Fines of up to 20 million dong for spreading fake information on Facebook are about to take effect

This is the highlight of the Decree No. 15/2020/NĐ-CP regulating administrative fines imposed in postal, telecommunications, radio frequency, information technology and electronic transaction sectors.

According to the Decree, fines ranging from 10,000,000 dong to 20,000,000 dong will be imposed on organizations abusing social networks to perform one of eight groups of acts specified in clause 1 of Article 101, specifically including: 

- Providing and sharing false and misleading information, distorting, slandering and offending reputation of other entities, personal renown or dignity;

- Providing and sharing information aimed at supporting unsound customs, superstitious, obscene, depraved and improper information contrary to traditional habits and customs;

- Providing and sharing detailed information about knife and stabbing crime, murder, accident, horrifying or terrifying scenes; 

- Providing and sharing fabricated information frightening the public, provoking violence, crime, debauchery, gambling or gambling support, etc.

In addition to being subject to monetary penalties, violators are forced to remove false and misleading information from their networks.

Notes:  Persons committing the same violations as organizations have to pay a half less than the fine rates applied to organizations.

Decree No. 15/2020/NĐ-CP is officially in force from April 15, 2020 and makes the Decree No. 174/2013/NĐ-CP dated November 13, 2013, and Article 2 in Decree No. 49/2017/NĐ-CP dated April 24, 2017, become defunct.
