Five Circulars effective at the end of May 2018

THƯ VIỆN PHÁP LUẬT would like to present 5 Circulars on import & export, education, etc. which will be effective at the end of May 2018 (from May 21 to May 31, 2018):

1. List of health products to have HS codes

Recently, the Ministry of Health has promulgated Circulars No. 05/2018/TT-BYT and No. 06/2018/TT-BYT on the list of products that have HS codes according to Vietnam’s nomenclature of exports and imports. To be specific:

- Circular No. 05/2018/TT-BYT promulgates the List of food, food additives, food processing supplements and tools, materials for packaging and holding food;

- Circular No. 06/2018/TT-BYT promulgates 10 lists of goods used for making drugs for humans, cosmetics for import and export, including poisons, poisonous ingredients; narcotic ingredients; cosmetics, etc.

The lists issued together with those Circulars above are the basis to make declarations of exports and imports.

Circulars No. 05/2018/TT-BYT and No. 06/2018/TT-BYT will be effective from May 21, 2018.

2. Criteria for identification of specialized goods directly serving educational purposes

Specialized goods directly serving educational purposes are goods used for rearing, caring, teaching, studying and scientific research of teachers and learners in educational facilities.

According to Circular No. 11/2018/TT-BGDĐT (effective from May 22, 2018), specialized goods directly serving educational purposes have to:

- Compliant to the existing regulations of Vietnamese law.

- Have distinct designs and functions, for use in educational facilities only.

- Be included in the list of teaching equipment for preschool and general education promulgated by the Minister of Education and Training, or

Be included in the list of purchases and bids belonging to educational facilities’ investment projects, scientific research tasks which are approved in accordance with existing regulations of Vietnamese law.

- Ensure the educational value, suitable for the objectives and curriculums in their respective levels of education and training; ensure the scientific research task's aim.

- Suitable for the development trend of science and technology at both regional and international levels.

3. New National Regulations on Meteorology

On November 20, 2017, the Ministry of Natural Resources and Environment promulgated Circular No. 48/2017/TT-BTNMT on a new national technical regulation on the coding rules in high-altitude meteorology and weather radars.

This regulation has the code number QCVN 64:2017/BTNMT, regulating the coding of observational data from high-altitude meteorology, weather radars, the ozone layer and ultraviolet radiation, appliance to observation, collection and use of those aforementioned data.

Circular No. 48/2017/TT-BTNMT will be effective from May 21, 2018.

4. Decrease in aircraft logbook retention period

This is a prominent point of Circular No. 14/2018/TT-BGTVT modifying Circular 03/2016/TT-BGTVT dated March 31, 2016.

The Circular specifies that the retention period of an aircraft's flight log and maintenance log shall be decreased from two to one year.

Circular No. 14/2018/TT-BGTVT will be effective from May 25, 2018.
