CHANGES TO THE EXPORT DUTY RATES OF SOME ARTICLES ON THE EXPORT
TARIFF SCHEDULE PROMULGATED TOGETHER WITH THE GOVERNMENT’S DECREE NO. 26/2023/ND-CP
ON EXPORT TARIFF SCHEDULE, PREFERENTIAL IMPORT TARIFF SCHEDULE, TARIFF
NOMENCLATURE AND FIXED DUTIES, MIXED DUTIES, OUT-OF-QUOTA IMPORT DUTIES

The Government of
Vietnam promulgates the Decree on changes to the rates of export duty on some
articles on the Export Tariff Schedule promulgated together with the
Government’s Decree No. 26/2023/ND-CP on Export Tariff Schedule, Preferential
Import Tariff Schedule, Tariff Nomenclature and fixed duties, mixed duties,
out-of-quota import duties.
Article 1. Changes to
the rates of export duty on some articles on the Export Tariff Schedule promulgated
together with the Government’s Decree No. 26/2023/ND-CP on Export Tariff
Schedule, Preferential Import Tariff Schedule, Tariff Nomenclature and fixed
duties, mixed duties, out-of-quota import duties
Changes to the rates of export
duty on some articles listed in Appendix I - Export Tariff Schedule promulgated
together with the Government’s Decree No. 26/2023/ND-CP are specified in the
Appendix promulgated together with this Decree.
Article 2. Replacement
of some phrases in Decree No. 26/2023/ND-CP
1. The phrase "the
Ministry of Planning and Investment" in Clause 1 Article 6, Point a.1
Clause 3 Article 8, Point c.2 Clause 3 Article 9, Clause 2 Article 11, Point
b.1.1 and Point b.9.1 Clause 2.2 Section II of Appendix II is replaced with
"the Ministry of Finance".
2. The phrase "the
Ministry of Transport" in Point b.4 Clause 2.2 Section II of Appendix II
is replaced with "the Ministry of Construction".
3. The phrase "the
Ministry of Information and Communications" in Point b.8 Clause 2.2
Section II of Appendix II, Form No. 03 and Form No. 04 is replaced with
"the Ministry of Science and Technology".
Article 3. Entry into
force
1. This Decree enters into
force from July 23, 2026.

Notes:
- "Bismuth cement”
classified under HS codes 8106.10.10.20, 8106.10.90.20, 8106.90.10.20,
8106.90.90.20 refers to products in powder form (particle size < 0,1 mm) or cake
form, with a bismuth content exceeding 70%, containing impurities such as iron
and copper, etc. and appearing in dark gray to blackish‑gray color, satisfying the
following manufacture requirements:
Bismuth cement recovered
from minerals containing bismuth in raw ore with bismuth content of
approximately 0,05% - 0,1% is subjected to crushed and finely ground before
flotation.
After flotation, bismuth
concentrate with bismuth content of approximately 9% - 11% is obtained. The
concentrate is leached in a sulfuric acid (H2SO4) with
added NaCl, followed by settling and filtration to produce a BiCl3solution.
The bismuth solution is purified to remove impurities and obtain clean BiCl3.
This BiCl3 solution is then cemented (precipitated) using Zn/Fe
metal powder (commonly Fe). Iron reduces bismuth from BiCl3 and
precipitates it in powder form. This process of bismuth recovery is referred to
as “cementation”.
After precipitation, the
bismuth powder is refined, filtered, and washed to produce a cleaner bismuth
powder, which is referred to as “bismuth cement”, which contains more than 70%
bismuth, with impurities such as Cu, Fe, S (the type and level of impurities
depend on the composition of the bismuth‑bearing ore). The product is in powder or cake form, dark
gray to blackish gray in color, with particle size < 0,1 mm.
