The Ordinance provides for imposition of penalties on the revelation of investigation secrets as follows:
- A fine ranging from VND 4 million to VND 8 million shall be imposed on participants in the proceedings who reveal investigation secrets though they are requested to keep investigated information secret by investigators, investigating officers, procurators or inspectors.
- A fine ranging from VND 8 million to VND 15 million shall be imposed on:
+ Participants in the proceedings who reveal investigation secrets that should be kept secret at the request resulting in delay and prolongation of investigation period.
+ Lawyers who reveal investigation secrets though they are requested to keep investigated information secret by investigators, investigating officers, procurators or inspectors.
- A fine ranging from VND 15 million to VND 30 million shall be imposed on lawyers who reveal investigation secrets leading to delay and prolongation of investigation period.
In addition, regulations on remedial measures include:
+ Compulsory retrieval of information, documents, data and items containing investigation secrets.
+ Compulsory removal of information, documents and data containing investigation secrets.
+ Surrender of benefits obtained from the revelation of investigation secrets leading to delay and prolongation of investigation period.
Ordinance No. 02/2022/UBTVQH15 comes into force from September 01, 2022.
