Pursuant to this Decree, protection of confidentiality and provision of client’s information by credit institutions and foreign bank branches will adhere to the following principles:
- Client’s information must be kept confidential and will be provided if required by laws.
- Refuse to provide client’s authentication information to any entity, organization or individual unless such provision is authorized in writing by that client or in any other form as agreed upon.
- Regulatory bodies, organizations and individuals may request clients to provide their information only if required by laws or accepted by these clients and must be responsible for that request.
- Regulatory bodies, organizations and individuals must ensure a client’s information is confidential, use information to serve the predetermined purposes upon request and must not be entitled to provide such information to the third party without the client's approval.
- Regulatory bodies, organizations and individuals must store and deposit a client's information, application for provision of information, delivery and receipt of client’s information in accordance with laws.
The Decree No. 117/2018/ND-CP will enter into force from November 1, 2018 and replace the Decree No. 70/2000/ND-CP dated November 21, 2000.
