1. An increase in standard monthly allowances for people with meritorious services to the revolution
This is a remarkable content of Decree No.99/2018/ND-CP on incentive allowances for people with meritorious services to the revolution
According to the Decree, the standard allowance as the basis for calculating incentive allowances for people with meritorious services to the revolution shall be increased from VND 1,417,000 to 1,515,000.
Monthly incentive allowances for people with meritorious services to the revolution may be increased according to the aforesaid standard allowance. For instance:
- For military revolutionists before January 01, 1945: VND 1,693,000/month (increased by VND 110,000 as previously)
- For non-military revolutionists before January 01, 1945: VND 2,874,000/month (increased by VND 186,000 as previously)
- For revolutionists participating from January 01, 1945 to the August Revolution: VND 1,566,000/month (increased by VND 101,000 as previously)
- For People’s Armed Force Heroes and Labor Heroes during wars: VND 1,270,000/month (increased by VND 82,000)
Decree No.99/2018/ND-CP comes into force from August 27, 2018 and new incentive allowances shall be applied from July 01, 2018.
2. Criteria for determination of complex legal aid cases in civil procedure
The Ministry of Justice promulgates Circular No.09/2018/TT-BTP on criteria for determination of complex and typical legal aid cases on June 21, 2018.
According to the Circular, a civil case in which legal aid is provided, except for civil matters and cases tried under reduced procedures, shall be considered a complex and typical if it meets one of the following criteria:
- A case meets one of the general criteria for legal proceedings;
- Legal aid is provided in a case in which regulations and laws on matters to be settled in such case are unclear, without guidance on consistent application or without legislative documents that directly govern them;
- Legal aid is provided in a case which is under jurisdiction of the inferior People's Court but is taken over for handling by the superior People's Court;
- Legal aid is provided in a case in which the period for trial preparation is extended.
Circular No.09/2018/TT-BTP comes into force from August 21, 2018.
3. New regulations on criteria for selection of national industrial encouragement schemes and tasks
This is a content of Circular No.17/2018/TT-BCT which amends Circular No.36/2013/TT-BCT on national industrial encouragement plans preparation, implementation and management comes into force from August 23, 2018.
According to the Circular, national industrial encouragement tasks and schemes shall be selected if they:
- conform to scheme preparing principles;
- include activities that promote national, regional and local development of industry and handicraft;
- are suitable for national industrial encouragement funding decided by the Minister of Industry and Trade;
- run by entities that have not breached the national industrial encouragement contracts in the last 2 years.
- are considered key schemes or schemes run in prioritized sectors and professions and areas as per regulations in Decree No.45/2012/ND-CP and guiding documents on industrial encouragement;
- In case of schemes run in areas with same conditions, or schemes with same sectors and professions, the schemes run by entities having better capacity and experiences for operation shall be selected.
4. Changes in organizational structure of Central Committee for Emulation and Reward
This is a content of Decision No.29/2018/QD-TTg on functions, duties, rights and organizational structure of the Central Committee for Emulation and Reward affiliated to the Ministry of Home Affairs.
According to the Decision, the Central Committee for Emulation and Reward affiliated to the Ministry of Home Affairs no longer includes the Center for Training in emulation and reward as previously.
Decision No.29/2018/QD-TTg comes into force from August 30, 2018 and replaces Decision No.05/2015/QD-TTg dated February 12, 2015.
