam, Heads of central socio-political organizations for 2 terms, from 8 to 10 years; Colonel General of the People’s Armed Force.

3. Having continuously participated in the resistance war against American imperialism or the period of Fatherland development and protection and assumed one of the following positions:

Permanent Member of the Secretariat of Vietnam; Member of the Politburo of Vietnam; Member of the Secretariat of Vietnam; President of the Vietnamese Fatherland Front; Chief Justice of the Supreme People’s Court of Vietnam; Director of the Supreme People’s Procuracy of Vietnam; Vice President of Vietnam; Deputy Prime Minister of Vietnam; Vice President of the National Assembly of Vietnam for 1 term, from 3 to 5 years. General in the People's Armed Force for at least 10 years.

Minister and equivalents for 13 to 15 years; Colonel General of the People’s Armed Forced for at least 10 years.

Article 11. Second-Class Independence Order

Second-Class Independence Orders shall be awarded or posthumously awarded to individuals satisfying Point a Clause 1 Article 37 of the Law on Emulation and Commendation who meet one of the following standards:

1. 3. Having continuously participated in the resistance war against American imperialism or the period of Fatherland development and protection and assumed one of the following positions: Minister and equivalents for 2 terms, from 8 to 10 years; Colonel General of the People’s Armed Force for at least 5 years; Deputy Minister and equivalents for 13 to 15 years.

Article 12. Third-Class Independence Order

Third-Class Independence Orders shall be awarded or posthumously awarded to individuals satisfying Point a Clause 1 Article 38 of the Law on Emulation and Commendation who meet one of the following standards:

1. Having participated in revolutionary activities before 1945, operated continuously, and assumed one of the following positions: Director, Member of the Provincial Committee or Central Committee, Head of the provincial department or division, or equivalents.

2. Having been recognized as pre-uprising officials and assumed one of the following positions: Director, Member of the Provincial Committee or Central Committee, Head of the provincial department or division, or equivalents, or having continuously operated for at least 10 years on the Southern battlefield and assumed the position of Member of the District-Level Committee or equivalents before April 30, 1975.

3. Having continuously participated in 2 resistance wars against French colonialism and American imperialism and assumed one of the following positions: Deputy Head of the CPV Central Department, Deputy Minister or equivalents, Deputy Secretary of the Provincial Committee, Central Committee, or CPV Committee affiliated to central authorities, President of the People’s Council or People's Committees of the province or centrally affiliated city, Vice President of the Central Committee of the Vietnamese Fatherland Front, Deputy Heads of central socio-political organizations for 1 term, from 3 to 5 years.

4. Having continuously participated in the resistance war against American imperialism or the period of Fatherland development and protection and assumed one of the following positions: Minister and equivalents for 1 term, from 3 to 5 years; Colonel General of the People’s Armed Force; Deputy Minister and equivalents for 2 terms from 8 to 10 years.

Article 13. First-Class Military Exploit Order

First-Class Military Exploit Orders shall be awarded or posthumously awarded to individuals satisfying Point a Clause 1 Article 39 of the Law on Emulation and Commendation who have contributions processes of at least 35 years in the People’s Armed Force and assumed one of the following positions: Minister, Deputy Minister, Chief of the General Staff, Head of the General Political Department, or equivalents; General or Colonel General of the People’s Armed Force for at least 5 years.

Third-Class Fatherland Defense Orders shall be awarded or posthumously awarded to individuals satisfying Point d Clause 1 Article 47 of the Law on Emulation and Commendation who have contributions processes of at least 30 years in the People’s Armed Force and assumed one of the following positions: Head of the regiment, Deputy Head of the regiment, or equivalents for at least 10 years.

Section 3. GREAT NATIONAL UNITY ORDER AND FRIENDSHIP ORDER

Article 22. Great National Unity Order

1. Great National Unity Orders shall be awarded or posthumously awarded to individuals who successfully comply with the guidelines of the CPV and policies and laws of the State and meet one of the following standards:

a) Meeting the standards prescribed in Clause 1 Article 51 of the Law on Emulation and Commendation;

2. If the recipients prescribed in Clause 1 of this Article have been awarded or posthumously awarded Orders prescribed in Articles 8, 9, 10, 11, 12, 13, 14, 15, 19, 20, and 21 and Clause 1 of Articles 16, 17, and 18 of this Decree, they shall not be eligible for the Great National Unity Order.

Article 23. Friendship Order

1. Standards of the award of Friendship Orders shall comply with Clause 1 Article 53 of the Law on Emulation and Commendation.

2. Recipients include:

a) Agencies and organizations of foreign States and Governments equivalent to levels of ministry, province, and city;

b) Foreign organizations to which Vietnam is a member or has partnerships;

c) Friendship associations of other countries associated with Vietnam;

d) Friendship associations at provincial levels, state levels, or city levels of countries that have special, strategic, or comprehensive partnerships with Vietnam;

dd) Foreign diplomatic missions in Vietnam;

g) Foreign non-governmental organizations operating in Vietnam;

h) Other foreign organizations not mentioned above but have exceptionally outstanding achievements and are eligible according to Clause 1 Article 53 of the Law on Emulation and Commendation recognized and recommended by ministries, central authorities, or local authorities;

i) Foreign individuals who are heads of agencies or organizations prescribed in Point a Clause 2 of this Article with a time of holding their positions for at least 5 consecutive years or a time of operating in Vietnam for at least a 3-year term;

k) Heads of foreign diplomatic missions in Vietnam of countries with special, strategic, or comprehensive partnerships with Vietnam who have operated in Vietnam for at least a 3-year term;

l) Foreign individuals who have been awarded Friendship Orders and continue to have positive contributions to the development, consolidation, and development of friendly relations and good and comprehensive cooperation with Vietnam for the following 5 years after such award;

m) Foreign individuals not mentioned above who meet the standards prescribed in Point b Clause 1 Article 53 of the Law on Emulation and Commendation recognized and recommended by ministries, central authorities, or local authorities.

Chapter III

AWARD AND RECEIPT OF EMULATION TITLES AND COMMENDATION FORMS

a) Orders: Gold Star Order, Ho Chi Minh Order, Independence Order, Military Exploit Order, Labor Order, Fatherland Defense Order, Feat Order, Great National Unity Order, Bravery Order, and Friendship Order;

b) Honorary titles of the state: Heroic Province, Heroic City, Vietnamese Heroic Mother, People's Armed Forces Hero, Labor Hero, People's Teacher, Teacher of Merit, People's Doctor, Doctor of Merit, People's Artist, Artist of Merit, People's Artisan, and Artisan of Merit;

c) Ho Chi Minh Prize and State Award;

d) Medals: Determined-to-Win Military Flag Medal, For National Security Medal, Glorious Fighter Medal, Friendship Medal, and Glorious Youth Volunteer Medal;

dd) Diploma of Merit of the Prime Minister of Vietnam;

e) Government Emulation Flag;

g) National Emulation Fighter.

2. The award and receipt of emulation titles and commendation forms shall be under the jurisdiction of ministries, central authorities, and local authorities; emulation titles and commendation forms under the jurisdiction of agencies and units of ministries, central authorities, and local authorities shall comply with this Decree.

2. It is mandatory to implement a civilized lifestyle and preserve cultural values and national identity during ward and receipt ceremonies of emulation titles and commendation forms.

3. Award and receipt ceremonies of emulation titles and commendation forms shall not be organized privately. Joint organizations may only be held on the occasion of anniversaries of major public holidays of Vietnam, establishment dates, traditional dates of ministries, central authorities, or local authorities, and final conferences according to specific programs in compliance with this Decree (excluding cases of awarding commendation forms for irregularly outstanding achievements, resistance achievements, and Vietnamese Heroic Mother Titles).

4. Representative leaders of eligible collectives and households shall directly receive emulation titles and commendation forms of collectives and households. Eligible individuals shall directly receive emulation titles and commendation forms. In case of posthumous awards, family representatives of the eligible individuals shall receive the awards.

5. Emulation titles and commendation forms shall be awarded by ranks, from high to low. In case of a commendation form for many recipients, it shall be awarded to collectives and households before being awarded to individuals. In case of an emulation title and commendation form decided by a competent authority, comply with the following principles: emulation title first, commendation form later, awards to collectives first and households and individuals later, and awards first, posthumous awards later.

6. During the disclosure, award, and receipt of emulation titles and commendation forms, irrelevant persons shall not gift flowers or film and photograph on the rostrum. It is forbidden to organize parades or processions for awarded emulation titles and commendation forms.

Article 26. Protocols of disclosure, award, and receipt of emulation titles and commendation forms

1. Operators of ceremonies shall be leader representatives of ministries, central authorities, local authorities, provincial People's Committees, and organizing units. Units presiding over the disclosure, award, and receipt ceremonies of emulation titles and commendation forms shall develop scripts for such ceremonies.

2. Disclosure of decisions on awards of emulation titles and commendation forms:

a) Leader representatives of agencies engaging in emulation and commendation or units organizing ceremonies shall disclose the full decisions on the awards of emulation titles and commendation forms;

c) Disclosure of decisions on awards of emulation titles and commendation forms of the Government of Vietnam and the Prime Minister of Vietnam: after the disclosure, the person in charge of the disclosure shall invite leader representatives of collectives or individuals included in the commendation decisions to the rostrum to receive emulation titles or commendation forms.

3. Award of emulations titles and commendation forms:

a) The persons awarding emulation titles and commendation forms shall be the persons competent to decide on the award of emulation titles and commendation forms or the persons authorized to award emulation titles and commendation forms or representatives of superior leaders participating in ceremonies. Such persons shall stand at the center of the rostrum;

b) The award shall comply with the following order: attach Orders (or Medals and Badges enclosed with titles) first, then award Diplomas and Hero Flags (for collectives eligible for Heroic Titles);

c) Regarding collectives with Traditional Flags: the awarding person shall attach the Orders (or Badges enclosed with titles) to the high corner of the right side of the Traditional Flags. The attachment position of Orders (or Badges enclosed with titles) on Traditional Flags shall be carried out by ranks, from high to low;

Regarding collectives without Traditional Flags: the awarding person shall award Diplomas with attached Orders (or Badges with enclosed titles);

d) Regarding individuals: the awarding person shall attach Orders (or Medals and Badges enclosed with titles) to the left side of the chest of the recipients, then award the Diplomas;

dd) Regarding posthumous awards: the awarding person shall award Diplomas with attached Orders (or Medals and Badges enclosed with titles) to family representatives of the eligible individuals;

e) Regarding the award of emulation titles and commendation forms in cases where eligible individuals are elderly persons with poor health conditions or persons with disabilities or commendation decisions are for many recipients, the agency presiding over the award ceremony shall consult with the competent person, authorized person, or representative of the superior leader for decisions.

a) Receipt of commendation forms under the jurisdiction of the President of Vietnam: the recipients shall strictly stand in a horizontal line in the center of the rostrum to receive commendation decisions;

b) Receipt of emulation titles and commendation forms under the jurisdiction of the Government of Vietnam and the Prime Minister of Vietnam: the recipients shall be invited to the center of the rostrum to receive emulation titles and commendation forms;

c) When receiving Diplomas (or Flags), the recipients shall raise the Diplomas or Flags to chest height and maintain their posture until they leave the rostrum;

d) In case of necessity, representatives of eligible collectives (or individuals or households) shall provide speeches after receiving the commendations.

5. Persons serving award protocols shall:

a) Restrain from turning their back to attendees; stand behind, to the right (dominant hand) of the awarding person when handing Orders (or Medals, Badges enclosed with titles, Diplomas, and Flags) to the awarding person;

b) Place Orders (or Medals, Badges enclosed with titles, and Diplomas) in trays covered with red cloth; ensure that Diplomas are framed; carry the trays and hand Orders, Diplomas, and Flags with both hands to the awarding person.

Article 27. Award of commendation forms to Vietnamese individuals and collectives residing abroad; foreign individuals and collectives; foreign agencies, organizations, and international organizations in Vietnam

2. Overseas award ceremonies shall be presided over by authorized heads of embassies or authorized heads of representative missions of the Socialist Republic of Vietnam abroad according to written requests of requesting agencies. Requesting agencies shall transfer commendation decisions and items and cooperate with embassies or representative missions of the Socialist Republic of Vietnam abroad in organizing award ceremonies, ensuring solemnity and conformity with actual conditions.

Chapter IV

COMPETENCE TO DECIDE AND REQUEST COMMENDATIONS; APPLICATIONS AND PROCEDURES FOR COMMENDATIONS

Section 1. COMPETENCE TO DECIDE ON THE AWARD OF TITLES OF DETERMINED-TO-WIN UNIT AND EXCELLENT LABOR COLLECTIVE

Article 28. Competence to award titles of Determined-to-Win Unit and Excellent Labor Collective in the People’s Army and People’s Public Security

1. The Minister of National Defense of Vietnam shall decide or authorize the decision on the award of titles of Determined-to-Win Unit and Excellent Labor Collective in the People’s Army.

2. The Minister of Public Security of Vietnam shall decide or authorize the decision on the award of titles of Determined-to-Win Unit and Excellent Labor Collective in the People’s Public Security.

SECTION 2. COMPETENCE TO COMMEND OR REQUEST COMMENDATION FOR ENTERPRISES AND OTHER ECONOMIC ORGANIZATIONS

2. Heads of ministries, departments, and central authorities shall commend or request superior authorities to commend enterprises and other economic organizations under their management; commend and request superior authorities to commend enterprises and other economic organizations that are not under their management but have contributions to sectors under their management after collecting feedback from the Provincial People's Committees (managing such enterprises and other economic organizations) or managing ministries (managing such enterprises and other economic organizations).

3. Presidents of Provincial People’s Committees shall commend and request superior authorities to commend industrial zones, economic zones, and export-processing zones under their management. Managing ministries shall commend and request superior authorities to commend industrial zones, economic zones, and export-processing zones under their management.

4. Regarding enterprises and collectives and individuals of enterprises in state zones:

State-owned groups and corporations and partially state-owned joint-stock enterprises (with over 50% of charter capital held by the State) shall comply with the following principles: State Capital Management Committees at enterprises or managing ministries shall commend or request superior authorities to commend enterprises and collectives and individuals of enterprises under their management.

Managing ministries, Provincial People’s Committees, or organizations assigned by the Government of Vietnam to carry out the rights and responsibilities of representatives of state ownership for enterprises shall commend or request superior authorities to commend enterprises and collectives and individuals of enterprises established or managed by them.

Member units of enterprises that operate and carry out obligations in provinces where they are not headquartered shall receive commendations decided by heads of such enterprises or request superior authorities for commendations.

5. Regarding enterprises and collectives and individuals of enterprises (including FDI enterprises)

Enterprises and collectives and individuals of enterprises operating in provinces where transaction headquarters are located (even in industrial zones, export-processing zones, and areas outside of such zones) shall receive commendation from heads of enterprises or request Presidents of People's Committees of communes or districts or Presidents of People's Committees of provinces where transaction headquarters are located to commend or request superior authorities to commend.

Regarding member units of enterprises that keep business accounts independently and carry out obligations in provinces where enterprises are not headquartered, aside from receiving commendations decided by heads of enterprises, heads of member units shall provide commendations under their jurisdiction and request the Presidents of People's Committees of districts or Presidents of People's Committees of provinces where member units are headquartered and carry out state obligations to commend or request superior authorities to commend.

Section 3. APPLICATIONS AND PROCEDURES FOR AWARDING EMULATION TITLES AND COMMENDATION FORMS

Article 30. General regulations on commendation applications and procedures

1. Collectives’ requests for Gold Star Orders and Ho Chi Minh Prizes shall be assessed and concluded by the Politburo of Vietnam and the Secretariat of Vietnam.

2. Individuals’ requests for the award or posthumous award of Gold Star Orders and Ho Chi Minh Prizes shall be assessed and concluded by the Politburo of Vietnam and the Secretariat of Vietnam.

Regarding individuals under the management of the Politburo of Vietnam and the CPV Central Secretariat Committee (including retired and dead officials) working in central or local agencies and unions, agencies engaging in emulation and commendation shall, based on CPV member records (or management records of officials if they are not CPV members) on working processes and gained achievements, cooperate with the CPV Organisation Commission, Organisation Mission of Provincial Committees, Central Committees, or Organization and Personnel Departments (divisions, departments) of ministries, departments, central authorities, and central unions in formulating applications for eligible cases and reporting to relevant committees to assess and confirm the working processes and forms of commendation and discipline (if any). Ministers, directors of ministerial agencies, governmental agencies, heads of central departments, divisions, agencies, and organizations, and Presidents of People’s Committees of provinces and centrally affiliated cities shall submit requests to the Prime Minister of Vietnam based on the work mentioned previously.

3. Regarding individuals under the management of central authorities, when requesting state commendation forms and National Emulation Fighter Titles, the CPV Organisation Committee, Inspection Commission of the CPV Central Committee, and CPV Central Departments managing the related sectors shall provide feedback on management contents of officials, such as the working processes, positions, time of holding positions, and forms of commendation and discipline (if any).

4. Standing Committees of Provincial Committees, Central Committees, and CPV Committees affiliated to central authorities, CPV Designated Representations, collectives of leaders (where there are no CPV Designated Representations) of ministries, central authorities, and central unions shall carry out assessments and provide written feedback before requesting the Prime Minister of Vietnam to:

a) Commend individuals under their management;

b) Award emulation titles and commendation forms of: National Emulation Fighter; Gold Star Order, Ho Chi Minh Order, Independence Order (all classes), People's Armed Forces Hero, Labor Hero, People's Teacher, People's Doctor, People's Artisan, Ho Chi Minh Prize, and State Award.

6. Regarding retired individuals or dissolved or merged units, units receiving tasks of such units shall assess and request commendations. Regarding retired individuals (or sacrificed/dead individuals), applications for commendations shall be assessed, completed, and presented to competent authorities by the agencies managing them before their retirement as per regulation.

Regarding dissolved, divided, or merged agencies or units, units receiving tasks of such agencies or units shall request commendations. Achievements of dissolved, divided, or merged agencies or units shall be calculated by years or based on the accumulation of years when such agencies or units gain achievements for requests for commendations following the general standards.

7. During meetings for assessment for titles of People’s Armed Forces Hero, Labor Hero, National Emulation Fighter, Emulation Fighter of ministries, departments, and central or local authorities, Government Emulation Flag, the Emulation-Commendation Councils that issue or present commendations shall conduct voting.

Regarding collectives and individuals recommended for the award of titles of People’s Armed Forces Hero, Labor Hero, National Emulation Fighter, or Emulation Fighter of ministries, departments, and central or local authorities, the percentage of consent votes of Emulation-Commendation Councils of ministries, departments, and central or local authorities shall be at least 90% based on the total members of such Councils (absent members shall submit written feedback). Regarding titles of Grassroots-Level Emulation Fighter, Emulation Flag of ministries, departments, and central or local authorities, and Government Emulation Flag, the percentage of consent votes of Emulation-Commendation Councils shall be at least 80% based on the total members of such Councils (absent members shall submit written feedback, which will be included in minutes of meetings for assessment for emulation titles or commendation assessment records).

8. Initiative councils and scientific councils at various levels shall be established by heads of agencies, organizations, and units. The composition of such councils shall include members with professional qualifications in sectors concerning initiative contents and scientific research topics and other members. Initiative councils and scientific councils at various levels shall assist the heads in recognizing the effective application and potential expansion of initiatives or recognizing the effective application and influential scope of scientific topics, scientific schemes, and scientific and technological works for use as the basis for requesting emulation fighter titles at various levels and commendation forms as per regulation. Certification or confirmation documents of heads of competent agencies and organizations on the effective application and potential expansion of initiatives or recognition of the effective application and influential scope of scientific topics, scientific schemes, and scientific and technological works used as the basis for requesting emulation fighter titles at various levels and commendation forms shall comply with Form No. 11 of Appendix I enclosed herewith.

9. The time for the following request for commendations shall be based on the time of gained achievements specified in the previous commendation decision. Regarding a commendation decision not specifying the mentioned time, the following request for commendation shall be based on the promulgation date of the previous commendation decision.

10. Regarding individuals (fishermen, ethnic groups, farmers, workers, disadvantaged persons, and persons with disabilities) and collectives with typically outstanding achievements in labor, production, and work and active, creative, dare-to-think, dare-to-do, and dare-to-break-through-for-common-interest officials who are discovered by heads of agencies, organizations, and units for commendations or recommendations to their superior authorities for commendations, commendation applications shall include statements with an enclosed list of requested recipients and reports on the summary of achievements made by the requesting agencies, organizations, and units.

11. Achievement reports of individuals, collectives, and households requested for commendations shall conform with the prescribed commendation forms. Such reports shall specify the decision numbers, dates, or documents confirming the outstanding or successful completion of tasks of competent authorities during the time for calculating achievements of individuals and collectives requested for commendations (regarding cases of commendation requests following the standards of outstanding or successful completion of tasks); decision numbers and dates of receipt of emulation titles and commendation forms (excluding cases of receipt of commendations based on simple procedures). Reports on achievements requested for commendations of individuals, collectives, and households shall, aside from specifying that achievements meet the prescribed standards, specify successful compliance with the guidelines of the CPV and policies and laws of the State following the Form in Appendix I enclosed herewith.

Regarding achievement reports of individuals, collectives, and households requested for emulation titles and commendation forms at the state level, the achievements in such reports shall be calculated until 6 months before ministries, departments, and central or local authorities present them to the Prime Minister of Vietnam. After the mentioned time limit, the Ministry of Home Affairs of Vietnam shall not accept any commendation presentation applications.

13. Statements of ministries, departments, and central or local authorities and the statement of the Ministry of Home Affairs of Vietnam to be presented to the Prime Minister of Vietnam for commendation assessment and decision or assessment and presentation to the President of Vietnam for issuance of commendation decisions to individuals, collectives, and households shall contain:

a) Legal grounds;

b) Contents, forms, and achievements requested for commendations;

c) Feedback from relevant agencies on cases requested for commendations;

d) Appraisal feedback from the Ministry of Home Affairs of Vietnam on whether cases requested for commendations comply with relevant regulations;

Detailed contents of the commendation request statement shall follow Form No. 01 of Appendix I enclosed herewith.

14. Ministries, departments, and central or local authorities shall submit paper commendation applications (original copies) while submitting electronic files (in Word or PDF format) of such applications to the Ministry of Home Affairs of Vietnam during their presentation to the Prime Minister of Vietnam through the Management System of E-Commendation Applications in Emulation-Commendation, excluding documents containing state secrets. Commendation applications shall only be received when the Ministry of Home Affairs of Vietnam receives the paper applications (original copies) and electronic files of such applications as per regulation.

The Ministry of Home Affairs of Vietnam shall submit the statement enclosed with the list of requested recipients and commendation applications in the form of electronic files (Word or PDF format) to the Office of the Government of Vietnam.

15. The Ministry of Home Affairs of Vietnam shall receive commendation applications and appraise them based on documents enclosed with such applications formulated by ministries, departments, and central or local authorities, including applications, procedures, conditions, and standards as per regulation, and present them to the Prime Minister of Vietnam.

1. The collection of feedback for the award of emulation titles and commendation forms at the state level prescribed in Clause 3 Article 84 of the Law on Emulation and Commendation and regulations of competent authorities shall comply with Clause 2 through Clause 4 of this Article.

2. Regarding commendations for agencies, organizations, units, and heads of central agencies, organizations, and units with having statuses as juridical persons under the management of ministries, departments, central authorities, and central unions in provinces, feedback on the following contents shall be collected from Provincial People’s Committees:

a) Compliance with the guidelines of the CPV and laws and policies of the State and operational results of CPV organizations and unions (if CPV organizations and unions have local activities);

b) Implementation of insurance benefits for workers and laborers; assurance of the environment during production and business, occupational hygiene and safety, and food safety (regarding production and business units);

c) Emulation titles and commendation forms subject to feedback collection: Government Emulation Flags, orders, medals, state honorable titles, Ho Chi Minh Prizes, State Awards, and Diplomas of Merit of the Prime Minister of Vietnam.

3. Regarding commendations for agencies and organizations affiliated to People’s Committees of provinces and centrally affiliated cities and individuals who are heads of same-level units, feedback on the following contents shall be collected from ministries, departments, central authorities, and central unions managing relevant sectors and fields:

a) Results of the counseling for the implementation of assigned political tasks (for collectives) and results from leading and directing agencies and units to carry out assigned political tasks (for individuals) during the time of calculating achievements for requesting commendations;

b) Emulation titles and commendation forms subject to feedback collection: Government Emulation Flags, orders, medals, state honorable titles, Ho Chi Minh Prizes, State Awards, and Diplomas of Merit of the Prime Minister of Vietnam.

4. Regarding diplomatic commendations, feedback from the Central Foreign Affairs Committee, the Ministry of Public Security of Vietnam, and the Ministry of Foreign Affairs of Vietnam shall be collected.

6. After receiving documents on the collection of feedback on commendations from ministries, departments, central or local authorities, or the Ministry of Home Affairs of Vietnam, receiving agencies shall provide written answers as per regulation within 10 working days from the receipt date of such documents (based on postmarks). Heads of receiving agencies shall take legal liability for the time of responding to the documents and the contents of their feedback.

If no feedback is provided, the Ministry of Home Affairs of Vietnam shall carry out the presentation and commendation as per regulation.

7. Within 10 working days from the date of receipt of the consistent or consensual feedback from competent agencies, the Ministry of Home Affairs of Vietnam shall request competent authorities to provide commendations as per regulation.

Article 32. Regulations on time for receiving applications, appraising, and notifying appraisal results and commendation results

1. The Ministry of Home Affairs of Vietnam’s time for receiving commendation applications is as follows:

a) Applications of ministries, departments, and central or local authorities to be presented to the Prime Minister of Vietnam for National Emulation Fighter Titles shall be submitted to the Ministry of Home Affairs of Vietnam by December 31 of the following year.

b) Applications of ministries, departments, and central or local authorities to be presented to the Prime Minister of Vietnam for Government Emulation Flags shall be submitted to the Ministry of Home Affairs of Vietnam by June 30 annually. Regarding the national education system, applications shall be submitted by December 31 annually.

The time for presenting applications for Government Emulation Flags, Orders, and Diplomas of Merit of the Prime Minister of Vietnam for collectives with outstanding achievements leading emulation movements launched by the Prime Minister of Vietnam shall comply with the guidelines of the Ministry of Home Affairs of Vietnam.

2. The Ministry of Home Affairs of Vietnam shall appraise commendation applications and present them to the Prime Minister of Vietnam within 20 days from the date of receipt of adequate applications as per regulation. The assessment of applications for the award or posthumous award of Heroic Titles and National Emulation Fighter Titles shall comply with Point b Clause 4 Article 37 of this Decree and the operational regulation of the Central Emulation-Commendation Council.

Regarding emulation titles and commendation forms under the jurisdiction of ministries, departments, and central or local authorities, emulation-commendation agencies shall appraise commendation applications and present them to competent authorities within 25 working days from the date of receipt of adequate applications as per regulation (excluding cases of irregular commendations).

Regarding requests for emulation titles and commendation forms according to state meritorious services, within 30 working days (or 40 working days regarding the award of Independence Orders, Ho Chi Minh Orders, Gold Star Orders, Heroic Titles, and Vietnamese Heroic Mother titles) from the date of receipt of adequate applications as per regulation, ministries, departments, and central or local authorities shall assess and present them to the Prime Minister of Vietnam.

4. The time for appraising applications for emulation titles and commendation forms in communes and districts of provinces and centrally affiliated cities and at agencies, organizations, and units of ministries, departments, and central or local authorities is as follows:

Regarding emulation titles and commendation forms under the jurisdiction of authorities of communes and districts and agencies, organizations, and units of ministries, departments, and central or local authorities, emulation-commendation agencies shall appraise commendation applications and present them to competent authorities within 20 working days from the date of receipt of adequate applications as per regulation (excluding cases of irregular commendations).

5. The time for notifying appraisal results and commendation results is as follows:

a) Regarding cases eligible for commendations as per regulation, the Ministry of Home Affairs of Vietnam shall request competent authorities to provide commendations. If the appraisal results of the Ministry of Home Affairs of Vietnam are different from the requests of ministries, departments, and central or local authorities, the Ministry of Home Affairs of Vietnam shall reach an agreement with such entities before presenting the applications to the Prime Minister of Vietnam for assessment and decision;

b) Regarding ineligible cases, within 5 working days, the Ministry of Home Affairs of Vietnam shall issue written notifications of the return of commendation applications to requesting ministries, departments, and central or local authorities;

c) If the Ministry of Home Affairs of Vietnam has requested the Prime Minister of Vietnam to issue commendation decisions or to request the President of Vietnam to issue commendation decisions but the Prime Minister of Vietnam or the President of Vietnam declines the request, within 10 working days from the date of receipt of the notification of the Office of the Government of Vietnam or the Office of the President of Vietnam, the Ministry of Home Affairs of Vietnam shall notify ministries, departments, and central or local authorities of the results of the settlement of their commendation requests;

d) If the President of Vietnam agrees to provide commendations, after receiving the commendation decisions of the Prime Minister of Vietnam, the Ministry of Home Affairs of Vietnam shall copy and send them to ministries, departments, and central or local authorities within 10 working days;

Article 33. Applications and procedures for National Emulation Fighter Titles

1. The Ministry of Home Affairs of Vietnam shall appraise applications, submit reports to the Standing Committee of the Central Emulation-Commendation Council, and collect feedback from relevant agencies as per regulation; request the Prime Minister of Vietnam to assess and decide on the award of National Emulation Fighter Titles based on the prescribed conditions and standards.

2. Applications, to be presented to the Prime Minister of Vietnam, shall include a set (original copy) of the following documents:

a) Statements of ministries, departments, and central or local authorities;

b) Reports on achievements of individuals requested for National Emulation Fighter Titles confirmed by authorities presenting such reports to the Prime Minister of Vietnam;

c) Meeting minutes and voting results of Emulation-Commendation Councils of ministries, departments, and central or local authorities;

d) Certification or confirmation of heads of ministries, departments, and central or local authorities concerning initiatives that have been effectively applied and have the potential for being expanded or scientific topics, scientific schemes, and scientific and technological works that have been tested and effectively applied with nationwide influences; certification or confirmation of the Minister of National Defense of Vietnam and the Minister of Public Security of Vietnam concerning ingenuity and creativity in combat and combat services with nationwide influences;

dd) Relevant documents according to Article 30 of this Decree (if any).

3. The Ministry of Home Affairs of Vietnam’s application, to be presented to the Prime Minister of Vietnam, includes the statement of the Ministry of Home Affairs of Vietnam enclosed with the list of requested recipients and electronic files of commendation applications.

1. Emulation Flags of ministries, departments, and central or local authorities, Emulation Fighter Titles of ministries, departments, and central or local authorities, Grassroots-Level Emulation Fighter Titles, Advanced Laborer Titles, Advanced Fighter Titles, Excellent Labor Collective Titles, Determined-to-Win Unit Titles, Advanced Labor Collective Titles, and Advanced Unit Titles shall be awarded annually. Applications and procedures for the mentioned titles shall comply with Clause 1 Article 84 of the Law on Emulation and Commendation.

2. An application for requesting consideration for awarding emulation titles include:

a) A statement on request for consideration for awarding emulation titles;

b) A report on achievements of the individual or collective;

c) Emulation assessment record of the Emulation-Commendation Council or emulation assessment record and voting results of the Emulation-Commendation Council in case of requesting Grassroots-Level Emulation Fighter Titles, Emulation Fighter Titles of ministries, departments, and central or local authorities, and Emulation Flags of ministries, departments, and central or local authorities;

b) Certification or confirmation of competent agencies and organizations for initiatives or scientific topics, scientific schemes, and scientific and technological works or the successful implementation of tasks or cleverness and creativity in combat in case of requesting Grassroots-Level Emulation Fighter Titles. Certification or confirmation of heads of ministries, departments, and central or local authorities for initiatives that are effectively applied and have the potential for being expanded in ministries, departments, and central or local authorities or scientific topics, scientific schemes, and scientific and technological works that have been tested and effectively applied with a scope of influence within such ministries, departments, and central or local authorities or cleverness and creativity in combat and combat services with a scope of influence in the whole army or people's public security force in case of requesting Emulation Titles of ministries, departments, and central or local authorities.

3. During the summary of thematic emulation movements launched by ministries, departments, and central or local authorities with an implementation time of at least 3 years, requests for the award of Emulation Flags of such ministries, departments, and central or local authorities to collectives leading the movements shall comply with the guidelines of such ministries, departments, and central or local authorities.

Article 35. Applications and procedures for Government Emulation Flags

1. The Government of Vietnam shall authorize the Prime Minister of Vietnam to assess and decide on the award of Government Emulation Flags. The Ministry of Home Affairs of Vietnam shall appraise applications, procedures, and achievements and present them to the Prime Minister of Vietnam.

b) Reports on achievements of collectives requested for Government Emulation Flags confirmed by the authorities requesting the Prime Minister of Vietnam;

3. Requests for the award of Government Emulation Flags to collective leading emulation blocks or clusters organized by the Central Emulation-Commendation Council shall comply with the guidelines of the Central Emulation-Commendation Council.

4. The Ministry of Home Affairs of Vietnam’s application, to be presented to the Prime Minister of Vietnam, includes the statement of the Ministry of Home Affairs of Vietnam enclosed with the list of requested recipients and electronic files of commendation applications.

Article 36. Applications and procedures for award or posthumous award of types of Orders (excluding Friendship Orders)

1. The Ministry of Home Affairs of Vietnam shall appraise applications and present them to the Prime Minister of Vietnam for assessment and presentation to the President of Vietnam for decision.

2. The award or posthumous award of Gold Star Orders and Ho Chi Minh Orders shall comply with the notification of the feedback of the Politburo of Vietnam concerning the assessment for the award of high-class Orders.

a) Statements of ministries, departments, and central or local authorities;

b) Reports on achievements of cases requested for commendations confirmed by the authorities requesting the Prime Minister of Vietnam;

c) Commendation assessment records of Emulation-Commendation Councils of ministries, departments, and central or local authorities;

d) If organizations and individuals are recommended for commendation for their special, irregular, and outstanding achievements in labor, work, production, business, study, and scientific research or other fields; great contributions to the socio-economic development, assurance of social security, and humanitarian charity; inventions, initiatives, and application of scientific and technological progress or scientific and technological works, there must be certification or confirmation of competent agencies and organizations regarding the mentioned achievements to request for commendations;

dd) Relevant documents according to Article 30 of this Decree (if any).

4. Applications for commendations for foreign individuals and collectives and Vietnamese individuals and collectives residing abroad shall contain a set (original copy) of the following documents: Statements of ministries, departments, and central or local authorities; reports on the summary of achievements of individuals and collectives formulated by the requesting agencies and confirmation documents of competent agencies regarding obligations they must fulfill for the State of Vietnam according to the law (if any).

5. The Ministry of Home Affairs of Vietnam’s application, to be presented to the Prime Minister of Vietnam, includes the statement of the Ministry of Home Affairs of Vietnam enclosed with the list of requested recipients and electronic files of commendation applications (excluding commendation applications containing state secrets).

Article 37. Procedures for award or posthumous award of Great National Unity Orders

1. Great National Unity Orders shall be awarded or posthumously awarded annually during the National Day September 2 and the establishment date of the National United Front November 18.

Article 40. Commendation according to simple procedures

1. Cases subject to commendation according to simple procedures shall comply with Article 85 of the Law on Emulation and Commendation.

2. An application for commendation according to simple procedures shall contain a set (original copy) of the following documents:

a) Statement on request for commendations;

b) Report on the summary of achievements of individuals and collectives under the management of agencies, organizations, and units specifying the actions, achievements, meritorious services, working processes, or summary of achievement results regarding commendation for achievements with confidential contents for request for commendation according to simple procedures.

3. Heads of ministries, departments, and central or local authorities or heads of agencies, organizations, and units shall provide commendations or request commendations immediately after individuals and collectives gain outstanding or irregular achievements according to Point b Clause 1 Article 85 of the Law on Emulation and Commendation.

4. The time for appraisal and commendation request for cases requested for commendations under Points a, c, d, dd Clause 1 Article 85 of the Law on Emulation and Commendation shall comply with Article 32 of this Decree.

5. The Ministry of Home Affairs of Vietnam’s application, to be presented to the Prime Minister of Vietnam, includes the statement of the Ministry of Home Affairs of Vietnam enclosed with the list of requested recipients and electronic files of commendation applications (excluding commendation applications containing state secrets).

dd) Relevant documents according to Article 30 of this Decree (if any).

Applications for commendations for foreign individuals and collectives and Vietnamese individuals and collectives residing abroad shall contain a set (original copy) of the following documents: Statements of ministries, departments, and central or local authorities; reports on the summary of achievements of individuals and collectives formulated by the requesting agencies and confirmation documents of competent agencies regarding obligations they must fulfill for the State of Vietnam according to the law (if any).

3. Article 44. Procedures for Orders, Medals, and Vietnamese titles and prizes for Vietnamese individuals and collectives residing abroad and foreign individuals and collectives; applications, procedures, and responsibilities of Vietnamese individuals and organizations when receiving Orders, Medals, titles, and prizes awarded by foreign countries and international organizations

1. Procedures for Orders, Medals, and Vietnamese titles and prizes for Vietnamese individuals and collectives residing abroad and foreign individuals and collectives; applications and procedures for Orders, Medals, titles, and prizes awarded by foreign countries and international organizations shall comply with the regulations of the CPV on the consistent management of diplomatic activities and this Decree.

Collection of feedback on diplomatic commendations shall comply with Clause 4 Article 31 of this Decree.

2. Vietnamese individuals and organizations, when receiving commendation forms from foreign individuals and organizations, shall, aside from complying with Clause 1 Article 14 of the Law on Emulation and Commendation, use commendation items in compliance with Vietnamese customs, traditions, and social morality and avoid using commendation forms to in a manner that negatively affects or impacts the political regime and society of Vietnam or disseminates propaganda against the State of Vietnam.

Section 4. RECOGNITION OF COMPLETION LEVEL OF TASKS OF INDIVIDUALS AND COLLECTIVES; DISCLOSURE OF INDIVIDUALS AND COLLECTIVES REQUESTED FOR COMMENDATIONS

Article 45. Recognition of completion level of tasks of individuals and collectives

1. The recognition of the completion level of tasks of individuals shall comply with the Law on Officials, Law on Public Employees, and relevant regulations.

Article 46. Disclosure of individuals and collectives requested for commendations

1. The Ministry of Home Affairs of Vietnam shall collect feedback from the People on the Web Portal of the Central Emulation-Commendation Council and Web Portal of the Ministry of Home Affairs of Vietnam regarding National Emulation Fighter Titles; Web Portal of the Central Emulation-Commendation Council, Web Portal of the Ministry of Home Affairs of Vietnam, Web Portal of the Government of Vietnam, People Newspaper, and Labor Newspaper regarding People's Armed Forces Hero Titles and Labor Hero Titles within 10 working days (except for cases subject to commendation for special, outstanding, and irregular achievements).

2. Persons competent to award orders and state honorable titles prescribed in Clause 5 Article 84 of the Law on Emulation and Commendation shall disclose the list of individuals and collectives on mass media of ministries, departments, and central or local authorities (Newspapers, Web Portals, Radio-Television Stations, etc.) at least 10 working days before meetings of Emulation-Commendation Councils of ministries, departments, and central or local authorities (except for cases requested for commendation according to simple procedures). The collection of feedback from the People on mass media and results of information processing (including denunciations and complaints (if any)) shall be made into written reports and submitted to Emulation-Commendation Councils of ministries, departments, and central or local authorities before being presented to superior authorities for commendations and included in the commendation assessment records of ministries, departments, and central or local authorities.

Chapter V

ORGANIZATION ND OPERATION OF EMULATION-COMMENDATION COUNCILS AT VARIOUS LEVELS

Article 47. Central Emulation – Commendation Council

1. The Central Emulation–Commendation Council provides advisory services to the CPV and the State regarding emulation and commendation with tasks and entitlements prescribed in Clause 3 Article 90 of the Law on Emulation and Commendation.

2. The composition of the Central Emulation-Commendation Council includes:

a) The President: Prime Minister of Vietnam;

c) Members of the Council.

3. The President of the Central Emulation-Commendation Council shall decide the composition, number of members, and tasks and entitlements of the President, Vice Presidents, Standing Members of the Council, Standing Committee of the Council, Members of the Council, and the standing agency assisting the Council; promulgate working regulations of the Council.

4. Operations of the Central Emulation – Commendation Council:

a) The Council shall operate under the principle of centralization, democracy, and vote by majority with all different opinions of Members of the Councils on proposals of guidelines and policies on emulation and commendation are reported to the Prime Minister of Vietnam and the President of the Council for assessment and decision;

b) The Council shall hold a meeting every 6 months to assess its operation, summarize Vietnam’s emulation and commendation work, implement tasks for the next 6 months, and give feedback on the settlement of other necessary issues. The Council may hold irregular meetings as summoned by the President of the Council.

The President of the Council shall preside over or authorize the first Vice President of the Council to preside over the meeting.

A meeting of the Council shall be attended by at least 2/3 of its Members. Regarding a meeting on assessment of the award of the posthumous award of Heroic Titles, it must be attended by at least 90% of the total Council Members. Cases requested for Heroic Titles shall receive at least 90% of consent votes from Council Members (absent members shall provide written feedback).

The Standing Committee of the Council shall hold a meeting every 3 months. The first Vice President and the Standing Vice President of the Council shall regularly assess and inspect the implementation progress of tasks of the Council. The Standing Committee of the Council shall provide advisory services and feedback on the award of National Emulation Fighter Titles at the request of the standing agency assisting the Council. Cases requested for National Emulation Fighter Titles shall receive at least 90% of consent votes from members of the Standing Committee of the Council (absent members shall provide written feedback);

c) The Council shall establish and provide guidelines on the organization and operation of emulation clusters and blocks organized by the Council;

dd) The working relationship between the Central Emulation-Commendation Council and Emulation-Commendation Councils of ministries, departments, and central or local authorities is a directive and cooperative relationship. Emulation-Commendation Councils at various levels shall, based on the functions and tasks of the Central Emulation-Commendation Council, carry out implementation cooperation.

5. The Ministry of Home Affairs of Vietnam shall be the standing agency of the Central Emulation-Commendation Council.

Article 48. Ministerial Emulation-Commendation Councils

1. Ministerial Emulation-Commendation Councils shall be established by heads of ministries, departments, central authorities, or central unions, responsible for providing advisory services for Ministers, Directors of ministerial agencies, governmental agencies, and heads of departments, central authorities, and central unions regarding emulation and commendation.

2. The composition of a Council includes:

a) President of the Council: Minister, Head of a ministerial agency or governmental agency, or head of a department, central authority, or central union;

b) The Council shall have no more than 4 Vice Presidents. The head of the agency or unit engaging in ministerial emulation and commendation shall be the Standing Vice President. The President of the Council shall decide the structure and composition of the members of the Council and promulgate the working regulations of the Council.

The composition of the Emulation-Commendation Councils of the Ministry of National Defense of Vietnam and the Ministry of Public Security of Vietnam shall be decided by the Minister of National Defense of Vietnam and the Minister of Public Security of Vietnam.

3. The Council shall have the following tasks and entitlements:

b) Periodically assess the results of emulation movements and commendation work; provide advisory services concerning the preliminary and final review of emulation and commendation work; suggest and propose guidelines and measures to promote patriotic emulation movements in each year and each stage; organize emulation in compliance with the law on emulation and commendation;

c) Provide advisory services for the Minister, Director of the ministerial agency or governmental agency, or head of the department, central authority, or central union regarding the inspection of emulation movements and implementation of guidelines, policies, and laws on emulation and commendation;

d) Provide advisory services for the Minister, Director of the ministerial agency or governmental agency, or head of the department, central authority, or central union regarding decisions to award emulation titles and commendation forms under his/her jurisdiction or requests for superior authorities to provide commendations.

4. Agencies and units engaging in emulation and commendation of ministries, departments, central authorities, and central unions shall be standing committees of Ministerial Emulation-Commendation Councils.

5. Heads of agencies, organizations, and units having statuses as juridical persons at the ministerial level shall establish and stipulate the functions, tasks, entitlements, composition, organization, and operation of Emulation-Commendation Councils of their agencies, organizations, and units to provide advisory services concerning emulation and commendation work under their management.

Article 49. Provincial Emulation-Commendation Councils

1. Provincial Emulation-Commendation Councils shall be established by the Presidents of Provincial People's Committees, responsible for providing advisory services for committees and authorities concerning local emulation and commendation work.

2. The composition of a Council includes:

a) President of the Council: President of the Provincial People’s Committee;

3. The Council shall have the following tasks and entitlements:

a) Provide advisory services for the President of the Provincial People’s Committees launching emulation movements under his/her jurisdiction;

b) Periodically assess the results of emulation movements and commendation work; provide advisory services concerning the preliminary and final review of emulation and commendation work; suggest and propose guidelines and measures to promote patriotic emulation movements in each year and each stage; organize emulation in compliance with the law on emulation and commendation;

c) Provide advisory services for the President of the Provincial People’s Committee regarding the inspection of emulation movements and implementation of guidelines, policies, and laws on emulation and commendation;

d) Provide advisory services for the President of the Provincial People’s Committee regarding decisions to award emulation titles and commendation forms under his/her jurisdiction or requests for superior authorities to provide commendations.

4. Emulation-Commendation Departments (Divisions) of the Departments of Home Affairs of provinces or centrally affiliated cities shall be the standing agencies of Provincial Emulation-Commendation Councils.

5. Heads of People’s Committees of districts, departments, authorities at the district level, and district-level units having statuses as juridical persons; Heads of People’s Committees of communes, Directors of agencies, organizations, and units, and legal representatives of enterprises and other economic organizations shall establish and stipulate the functions, tasks, entitlements, composition, organization, and operation of same-level Emulation-Commendation Councils to provide advisory services concerning the implementation of emulation and commendation work under their management.

Chapter VI

EMULATION AND COMMENDATION FUNDS

Article 50. Emulation and commendation fund establishment

1. Emulation and commendation funds of ministries, ministerial agencies, governmental agencies, the Supreme People’s Court of Vietnam, the Supreme People’s Procuracy of Vietnam, the Office of the CPV Central Committee, CPV Departments, and equivalents at the central level; Office of the National Assembly of Vietnam; Office of the National Assembly of Vietnam; Office of the President of Vietnam; State Audit Office of Vietnam may be established with funding from:

a) The state budget with the maximum amount of 20% of the total salary fund according to grades and ranks of officials and public employees in the payroll and wages approved for the whole year; contributions from domestic and foreign organizations and individuals;

b) The state budget for expenditures on the award of State Honorable Titles, Ho Chi Minh Prizes, and State Awards, which will be assigned to ministries and central authorities to preside over the award of such by phases.

2. Emulation and commendation funds of public service providers affiliated with ministries, ministerial agencies, governmental agencies, departments, central authorities, and central unions that ensure less than 70% of their recurrent expenditures shall be established with funding from the annual state budget, with an amount of 20% of the total salary fund according to grades and ranks of public employees in the payroll and wages approved for the whole year and from contributions of domestic and foreign individuals and organizations. Regarding emulation and commendation funds of public service providers affiliated with ministries, ministerial agencies, governmental agencies, departments, central authorities, and central unions that ensure 70% to under 100% of their recurrent expenditures, the establishment of such funds shall ensure compliance with the law. 

3. Emulation and commendation funds of districts and communes shall be established with funding from the annual state budget on the total recurrent budget expenditure for each level of state budget agencies of provinces and cities, allocated at the beginning of the year according to the following percentages:

a) Emulation and commendation funds of district-level departments, authorities, and public service providers with recurrent expenditures ensured by the State or ensure parts of their recurrent expenditures shall be established with funding from the annual state budget, with a maximum amount of 20% of the total salary fund according to grades and ranks of officials and public employees in the payroll and wages approved for the whole year and from contributions of domestic and foreign individuals and organizations;

b) Emulation and commendation funds of districts and communes shall be established with funding from the annual state budget, with a maximum amount equal to 1,0% of recurrent budget expenditures for each level of state budget agencies of delta provinces and centrally affiliated cities and a maximum amount equal to 1,5% of the recurrent budget expenditures for each level of state budget agencies of provinces in mountainous areas, midland areas, Western Highlands, remote areas, and islands, and from contributions of domestic and foreign individuals and organizations. Regarding units that are no longer state budget agencies carrying out tasks of budget estimate units, authorities of centrally affiliated cities shall be in charge of the allocation.

4. Emulation and commendation funds of political organizations, Central Committee of the Vietnamese Fatherland Front, and socio-political organizations shall be funded by the state budget (the Ministry of Finance of Vietnam shall, based on the nature of operations of each organization, decide on the annual allocation percentage) and by contributions from domestic and foreign individuals and organizations.

6. State-owned enterprises may use commendation and welfare funds according to the law on management and use of state capital invested in production and trading at enterprises; law on labor, salaries, remuneration, and bonuses regarding companies with shares and contributed capital controlled by the State for expenditures on emulation and commendation according to the law on emulation and commendation.

7. Foreign-invested enterprises and enterprises of economic sectors (excluding state-owned enterprises prescribed in Clause 6 of this Article) shall decide on and assume responsibility for the establishment, management, and use of their emulation and commendation funds after fulfilling obligations according to the regulations of the State.

8. Emulation and commendation funds of cooperatives of agriculture, forestry, fishery, and very small handicrafts, transport cooperatives, construction cooperatives, fishing and salt cooperatives, and cooperatives in other sectors shall be funded by their undistributed funds (cooperatives shall decide the fund) and contributions from domestic and foreign individuals and organizations.

9. Emulation and commendation funds of private educational institutions shall be under the jurisdiction and responsibility of such institutions after fulfilling obligations according to the regulations of the State.

Article 51. Emulation and commendation fund management

1. An emulation and commendation fund of a specific level shall be under the jurisdiction of the Director of the agency of that level and assigned to an emulation and commendation fund management agency for implementation. Regarding the provincial level, the agency assigned to provide advisory services concerning the implementation of provincial emulation and commendation work shall cooperate with the provincial financial agency in managing and using funding for expenditures on emulation and commendation based on the prescribed estimates. The final settlement shall be based on the actual expenditures in compliance with the prescribed regulations and policies.

2. Persons issuing commendation decisions according to Clause 4 Article 11 of the Law on Emulation and Commendation shall be responsible for expenditures on bonuses for individuals and collectives under the payroll and salary under the management of their agencies and record the expenditures as per regulation.

Regarding individuals and collectives of ministries, departments, and central or local authorities receiving commendation decisions from the Prime Minister of Vietnam or the President of Vietnam, such ministries, departments, and central or local authorities shall conduct expenditures on bonuses for such individuals and collectives using funding from their state budget and record the expenditures in a separate category.

Ministries and central authorities assigned to preside over the award of state honorable titles, Ho Chi Minh Prizes, and State Wards shall conduct expenditures on bonuses for commended individuals and record such expenditures in a separate category.

1. Emulation and commendation funds shall be used for expenditures on the implementation of emulation and commendation work as follows:

a) Expenditures on bonuses for emulation titles and commendation forms for achievements gained in Fatherland development and protection (excluding Vietnamese Heroic Mother Titles); expenditures on printing and making of commendation items or souvenirs for individuals, collectives, and households. 20% of the total emulation and commendation councils of each level shall be extracted for expenditures on the launch, implementation, directive, and preliminary and final review of emulation movements; dissemination and popularization of examples of typically advanced individuals and study and exchange of emulation and commendation experience; inspection of emulation and commendation work of Emulation-Commendation Councils; meetings on assessment for emulation titles and commendation forms; implementation of the law on emulation and commendation. Specific expenditures shall comply with the guidelines of the Ministry of Finance of Vietnam;

b) Expenditures on assessment for the award of state honorable titles, Ho Chi Minh Prizes, and State Awards. Funding shall be recorded independently in each phase of assessment for the award of commendations for operations as prescribed by the law.

2. The Ministry of Home Affairs of Vietnam shall conduct expenditures on the printing and procurement of commendation items using the allocated annual state budget for inclusion in the award of emulation titles and commendation forms as decided by the President of Vietnam, the Government of Vietnam, or the Prime Minister of Vietnam.

3. Commended individuals, collectives, and households shall, aside from receiving emulation titles, emulation flags, state honorable titles, Ho Chi Minh Prizes, State Awards or being awarded or posthumously awarded Orders, Medals, Diplomas of Merit, Commemorative Medals, Certificates of Merit enclosed with commendation items, receive bonuses and souvenirs with equivalent value according to Articles 54, 55, 56, 57, 58, and 59 of this Decree.

4. Commended Vietnamese individuals and collectives residing abroad; foreign individuals and collectives; foreign agencies and organizations and international organizations in Vietnam shall receive commendation items enclosed with souvenirs with equivalent values according to Articles 54, 55, 56, 57, 58, and 59 of this Decree.

5. Bonuses for diplomas of merit of political organizations and socio-political organizations at the provincial level shall be decided by the central agencies of such organizations, ensuring the balance of such bonuses for emulation titles and commendation forms prescribed in this Decree.

2. Bonuses shall be rounded to tens of thousands of VND after being multiplied by the base salary coefficient.

3. The higher the emulation titles and commendation forms, the higher the bonuses.

4. In the same commendation form or level, the bonuses for collectives shall be higher than those for individuals.

5. An entity with many different emulation titles gained in different periods shall receive bonuses for respective emulation titles.

6. An entity with many different commendation forms gained in different periods or by different achievements shall receive bonuses for respective commendation forms.

7. An entity that is recognized for its emulation titles and receives decisions on commendation forms simultaneously shall receive bonuses for such emulation titles and commendation forms.

8. If salary reform policies are implemented, the Government of Vietnam shall stipulate regulations on emulation and commendation funds and bonuses for emulation titles and commendation forms awarded to individuals, collectives, and households.

Article 54. Bonuses for emulation titles

b) Emulation Fighter Titles of ministries, departments, and central or local authorities shall be awarded together with Diplomas of Recognition, frames, Badges, and badge containers and bonuses equivalent to 3,0 times the base salary;

c) Grassroots-Level Emulation Fighter Titles shall be awarded together with Diplomas of Recognition and frames and bonuses equivalent to 1,0 time the base salary;

d) Advanced Laborer Titles and Advanced Fighter Titles shall be awarded together with bonuses equivalent to 0,3 times the base salary.

2. For collectives:

a) Excellent Labor Collective and Determined-to-Win Unit Titles shall be awarded together with Diplomas of Recognition and frames and bonuses equivalent to 1,5 times the base salary;

b) Advanced Labor Collective and Advanced Unit Titles shall be awarded together with bonuses equivalent to 0,8 times the base salary;

c) Typical commune, ward, or town titles shall be awarded together with Diplomas of Recognition and frames and bonuses equivalent to 2,0 times the base salary;

d) Village or street quarter of culture titles shall be awarded together with Diplomas of Recognition and frames and bonuses equivalent to 1,5 times the base salary;

dd) Government Emulation Flags shall be awarded together with the flags and bonuses equivalent to 12,0 times the base salary;

g) Titles of Emulation Flags of military regions, corps, services, armies, general departments, and equivalents of the Ministry of National Defense of Vietnam and the Government Cipher Committee; Titles of Emulation Flags of National Universities shall be awarded together with the flags and bonuses equivalent to 6,0 times the base salary.

Article 55. Bonuses for Orders of all types

1. Individuals eligible for the award or posthumous award of Orders of all types shall be awarded Diplomas, frames, and Orders enclosed with the following bonuses:

a) Gold Star Order: 46,0 times the base salary;

b) Ho Chi Minh Order: 30,5 times the base salary;

c) First-Class Independence Order and First-Class Military Exploit Order: 15,0 times the base salary;

d) Second-Class Independence Order and Second-Class Military Exploit Order: 12,5 times the base salary;

dd) Third-Class Independence Order and Third-Class Military Exploit Order: 10,5 times the base salary;

e) First-Class Labor Order, First-Class Feat Order, and First-Class Fatherland Defense Order: 9,0 times the base salary;

h) Third-Class Labor Order, Third-Class Feat Order, Third-Class Fatherland Defense Order, and Great Bravery Order: 4,5 times the base salary.

2. Collectives eligible for Orders of all types shall be awarded Diplomas, frames, and Orders enclosed with bonuses equivalent to 2 times the bonuses for individuals prescribed in Clause 1 of this Article.

Article 56. Bonuses for state honorable titles

1. Mothers eligible for the award or posthumous award of Vietnamese Heroic Mother Titles shall be awarded Badges, Badge containers, Title Diplomas, and frames and bonuses equivalent to 15,5 times the base salary.

2. Individuals eligible for the award or posthumous award of People’s Armed Forces Hero Titles and/or Labor Hero Titles shall be awarded Diplomas, frames, Badges, and Badge Containers and bonuses equivalent to 15,5 times the base salary.

Collectives eligible for the award of People’s Armed Forces Hero Titles and/or Labor Hero Titles shall awarded Flags, Diplomas, frames, Badges, and Badge Containers and bonuses equivalent to 2 times the bonuses for individuals.

3. Individuals eligible for the award of People’s Teacher, Teacher of Merit, People’s Doctor, Doctor of Merit, People’s Artist, Artist of Merit, People’s Artisan, and Artisan of Merit Titles shall be awarded Badges, Badge Containers, Diplomas of Merit, and frames and bonuses equivalent to 12,5 times the base salary for People’s Titles or 9,0 times the base salary for Merit Titles.

Article 57. Bonuses for Ho Chi Minh Prizes and State Awards

1. Ho Chi Minh Prizes concerning science and technology and Ho Chi Minh Prizes concerning literature and art shall be awarded together with Diplomas, frames, and bonuses equivalent to 270,0 times the base salary.

Article 58. Bonuses for Diplomas of Merit, Certificates of Merit, and Commemorative Medals

1. For individuals:

a) Individuals eligible for the award or posthumous award of Diplomas of Merit of the Prime Minister of Vietnam shall be awarded Diplomas, frames, and bonuses equivalent to 3,5 times the base salary;

b) Individuals eligible for the award or posthumous award of Diplomas of Merit of ministries, departments, and central or local authorities shall be awarded Diplomas, frames, and bonuses equivalent to 1,5 times the base salary;

c) Individuals eligible for the award of Commemorative Medals of the Standing Committee of the National Assembly of Vietnam shall be awarded Diplomas, frames, Commemorative Medals, Commemorative Medal Containers, and bonuses up to 0,8 times the base salary;

d) Individuals eligible for the award of Commemorative Medals of ministries, departments, central or local authorities, political organizations, socio-political organizations, social-vocational political organizations, social organizations, and socio-vocational organizations with CPV Designated Representations or CPV organizations of CPV Designated Representations of central authority clusters shall be awarded Diplomas, frames, Commemorative Medals, Commemorative Medal Containers, and bonuses up to 0,6 times the base salary;

dd) Individuals eligible for the award of Diplomas of Merit of military regions, corps, services, armies, general departments, and equivalents of the Ministry of National Defense of Vietnam and the Government Cipher Committee; Diplomas of Merit of National Universities shall be awarded Diplomas, frames, and bonuses equivalent to 1,0 time the base salary;

e) Individuals eligible for Certificates of Merit prescribed in Points a, b, c, and d Clause 1 Article 75 of the Law on Emulation and Commendation shall be awarded Diplomas, frames, and bonuses equivalent to 0,3 times the base salary;

g) Individuals eligible for Certificates of Merit of Presidents of People’s Committees of communes shall be awarded Diplomas, frames, and bonuses equivalent to 0,15 times the base salary.

a) Collectives eligible for the award of Diplomas of Merit of the Prime Minister of Vietnam and/or Diplomas of Merit of ministries, departments, and central or local authorities shall be awarded Diplomas, frames, and bonuses equivalent to 2 times those for individuals as prescribed in Points a and b Clause 1 of this Article;

b) Collectives eligible for the award of Diplomas of Merit of military regions, corps, services, armies, general departments, and equivalents of the Ministry of National Defense of Vietnam and the Government Cipher Committee; Diplomas of Merit of National Universities shall be awarded Diplomas, frames, and bonuses equivalent to 2 times those for individuals as prescribed in Point dd Clause 1 of this Article;

c) Collectives eligible for Certificates of various levels shall be awarded Diplomas, frames, and bonuses equivalent to 2 times those for individuals as prescribed in Point e Clause 1 of this Article.

3. Households eligible for the award of commendation forms shall be awarded Diplomas, frames, and bonuses equivalent to 1,5 times those for individuals.

Article 59. Bonuses for Medals

Individuals eligible for the award or posthumous award of Medals prescribed in Clause 2 Article 54 of the Law on Emulation and Commendation shall be awarded Diplomas, frames, Medals, Medal Containers, and bonuses equivalent to 1,5 times the base salary.

HONORING AND AWARDING TITLES AND PRIZES TO BUSINESSMEN, ENTERPRISES, AND OTHER ECONOMIC ORGANIZATIONS

1. Agencies and units competent to carry out assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations include:

a) Ministries, ministerial agencies, governmental agencies, central agencies of socio-political organizations, and Vietnam Chamber of Commerce and Industry (hereinafter referred to as “ministries, central authorities, and central unions”);

b) People’s Committees of provinces and centrally affiliated cities (hereinafter referred to as “Provincial People’s Committees”).

2. Subjects assessed for eligibility for being honored and awarded titles and prizes:

a) Vietnamese or foreign businessmen engaging in production and trading in Vietnam’s territory according to the law;

b) Enterprises of economic sectors and other economic organizations.

Article 61. Principles of honoring and awarding titles and prizes

1. Principles of honoring and awarding titles and prizes shall comply with Clause 2 Article 81 of the Law on Emulation and Commendation.

2. Titles and prizes awarded to businessmen, enterprises, and other economic organizations under this Decree are not commendation forms prescribed in the Law on Emulation and Commendation nor the grounds to calculate achievements during assessment for commendation forms at the State level.

1. Scope

a) Assessments for eligibility for being honored and awarded national titles and prizes shall be organized by ministries, central authorities, and central unions or inter-ministerial, inter-sectoral, and inter-provincial agencies. Participants shall be businessmen, enterprises, and other economic organizations in Vietnam;

b) Assessments for eligibility for being honored and awarded provincial titles and prizes shall be organized by Provincial People’s Committees. Participants shall be businessmen, enterprises, and other economic organizations with business registration in areas under the management of such Provincial People’s Committees.

2. Time

a) Assessments for eligibility for being honored and awarded national titles and prizes shall be organized once every 5 years;

b) Assessments for eligibility for being honored and awarded provincial titles and prizes shall be organized once every 3 years;

c) Any following assessment shall be based on the time of the previous organization of the Ceremony for Awarding Titles and Prizes.

Article 63. Competence to decide assessments for eligibility for being honored and awarded titles and prizes

1. Directors of ministries, central authorities, and central unions shall decide on the organization of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations under their management.

Section 2. RIGHTS AND RESPONSIBILITIES OF BUSINESSMEN AND ENTERPRISES; FUNDING FOR ASSESSMENTS FOR HONORING AND AWARDING TITLES AND PRIZES TO BUSINESSMEN, ENTERPRISES, AND OTHER ECONOMIC ORGANIZATIONS

Article 64. Rights and responsibilities of business, enterprises, and other economic organizations with awarded titles and prizes

1. They may receive Trophies, Certificates, and bonuses (if any) from organizing agencies and units and use or utilize logos of titles and prizes for commercial purposes.

2. They shall preserve and promote gained achievements and refrain from taking advantage of awarded titles and prizes for illegal act commission.

Article 65. Organizational funding

1. Funding for organizing assessments for honoring and awarding titles, prizes, and bonuses (if any) to businessmen, enterprises, and other economic organizations shall be carried out by organizing agencies and units.

Funding for assessments for eligibility for being honored and awarded titles, prizes, and bonuses shall be established from voluntary contributions from domestic and foreign businessmen, enterprises, organizations, and individuals in conformity with the law.

2. The management and use of funding prescribed in Clause 1 of this Article shall comply with the law. The funding shall be publicly used for organizing assessments for the award of titles and prizes.

1. Having good moral qualities and strictly implementing the guidelines and policies of CPV, laws of the State, and regulations of their agencies, organizations, and residential areas.

2. Holding positions of managers of enterprises and other economic groups in a manner of stability and continuous development for at least 7 years when participating in assessments for titles and prizes of ministries, central departments, central unions, and socio-vocational organizations and for at least 5 years when participating in assessments for eligibility for being honored and awarded provincial titles and prizes of provinces or centrally affiliated cities (by the time of applying for participation). Regarding businessmen operating many different enterprises or changing jobs, the time spent operating enterprises and other economic organizations shall be accumulated to calculate conditions for participating in assessments for titles and prizes.

3. Proactively learning for improvement of enterprise management qualification and capacity.

4. Having innovation initiatives or new management measures or technical applications that contribute to the improvement of productivity, product quality, and competitiveness of enterprises and other economic groups.

5. Providing training in the improvement of qualifications and skills for workers and improving the quality of personnel for enterprises and other economic organizations. Successfully and adequately providing benefits for workers as prescribed by the law.

6. Proactively participating in emulation movements and contributing, supporting, and successfully carrying out social responsibilities of enterprises, businessmen, and other economic organizations in their areas; caring for the development of CPV organizations, Trade Unions, and mass associations (if any) in enterprises and other economic organizations.

7. Enterprises and other economic organizations managed by businessmen shall comply with the law, have revenues and profits, provide payments for the state budget, ensure stable and growing income for their workers, and not be subject to any complaint, denunciation, lawsuit, strike, or mass furlough.

Article 67. Participation conditions of enterprises and other economic organizations

1. Complying with conditions by registered sectors or professions or having issued investment licenses and complying with laws on enterprises, investment, labor, land, construction, environmental protection, intellectual property, quality of goods and products, and laws relevant to business and trading.

3. Having new scientific and technological initiatives and innovations applied to production and trading effectively; having innovation and creativity in production and trading that positively contribute to the general development of society and Vietnam.

4. Adequately complying with obligations concerning finance, tax, and other state budget revenues as prescribed by the law.

5. Ensuring that workers have stable jobs and gradually increasing income; adequately and promptly providing social insurance, health insurance, and unemployment insurance benefits and benefits of relevant policies and laws for workers.

6. Successfully carrying out social security work, proactively and effectively participating in emulation movements launched by ministries and central or local authorities; proactively developing CPV organizations, Trade Unions, and mass associations (if any) in enterprises and other economic organizations.

7. Not being subject to any complaint, denunciation, lawsuit, strike, or mass furlough.

Article 68. Applications and procedures for national scope

1. Applications

a) Written requests of agencies, organizations, and units of ministries, central authorities, and central unions;

b) Organizational schemes containing names of titles and prizes and organizational contents; organizational purposes and requirements; expected time and location of the organization (organizational locations shall ensure fire and explosion safety and order and security; organizational scope and forms; quantity and structure of titles and prizes; composition of the Organizational Board and Council for assessments for eligibility for being honored and awarded titles and prizes with specific regulations on the quantity, structure, composition, functions, and tasks of the mentioned entities. The Head of the Organizational Board and the President of the Award Council shall be heads of ministries, central authorities, central unions, and socio-vocational organizations or heads of provinces or centrally affiliated cities. Members of the Award Council include representatives of relevant agencies, specialists with knowledge and qualification concerning sectors, fields, and contents of titles and prizes; financial schemes specifying revenue sources, collection principles, expense principles, expenditures, and responsibilities for financial management and implementation. Commitment of the organizing unit to not collect any fees from businessmen and enterprises participating in assessments for titles and prizes in any form;

2. Procedures

a) Applications to be presented to Directors of ministries, central authorities, and central unions shall be submitted through advisory agencies engaging in ministerial emulation and commendation work;

b) Within 10 working days from the date of receipt of adequate applications as per regulation, advisory agencies engaging in ministerial emulation and commendation work shall appraise and present such applications to Directors of ministries, central authorities, and central unions for decisions.

3. In case ministries, central authorities, and central unions have issued decisions on the issuance of regulations on the organization of assessments for honoring and awarding titles and prizes to businessmen and enterprises in conformity with this Decree, the organization of assessments for eligibility for being honored and awarded titles and prizes shall comply with regulations of ministries, central authorities, and central unions.

4. Directors of ministries, central authorities, and central unions shall decide on and assume responsibility for the organization of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations under their management.

Article 69. Applications and procedures for provincial scope

1. Applications

a) Written requests of departments and authorities of provinces and centrally affiliated cities;

b) Organizational schemes according to Point b Clause 1 Article 68 of this Decree, specifying professions, participants, award criteria, and methods and procedures for awarding titles and prizes.

a) Applications to be presented to Presidents of Provincial People’s Committees shall be submitted through agencies specialized in provincial emulation and commendation work;

b) Within 10 working days from the date of receipt of adequate applications as per regulation, agencies specialized in provincial emulation and commendation work shall appraise and present such applications to Presidents of Provincial People’s Committees for decisions.

3. In case Provincial People’s Committees have issued decisions on the issuance of regulations on the organization of assessments for honoring and awarding titles and prizes to businessmen and enterprises in conformity with this Decree, the organization of assessments for eligibility for being honored and awarded titles and prizes shall comply with regulations of Provincial People’s Committees.

4. Presidents of Provincial People’s Committees shall decide on and assume responsibility for the organization of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations under their management.

Article 70. Organization of assessments for eligibility for being honored and awarded titles and prizes

1. After receiving decisions to honor and award titles and prizes to businessmen, enterprises, and other economic organizations, organizing agencies, units, and information and communications agencies shall carry out dissemination work and organize activities relevant to the award of titles and prizes.

2. Agencies and units shall organize assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations in compliance with the law, organizational schemes, and award regulations; collect feedback from relevant agencies and the people on mass media on the participating businessmen, enterprises, and other economic organizations.

3. Honoring and awarding titles and prizes of ministries, central authorities, and central unions to businessmen, enterprises, and other economic organizations shall be carried out by leaders of such ministries, central authorities, and central unions; titles and prizes of provinces and centrally affiliated cities shall be awarded by leaders of such provinces and centrally affiliated cities.

Article 71. Suspension of assessments for eligibility for being honored and awarded titles and prizes

a) Organizing assessments for eligibility for being honored and awarded titles and prizes without permission from competent authorities;

b) Formulating untruthful applications for requesting competent authorities to permit the organization of assessments for eligibility for being honored and awarded titles and prizes;

c) Carrying out the organization contrary to schemes for and regulations on assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations approved by competent authorities;

d) Having acts of deceiving or forcing businessmen, enterprises, and other economic organizations to participate in assessments for eligibility for being honored and awarded titles and prizes;

dd) Mobilizing funding in specific forms from individuals and organizations participating in the voting for eligibility for being honored and awarded titles and prizes.

2. Advisory agencies engaging in ministerial emulation and commendation work shall, based on the conclusions of competent authorities, request ministerial Directors to suspend the organization of assessments for the award of national titles and prizes. Advisory agencies engaging in provincial emulation and commendation work shall request the Presidents of Provincial People’s Committees to suspend the organization of assessments for the award of provincial titles and prizes.

3. Applications for suspension include:

a) Statements of agencies engaging in provincial emulation and commendation work;

b) Conclusions of competent authorities on violations of agencies or units organizing assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations.

a) Within 15 working days from the date of conclusions on legal violations in the organization of the award of titles and prizes to businessmen, enterprises, and other economic organizations, inspection teams or competent authorities shall send the conclusions to agencies specialized in ministerial or provincial emulation and commendation work;

b) Within 10 working days from the date of receipt of conclusions on legal violations, agencies specialized in ministerial or provincial emulation and commendation work shall request Directors of ministries, central authorities, and central unions or Presidents of Provincial People's Committees to issue decisions to suspend the organization of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations.

5. Suspended agencies and units shall immediately suspend the organization of assessments for eligibility for being honored and awarded titles and prizes, cancel results concerning awarded titles and prizes, and provide compensations (if any) for relevant organizations and individuals according to the law.

Article 72. Cancelation of results of assessments for eligibility for being honored and awarded titles and prizes

1. Businessmen, enterprises, and other economic organizations shall have their results concerning assessments for eligibility for being honored and awarded titles and prizes canceled if they commit one of the following acts:

a) Declaring untruthful achievements to participate in assessments for eligibility for being honored and awarded titles and prizes;

b) Taking advantage of awarded titles and prizes for legal violation commission;

c) Committing legal violations during the period of achievement calculation for assessments for eligibility for being honored and awarded titles and prizes liable for criminal prosecution.

2. Agencies and units organizing assessments for the award of titles and prizes shall, based on the conclusions of competent authorities concerning the untruthful declarations of achievements or legal violations of businessmen, enterprises, and other economic organizations, decide to cancel the results of award assessments, recover Trophies, Certificates, and bonuses (if any) awarded to businessmen, enterprises, and other economic organizations, and disclose such operation to communications agencies.

1. The Ministry of Home Affairs of Vietnam shall assist the Government of Vietnam in the state management of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations.

2. Ministries, ministerial agencies, and People’s Committees of provinces and centrally affiliated cities shall, within their scope of tasks and entitlements, carry out the state management of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations; carry out assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations in compliance with this Decree.

3. Central agencies of socio-political organizations shall, within their scope of tasks and entitlements, implement regulations on the organization of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations according to this Decree.

4. Mass information agencies shall disseminate and popularize legal regulations on assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations; discover and disseminate advanced examples of businessmen, enterprises, and other economic organizations. Mass information agencies shall not televise or report cases of assessments for honoring and awarding titles and prizes to businessmen, enterprises, and other economic organizations contrary to the law.

Chapter VIII

PROCEDURES FOR CANCELING DECISIONS ON THE AWARD OF EMULATION TITLES AND COMMENDATION FORMS; PROCEDURES FOR DEPRIVING, REINSTATING, AND RE-AWARDING STATE HONORABLE TITLES; PROCEDURES FOR RECOVERING COMMENDATION ITEMS AND BONUSES

Section 74. Applications and procedures for canceling decisions on the award of emulation titles and commendation forms

1. Collectives, individuals, and households committing acts prescribed in Clause 2 Article 93 of the Law on Emulation and Commendation shall have their decisions on the award of emulation titles and commendation forms canceled and received items and bonuses recovered.

2. Requesting authorities shall, based on the conclusions of competent authorities concerning whether individuals and collectives have acts of violations prescribed in Clause 2 Article 93 of the Law on Emulation and Commendation, request competent authorities to issue decisions to cancel decisions on the award of emulation titles and commendation forms and recovery of items and bonuses.

a) Statements of ministries, departments, and central or local authorities requesting the recovery of each emulation title and commendation form of individuals, collectives, and households;

b) Summary reports of authorities requesting the commendations on reasons for requesting competent authorities to cancel decisions on the award of emulation titles and commendation forms (enclosed with commendation decisions).

4. The Ministry of Home Affairs of Vietnam shall summarize applications and present them to the Prime Minister of Vietnam within 10 working days from the date of receipt of adequate applications as per regulation.

5. The Ministry of Home Affairs of Vietnam’s application, to be presented to the Prime Minister of Vietnam, includes the statement of the Ministry of Home Affairs of Vietnam enclosed with the applications prescribed in Clause 3 of this Article.

Article 75. Applications and procedures for depriving, reinstating, and re-awarding state honorable titles

1. Individuals and commercial juridical persons with awarded state honorable titles that commit violations prescribed in Clauses 3, 4, and 5 Article 93 of the Law on Emulation and Commendation shall have their state honorable titles deprived.

2. Within 30 days from the legally effective date of judgments, authorities requesting commendations shall request the Prime Minister of Vietnam to request the President of Vietnam to decide on the deprivation of state honorable titles.

3. Individuals and commercial juridical persons that are deprived of their state honorable titles and then receive legally effective judgments or decisions of the Court declaring their innocent and exemption from criminal liabilities or are not subject to cases prescribed in Clauses 3, 4, and 5 Article 93 of the Law on Emulation and Commendation shall have their state honorable titles reinstated or re-awarded.

4. Applications for deprivation, reinstatement, and re-award of state honorable titles shall contain a set (original copy) of the following documents:

b) Summary reports of the authorities requesting the commendations specifying the contents or reasons for requests and feedback from competent authorities.

5. The Ministry of Home Affairs of Vietnam shall summarize applications and present them to the Prime Minister of Vietnam within 10 working days after the date of receipt of adequate applications as per regulation.

6. The Ministry of Home Affairs of Vietnam’s application, to be presented to the Prime Minister of Vietnam, includes the statement of the Ministry of Home Affairs of Vietnam enclosed with the applications prescribed in Clause 4 of this Article.

Article 76. Recovery of commendation items and bonuses

1. Recovery of state commendation items and bonuses

a) Within 15 working days after the date of receipt of decisions on deprivation of state honorable titles or cancellation of commendation decisions of the President of Vietnam or decisions to award emulation titles and commendation forms of the Government of Vietnam and the Prime Minister of Vietnam, individuals and collectives shall adequately return the received commendation items and bonuses to ministries, departments, and central or local authorities that requested the commendations and paid bonuses to individuals, collectives, and households.

b) Ministries, departments, and central or local authorities shall urge individuals, collectives, and households to return received commendation items punctually and send them to the Ministry of Home Affairs of Vietnam within 15 working days after the date of receipt of such returned items; recovered bonuses shall be transferred to the state budget or emulation and commendation funds as per regulation;

c) The Ministry of Home Affairs of Vietnam shall urge ministries, departments, and central or local authorities to recover awarded commendation items.

b) Competent authorities issuing decisions to award emulation titles and commendation forms shall urge individuals, collectives, and households to return received commendation items and bonuses punctually and organize the recovery as per regulation.

FORMS OF ORDERS, MEDALS, AND COMMEMORATIVE MEDALS; FORMS OF CERTIFICATES OF EMULATION TITLES AND COMMENDATION FORMS; FORMS OF CERTIFICATES OF STATE HONORABLE TITLES AND EMULATION FLAGS; FORMS OF DIPLOMAS, FRAMES, CONTAINERS, AND FLAGS OF EMULATION TITLES AND COMMENDATIONS FORMS; PROCEDURES FOR REPLACING AND RE-ISSUING COMMENDATION ITEMS

Types with classification have 3 classes, distinguished by the number of stars attached on the top bars and ribbons of Orders (the First Class has 3 stars, the Second Class has 2 stars, and the Third Class has 1 star).

Article 79. Forms of badges of National Emulation Fighter Titles, Emulation Fighter Titles of ministries, departments, and central or local authorities, and state honorable titles; forms of commemorative medals

1. The structure of Badges of state honorable titles and badges of National Emulation Fighter Titles and Emulation Fighter Titles of ministries, departments, and central or local authorities includes 2 parts: the top bar and the body.

Forms of badges of emulation fighter titles of ministries, departments, and central or local authorities shall be stipulated by such entities in conforming with and carrying the meaning of each sector, occupation, and province with a size smaller than badges of state honorable titles.

Badges of state honorable titles and badges of National Emulation Fighter Titles are illustrated in Appendix II enclosed herewith.

2. Commemorative Medals of the Standing Committee of the National Assembly of Vietnam, ministries, departments, central or local authorities, political organizations, socio-political organizations, socio-vocational political organizations, social organizations, socio-vocational organizations with CPV Designated Representations or CPV organizations of CPV Designated Representations of central authority clusters.

a) The structure of a Commemorative Medal includes 2 parts: the top bar and the body;

b) Forms of Commemorative Medals shall be stipulated by the Standing Committee of the National Assembly of Vietnam, ministries, departments, central or local authorities, political organizations, socio-political organizations, socio-vocational political organizations, social organizations, socio-vocational organizations with CPV Designated Representations or CPV organizations of CPV Designated Representations of central authority clusters conforming with and carrying the meaning of each sector, occupation, and province.

Article 81. Forms of Ho Chi Minh Orders

1. The top bar shall be made of copper with Gold Nickel Alloy plating, sized 28 mm x 14 mm, wrapped in woven polyester fabric or equivalents with yellow outer edges, ensuring sturdiness and durability with a red background and two yellow lines.

2. The ribbon shall have a stylized A shape and be made of stainless steel with Gold Nickel Alloy plating, sized 28 mm x 51 mm x 41 mm x 51mm, wrapped in woven polyester fabric or equivalents, ensuring sturdiness and durability with a red background and two yellow lines.

3. The body shall be made of a circle with a diameter of 40 mm; the middle of the circle shall contain a side portrait of President Ho Chi Minh, placed on a background of yellow ancient lotus motifs with the phrase “Huân chương Hồ Chí Minh” (Ho Chi Minh Order) above and the phrase “Việt Nam” (Vietnam) below in red. The material of the body is copper with Gold Nickel Alloy plating.

1. Form:

a) Diplomas shall be printed on A3 papers (sized 420 mm x 297 mm); the size of the border motif is 360 mm x 237 mm;

b) Motifs:

The border and four corners outside of the border shall be decorated with motifs. Diplomas of medals, diplomas of meritorious state honorable titles, Diplomas of Merit of the Prime Minister of Vietnam, and diplomas of National Emulation Fighter Titles shall not have motifs outside of the border.

Above the middle shall be the National Emblem of the Socialist Republic of Vietnam with motifs transitioning between the National Emblem and the border motif. A Diploma of a National Emulation Fighter Title shall have lines of red flags on both sides instead of transitional motifs.

The image of the body of the order, medal, or badge shall be placed in the middle below the border motif. A Diploma of a Ho Chi Minh Order shall use the image of a lotus instead of the image of the body of the Order;

c) Background:

A Diploma of a Gold Star Order shall use the motif of the bronze drum with a star shape in the middle.

A Diploma of a Ho Chi Minh Order shall use a lotus motif.

A Diploma of a Fatherland Defense Order shall use the motif of the bronze drum with a map of Vietnam in the middle.

Diplomas of Independence Orders, Labor Orders, Bravery Orders, Great National Unity Orders, Friendship Orders, Friendship Medals, and state honorable titles shall use the motif of the bronze drum.

Diplomas of Merit of the Prime Minister of Vietnam shall use the cloud motif.

Diplomas of National Emulation Fighter Titles shall use the symbol of the National Patriotic Emulation Congress.

2. Content:

a) National Name: “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” (SOCIALIST REPUBLIC OF VIETNAM), presented in capital letters, font “Times New Roman”, font size 15, and vertical, bold, and black letters;

b) Motto: “Độc lập - Tự do - Hạnh phúc” (Independence-Freedom-Happiness), presented in lowercase letters, font “Times New Roman”, font size 16, vertical, bold, and black letters, below the National Name; the first letter of each phrase shall be capitalized with hyphens and spaces between phrases; phrases shall be underlined, with a length equal to the length of the text;

c) Competence to decide on commendations:

Phrases “CHỦ TỊCH” (PRESIDENT) and “NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” (SOCIALIST REPUBLIC OF VIETNAM) shall be written in 2 separate lines for diplomas of commendation forms of the President of Vietnam or phrases “THỦ TƯỚNG” (PRIME MINISTER) and “CHÍNH PHỦ NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” (GOVERNMENT OF SOCIALIST REPUBLIC OF VIETNAM) for commendation forms of the Prime Minister of Vietnam; capital letters, font “Times New Roman”, font size 26 for the upper line and 20 for the lower line, and vertical, bold, and black letters

“TẶNG” (AWARD) or “TRUY TẶNG” (POSTHUMOUS AWARD) shall be written for diplomas of orders, medals, Ho Chi Minh Prizes, State Awards, and Diplomas of Merit of the Prime Minister of Vietnam; “TẶNG DANH HIỆU” (AWARD OF TITLE) or “TRUY TẶNG DANH HIỆU” (POSTHUMOUS AWARD OF TITLE) shall be written for diplomas of state honorable titles and “TẶNG DANH HIỆU” (AWARD OF TITLE) shall be written for diplomas of National Emulation Fighter Titles; capital letters, font “Times New Roman”, font size 24, and vertical, bold, and black letters

dd) Names of commendation forms or emulation titles; capital letters, font “Times New Roman”, font size 42, and vertical, bold, and red letters;

e) The classification of emulation forms (if any) and names of commended units and individuals: capital, vertical, bold, and black letters; addresses (or positions and working units for individuals working at agencies and units or governing bodies for collectives) and achievements of commended individuals and collectives: lowercase letters, font “Times New Roman”, appropriate font size, and vertical, bold, and black letters;

g) Decision numbers and decision dates shall be written based on the numbers and promulgation dates of decisions; “Số sổ vàng” (Gold book number) shall display the serial numbers of the commendation subjects in decisions; lowercase letters, font “Times New Roman”, font size 14, and italic, bold, and black letters;

h) Geographical locations and dates: lowercase letters, font “Times New Roman”, font size 15, and italic, bold, and black letters;

i) Positions of persons competent to decide on commendations: the phrase “CHỦ TỊCH” (PRESIDENT) shall be written for commendation decisions under the jurisdiction of the President of Vietnam or “THỦ TƯỚNG” (PRIME MINISTER) for commendation decisions under the jurisdiction of the Prime Minister of Vietnam; capital letters, font “Times New Roman”, font size 14, and vertical, bold, and black letters;

k) Space to sign, stamp, and write the full names of the persons competent to decide on commendations.

a) Diplomas shall be printed on papers sized 360 mm x 237 mm;

b) Motifs:

The border shall be decorated with motifs but shall not be identical or similar to state-level diplomas of merit.

Above the middle is the National Emblem of the Socialist Republic of Vietnam or symbols of agencies or organizations instead of the National Emblem for diplomas of merit and diplomas of emulation fighter titles of CPV Departments and central unions and diplomas of merit of provincial political organizations and socio-political organizations. There shall not be motifs in the four corners outside of the border motif and transitional motifs between the National Emblem and the border motif. Regarding diplomas of emulation fighter titles, there shall be lines of red flags on both sides of the National Emblem or symbols of agencies or organizations;

c) The background of the diploma shall be stipulated by the competent authority, ensuring that it is not identical to the background of diplomas awarded or posthumously awarded by the President of Vietnam and the Prime Minister of Vietnam.

2. Content:

The content, layout, font, and font size shall be stipulated by agencies and units competent to decide on commendations, ensuring beauty, formality, and the following main contents:

a) The first line and second line shall display:

Diplomas of merit and diplomas of emulation fighter titles of CPV agencies shall have the phrase “ĐẢNG CỘNG SẢN VIỆT NAM” (COMMUNIST PARTY OF VIETNAM) instead of the National Name, presented in capital, vertical, bold, and black letters;

b) The third line shall display the positions of persons competent to decide on commendations, presented in capital, vertical, bold, and red letters;

c) The fourth line shall display the commendation nature.

“TẶNG” (AWARD) shall be written for diplomas of merit or “TẶNG DANH HIỆU” (AWARD OF TITLE) for diplomas of emulation fighter titles; capital, vertical, bold, and black letters;

d) The fifth line shall display names of commendation forms or emulation titles; capital, vertical, bold, and red letters;

dd) The following lines shall display names of commended collectives, individuals, and households; addresses or titles and working units regarding individuals working at agencies or units or governing bodies regarding collectives and achievements of commended collectives, individuals, and households; black letters;

e) Below the left side are the decision numbers and decision dates, written based on the numbers and promulgation dates of decisions; “Số sổ vàng” (Gold book number), placed below the line of the decision numbers, displays the serial numbers of the commendation subjects in decisions; lowercase, italic, bold, and black letters;

g) Below the right side shall contain geographical locations and dates; lowercase, italic, bold, black letters.

Below geographical locations shall be the positions of persons competent to decide on commendations, capital, vertical, bold, and black letters;

Article 104. Forms of certificates of merit and diplomas of Grassroots-Level Emulation Fighter Titles

1. Form:

a) Diplomas shall be printed on A4 papers sized 297 mm x 210 mm;

b) Motifs:

The border shall be decorated with motifs but shall not be identical or similar to the motifs on state-level diplomas of merit.

Above the middle shall have:

The National Emblem of the Socialist Republic of Vietnam for certificates of merit and diplomas of Grassroots-Level Emulation Fighter Titles of Directors of agencies and units of ministries, departments, ministerial agencies, governmental agencies, Directors of specialized agencies and equivalents of Provincial People’s Committees, and Presidents of People’s Committees of districts and certificates of Presidents of People’s Committees of communes.

Symbols of agencies and organizations for certificate of merit and diplomas of Grassroots-Level Emulation Fighter Titles of political organizations and socio-political organizations and certificates of merit of Presidents of Administrative Councils, Presidents of Member Councils, Directors-General, Directors of enterprises, and collectives.

Regarding diplomas of Grassroots-Level Emulation Fighter Titles, there shall be lines of red flags on both sides of the National Emblem or symbols of unions;

c) The background shall be blank.

2. Content:

The content, layout, font, and font size shall be stipulated by agencies and units competent to decide on commendations, ensuring the aesthetics and the following main contents:

a) The first line and second line shall display:

National Name: “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” (SOCIALIST REPUBLIC OF VIETNAM), presented in capital, vertical, bold, and black letters.

Motto: “Độc lập - Tự do - Hạnh phúc” (Independence-Freedom-Happiness), presented in lowercase, vertical, bold, and black letters below the National Name; the first letter of each phrase shall be capitalized with hyphens and spaces between phrases; phrases shall be underlined, with a length equal to the length of the text. Certificates of merit and diplomas of Grassroots-Level Emulation Fighter Titles of CPV agencies shall have the phrase “ĐẢNG CỘNG SẢN VIỆT NAM” (COMMUNIST PARTY OF VIETNAM) instead of the National Name, presented in capital, vertical, bold, and black letters;

b) The third line shall display the positions of persons competent to decide on commendations, presented in capital, vertical, bold, and red letters;

c) The fourth line shall contain “TẶNG” (AWARD) for certificates of merit or “TẶNG DANH HIỆU” (AWARD OF TITLE) for diplomas of Grassroots-Level Emulation Fighter Titles; capital, vertical, bold, and black letters;

d) The fifth line shall display names of commendation forms or emulation titles; capital, vertical, bold, and red letters;

e) Below the left side are the decision numbers and decision dates, written based on the numbers and promulgation dates of decisions; “Số sổ vàng” (Gold book number), placed below the line of the decision numbers, displays the serial numbers of the commendation subjects in decisions; lowercase, italic, bold, and black letters;

g) Below the right side shall contain geographical locations and dates; lowercase, italic, bold, black letters.

Below geographical locations shall be the positions of persons competent to decide on commendations; capital, vertical, bold, and black letters;

h) Space to sign, stamp, and write the full names of the persons competent to decide on commendations.

Article 105. Forms of Diplomas of Commemorative Medals of the Standing Committee of the National Assembly of Vietnam and Commemorative Medals of ministries, departments, and central or local authorities; certificates of Family of Culture Titles

Diplomas shall be printed on A5 papers sized 210 mm x 148 mm;

Contents of and motifs on diplomas shall be stipulated by the Standing Committee of the National Assembly of Vietnam and ministries, departments, and central or local authorities.

Article 106. Forms of Diplomas of Excellent Labor Collective and Determined-to-Win Unit titles; typical commune, ward, or town titles; village or street quarter of culture titles

b) Motifs:

Above the middle is the National Emblem of the Socialist Republic of Vietnam and lines of red flags on both sides (for certification diplomas under the jurisdiction of Ministers, Directors of ministerial agencies, governmental agencies, Chief Justice of the Supreme People’s Court of Vietnam, Director of the Supreme People’s Procuracy, Head of the Office of the National Assembly of Vietnam, Head of the Office of the President of Vietnam, Auditor General of the State Audit Office of Vietnam, Presidents of People’s Committees of provinces and districts, and Heads of competent units of the Ministry of National Defense of Vietnam); or symbols of agencies and organizations and lines of red flags on both sides (for certification diplomas under the jurisdiction of Heads of CPV Departments and equivalents at the central level, Chief of Office of the CPV Central Committee, heads of central authorities of the Vietnamese Fatherland Front, and unions);

c) The background shall be blank.

2. Content:

The content shall be stipulated by agencies and units competent to decide on commendations. The layout, font, and font size shall ensure the aesthetics and the following main contents:

a) The first line and second line shall display:

dd) The following lines shall display names of units receiving emulation titles; addresses (or governing bodies regarding collectives) and achievements of commended collectives; black letters;

e) Below the left side are the decision numbers and decision dates, written based on the numbers and promulgation dates of decisions; “Số sổ vàng” (Gold book number), placed below the line of the decision numbers, displays the serial numbers of the commendation subjects in decisions; lowercase, italic, bold, and black letters;

g) Below the right side shall contain geographical locations and dates; lowercase, italic, bold, black letters.

Below geographical locations shall be the positions of persons competent to decide on commendations; capital, vertical, bold, and black letters;

h) Space to sign, stamp, and write the full names of the persons competent to decide on commendations.

Article 107. Forms of flags of Heroic Province, Heroic City, People's Armed Forces Hero, and Labor Hero Titles

2. Contents be embroidered with yellow thread with capital, vertical, and bold letters; font and font size shall be appropriately adjusted depending on the contents of flags, ensuring beauty, formality, and the following main contents:

a) The first line shall contain “CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM” (SOCIALIST REPUBLIC OF VIETNAM), presented in capital, vertical, bold, and black letters;

b) The second line shall contain “TẶNG DANH HIỆU” (AWARD OF TITLE), presented in capital, vertical, and bold letters;

c) Below the second line, there shall be a five-pointed gold star in the middle;

d) Below the star, names of the emulation titles shall be written (i.e., “ANH HÙNG LAO ĐỘNG” (LABOR HERO), “ANH HÙNG LỰC LƯỢNG VŨ TRANG NHÂN DÂN” (PEOPLE’S ARMED FORCES HERO), “TỈNH ANH HÙNG” (HEROIC PROVINCE), or “THÀNH PHỐ ANH HÙNG” (HEROIC CITY)) in capital, vertical, and bold letters and names of the commended units shall be written at the end.

Forms of flags are illustrated in Appendix II.3 enclosed herewith.

Article 108. Forms of Emulation Flags of the Government of Vietnam

1. Form: Flag size: 850 mm x 650 mm; material: two-layer red satin fabric.

2. Contents be embroidered with yellow thread with capital, vertical, and bold letters; font and font size shall be appropriately adjusted depending on the contents of flags, ensuring beauty, formality, and the following main contents:

b) The second line shall contain “TẶNG” (AWARD), presented in capital, vertical, and bold letters;

c) Below the second line, there shall be a five-pointed gold star in the middle;

d) Below the star, the names of the units receiving the Emulation Flags of the Government of Vietnam and “ĐƠN VỊ XUẤT SẮC TRONG PHONG TRÀO THI ĐUA NĂM HOẶC PHONG TRÀO THI ĐUA” (EXCELLENT UNIT IN THE EMULATION MOVEMENT OF THE YEAR OR EMULATION MOVEMENT) shall be written; the "YEAR" shall be the year when units with achievements are awarded titles and "EMULATION MOVEMENT" shall be the emulation movement launched by the Prime Minister of Vietnam; capital, vertical, and bold letters.

Forms of flags are illustrated in Appendix II.3 enclosed herewith.

Article 109. Forms of Emulation Flags of ministries, departments, and central or local authorities

1. Form: Flag size: 800 mm x 600 mm; material: two-layer red satin fabric.

2. Contents be embroidered with yellow thread with capital, vertical, and bold letters; font and font size shall be appropriately adjusted depending on the contents of flags, ensuring beauty, formality, and the following main contents:

a) The first line shall contain names of ministries, central authorities, central unions, local authorities, or centrally affiliated cities; capital, vertical, and bold letters;

b) The second line shall contain “TẶNG” (AWARD), presented in capital, vertical, and bold letters;

d) Below the star, the names of the units receiving the Emulation Flags and “ĐƠN VỊ DẪN ĐẦU PHONG TRÀO THI ĐUA NĂM HOẶC PHONG TRÀO THI ĐUA” (LEADING UNIT IN THE EMULATION MOVEMENT OF THE YEAR OR EMULATION MOVEMENT) shall be written; the "YEAR" shall be the year when units with achievements are awarded titles and "EMULATION MOVEMENT" shall be the emulation movement launched by ministries, departments, and central or local authorities; capital, vertical, and bold letters.

Article 110. Forms of Emulation Flags of military regions, corps, services, armies, general departments, and equivalents of the Ministry of National Defense of Vietnam, emulation flags of the Government Cipher Committee, and emulation flags of National Universities

1. Form: Flag size: 750 mm x 550 mm; material: two-layer red satin fabric.

2. Embroidered contents shall be stipulated by the Ministry of National Defense of Vietnam and the Ministry of Education and Training of Vietnam.

Article 111. Forms of frames of diplomas of emulation titles and commendation forms

Frames shall be provided together with diplomas of emulation titles and commendation forms. Forms of frames are stipulated as follows:

1. Forms of frames of diplomas of emulation titles and commendation forms shall be under the jurisdiction of the President of Vietnam and the Prime Minister of Vietnam, with size and material ensuring beauty and formality in conformity with the size of diplomas and commendation forms.

2. Frames of diplomas of other emulation titles and commendation forms shall be stipulated by authorities competent to issue commendation decisions, with size and material ensuring beauty and formality in conformity with each commendation form.

Article 112. Containers of orders, medals, badges of state honorable titles, badges of National Emulation Fighter Titles, and Commemorative Medals; containers of frames of diplomas of emulation titles and commendation forms under the jurisdiction of the President of Vietnam, the Government of Vietnam, and the Prime Minister of Vietnam

2. Containers of Commemorative Medals prescribed in Article 71 of the Law on Emulation and Commendation shall be stipulated by authorities competent to issue decisions to award Commemorative Medals with form, size, and material that ensure beauty and formality.

3. Containers of frames of diplomas of emulation titles and commendation forms shall be under the jurisdiction of the President of Vietnam, the Government of Vietnam, and the Prime Minister of Vietnam with form, size, and material that ensure beauty and formality in conformity with the size of frames of diplomas of emulation titles and commendation forms under the jurisdiction of the President of Vietnam, the Government of Vietnam, and the Prime Minister of Vietnam.

Section 2. PROCEDURES FOR REPLACING AND RE-ISSUING COMMENDATION ITEMS

Article 113. Management and issuance of commendation items

1. The Ministry of Home Affairs of Vietnam shall procure, preserve, and issue state-level commendation items to ministries, departments, and central or local authorities with commended individuals, collectives, and households; manage, instruct, and inspect the issuance of state-level commendation items of ministries, departments, and central or local authorities to commended individuals, collectives, and households.

2. Ministries, departments, and central or local authorities shall award emulation titles and commendation forms of the President of Vietnam, the Government of Vietnam, and the Prime Minister of Vietnam with enclosed commendation items to commended individuals, collectives, and households.

3. Regarding other emulation titles and commendation forms, authorities competent to issue commendation decisions shall procure, preserve, award, and issue commendation items.

4. Individuals, collectives, and households receiving emulation titles and commendation forms may store, display, preserve, and use commendation items for long terms and the proper purposes and meaning. Collectives may use symbols of awarded commendation items for dissemination on their official documents.

Article 114. Commendation item replacement

a) Official dispatch requesting the replacement of the collective or the unit requesting the replacement of an individual or household if the commendation items are subject to damage to the point of being unusable or subject to damage due to objective reasons such as natural disasters, floods, fire, or faulty printing enclosed with commendation items subject to the request;

b) Official dispatch requesting the replacement of the ministry, department, or central or local authority following Form 4.5 in Appendix II.4 submitted to the Ministry of Home Affairs of Vietnam to request for state-level commendation item replacement.

2. Procedures for replacing state-level commendation items:

a) Collectives shall have official dispatches, and individuals and households shall have applications for the replacement (following Forms 4.1 and 4.2 in Appendix II.4) submitted to ministries, departments, and central or local authorities (where they are operating or residing) enclosed with commendation items subject to the request;

b) Ministries, departments, and central or local authorities shall summarize the documents mentioned above and send official dispatches requesting the replacement enclosed with lists (following Form 4.5 in Appendix II.4) and old and damaged commendation items to the Ministry of Home Affairs of Vietnam for assessment and replacement;

c) Commendation confirmation and implementation of commendation item replacement:

The Ministry of Home Affairs of Vietnam shall, based on official dispatches requesting commendation item replacement of ministries, departments, and central or local authorities, look up and verify the commendation and carry out the replacement of commendation items while recovering old and damaged commendation items.

Commendation items used for the replacement shall be procured and printed by the Ministry of Home Affairs of Vietnam according to the prescribed forms. Regarding previous state-level commendation items (not prescribed in the current Law on Emulation and Commendation), comply with the prescribed forms at the time when individuals and collectives receive commendation decisions.

Forms of replaced diplomas shall be printed following the design at the time when individuals and collectives receive commendations. Specifically, below the right side shall have the forms of the seal and signature of the person competent at such time pre-printed; below the left side shall have “Quyết định khen thưởng số, ngày, tháng, năm, số sổ vàng” (commendation decision number and date and gold book number) and “chứng nhận cấp đổi bằng số, ngày, tháng, năm” (diploma replacement certification number and date) of the Ministry of Home Affairs of Vietnam. Collectives and individuals with replaced diplomas shall receive replacement certificates (following Form 4.7 in Appendix II.4).

Ministries, departments, and central or local authorities shall submit applications to the Ministry of Home Affairs of Vietnam within 15 days after receiving requests from individuals and collectives.

The Ministry of Home Affairs of Vietnam shall return the replacement results to ministries, departments, and central or local authorities within 30 days after receiving the mentioned applications.

Annually, the Ministry of Home Affairs of Vietnam shall submit reports to the Office of the President of Vietnam and the Office of the Government of Vietnam on the replacement of state-level commendation items for monitoring and cooperative implementation.

4. Applications, procedures, and processing time of other commendation item replacement:

Authorities competent to issue commendation decisions shall settle the replacement of commendation items within 15 working days after receiving requests.

5. Recovered commendation items shall be liquidated, processed, or destroyed by competent authorities as per regulation.

Article 115. Commendation item re-issuance

1. An application for re-issuing state-level commendation items shall contain a set (original copy) of the following documents:

a) Official dispatch requesting the re-issuance of the collective or application for the re-issuance of the individual or household when commendation items are lost due to objective reasons such as natural disasters, floods, fire, or faulty printing submitted to the ministry, department, and central or local authorities requested the commendations for such an individual, collective, or household;

2. Procedures for re-issuing state-level commendation items.

a) Collectives shall have official dispatches, and individuals and households shall have applications for the re-issuance (following Forms 4.3 and 4.4 in Appendix II.4) submitted to ministries, departments, and central or local authorities that requested commendations for such individuals, collectives, and households;

b) Ministries, departments, and central or local authorities shall compare the received applications with the stored applications, verify and summarize them, and send official dispatches enclosed with lists (following Form 4.6 in Appendix II.4) to the Ministry of Home Affairs of Vietnam;

c) Commendation confirmation and implementation of commendation item re-issuance;

The Ministry of Home Affairs of Vietnam shall, based on official dispatches requesting commendation item re-issuance of ministries, departments, and central or local authorities, look up applications, verify the commendation, and re-issue commendation items.

Re-issued commendation items shall be procured and printed by the Ministry of Home Affairs of Vietnam according to following prescribed forms:

Forms of Orders, Medals, and badges prescribed in this Decree. The Ministry of Home Affairs of Vietnam shall return the re-issuance results to ministries, departments, and central or local authorities within 30 days after receiving the mentioned applications.

Chapter X

IMPLEMENTATION PROVISIONS

Article 116. Entry into force

1. This Decree comes into force as of January 1, 2024.

2. Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government of Vietnam; Decree No. 85/2014/ND-CP dated September 10, 2014 of the Government of Vietnam, Decree No. 101/2018/ND-CP dated July 20, 2018 of the Government of Vietnam; Clauses 1, 2, and 3 Article 2 and Articles 25, 26, 27, and 28 of Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government of Vietnam; Decision No. 51/2010/QD-TTg dated July 28, 2010 of the Prime Minister of Vietnam shall be annulled from the effective date of this Decree.

Ministers, Directors of ministerial agencies and governmental agencies, Presidents of People’s Committees of provinces and centrally affiliated cities, and related agencies, organizations, units, and individuals shall implement this Decree./.
