Để nâng cao hiệu lực, hiệu quả, đảm bảo công tác quản lý nhà nước về hải quan, đồng thời tiếp tục thực hiện nghiêm Chỉ thị số 03/CT-TTg ngày 30/3/2015 của Thủ tướng Chính phủ về việc tăng cường hiệu lực thực thi chính sách, pháp luật về khoáng sản; Qua khảo sát tại một số đơn vị về tình hình thực hiện thủ tục và quản lý đối với mặt hàng vôi, đôlômit xuất khẩu, Tổng cục Hải quan yêu cầu Cục Hải quan các tỉnh, thành phố chỉ đạo các Chi cục Hải quan thực hiện một số nội dung sau:

1. Hồ sơ xuất khẩu vôi, đôlômit phải thực hiện theo đúng hướng dẫn của Bộ Xây dựng tại công văn số 37/BXD-VLXD ngày 11/9/2017 và hướng dẫn của Bộ Tài nguyên và Môi trường tại công văn số 5815/BTNMT-ĐCKS ngày 27/10/2017. Chỉ xem xét giải quyết thủ tục thông quan xuất khẩu vôi, đôlômit khi hồ sơ hải quan đầy đủ và đúng hướng dẫn của Bộ Xây dựng, Bộ Tài nguyên và Môi trường.

2. Rà soát toàn bộ hồ sơ xuất khẩu vôi, đôlômit đã được thông quan trong đó lưu ý đối với các trường hợp doanh nghiệp thương mại xuất khẩu (doanh nghiệp không trực tiếp khai thác, chế biến) phải đảm bảo đầy đủ hóa đơn giá trị gia tăng mua bán theo đúng quy định.

3. Phối hợp với cơ quan thuế địa phương và các cơ quan chức năng khác theo dõi khối lượng bán và xuất khẩu của cơ sở sản xuất để không vượt quá công suất đã được cơ quan nhà nước có thẩm quyền cho phép khai thác, đầu tư theo quy định; thực hiện kiểm tra doanh nghiệp khai thác vôi, đôlômit trên địa bàn trong trường hợp có nghi vấn số lượng khai thác để bán và xuất khẩu vượt quá công suất khai thác.

4. Tổ chức phân công cán bộ công chức theo dõi các doanh nghiệp xuất khẩu mặt hàng vôi, đôlômit để quản lý, cảnh báo, kiểm tra, xử lý kịp thời các doanh nghiệp vi phạm quy định.

Trong quá trình thực hiện nếu phát sinh vướng mắc thì kịp thời báo cáo Tổng cục Hải quan (qua Cục Giám sát quản lý về hải quan) để được hướng dẫn.

Tổng cục Hải quan thông báo để Cục Hải quan các tỉnh, thành phố biết, thực hiện./.

To: Customs Departments of provinces and cities.

To improve effectiveness and guarantee state management in terms of customs operation while stringently implementing Directive No. 03/CT-TTg dated March 30, 2015 of the Prime Minister on increasing effectiveness of implementation of policies and regulations and law on minerals; After surveying in several entities on adoption of procedures and management of exported lime and dolomites, General Department of Customs hereby request Customs Departments of provinces and cities to direct Customs Sub-departments to:

1. Export documents for lime and dolomites must conform to guidelines of Ministry of Construction under Official Dispatch No. 37/BXD-VLXD dated September 11, 2017 and guidelines of Ministry of Natural Resources and Environment under Official Dispatch No. 5815/BTNMT-DCKS dated October 27, 2017. Only consider following up procedures for granting customs clearance to export lime and dolomites for adequate and correct customs documents of Ministry of Construction and Ministry of Natural Resources and Environment.

2. Review the entire export documents for lime and dolomites that have been granted customs clearance while ensure that commercial export enterprises (enterprises that do not directly extract or process) guarantee adequate VAT invoices for sales as per the law. 

3. Cooperate with local tax authorities and other authorities to monitor sale and export amount of manufacturing facilities to not exceed the capacity permitted by competent authorities; inspect enterprises extracting lime and dolomites in the areas in case extraction amount is suspected to exceed extraction capacity.

4. Assign officials to monitor enterprises exporting lime and dolomites to manage, warn, examine and deal with enterprises violating the law.

Difficulties that arise during the implementation should be reported to the General Department of Customs (via Department of Customs Supervision and Management) for guidance.
