số 546/CV-CT ngày 21/6/2007 của Công ty liên doanh vận tải hỗn hợp Việt Nhật số
l đề nghị hướng dẫn về thuế suất thuế giá trị gia tăng đối với một số dịch vụ
cung cấp cho doanh nghiệp chế xuất. Về vấn đề này, Bộ Tài chính có ý kiến như
sau:
Tại Điểm l, Mục
II, Phần B Thông tư 32/2007/TT-BTC ngày 9/4/2007 của Bộ Tài chính hướng dẫn
thi hành Nghị định số 158/2003/NĐ-CP ngày 10/12/2003, Nghị định số 148/2004/NĐ-CP
ngày 23/7/2004 và Nghị định số 156/2005/NĐ-CP ngày 5/12/2005 của Chính phủ quy
định chi tiết thi hành Luật thuế giá trị gia tăng và Luật sửa đổi, bổ sung một
số điều của Luật thuế giá trị gia tăng có quy định: Hàng hoá, dịch vụ xuất khẩu...
Dịch vụ xuất khẩu và dịch vụ cung cấp cho doanh nghiệp chế xuất để sử dụng cho
sản xuất kinh doanh của doanh nghiệp chế xuất, trừ các dịch vụ sử dụng cho tiêu
dùng cá nhân (dịch vụ vận chuyển đưa đón công nhân, cung cấp suất ăn cho công
nhân của doanh nghiệp chế xuất...) áp dụng thuế suất thuế GTGT 0%.
Chi phí vận chuyển đưa đón nhân
viên của doanh nghiệp chế xuất và chi phí thuê căn hộ cho cán bộ làm việc cho
doanh nghiệp chế xuất thực chất là một phần chi phí tiền lương doanh nghiệp phải
trả cho người lao động theo hợp đồng lao động thay vì trả tiền cho người lao động
và người lao động tự trả chi phí về phương tiện đi lại và thuê nhà để ở. Do đó,
những khoản chi phí này được tính vào chi phí hợp lý khi xác định thu nhập chiu
thuế.
Vì vậy, căn cứ vào hướng dẫn nêu
trên, trường hợp Công ty thực hiện cung cấp các dịch vụ: vận chuyển đưa đón
công nhân của doanh nghiệp chế xuất; cho người Nhật (làm việc trong doanh nghiệp
chế xuất) thuê căn hộ (không phân biệt Công ty ký hợp đông với cá nhân hay với
doanh nghiệp chế xuất) thì các dịch vụ này không thuộc diện áp dụng thuế suất
thuế GTGT 0%. Công ty thực hiện kê khai, nộp thuế đối với dịch vụ vận chuyển
theo mức thuế suất thuế GTGT là 5%; đối với hoạt động cho thuê nhà theo mức thuế
suất thuế GTGT là 10%.

546/CV-CT of June 21, 2007, from Vietnam-Japan Mixed Transportation
Joint-Venture Company No. 1, requesting the guidance on value-added tax (VAT)
rates of a number of services provided to export-processing enterprises.
Concerning this issue, the Ministry of Finance gives the following opinions: Point 1, Section II, Part B of the Finance Ministry’s
Circular No. 32/2007/TT-BTC of April 9, 2007, guiding the implementation of
the Government’s Decree No. 158/2003/ND-CP of December 10, 2003, Decree No.
148/2004/ND-CP of July 23, 2004, and Decree No. 156/2005/ND-CP of December 5,
2005, detailing the implementation of the VAT Law and the Law Amending and
Supplementing a number of Articles of the VAT Law, stipulates: Exported goods
and services..., Exported services and services provided to export-processing
enterprises for their production and business activities, excluding services
for personal consumption (such as transportation of workers, supply of food
rations for workers of export-processing enterprises, etc.), are subject to the
VAT rate of 0%. Actually, the expense for transportation of workers of
export-processing enterprises and the expense for lease of apartments for
officers working for these enterprises constitute part of salary expenses which
the enterprises have to pay to laborers under labor contracts, instead of
paying money to laborers while laborers paying by themselves expenses for
travel and accommodation. Therefore, these expenses are accounted as reasonable
expenses in the determination of taxable incomes. So, based on the above guidance, if the Company provides
services of: transportation of workers of export-processing enterprises and
lease of apartments to Japanese officers (working in export-processing
enterprises) (regardless of whether it signs contracts with individuals or
export-processing enterprises), these services are not subject to the VAT rate
of 0%. The Company shall declare and pay VAT at the rate of 5% for the
transportation service, and 10% for the lease service. The Ministry of Finance gives the above reply to the Company
