Notable policies coming into force at the end of March 2018

THƯ VIỆN PHÁP LUẬT introduces 04 notable policies which will come into force during March 21 – 31, 2018:

1. Bank managers not permitted to receive brokerage commissions

Circular No. 16/2018/TT-BTC on finance of credit institutions and branches of foreign banks (hereinafter referred to as “credit institutions”) comes into force on March 26, 2018.

According to the Circular, the following entities are not allowed to receive brokerage commissions:

- Managers, employees and related persons of credit institutions;

- Agents of credit institutions.

Brokerage commissions may only be paid for brokerage activities permitted by law and specified in a contract or written confirmation between the credit institution and the broker.

The contract or confirmation must contain basic information such as name of the broker, commission amount, method of payment, etc.

The Board of Directors, the Board of members or General Director (Director) of the credit institution shall introduce and publish regulations on brokerage commissions.

2. Subsidies on insurance for off-shore fishing vessels

This is specified in Decree No. 17/2018/NĐ-CP which amends Decree No. 67/2014/NĐ-CP on fishery development and comes into force from March 25, 2018.

According to the Decree, state budget will provide subsidies on insurance for:

- Off-shore fishing vessels;

- Off-shore logistics vessels.

(These vessels must be members of fishing groups, associations or cooperatives and have a primary engine power of at least 90 CV).

Annual subsidies:

- 100% of premiums of accident insurance for every crewmember;

- 50% of premiums of hull insurance (insurance against every damage to the hull except fishing equipment).

The said subsidies will be provided from January 01, 2018 to December 31, 2010 inclusive.

3. New regulations on fees for maintenance of digital certificate status checking system

Circular No. 17/2018/TT-BTC amends Circular No. 305/2016/TT-BTC on fees for maintenance of the digital certificate status checking system.

According to the Circular, there are changes to the fees as follows:

- For subscribers that are organizations or enterprises: VND 3000 per month per certificate (not applicable to individuals).

- It will be considered one month when a digital certificate is issued regardless of its effective date.

- Unexpired digital certificates under contracts concluded before January 01, 2017 are exempt from such fee from July 01, 2017 until expiration of the contracts.

Circular No. 17/2018/TT-BTC comes into force from March 26, 2018.

4. Eligibility requirements for inspectors of good distribution practice (GDP)

These are notable contents of Circular No. 03/2018/TT-BYT on GDP for drugs and medicinal ingredients.

According to the Circular, every inspector of GDP for drugs and medicinal ingredients must:

- be an official or and public employee of the Department of Health, an official, public employee or contracted employee of a unit affiliated to the Department of Health;

- have at least a bachelor’s degree or associate degree in pharmacy or medicine;

- be trained in GPP and inspection techniques; grasp GPP rules and standards;

- have honesty, objectivity; comply with internal rules and regulations of law during the inspection; does not have conflict of interest with the inspected facility;

- The chief inspector shall have at least a bachelor’s degree in pharmacy and 02 years’ experience of pharmacy management.

Circular No. 03/2018/TT-BYT comes into force from March 26, 2018.
