From January 1, 2021, children’s toys must be made according to new national regulations

This is the highlight of the Circular No. 09/2019/TT-BKHCN on issuance of National Technical Regulation on safety for children’s toys.

Pursuant to this Circular, National Technical Regulation on safety for children’s toys, QCVN 03:2019/BKHCN, will replace QCVN 3:2009/BKHCN according to the following schedule of application:

- From January 1, 2021, imported and domestically-made toys for kids must meet the requirements set forth in Section 2 of QCVN 03:2019/BKHCN before obtaining marketing authorization.

- Organizations and individuals manufacturing and importing children’s toys will be encouraged to implement regulations laid down in QCVN 03:2019/BKHCN from December 31, 2019.

Notes:  Children’s toys freely sold in domestic market in compliance with the Circular No. 18/2009/TT-BKHCN on issuance of QCVN 3:2009/BKHCN before December 31, 2020 will continue to be sold in domestic markets till end of December 31, 2021.
 

“According to the schedule of the Ministry of Science and Technology, from January 1, 2022, both toys for children imported and domestically-made in compliance with QCVN 3:2009/BKHCN will be banned from free sale. Children’s toys businesses and dealers need to get updated with this in order to avoid being fined", Mr. Bui Tuong Vu, Legal Advocate and Director of THƯ VIỆN PHÁP LUẬT Co., advised.


The Circular No. 09/2019/TT-BKHCN will enter into force on December 31, 2019.
