THƯ VIỆN PHÁP LUẬT introduces some new contents of notable Circulars coming into force from January 01, 2018.

9. Vietnam’s nomenclature of exports and imports 2018

Circular No. 65/2017/TT-BTC promulgates Vietnam’s nomenclature of exports and imports, which contains many commodities that were not included in the nomenclature promulgated together with No. 103/2015/TT-BTC dated June 01, 2015.

On the basis of this new nomenclature, the authorities will:

- Compile tariff schedules.

- Compile list of commodities serving state management in accordance with regulations of the Government and Clause 4 of Article 26 of the Law on Customs.

- Prepare state statistics on exports and imports.

- Serve state management of export, import and other fields.

Circular No. 65/2017/TT-BTC will replace Circular No. 103/2015/TT-BTC , which also promulgated a Vietnam’s nomenclature of exports and imports.

10. Increase in tariff-rate quota on raw tobacco in 2018

Circular No. 25/2017/TT-BCT provides for 2018’s tariff quota on raw tobacco. According to the Circular:

The tariff-rate quota on raw tobacco in 2018 is 53,604 tonnes, which increases by 2,553 tonnes compared to 2017 (according to Circular No. 39/2016/TT-BCT dated December 30, 2016).

The license to import under tariff-rate quota will be granted if:

- The trader has a license to produce cigarettes granted by the Ministry of Industry and Trade; and

- The amount of raw tobacco needed by the trader for production of cigarettes is certified by the Ministry of Industry and Trade.

11.  Instructions on loss of herbal ingredients covered by health insurance

Circular No. 43/2017/TT-BYT provides for ratios of loss of herbal ingredients and payment for the loss at health facilities.

According to the Circular, the payment for loss of herbal ingredients covered by health insurance is made on the basis of:

- Purchase prices for the herbal ingredients according to regulations of the health facility (the invoices must specify the status of herbal ingredients upon purchase);

- Ratio of loss of herbal ingredients during preparation;

- Ratio of loss of herbal ingredients during preservation and division.

The ratio of loss covered by health insurance must not exceed the ratio specified in the list enclosed with the Circular.

12. Labeling of tissues and toilet papers

Circular No. 36/2015/TT-BCT contains National Technical Regulation No. QCVN 09:2015/BCT on tissues and toilet papers.

This document applies to manufacturers, processors, importers and distributors of tissues and toilet papers in Vietnam, relevant organizations and individuals.

According to the Circular:

- Every package must have a label the content of which is clear, readable, tamper-resistant and conformable with regulations on good labels.

- Such a label must contain the following information:

+ Name and address of the manufacturer;

+ Name and address of the importer (for imported products);

+ The brand name;

+ Number of the applied standards declared by the manufacturer;

+ The conformity marking (CR marking);

+ Thickness of a layer of paper;

+ Type of paper pulp;

+ Number of layers;

+ Manufacturing date and expiry date.
