Pursuant to this Circular, regulations on special safeguard measures for implementation of the CPTPP agreement are composed of the followings:
- Safeguard measures to be taken during the transition period (transitional safeguard measures) are those measures specified in Article 99 in the Law on Foreign Trade Management and Article 6.3 of Chapter 6 in the Agreement.
- Emergency measures for textile products are those measures specified in Article 99 in the Law on Foreign Trade Management and Article 4.3 of Chapter 4 in the Agreement.
These Regulations laid down in this Circular will be applied to the followings:
- Vietnamese regulatory authorities having jurisdiction to inspect, apply and handle special safeguard measures for implementation of the Agreement.
- Vietnamese traders, traders of member states of the Agreement, other domestic and foreign entities and individuals related to inspection, application and handling of special safeguard measures for implementation of the Agreement.
Inspection authorities are authorized to consider receiving applications submitted to request application of transitional safeguard measures or emergency safeguard measures for textile products according to the effect of the Agreement.
Circular No. 19/2019/TT-BTC is entering into force on November 14, 2019.
