QUYẾT ĐỊNH

CỦA THỦ TƯỚNG CHÍNH PHỦ SỐ 150/2003/QĐ-TTG NGÀY 22 THÁNG 7 NĂM 2003VỀ VIỆC SỬA ĐỔI, BỔ SUNG QUYẾT ĐỊNH SỐ 46/2001/QĐ-TTG VỀ QUẢN LÝ XUẤT KHẨU, NHẬP KHẨU HÀNG HOÁ THỜI KỲ 2001 - 2005 VÀ QUYẾT ĐỊNH SỐ 79/2002/QĐ-TTG VỀ QUẢN LÝ VIỆC THU CÁC CHƯƠNG TRÌNH TRUYỀN HÌNH CỦA NƯỚC NGOÀI

Căn cứ Luật Tổ chức Chính phủ ngày 25 tháng 12 năm 2001;
Xét đề nghị của Bộ trưởng Bộ Thương mại và Bộ trưởng Bộ Văn hoá -Thông tin;

QUYẾT ĐỊNH:

Điều 1. Sửa đổi, bổ sung Điều 6 Quyết định số 79/2002/QĐ-TTg ngày 18 tháng 6 năm 2002 của Thủ tướng Chính phủ về quản lý việc thu các chương trình truyền hình của nước ngoài, như sau:

"Điều 6. Trách nhiệm quản lý việc thu các chương trình truyền hình của nước ngoài:

1. Bộ Văn hoá - Thông tin:

a) Cấp phép nhập khẩu, kinh doanh các thiết bị TVRO.

b) Cấp phép lắp đặt và sử dụng TVRO thu các chương trình truyền hình của nước ngoài cho các đối tượng nêu tại các điểm a, c, đ, e khoản 1 và các điểm a, b khoản 2 Điều 1 Quyết định này.

c) Cấp đăng ký cho các hãng truyền hình nước ngoài cung cấp các bộ giải mã chương trình cho các đại diện phân phối tại Việt Nam.

d) Cấp đăng ký cho các cơ quan, tổ chức làm đại diện phân phối tại Việt Nam các bộ giải mã chương trình truyền hình nước ngoài.

đ) Cấp đăng ký cho các cơ quan, tổ chức kinh doanh việc lắp đặt, sửa chữa các thiết bị TVRO.

2. Uỷ ban nhân dân các tỉnh, thành phố trực thuộc Trung ương :

Cấp phép lắp đặt và sử dụng TVRO thu các chương trình truyền hình của nước ngoài cho các đối tượng nêu tại các điểm b, d khoản 1 và các điểm c, d khoản 2 Điều 1 Quyết định này trên địa bàn địa phương mình.

Sở Văn hoá - Thông tin chịu trách nhiệm trước ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương thực hiện việc cấp phép lắp đặt và sử dụng TVRO thu các chương trình truyền hình của nước ngoài trên địa bàn địa phương mình".

Điều 2. Sửa đổi, bổ sung Quyết định số 46/2001/QĐ-TTg ngày 04 tháng 4 năm 2001 của Thủ tướng Chính phủ về quản lý xuất khẩu, nhập khẩu hàng hoá thời kỳ 2001 - 2005, như sau:

Bổ sung điểm 5 vào phần "Hàng hoá nhập khẩu" của mục ''V- Danh mục hàng hoá thuộc diện quản lý chuyên ngành của Bộ Văn hoá - Thông tin" trong

"Phụ lục số 03: Danh mục hàng hoá thuộc diện quản lý 07 chuyên ngành và nguyên tắc quản lý", với nội dung như sau:

	Hàng hoá nhập khẩu	Hình thức quản lý
5	Thiết bị thu tín hiệu truyền hình từ vệ tinh (TVRO)	Giấy phép nhập khẩu

Điều 3. Quyết định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo.

Điều 4. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Uỷ ban nhân dân các tỉnh, thành phố trực thuộc Trung ương và mọi tổ chức, cá nhân chịu trách nhiệm thi hành Quyết định này.

DECISION

AMENDING AND SUPPLEMENTING DECISION NO. 46/2001/QD-TTG ON THE MANAGEMENT OF GOODS IMPORT AND EXPORT IN THE 2001-2005 PERIOD AND DECISION NO. 79/2002/QD-TTG ON MANAGEMENT OF THE RECEPTION OF FOREIGN TELEVISION PROGRAMS

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
At the proposals of the Minister of Trade and the Minister of Culture and Information,

DECIDES:

Article 1.- To amend and supplement Article 6 of the Prime Minister’s Decision No. 79/2002/QD-TTg of June 18, 2002 on management of the reception of foreign television programs as follows:

“Article 6.- Responsibilities for management of the reception of foreign television programs:

1. The Ministry of Culture and Information:

b/ To grant permits for the installation and use of TVRO to receive foreign television programs to the subjects mentioned at Points a, c, e and f of Clause 1 and Points a and b, Clause 2, Article 1 of this Decision.

c/ To grant registration papers to foreign television firms which supply program decoders to their representative distributors in Vietnam;

d/ To grant registration papers to agencies and organizations which act as Vietnam-based representative distributors of foreign television program decoders;

e/ To grant registration papers to agencies and organizations which deal in the installation and/or repair of TVRO equipment.

2. The People’s Committees of the provinces and centrally-run cities:

To grant permits for the installation and use of TVRO to receive foreign television programs to the subjects mentioned at Points b and d of Clause 1, and Points c and d, Clause 2, Article 1 of this Decision in their respective localities.

The provincial/municipal Services of Culture and Information shall be held responsible before the provincial/municipal People’s Committees for the granting of permits for the installation and use of TVRO to receive foreign television programs in their respective localities.”

Article 2.- To amend and supplement the Prime Minister’s Decision No. 46/2001/QD-TTg of April 4, 2001 on the management of goods import and export in the 2001-2005 period as follows:

To add Point 5 to the “Import goods” part of Section “V – List of goods subject to specialized management by the Ministry of Culture and Information” in “Appendix No. 03: List of goods subject to the management by 07 specialized branches and their management principles”, with the following contents:

Article 3.- This Decision takes implementation effect 15 days after its publication in the Official Gazette.

Article 4.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People’s Committees of the provinces and centrally-run cities as well as all organizations and individuals shall have to implement this Decision.
