Vietnam's guideline on declaration and payment of fees for review of environmental impact assessment reports

On June 8, 2023, the Minister of Finance of Vietnam promulgated Circular No. 38/2023/TT-BTC on fees for review of environmental impact assessment (EIA) reports performed by central agencies, collection, payment, management, and use thereof.

Declaration and payment of fees for review of EIA reports

- Applicants shall pay the fees to collectors within the period from when they apply for review to before the meeting of the Review Council in compliance with Circular No. 74/2022/TT-BTC .

- By later than the 5th day of every month, the collectors shall transfer the collected fees of the previous month to a designated account opened at the Vietnam State Treasury pending transfer to state budget.

Collectors shall declare, collect, transfer, and finalize the fees following circular No. 74/2022/TT-BTC .

Fees for review of EIA reports

The fees for review of EIA reports performed by central authorities are prescribed in the Tariff promulgated together with Circular No. 38/2023/TT-BTC .

Management and use of fees for review of EIA reports

- Collectors shall transfer 100% of the collected fees to the state budget (central government budget). The cost of review and fee collection shall be covered by the state budget according to the collectors’ cost estimates as prescribed by laws.

- In case the collector is a state agency permitted to use the collected fees to cover its operation costs as prescribed in Clause 1 Article 4 of Decree No. 120/2016/ND-CP :

+ It may retain 65% of the collected fees to cover the costs of review and fee collection according to Article 5 of Decree No. 120/2016/ND-CP ;

+ The remaining 35% shall be transferred to the state budget (central government budget) according to state budget laws.

Circular No. 38/2023/TT-BTC of the Ministry of Finance of Vietnam comes into force as of August 1, 2023.
