epidemic according to Decision No. 3749/QD-TLD dated December 15, 2021

To:
- Federation of Labor of Thu Duc city and districts;
- Unions of provincial authorities, departments, inter-organizations,
controlling companies, and equivalently superior authorities;
- Internal union organizations affiliated to Ho Chi Minh city Federation of
Labor;
- Economic or career units affiliated to Ho Chi Minh city Federation of
Labor.
Pursuant to Decision No.
3749/QD-TLD dated December 15, 2021 of the Presidium of the Vietnam General
Federation of Labor on expenditures on provision of support for union members
and workers affected by the Covid-19 epidemic (hereinafter referred to as
Decision No. 3749/QD-TLD).
The Standing Committee of
the Ho Chi Minh City Federation of Labor provides guidelines for the Federation
of Labor of Thu Duc city and districts, unions of provincial authorities,
departments, inter-organizations, controlling companies, and equivalently
superior authorities (hereinafter referred to as superior union); economic or
career units affiliated to the Ho Chi Minh City Federation of Labor on the
implementation of the following contents:
1. Expenditures
on provision of support for union members and workers affected by the Covid-19
epidemic:
- Assign the superior union to pay the entities prescribed in
Clauses 1, 2, 3 Article of Decision No. 3749/QD-TLD within its management
scope.
- The Ho Chi Minh City Federation of Labor shall pay the
entities prescribed in Clauses 1, 2, 3 Article 1 of the Decision No.
3749/QD-TLD affiliated to economic or career units, and unions of affiliates of
the Ho Chi Minh City Federation of Labor.

- Assign the Standing Committee of the union that is superior
to the internal union organization to consider and regulate specific subjects
and expenditures in other cases that need support in accordance with
regulations prescribed in Clause 3 Article 1 of Decision No. 3749/QD-TLD.
However, such expenditures shall be lower than the one specified in Point b
Clause 1 Article 1 of Decision No. 3749/QD-TLD.
- In other cases that apply to the affiliated economic or
career units and unions of affiliates of the Ho Chi Minh City Federation of
Labor. They shall receive an amount of 1.000.000 VND/person when union members
or workers are F0 outpatient treatment for less than 21 days and fall into one
of the following cases: suffering from an incurable or fatal disease; subject
to 61% rate or above work accident; subject to the “Trái tim nghĩa tình"
(Sentimental Heart) program.
2. Expenditures
on provision of support for union officers that participate in Covid-19
prevention:
- Assign the superior union to consider paying for entities
prescribed in Clauses 1, 3 Article 2 of Decision No. 3749/QD-TLD.
- Assign internal union organizations at economic or career
units, and internal union organizations affiliated to the Ho Chi Minh City
Federation of Labor to base the financial resource on the approved annual
estimated budget and consider paying for entities specified in Clause 2 Article
2 of Decision No. 3749/QD-TLD.
3. Support
principles:
Each F0 patient may only
receive support once even if he/she tests positive for Sars-CoV-2 multiple
times. If a person is eligible to benefit from many support policies in
accordance with regulations prescribed in Article 1 of Decision No.
3749/QD-TLD, he/she may only benefit from the policy that has the highest
benefit. If an F0 patient dies because of Covid-19 after he/she has already
received the support, his/her family shall receive the support as prescribed in
Clause 2 Article 1 of Decision No. 3749/QD-TLD.
4. Implementation
budget:
4.1. The expenditure on the
provision of support for entities prescribed in Clauses 1, 2, 3 Article 1 and
Clauses 1, 3 Article 2 of Decision No. 3749/QD-TLD shall be balanced in the
estimated collection, approved annual union financial expenditures (including
the budget provided according to the estimated budget - if any), accumulated
financial resources, and private investment resources of the union that is
superior to the internal union organization.

4.2. The internal union
organization shall decide and be responsible for the expenditure on provision
of support for entities specified in Clause 2 Article 2 of Decision No.
3749/QD-TLD from its approved annual financial resource.
4.3. With regard to the
unions that are superior to internal union organizations and subject to units
with the budget provided by the Ho Chi Minh City Federation of Labor (fully or
partly) according to the approved annual estimated budget, after using every
financial resource in the year without achieving equilibrium, submit requests
to the Ho Chi Minh City Federation of Labor for consideration and decision.
5. Final
account document:
5.1. General documents
- A support plan for union members, workers, and other entities
affected by the Covid-19 epidemic according to Decision No. 3749/QD-TLD
approved by the Standing Committee in which specifies entities, supported
amounts, and methods.
- A proposal letter of the internal union organization or
enterprise (in case the internal union organization is not established) with a
list of supported entities in accordance with regulations prescribed in Clauses
1, 2, 3 Article 1 of Decision No. 3749/QD-TLD.
- A report, payment request letter, etc. with a list of
supported entities and their supported amounts approved by the account holder
and accountant of the superior union.
- A list of signatures for receipt of supported individuals.
If a supported individual is unable to directly receive cash, transfer the
money directly to his/her account with a receipt (for each individual or groups
of individuals) in the final account document. If an individual does not have
an account and cannot directly receive cash, he/she shall have a letter of
authorization (certified by the internal union organization or its superior
union) in order to authorize another recipient.
- A proposal letter of the economic or career unit or
internal union organizations fully affiliated to the Ho Chi Minh City
Federation of Labor with documents for each of the proposed cases above (if
any).

5.2. Additional detailed
documents according to specific expenditures
a. Clauses 1, 2, 3
Article 1 and Clause 3 Article 2 of Decision No. 3749/QD-TLD
- A copy of the hospital discharge letter or other documents
(medical record, etc.) issued by a healthcare authority to F0 patients in which
specifies the number of days in inpatient treatment (or date of hospitalization,
date of hospital discharge) at a hospital or healthcare facility that receives
and treats Covid-19 cases.
- A copy of the paper of medical isolation completion or the
medical isolation document issued by the competent authority (the People's
Committee of all levels or the Local Steering Committee for Epidemic Prevention
or the healthcare facility, etc.) to F0 outpatient treatment cases in which
specifies the number of medical isolation days.
- A copy of the Covid-19 death certificate.
- Copies of documents proving “other cases” of supported
entities according to section 1 of this document.
*Attention:
- Verification documents in this Clause shall specify the
basis for proving supported cases (F0, death by Covid, etc.). Such documents
shall be in the correct form of documents, signed and sealed by the competent
authority in accordance with its regulated entitlements.
- In case of changes in the verification documents for F0
cases in accordance with the medical state authority, comply with the amended
contents.

The decision on the
mobilization – assignment of tasks with the timesheets of mobilized - assigned
entities participating in the epidemic prevention and control is prescribed in
Clause 1 Article 2 of Decision No. 3749/QD-TLD.
6. Implementation:
- Assign the department of law policies to provide guidelines
for entity criteria; recapitulate and report every month or upon request of the
General Federation; recapitulate and propose cases that need support at
economic or career units, internal union organizations fully affiliated to the
Ho Chi Minh City Federation of Labor. The Department of Finance provides
guidelines for professions of final account and payment. The Inspection
Committee of the Ho Chi Minh City Federation of Labor provides the union
inspection committee of all levels the guidelines for annual inspection and
supervision of the implementation of this Official Dispatch at the same or
inferior unions.
- Assign the union at the directly higher level of primary
one, economic or career unit, internal union organization fully affiliated to
the Ho Chi Minh City Federation of Labor to implement Decision No. 3749/QD-TLD
and this document; report the implementation result to the Department of Law Policies
of the Ho Chi Minh City Federation of Labor every month (before the 10th of
each month) in order to recapitulate in accordance with regulations.
- With regard to transitional handling: units shall base on
when they receive the application for payment (including time proposed in the
application of the internal union organization and the time when cases that
need support occur according to proving documents) and conduct transitional
handling as follows:
+ Application received
before December 15, 2021: pay according to Decision No. 2606/QD-TLD dated May
19, 2021 and Decision No. 3022/QD-TLD dated August 9, 2021 of the General
Federation; ensure the final account or payment day is no later than December
31, 2021 according to Official Dispatch No. 932/LDLD-TC dated November 25, 2021
of the Ho Chi Minh City Federation of Labor.
+ Application received
starting from December 15, 2021: pay according to Decision No. 3749/QD-TLD and
this guideline; conduct final account in 2021 and 2022 financial year according
to the actual time of payment or final account of the expenditures.
+ Other cases shall be
conducted according to Article 5 of Decision No. 3749/QD-TLD.
All of the above are
guidelines of the Ho Chi Minh City Federation of Labor for implementation of a number
of contents of Decision No. 3749/QD-TLD dated December 15, 2021 of the
Presidium of the Vietnam General Confederation of Labor. Any difficulties that
arise during the implementation of this Official Dispatch should be reported to
the Ho Chi Minh City Federation of Labor through the Department of Law Policies
