Để triển khai thực hiện sử dụng seal định vị điện tử theo Quyết định số 138/QĐ-TCHQ ngày 21/01/2020 của Tổng cục trưởng Tổng cục Hải quan, Tổng cục Hải quan đã có các công văn số 5227/TCHQ-GSQL ngày 07/8/2022 và công văn số 1023/TCHQ-GSQL ngày 25/3/2022 hướng dẫn sử dụng seal định vị điện tử để niêm phong, giám sát hải quan đối với hàng hóa vận chuyển chịu sự giám sát hải quan. Tuy nhiên, qua theo dõi, thống kê tình hình sử dụng seal định vị điện tử tại các Cục Hải quan tỉnh, thành phố, thấy rằng, một số đơn vị chưa nghiêm túc thực hiện việc sử dụng seal định vị điện tử để niêm phong, giám sát hàng hóa chịu sự giám sát hải quan. Tổng cục Hải quan yêu cầu các Cục Hải quan tỉnh, thành phố thực hiện các nội dung sau:

1. Thực hiện nghiêm việc sử dụng seal định vị điện tử đã được bàn giao để giám sát đối với hàng hóa vận chuyển chịu sự giám sát hải quan theo Quyết định số 138/QĐ-TCHQ ngày 21/01/2020 và các văn bản chỉ đạo hướng dẫn của Tổng cục Hải quan nêu trên theo nguyên tắc:

a) Khi sử dụng hết seal định vị điện tử để niêm phong hàng hóa chịu sự giám sát hải quan vận chuyển giữa các Cục Hải quan thì mới sử dụng đến seal, niêm phong hải quan thường để niêm phong theo quy định.

b) Đối với hàng hóa quá cảnh; hàng hóa gửi kho ngoại quan; hàng hóa kinh doanh tạm nhập - tái xuất (bao gồm cả kinh doanh tạm nhập - tái xuất gửi kho ngoại quan) vận chuyển từ cửa khẩu nhập đến địa điểm lưu giữa hoặc vận chuyển đến cửa khẩu xuất phải sử dụng seal định vị điện tử để niêm phong, giám sát, khi sử dụng hết seal định vị điện tử thì mới sử dụng đến seal, niêm phong hải quan thường để niêm phong theo quy định.

2. Yêu cầu Cục trưởng Cục Hải quan tỉnh, thành phố chỉ đạo các Chi cục Hải quan: Từ ngày 26/7/2022, đơn vị nào không thực hiện theo đúng nguyên tắc sử dụng hết seal điện tử mới được chuyển sang seal, niêm phong hải quan thường theo chỉ đạo, hướng dẫn của Tổng cục Hải quan thì xem xét, xử lý kỷ luật Chi cục trưởng theo quy định và Cục trưởng Cục Hải quan các tỉnh, thành phố phải chịu trách nhiệm trước Tổng cục trưởng Tổng cục Hải quan.

Tổng cục Hải quan thông báo, yêu cầu Cục Hải quan các tỉnh, thành phố nghiêm túc thực hiện./.

To: Customs Departments of provinces and cities

In order to implement electronic GPS tracker seals in accordance with Decision No. 138/QD-TCHQ dated January 21, 2020 of the General Director of General Department of Vietnam Customs, the General Department of Vietnam Customs issued Official Dispatch No. 5227/TCHQ-GSQL dated August 7, 2022 and Official Dispatch No. 1023/TCHQ-GSQL dated March 25, 2022 guiding the use of electronic GPS tracker seals for sealing and implementing customs supervision for goods transported under customs supervision. However, by monitoring and recording the use of electronic GPS tracker seals in Customs Departments of provinces and cities, entities have not been entirely compliant with the use of electronic GPS tracker seals for sealing and implementing customs supervision for goods transported under customs supervision. The General Department of Vietnam Customs hereby requests Custosm Departments of provinces and cities to:

1. Strictly comply with the use of electronic GPS tracker seals to supervise goods transported under customs supervision in accordance with Decision No. 138/QD-TCHQ dated January 21, 2020 and guiding documents of the General Department of Vietnam Customs on the following basis:

a) Regular customs seals for sealing shall only be used if electronic GPS tracker seals for sealing goods under customs supervision transported between Customs Departments run out.

b) In respect of transit goods; goods sent to bonded warehouses; goods temporarily imported - re-exported (including goods temporarily imported - re-exported and sent to bonded warehouses) and transported from import checkpoints to storage location or to export checkpoints, regular customs seals for sealing shall be used if electronic GPS tracker seals run out.

2. Request Directors of Customs Departments of provinces and cities to coordinate Customs Sub-departments: Starting from July 26, 2022, if entities fail to comply with the aforesaid principles, directors of corresponding Customs Sub-departments shall be met with disciplinary actions as per the law and Directors of Customs Departments of provinces and cities shall be responsible to the General Director of the General Department of Vietnam Customs.
