Notable policies coming into force from the end of June, 2019

THƯ VIỆN PHÁP LUẬT would like to introduce 04 notable policies that are coming into force from the end of June, 2019 (June 21 – 30, 2019), including:

1. Eligible candidates and preference scores in commune-level civil service exams

On April 24, 2019, the Government has promulgated the Decree No. 34/2019/ND-CP providing amendments to regulations on commune-level officials and part-time employees working at communes, hamlets and quarters.

According to the Decree, regulations on eligible candidates and preference scores in commune-level civil service exams are amended as follows:

- Candidates who are awarded the title of the Hero of the People’s Armed Forces or the Hero of Labour, or wounded soldiers, persons eligible for benefits as wounded soldiers or type-B wounded soldiers shall have 7.5 points added to their round-2 exam results.

- According to new regulations, sick soldiers are no longer eligible for preference treatments in test-optional admission of commune-level officials, and type-B wounded soldiers will be eligible for such preference treatments..

- The above-mentioned candidates who are qualified for preference treatments shall have 7.5 points added to their round-2 exam results instead of 30 points added to their overall scores as prescribed in current regulations.

The Decree No. 34/2019/ND-CP is coming into force from June 25, 2019.

2. Individuals taking 40 days of annual leave are still eligible for consideration of "Lao động tiên tiến" title in People's Procuracy sector

This is a notable content of the Circular No. 01/2019/TT-VKSTC providing instructions on commendation and rewards in People’s Procuracy sector.

According to the Circular No. 01/2019/TT-VKSTC the current regulation that an individual who takes 40 days of leave or more is not eligible for consideration of competitive titles shall be annulled.

Besides, an individual shall not be eligible for the “Lao động tiên tiến” title in People’s Procuracy sector if he/she:

- has been employed for less than 10 months; or

- has received a reprimand or a harsher disciplinary action.

The Circular No. 01/2019/TT-VKSTC is coming into force from June 28, 2019.

3. Principles for publishing and releasing external affairs-related information in the press

This content is introduced in the Circular No. 03/2019/TT-BTTTT which provides for the publishing and releasing of external affairs-related information in the press.

According to the Circular, the publishing and releasing of external affairs-related information in the press must comply with the following principles:

- Publishing and releasing of external affairs-related information must comply with guidelines and strategies of the Communist Party as well as state laws and policies, and ensure benefits of the nation and people of Vietnam.

- Publishing and releasing of the following information shall be prohibited:

+ Information that causes adverse influence on prestige and image of Vietnam;

+ Information that harms international relations or cooperation between Vietnam and other countries; or 

+ Information that promotes violence or communicates about wars, invasions and hatreds between ethnic groups and people around the world.

The Circular No. 03/2019/TT-BTTTT is coming into force from June 21, 2019.

4. Abrogation of Circular 31 prescribing probationary period for teachers

The Ministry of Education and Training has promulgated the Circular No. 09/2019/TT-BGDDT on abrogation of Circular No. 31/2018/TT-BGDDT prescribing probationary period for teachers and lecturers of public educational institutions.

According to the Circular, from June 29, 2019, probationary period for teachers and lecturers of public educational institutions shall comply with Decree No. 161/2018/ND-CP To be specific:

- 12 months for a holder of the job title which requires a higher education qualification;

- 09 months for a holder of the job title which requires an associate degree; or

- 06 months for a holder of the job title which requires a professional intermediate school’s diploma.

The Circular No. 09/2019/TT-BGDDT is coming into force from June 29, 2019.
