All Decrees coming into force since middle of October 2018

THƯ VIỆN PHÁP LUẬT introduces all the Decrees that will come into force during October 11 – 20, 2018: 2018:

1. Addition of cases of public sector layoff

This is a notable content of Decree No. 113/2018/NĐ-CP which amends Decree No. 108/2014/NĐ-CP on public sector layoff and comes into force from October 15, 2018. According to the Decree, the following persons are subject to layoff:

- Officials and public employees that no longer hold managerial positions due to organizational changes decided by competent authorities and whose voluntary resignation is approved by their employers.

- Officials and public employees that have been reassigned to state-funded associations in any of the cases specified in Points d, e, g Clause 1 Article 6 of Decree No. 108.

2. Suspension of violating festivals

The Government has promulgated Decree No. 110/2018/NĐ-CP on management and organization of festivals, which comes into force from October 15, 2018.

According to the Decree, the authority to which the festival is registered or notified is entitled to suspend it in the following cases by sending a written notice:

- The content or value of the festival is unconformable;

- The festival causes disruption to social order and safety; violates traffic rules, environmental protection rules causing serious consequences; causes fire, explosion or fatalities;

- There is a natural disaster or epidemic that negatively affects local life;

- False information or materials that contain false information about the value or tradition of the festival are spread or circulated during the festival.

Regulations on festival organization in Section 3 Chapter 2 of Decision No. 308/2005/QĐ-TTg and Chapter V of Decree No. 103/2009/NĐ-CP are annulled from the effective date of Decree 110.

3. Increases in fines for street food safety violations

This is a notable content of Decree No 115/2018/NĐ-CP on penalties for administrative violations on food safety, which comes into force from October 20, 2018. To be specific:

- The fines for the following violations will be increased from VND 300.000 – VND 500.000 to VND 500.000 – VND 1.000.000:

+ Failure to have conformable shelves, tables and tools to display foods;

+ Failure to protect foods from dust, insects or harmful animals;

+ Failure to use gloves while touching cooked or instant foods

- The fines for the following violations will be increased from VND 500.000 – VND 1.000.000 to VND 1.000.000 – VND 3.000.000:

Use of unhygienic water for processing of foods or cleaning cooking equipment or tableware;

Decree No. 115/2018/NĐ-CP replaces Decree No. 178/2013/NĐ-CP dated November 14, 2013.

4. Various incentives for investment in organic products

The Government has promulgated Decree No. 109/2018/NĐ-CP on organic agriculture, which comes into force from October 15, 2018.

According to the Decree, producers or sellers of organic products and investors in organic productions will be eligible for the following incentives:

- Incentives for small and medium enterprises; incentives for enterprises investing in agriculture and rural areas;

- Incentives for agriculture cooperatives; incentives for combination of production and sale, large field development and provision of vocational training in rural areas;

- Incentives in terms of seeds, capital and technology for herb cultivation;

- Assistance in trade promotion and brand development.

5. Decree No. 111/2018/NĐ-CP on anniversaries and inspiration dates of central and local authorities comes into force from October 15, 2018.
