Application and documentation requirements and procedures for entitlement of employees holding employment contracts to covid-19 benefits

The Government has issued the Decision No. 15/2020/QD-TTg on implementation of support policies for people stricken with the COVID-19 pandemic.

The Decision provides guidance about application and documentation requirements and procedures for entitlement of employees holding labor contracts or employment agreements to benefits as follows:

 (1) With regard to those employees whose labor contracts are temporarily suspended or who take unpaid leave

- Eligibility requirements for entitlement to benefits:

+ The length of time during which their employment contracts are temporarily suspended or they take unpaid leave within their contract term must be at least 1 consecutive month within the period from April 1, 2020 to end of June 30, 2020; the date of commencement of temporary suspension of their employment contracts or unpaid leave falls within the period from April 1, 2020 to June 1, 2020.

+ They are participating in the compulsory social insurance plan till the date immediately before the temporary suspension of their employment contracts or their unpaid leave occurs.

+ They are working for enterprises generating no revenue or no longer having funds for payment of their wages (after these enterprises have already used up wage reserve funds, their after-tax profit and other legitimate financing sources, based on the balance calculated till March 31, 2020) due to the Covid-19 pandemic.

- Application and documentation procedures:

- Affected enterprises compile the list of employees subject to the temporary suspension of their employment contracts or compulsory unpaid leave that meet the aforesaid requirements, and request their grassroots-level trade unions (if any) and social security authorities to attest to the list (within 03 working days).

- Enterprises submit the application package No. 01 to People’s Committees of the districts where their offices are located, waiting for approval of the list and receiving benefits.

(2) With regard to those employees who have their labor contracts or employment agreements terminated but are not yet eligible for unemployment benefits 

- Eligibility requirements for entitlement to benefits:

+ They have entered into labor contracts or employment agreements before April 1, 2020 and are participating in the social insurance plan;

+ They have their labor contracts or employment agreements terminated within the period from April 1, 2020 to end of June 15, 2020, but are not eligible for unemployment benefits prescribed in regulations;

+ They do not have income or earn income under the near-poor standard in accordance with the Decision No. 59/2015/QD-TTg dated November 19, 2015.

 (The income meeting the near-poor standard prescribed in the Decision No. 59 is 1,000,000 dong/income-earner/month at rural areas and 1,300,000 dong/income-earner/month at urban areas). 

- Application and documentation procedures:  Employees submit the application package No. 03 to People’s Committees of the communes where they are residing, waiting for approval of the list and receiving benefits.

The Decision No. 15/2020/QD-TTg is set to take effect on April 24, 2020 and incentive policies specified in this Decision are in force from April 1, 2020.
