7 new policies coming into force at the end of May 2017

From May 21 - May 31, 2017, many new documents will come into force with the following details:

1. Criteria for evaluating agricultural cooperatives in 2017

On April 17, 2017, the Ministry of Agriculture and Rural Development promulgated the Circular No. 09/2017/TT-BNNPTNT providing the guidelines for the classification and evaluation of agriculture cooperatives.

According to the Circular, there are 6 criteria for evaluating an agricultural cooperative:

- The revenue and the income earned in a year;

- Benefits of the members of the agricultural cooperative;

- The working capital;

- The number of members who have positive influence on the community;

- The reward(s) earned in a year;

- The satisfaction of the members.

In addition, the Circular No. 09/2017/TT-BNNPTNT which will be effective from May 31, 2017, also defines the method and procedures for evaluating agricultural cooperatives.

2. New guidance on the depreciation of multi-purpose buildings

The Circular No. 28/2017/TT-BTC amending a number of articles of the Circular No. 45/2013/TT-BTC and the Circular No. 147/2016/TT-BTC on the management, use and depreciation of fixed assets will come into force from May 26, 2017.

This Circular details the depreciation of multi-purpose buildings used both for business operation and for sale or for lease. Some notable contents:

- The value of the area used for business operation and for lease (excluding financial lease) shall be recorded as a fixed asset and depreciated as prescribed;

- The value of the area for sale shall be neither recorded as a fixed asset nor depreciated and shall be treated as a property for sale.

The property shall be depreciated according to the ratio of the value of each area to the total value of the building, or according to the purpose of each area.

3. Cost of publishing information about supporting industries now fully covered

The Decision No. 10/2017/QD-TTg on the management and implementation of the Supporting industry development program will come into force from May 25, 2017.

According to this Decision, the State will cover 100% of the cost of collecting, processing and publishing of information about supporting industries as follows:

- Carry out surveys, develop and update the database about manufacturers of finished products and products of supporting industries used for the textiles, footwear, electronics, automobile manufacturing and assembly, mechanical engineering and high-tech industries;

- Purchase the data commonly used by supporting industries (if the data is unavailable in Vietnam or unreliable);

- Provide information about market demand and supply of products of supporting industries as well as information about policies on supporting industries;

- Organize annual workshops in order to announce the information about the capacity of Vietnam’s supporting industries;

- Publish documents related to supporting industries;

- Operate the supporting industry web portal.

Moreover, the Decision No. 10/2017/QD-TTg also specifies the funding for provision of advanced training to meet the needs of supporting industries.

4. Repeal of a number of legislative documents

The Circular No. 04/2017/TT-BTP will come into force from May 28, 2017 and will repeal the following documents:

- The Decision No. 483/TCCB-QD dated July 26, 1993.

- The Circular No. 339/1998/TT-BTP dated March 19, 1998.

- The Joint Circular No. 01/2005/TTLT-BTP-BNV dated January 24, 2005.

- The Circular No. 07/2005/TT-BTP dated August 31, 2005.

- The Joint Circular No. 04/2006/TTLT-BTP-BTNMT dated June 13, 2006.

- The Circular No. 20/2014/TT-BTP dated September 25, 2014.

- Article 7, Article 8, Article 11, Article 18, Article 19 and Article 23 of the Circular No. 17/2011/TT-BTP dated October 14, 2011.

5. The Circular No. 01/2017/TT-TTCP defining the awarding of “Vi su nghiep thanh tra” medals will be effective from May 25, 2017.

6. The Circular No. 84/2017/TT-BQP defining the science and technology project management in Ministry of National Defense will be effective from May 26, 2017.

7. The Circular No. 03/2017/TT-BTP stipulating the titles, the identification numbers and standards applied to officials specialized in civil judgment enforcement will come into force from May 22, 2017.
