New regulations on labour and salary coming into force as of the beginning of July, 2017

The following policies on labour and salary are coming into force as of July 01 - 10, 2017:

1. Rise of the statutory pay rate as of July 01, 2017

Pursuant to the Decree No. 47/2017/ND-CP the statutory pay rate shall be increased from VND 1,210,000/ month to VND 1,300,000/ month as of July 01, 2017.

The foregoing statutory pay rate shall be used as the basis for:

- Determining the level of salary and allowances and other benefits as per legal regulations with regard to individuals as defined in Article 2 of this Decree;

- Determining the level of costs for operation and activities as per the laws;

- Determining contributions and benefits concerning the statutory pay rate.

2. Guidance on application of new statutory pay rate to calculation of salary for officials and public employees

Ministry of Home Affairs promulgates the Circular No. 02/2017/TT-BNV (which is coming into force as from July 01, 2017) to provide guidance on application of new statutory pay rate to calculation of salary and allowances for employees on payroll of public service providers of the Communist Party or of the Government, socio-political organizations and associations.

Pursuant to the foregoing Circular, detailed guidance on calculation of salary, allowances and costs of operation for officials, public employees and workers; deputies of People’s Council; non-specialized officials of communes, hamlets or residential groups, etc. shall be provided.

3. Arrangement of working hours for vocational education teachers

This is a noticeable regulation in the Circular No. 07/2017/TT-BLDTBXH on working regime for vocational education teachers.

According to this Circular, teachers of vocational college and secondary levels shall work 44 weeks per year according to 40-hour per week regime. Working time shall be arranged as follows:

- Teaching time:

+ 32 weeks for teachers of vocational college level;

+ 36 weeks for teachers of vocational secondary level.

- Time for attending standardized knowledge/ re-training courses and/or scientific research activities:

+ 08 weeks for teachers of vocational college level (previously, 12 weeks);

+ 04 weeks for teachers of vocational secondary level (previously, 08 weeks).

- Time for professional practice at enterprises/ agencies: 04 weeks.

In case a teacher fails to use the full of given time for attending re-training courses and/or performing scientific research activities as prescribed, the remaining time may be converted into teaching time or used for performing other duties as assigned by Vocational Training Institution's Principal or Director.

This Circular nullifies Section II of the Circular No. 09/2008/TT-BLDTBXH dated June 27, 2008 and Chapter III of the Circular No. 40/2015/TT-BLDTBXH dated October 20, 2015.

4. The Decree No. 29/2017/ND-CP on conditions for seafarer's training facilities and seafarer’s recruitment and placement service providers (which is coming into force as from July 01, 2017).

5. The Circular No. 13/2017/TT-BGTVT providing regulations on professional practicing certificates for shipping agencies (which is coming into force as from July 01, 2017).

6. The Circular No. 13/2017/TT-BLDTBXH providing for declaration, investigation, statistical works and report on maritime occupational accidents (which is coming into force as from July 01, 2017).

7. The Circular No. 25/2017/TT-BYT on annulment of legislative documents promulgated by Minister of Health (which is coming into force as from July 01, 2017).

8. The Circular No. 14/2017/TT-BLDTBXH regarding formulation, appraisal and promulgation of technical – economic norms on training applicable to vocational training sector (which is coming into force as from July 10, 2017).

9. The Circular No. 134/2017/TT-BQP on list of vocations and standards for vocational levels of munitions workers according to specific vocations in special operations (which is coming into force as from July 10, 2017).
