Fines for illegally using foreign currencies in contract prices are set to drop

On November 14, 2019 the Government promulgated the Decree No. 88/2019/ND-CP on administrative penalties for violations arising in the monetary and banking sector.

The Decree prescribes that any transaction, quotation or determination of contract prices to be carried out using any foreign currency in breach of laws will be fined from 30 million dong to 50 million dong (from 200 million dong to 250 million dong as prescribed in existing regulations).  

In addition, any act of buying or selling foreign currency at unauthorized currency conversion entities will be fined at the following specific levels (instead of a general fine ranging from 80 million dong to 100 million dong as prescribed in existing regulations):

- Cautions will be given if value of foreign currency sold or bought is less than USD 1,000;

- Fines ranging from 10 million dong to 20 million dong will be imposed if value of foreign currency sold or bought is from USD 1,000 to under USD 10,000, or is less than USD 1,000 for any repeat or serial offence;

- Fines ranging from 20 million dong to 30 million dong will be imposed if value of foreign currency sold or bought is from USD 10,000 to under USD 100,000;

- Fines ranging from 20 million dong to 30 million dong will be imposed if value of foreign currency sold or bought is equal to or greater than USD 100,000.

Notes:  The aforesaid fine amounts will be applied to violating persons while entities committing the same violations will be fined 02 times higher.   

The Decree No. 88/2019/ND-CP is entering into force on December 31, 2019, replacing the Decree No. 96/2014/ND-CP dated October 17, 2014.
