Notable Circulars coming into force from January 01, 2018 (Part 2)

THƯ VIỆN PHÁP LUẬT introduces notable provisions of new Circulars coming into force from January 01, 2018.

5. New regulations on number of days of inpatient treatment

Circular No. 44/2017/TT-BYT which amends Circular No. 02/2017/TT-BYT on maximum prices for medical services not covered by health insurance, changes the calculation of number of days of inpatient treatments as follows:

- If a patient is admitted and discharged within the same day, it will be considered 01 day of inpatient treatment (except for emergency cases specified in Circular 02).

- If a patient is admitted before 12 PM, it will be considered 70% of a day. If a patient is admitted after 12 AM, it will be considered 50% of a day.

- If a patient is discharged before 12 PM, it will be considered 50% of a day. If a patient is admitted after 12 AM, it will be considered 70% of a day.

Circular No. 44/2017/TT-BYT also changes the names and maximum prices for some services in Appendix III of Circular 02.

6. Changes to list of diseases in expanded immunization program

This is the main content of Circular No. 38/2017/TT-BYT on the list of infectious diseases, mandatory use of vaccines and biologicals. According to the Circular:

- 2 diseases (typhoid and cholera) in Circular No. 26/2011/TT-BYT are removed from the list in Circular 38.

- Rubella vaccine is added to the expanded immunization program for children under 2 years of age and may be administered as soon as the child reaches 18 months.

- This list will be updated by the Ministry of Health where necessary.

More than 10 diseases are also removed from the list of infectious diseases for which vaccination is mandatory for people living in or moving to affected areas.

Circular 38/2017/TT-BYT will replace Circular 26.

7. New formula for calculation of interest rates in 2018

The State bank promulgated Circular No. 14/2017/TT-NHNN on calculation of interest rates in receipt of deposits and credit extension.

To be specific:

Daily interest = (balance x interest rate)/365

Interest accrued during a term equals (=) the sum of daily interests of all of the days of the term.

For deposits and credit extension whose balance is maintained for more than 01 day during the term:

Interest = ∑(balance x number of days over which the balance is maintained x interest rate)/365.

Circular No. 14/2017/TT-NHNN will replace Decision No. 652/2001/QĐ-NHNN dated May 17, 2001, Decision No. 51/2006/QĐ-NHNN dated October 06, 2006 and Clause 2 Article 13 of Decision No. 1160/2004/QĐ-NHNN dated September 13, 2004.

8. Some regulations on export and import annulled from 2018

Circular No. 28/2017/TT-BCT amends and annuls some Circulars on trading of oil and gas, provision of conformity assessment services, export and import under the management of the Ministry of Industry and Trade.

According to the Circular, the following regulations and documents on export and import are annulled:

- Circular No. 20/2011/TT-BCT on additional procedures for import of motor vehicles having ≤ 09 seats.

- Circular No. 04/2017/TT-BCT on amendments to Circular No. 20/201.

- Chapter IV of Circular No. 44/2010/TT-BCT elaborating some Articles of Decree No. 109/2010/NĐ-CP on export of rice.
