NGƯỜI CAO TUỔI

Căn cứ Hiến pháp nước Cộng hoà xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Quốc hội ban hành Luật người cao tuổi.

Chương I

NHỮNG QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Luật này quy định về quyền và nghĩa vụ của người cao tuổi; trách nhiệm của gia đình, Nhà nước và xã hội trong việc phụng dưỡng, chăm sóc và phát huy vai trò người cao tuổi; Hội người cao tuổi Việt Nam.

Điều 2. Người cao tuổi

Người cao tuổi được quy định trong Luật này là công dân Việt Nam từ đủ 60 tuổi trở lên.

Điều 3. Quyền và nghĩa vụ của người cao tuổi

1. Người cao tuổi có các quyền sau đây:

a) Được bảo đảm các nhu cầu cơ bản về ăn, mặc, ở, đi lại, chăm sóc sức khoẻ;

b) Quyết định sống chung với con, cháu hoặc sống riêng theo ý muốn;

c) Được ưu tiên khi sử dụng các dịch vụ theo quy định của Luật này và các quy định khác của pháp luật có liên quan;

d) Được tạo điều kiện tham gia hoạt động văn hoá, giáo dục, thể dục, thể thao, giải trí, du lịch và nghỉ ngơi;

đ) Được tạo điều kiện làm việc phù hợp với sức khoẻ, nghề nghiệp và các điều kiện khác để phát huy vai trò người cao tuổi;  

e) Được miễn các khoản đóng góp cho các hoạt động xã hội, trừ trường hợp tự nguyện đóng góp;

g) Được ưu tiên nhận tiền, hiện vật cứu trợ, chăm sóc sức khỏe và chỗ ở nhằm khắc phục khó khăn ban đầu khi gặp khó khăn do hậu quả thiên tai hoặc rủi ro bất khả kháng khác;

h) Được tham gia Hội người cao tuổi Việt Nam theo quy định của Điều lệ Hội;

i) Các quyền khác theo quy định của pháp luật.

2. Người cao tuổi có các nghĩa vụ sau đây:

a) Nêu gương sáng về phẩm chất đạo đức, lối sống mẫu mực; giáo dục thế hệ trẻ giữ gìn và phát huy truyền thống tốt đẹp của dân tộc; gương mẫu chấp hành và vận động gia đình, cộng đồng chấp hành chủ trương, đường lối của Đảng, pháp luật của Nhà nước;

b) Truyền đạt kinh nghiệm quý cho thế hệ sau;

c) Các nghĩa vụ khác theo quy định của pháp luật.

Điều 4. Chính sách của Nhà nước đối với người cao tuổi

1. Bố trí ngân sách hằng năm phù hợp để thực hiện chính sách chăm sóc và phát huy vai trò người cao tuổi.

2. Bảo trợ xã hội đối với người cao tuổi theo quy định của Luật này và các quy định khác của pháp luật có liên quan.

3. Lồng ghép chính sách đối với người cao tuổi trong chính sách phát triển kinh tế - xã hội.

4. Phát triển ngành lão khoa đáp ứng nhu cầu khám bệnh, chữa bệnh cho người cao tuổi; đào tạo nhân viên chăm sóc người cao tuổi.

5. Khuyến khích, tạo điều kiện cho người cao tuổi rèn luyện sức khoẻ; tham gia học tập, hoạt động văn hoá, tinh thần; sống trong môi trường an toàn và được tôn trọng về nhân phẩm; phát huy vai trò người cao tuổi trong sự nghiệp xây dựng và bảo vệ Tổ quốc.

6. Khuyến khích, hỗ trợ cơ quan, tổ chức, cá nhân thực hiện tuyên truyền, giáo dục ý thức kính trọng, biết ơn người cao tuổi, chăm sóc, phát huy vai trò người cao tuổi.

7. Khen thưởng cơ quan, tổ chức, cá nhân có thành tích xuất sắc trong việc chăm sóc, phát huy vai trò người cao tuổi.

8. Xử lý nghiêm minh cơ quan, tổ chức, cá nhân có hành vi vi phạm quy định của Luật này và các quy định khác của pháp luật có liên quan.

Điều 5. Trách nhiệm của cơ quan, tổ chức, gia đình và cá nhân

1. Cơ quan tổ chức trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm chăm sóc, bảo vệ quyền và lợi ích hợp pháp của người cao tuổi.

2. Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên, các tổ chức khác có trách nhiệm tuyên truyền, vận động nhân dân nâng cao trách nhiệm chăm sóc và phát huy vai trò người cao tuổi; tham gia giám sát việc thực hiện chính sách, pháp luật về người cao tuổi.

3. Gia đình người cao tuổi có trách nhiệm chủ yếu trong việc phụng dưỡng người cao tuổi.  

4. Cá nhân có trách nhiệm kính trọng và giúp đỡ người cao tuổi.

Điều 6. Ngày người cao tuổi Việt Nam

Ngày 06 tháng 6 hằng năm là Ngày người cao tuổi Việt Nam.

Điều 7. Quỹ chăm sóc và phát huy vai trò người cao tuổi  

1. Quỹ chăm sóc và phát huy vai trò người cao tuổi là quỹ xã hội, từ thiện.

2. Quỹ chăm sóc và phát huy vai trò người cao tuổi được hình thành từ các nguồn sau đây:

a) Đóng góp tự nguyện, tài trợ của tổ chức, cá nhân trong nước và nước ngoài;

b) Hỗ trợ từ ngân sách nhà nước;

c) Các khoản thu hợp pháp khác.

3. Việc thành lập, hoạt động và quản lý Quỹ chăm sóc và phát huy vai trò người cao tuổi được thực hiện theo quy định của pháp luật.

Điều 8. Hợp tác quốc tế về người cao tuổi  

1. Hợp tác quốc tế về người cao tuổi được thực hiện trên cơ sở tôn trọng độc lập, chủ quyền, toàn vẹn lãnh thổ, bình đẳng, phù hợp với pháp luật Việt Nam và pháp luật quốc tế.

2. Nội dung hợp tác quốc tế về người cao tuổi bao gồm:

a) Xây dựng và thực hiện chương trình, dự án hợp tác quốc tế về người cao tuổi;

b) Tham gia tổ chức quốc tế; ký kết, gia nhập và thực hiện điều ước quốc tế, thỏa thuận quốc tế liên quan đến người cao tuổi;

c) Trao đổi thông tin, kinh nghiệm về chăm sóc và phát huy vai trò người cao tuổi.

Điều 9. Các hành vi bị cấm

1. Lăng mạ, ngược đãi, xúc phạm, hành hạ, phân biệt đối xử đối với người cao tuổi.

2. Xâm phạm, cản trở người cao tuổi thực hiện quyền về hôn nhân, quyền về sở hữu tài sản và các quyền hợp pháp khác.

3. Không thực hiện nghĩa vụ phụng dưỡng người cao tuổi.

4. Lợi dụng việc chăm sóc, phụng dưỡng người cao tuổi để vụ lợi.

5. Ép buộc người cao tuổi lao động hoặc làm những việc trái với quy định của pháp luật.

6. Ép buộc, kích động, xúi giục, giúp người khác thực hiện hành vi vi phạm pháp luật đối với người cao tuổi.  

7. Trả thù, đe doạ người giúp đỡ người cao tuổi, người phát hiện, báo tin ngăn chặn hành vi vi phạm pháp luật đối với người cao tuổi.

Chương II

PHỤNG DƯỠNG, CHĂM SÓC NGƯỜI CAO TUỔI

Mục 1. PHỤNG DƯỠNG NGƯỜI CAO TUỔI

Điều 10. Nghĩa vụ và quyền phụng dưỡng người cao tuổi

1. Phụng dưỡng người cao tuổi là chăm sóc đời sống tinh thần, vật chất nhằm đáp ứng nhu cầu cơ bản về ăn, mặc, ở, đi lại, chăm sóc sức khoẻ và các nhu cầu về vui chơi, giải trí, thông tin, giao tiếp, học tập của người cao tuổi.

2. Người có nghĩa vụ và quyền phụng dưỡng người cao tuổi là con, cháu của người cao tuổi và những người khác có nghĩa vụ nuôi dưỡng, cấp dưỡng theo quy định của pháp luật về hôn nhân và gia đình.  

3. Người có nghĩa vụ và quyền phụng dưỡng người cao tuổi tùy theo hoàn cảnh cụ thể phải sắp xếp nơi ở phù hợp với điều kiện sức khoẻ, tâm lý của người cao tuổi; chu cấp về kinh tế; thanh toán chi phí điều trị và chăm sóc y tế động viên khi người cao tuổi ốm đau; mai táng khi người cao tuổi chết.  

4. Người có nghĩa vụ và quyền phụng dưỡng người cao tuổi phải cùng nhau hợp tác trong việc phụng dưỡng người cao tuổi.  

5. Khuyến khích tổ chức, cá nhân không thuộc đối tượng quy định tại khoản 2 Điều này tham gia phụng dưỡng người cao tuổi.  

Điều 11. Uỷ nhiệm chăm sóc người cao tuổi

1. Người có nghĩa vụ và quyền phụng dưỡng không có điều kiện trực tiếp chăm sóc người cao tuổi thì uỷ nhiệm cho cá nhân hoặc tổ chức cung ứng dịch vụ chăm sóc người cao tuổi, nhưng phải được người cao tuổi đồng ý.  

Việc uỷ nhiệm chăm sóc người cao tuổi được thực hiện dưới hình thức hợp đồng dịch vụ giữa người có nghĩa vụ và quyền phụng dưỡng với cá nhân hoặc tổ chức cung ứng dịch vụ.

2. Cá nhân hoặc tổ chức cung ứng dịch vụ được uỷ nhiệm chăm sóc người cao tuổi có trách nhiệm thực hiện đầy đủ cam kết theo hợp đồng dịch vụ với người uỷ nhiệm.

3. Người cao tuổi có quyền yêu cầu người có nghĩa vụ và quyền phụng dưỡng thay đổi cá nhân hoặc tổ chức cung ứng dịch vụ được uỷ nhiệm chăm sóc mình.

4. Chính phủ quy định chi tiết Điều này.

Mục 2. CHĂM SÓC SỨC KHOẺ NGƯỜI CAO TUỔI

Điều 12. Khám bệnh, chữa bệnh

1. Việc ưu tiên khám bệnh, chữa bệnh cho người cao tuổi được thực hiện như sau:

a) Người từ đủ 80 tuổi trở lên được ưu tiên khám trước người bệnh khác trừ bệnh nhân cấp cứu, trẻ em dưới 6 tuổi, người khuyết tật nặng;

b) Bố trí giường nằm phù hợp khi điều trị nội trú.

2. Các bệnh viện, trừ bệnh viện chuyên khoa nhi, có trách nhiệm sau đây:

a) Tổ chức khoa lão khoa hoặc dành một số giường để điều trị người bệnh là người cao tuổi;

b) Phục hồi sức khoẻ cho người bệnh là người cao tuổi sau các đợt điều trị cấp tính tại bệnh viện và hướng dẫn tiếp tục điều trị, chăm sóc tại gia đình;

c) Kết hợp các phương pháp điều trị y học cổ truyền với y học hiện đại, hướng dẫn các phương pháp chữa bệnh không dùng thuốc ở tuyến y tế cơ sở đối với người bệnh là người cao tuổi.

3. Nhà nước khuyến khích tổ chức, cá nhân khám bệnh, chữa bệnh miễn phí cho người cao tuổi.

Điều 13. Chăm sóc sức khoẻ ban đầu tại nơi cư trú

1. Trạm y tế xã, phường, thị trấn có trách nhiệm sau đây:

a) Triển khai các hình thức tuyên truyền, phổ biến kiến thức phổ thông về chăm sóc sức khỏe; hướng dẫn người cao tuổi kỹ năng phòng bệnh, chữa bệnh và tự chăm sóc sức khoẻ;

b) Lập hồ sơ theo dõi, quản lý sức khoẻ người cao tuổi;

c) Khám bệnh, chữa bệnh phù hợp với chuyên môn cho người cao tuổi;

d) Phối hợp với cơ sở khám bệnh, chữa bệnh tuyến trên tổ chức kiểm tra sức khoẻ định kỳ cho người cao tuổi.

2. Trạm y tế xã, phường, thị trấn cử cán bộ y tế đến khám bệnh, chữa bệnh tại nơi cư trú đối với người cao tuổi cô đơn bị bệnh nặng không thể đến khám bệnh, chữa bệnh tại cơ sở khám bệnh, chữa bệnh. Uỷ ban nhân dân xã, phường, thị trấn có trách nhiệm hỗ trợ việc đưa người bệnh quy định tại khoản này tới cơ sở khám bệnh, chữa bệnh theo đề nghị của trạm y tế xã, phường, thị trấn.

3. Nhà nước khuyến khích tổ chức, cá nhân khám bệnh, chữa bệnh cho người cao tuổi tại nơi cư trú.

4. Kinh phí để thực hiện các quy định tại điểm a, b và d khoản 1 và khoản 2 Điều này do ngân sách nhà nước bảo đảm.

Mục 3. CHĂM SÓC NGƯỜI CAO TUỔI TRONG HOẠT ĐỘNG VĂN HOÁ, GIÁO DỤC, THỂ DỤC, THỂ THAO, GIẢI TRÍ, DU LỊCH, SỬ DỤNG CÔNG TRÌNH CÔNG CỘNG VÀ THAM GIA GIAO THÔNG CÔNG CỘNG

Điều 14. Hoạt động văn hoá, giáo dục, thể dục, thể thao, giải trí và du lịch

1. Nhà nước đầu tư và khuyến khích tổ chức, cá nhân đầu tư xây dựng cơ sở văn hóa, giáo dục, thể dục, thể thao, giải trí, du lịch nhằm đáp ứng nhu cầu tinh thần và rèn luyện sức khoẻ của người cao tuổi.

2. Nhà nước và xã hội tạo điều kiện thuận lợi để người cao tuổi được học tập, nghiên cứu và tham gia hoạt động văn hóa, thể dục, thể thao, giải trí, du lịch thông qua các biện pháp sau đây:

a) Cung cấp thông tin, tài liệu, người hướng dẫn để người cao tuổi tham gia học tập, nghiên cứu;

b) Hỗ trợ, hướng dẫn người cao tuổi tham gia hoạt động văn hóa, giải trí du lịch, luyện tập dưỡng sinh và các hoạt động thể dục, thể thao khác phù hợp với sức khỏe và tâm lý;

c) Hỗ trợ địa điểm, dụng cụ, phương tiện và cơ sở vật chất khác phù hợp với hoạt động của người cao tuổi;

d) Khuyến khích doanh nghiệp, cá nhân sản xuất, kinh doanh sản phẩm, hàng hoá phù hợp với nhu cầu của người cao tuổi.

3. Chính phủ quy định chi tiết Điều này.

Điều 15. Công trình công cộng, giao thông công cộng

1. Việc xây dựng mới hoặc cải tạo khu chung cư, công trình công cộng khác phải phù hợp với đặc điểm, nhu cầu sử dụng của người cao tuổi.  

2. Khi tham gia giao thông công cộng, người cao tuổi được giúp đỡ, sắp xếp chỗ ngồi thuận tiện.

3. Chính phủ quy định chi tiết Điều này.

Điều 16. Giảm giá vé, giá dịch vụ

Người cao tuổi được giảm giá vé, giá dịch vụ khi sử dụng một số dịch vụ theo quy định của Chính phủ.

Mục 4. BẢO TRỢ XÃ HỘI ĐỐI VỚI NGƯỜI CAO TUỔI

Điều 17. Đối tượng được hưởng chính sách bảo trợ xã hội

1. Người cao tuổi thuộc hộ gia đình nghèo không có người có nghĩa vụ và quyền phụng dưỡng hoặc có người có nghĩa vụ và quyền phụng dưỡng nhưng người này đang hưởng chế độ trợ cấp xã hội hằng tháng.  

2. Người từ đủ 80 tuổi trở lên không thuộc trường hợp quy định tại khoản 1 Điều này mà không có lương hưu, trợ cấp bảo hiểm xã hội hằng tháng trợ cấp xã hội hằng tháng.

Điều 18. Chính sách bảo trợ xã hội

1. Người cao tuổi quy định tại Điều 17 của Luật này được hưởng bảo hiểm y tế, được hưởng trợ cấp xã hội hằng tháng và hỗ trợ chi phí mai táng khi chết, trừ trường hợp quy định tại khoản 2 Điều này.

2. Người cao tuổi thuộc hộ gia đình nghèo không có người có nghĩa vụ và quyền phụng dưỡng, không có điều kiện sống ở cộng đồng, có nguyện vọng và được tiếp nhận vào cơ sở bảo trợ xã hội thì được hưởng các chế độ sau đây:

a) Trợ cấp nuôi dưỡng hằng tháng;

b) Cấp tư trang, vật dụng phục vụ cho sinh hoạt thường ngày;

c) Được hưởng bảo hiểm y tế;

d) Cấp thuốc chữa bệnh thông thường;

đ) Cấp dụng cụ, phương tiện hỗ trợ phục hồi chức năng;

e) Mai táng khi chết.

3. Chính phủ quy định chi tiết Điều này.

Điều 19. Chăm sóc người cao tuổi tại cộng đồng

Người cao tuổi thuộc diện quy định tại khoản 2 Điều 18 mà có người nhận chăm sóc tại cộng đồng thì được hưởng trợ cấp xã hội hằng tháng bằng mức nuôi dưỡng tại cơ sở bảo trợ xã hội, được hưởng bảo hiểm y tế và hỗ trợ chi phí mai táng khi chết.

Điều 20. Cơ sở chăm sóc người cao tuổi

1. Cơ sở chăm sóc người cao tuổi là nơi chăm sóc, nuôi dưỡng, tư vấn hoặc hỗ trợ những điều kiện cần thiết khác cho người cao tuổi.

2. Cơ sở chăm sóc người cao tuổi bao gồm:

a) Cơ sở bảo trợ xã hội;

b) Cơ sở tư vấn, dịch vụ chăm sóc người cao tuổi;

c) Cơ sở chăm sóc người cao tuổi khác.

Chính phủ quy định chi tiết việc thành lập và hoạt động của các cơ sở chăm sóc người cao tuổi quy định tại khoản này.

3. Nhà nước khuyến khích tổ chức, cá nhân đầu tư xây dựng cơ sở chăm sóc người cao tuổi; đầu tư cơ sở vật chất và hỗ trợ kinh phí hoạt động cho cơ sở chăm sóc người cao tuổi công lập; hỗ trợ kinh phí cho cơ sở chăm sóc người cao tuổi ngoài công lập nuôi dưỡng người cao tuổi quy định tại khoản 2 Điều 18 của Luật này.

4. Tổ chức, cá nhân đóng góp, đầu tư xây dựng cơ sở chăm sóc người cao tuổi bằng nguồn kinh phí của mình được hưởng các chính sách ưu đãi theo quy định của pháp luật về chính sách khuyến khích xã hội hóa đối với các hoạt động trong lĩnh vực giáo dục, dạy nghề, y tế, văn hóa, thể thao, môi trường.

Mục 5. CHÚC THỌ, MỪNG THỌ, TỔ CHỨC TANG LỄ

Điều 21. Chúc thọ, mừng thọ người cao tuổi

1. Người thọ 100 tuổi được Chủ tịch nước Cộng hoà xã hội chủ nghĩa Việt Nam chúc thọ và tặng quà.

2. Người thọ 90 tuổi được Chủ tịch Uỷ ban nhân dân tỉnh, thành phố trực thuộc trung ương chúc thọ và tặng quà.

3. Uỷ ban nhân dân xã, phường, thị trấn phối hợp với Hội người cao tuổi tại địa phương, gia đình của người cao tuổi tổ chức mừng thọ người cao tuổi ở tuổi 70, 75, 80, 85, 90, 95 và 100 tuổi trở lên vào một trong các ngày sau đây:

a) Ngày người cao tuổi Việt Nam;

b) Ngày Quốc tế người cao tuổi;

c) Tết Nguyên đán;

d) Sinh nhật của người cao tuổi.

4. Kinh phí thực hiện quy định tại Điều này do ngân sách nhà nước bảo đảm và nguồn đóng góp của xã hội.

Điều 22. Tổ chức tang lễ và mai táng khi người cao tuổi chết

1. Khi người cao tuổi chết, người có nghĩa vụ và quyền phụng dưỡng người cao tuổi có trách nhiệm chính trong việc tổ chức tang lễ và mai táng cho người cao tuổi theo nghi thức trang trọng, tiết kiệm, bảo đảm nếp sống văn hoá, trừ trường hợp pháp luật có quy định khác; trường hợp người cao tuổi không có người có nghĩa vụ và quyền phụng dưỡng hoặc có người có nghĩa vụ và quyền phụng dưỡng nhưng người này không có điều kiện tổ chức tang lễ và mai táng thì Uỷ ban nhân dân xã, phường, thị trấn hoặc cơ sở bảo trợ xã hội nơi người cao tuổi cư trú chủ trì phối hợp với Hội người cao tuổi và các tổ chức đoàn thể tại địa phương tổ chức tang lễ và mai táng.

2. Khi người cao tuổi chết, cơ quan, tổ chức nơi người cao tuổi đang làm việc hoặc cơ quan, tổ chức nơi làm việc cuối cùng của người cao tuổi, Hội người cao tuổi, Uỷ ban nhân dân xã, phường, thị trấn và các tổ chức đoàn thể tại địa phương có trách nhiệm phối hợp với gia đình người cao tuổi tổ chức tang lễ và mai táng.

Chương III.

PHÁT HUY VAI TRÒ NGƯỜI CAO TUỔI

Điều 23. Hoạt động phát huy vai trò người cao tuổi

Nhà nước, xã hội và gia đình tạo điều kiện để người cao tuổi phát huy trí tuệ kinh nghiệm quý và phẩm chất tốt đẹp trong các hoạt động sau đây:

1. Giáo dục truyền thống đoàn kết, yêu nước, yêu con người và thiên nhiên;

2. Xây dựng đời sống văn hoá; bảo tồn và phát huy bản sắc văn hoá dân tộc ở cơ sở và cộng đồng; tham gia các phong trào khuyến học, khuyến tài, hỗ trợ giáo dục, đào tạo, bồi dưỡng người có đức, có tài và các cuộc vận động khác tại cộng đồng;

3. Truyền thụ kỹ năng, kinh nghiệm, kiến thức kinh tế, văn hóa, xã hội, khoa học, công nghệ và nghề truyền thống cho thế hệ trẻ;

4. Nghiên cứu, giáo dục, đào tạo, ứng dụng khoa học và công nghệ; tư vấn chuyên môn, kỹ thuật;

5. Phát triển kinh tế, giảm nghèo, làm giàu hợp pháp;

6. Giữ gìn an ninh chính trị, trật tự an toàn xã hội; hoà giải mâu thuẫn, tranh chấp tại cộng đồng;

7. Thực hiện pháp luật về dân chủ ở cơ sở; thực hành tiết kiệm chống lãng phí; phòng, chống tham nhũng, quan liêu; phòng, chống HIV/AIDS và tệ nạn xã hội;

8. Đóng góp ý kiến xây dựng chính sách, pháp luật và tham gia giám sát việc thực hiện chính sách, pháp luật;

9. Các hoạt động xã hội khác vì lợi ích của Tổ chức và nhân dân.

Điều 24. Trách nhiệm phát huy vai trò người cao tuổi

1. Nhà nước có trách nhiệm thực hiện các biện pháp sau đây để người cao tuổi phát huy vai trò phù hợp với khả năng của mình:

a) Tạo điều kiện để người cao tuổi được bày tỏ ý kiến, nguyện vọng, kiến nghị với cơ quan, tổ chức về những vấn đề mà người cao tuổi quan tâm;

b) Tạo điều kiện để người cao tuổi là nhà khoa học, nghệ nhân và những người cao tuổi khác có kỹ năng, kinh nghiệm đặc biệt, có nguyện vọng được tiếp tục cống hiến;

c) Ưu đãi về vốn tín dụng đối với người cao tuổi trực tiếp sản xuất, kinh doanh tăng thu nhập, giảm nghèo;

d) Biểu dương, khen thưởng người cao tuổi có thành tích xuất sắc.

2. Cơ quan, Hội người cao tuổi, các tổ chức khác, gia đình và cá nhân có trách nhiệm tạo điều kiện để người cao tuổi thực hiện các hoạt động phát huy vai trò người cao tuổi.

Chương IV

HỘI NGƯỜI CAO TUỔI VIỆT NAM

Điều 25. Hội người cao tuổi Việt Nam

1. Hội người cao tuổi Việt Nam là tổ chức xã hội, đại diện cho nguyện vọng, quyền và lợi ích hợp pháp của người cao tuổi Việt Nam.

2. Hội người cao tuổi Việt Nam được tổ chức theo nguyên tắc tự nguyện, hoạt động theo Hiến pháp, pháp luật và Điều lệ Hội.

Điều 26. Kinh phí hoạt động của Hội người cao tuổi Việt Nam

1. Kinh phí hoạt động của Hội người cao tuổi Việt Nam được hình thành từ các nguồn sau đây:

a) Hỗ trợ từ ngân sách nhà nước;

b) Hội phí của hội viên;

c) Các nguồn thu hợp pháp khác.

2. Hội người cao tuổi Việt Nam quản lý và sử dụng kinh phí hoạt động theo quy định của pháp luật.

Điều 27. Nhiệm vụ của Hội người cao tuổi Việt Nam

1. Tập hợp, đoàn kết, động viên người cao tuổi tham gia sinh hoạt Hội người cao tuổi, góp phần thực hiện các chương trình kinh tế - xã hội, giáo dục thế hệ trẻ, xây dựng nếp sống văn minh, gia đình văn hoá, giữ gìn an ninh chính trị, trật tự an toàn xã hội, xây dựng và bảo vệ Tổ quốc.

2. Làm nòng cốt trong phong trào toàn dân chăm sóc, phụng dưỡng, phát huy vai trò người cao tuổi.

3. Bảo vệ quyền và lợi ích hợp pháp của người cao tuổi.

4. Nghiên cứu nhu cầu, nguyện vọng của người cao tuổi để kiến nghị cơ quan nhà nước có thẩm quyền.

5. Đại diện cho người cao tuổi Việt Nam tham gia các tổ chức quốc tế, các hoạt động đối ngoại nhân dân vì lợi ích của người cao tuổi và của Tổ quốc.

Chương V

TRÁCH NHIỆM CỦA CƠ QUAN NHÀ NƯỚC VỀ CÔNG TÁC NGƯỜI CAO TUỔI

Điều 28. Cơ quan quản lý nhà nước về công tác người cao tuổi

1. Chính phủ thống nhất quản lý nhà nước về công tác người cao tuổi.

2. Bộ Lao động - Thương binh và Xã hội chịu trách nhiệm trước Chính phủ thực hiện quản lý nhà nước về công tác người cao tuổi.

3. Bộ, cơ quan ngang bộ trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm phối hợp với Bộ Lao động - Thương binh và Xã hội thực hiện quản lý nhà nước về công tác người cao tuổi.

4. Uỷ ban nhân dân các cấp trong phạm vi nhiệm vụ, quyền hạn của mình thực hiện quản lý nhà nước về công tác người cao tuổi; lồng ghép hoạt động về người cao tuổi vào kế hoạch phát triển kinh tế - xã hội của địa phương; tạo điều kiện cho cơ quan, tổ chức, cá nhân tham gia chăm sóc, phát huy vai trò người cao tuổi.

Điều 29. Trách nhiệm của bộ, cơ quan ngang bộ

1. Bộ Lao động - Thương binh và Xã hội có trách nhiệm sau đây:

a) Xây dựng và trình cơ quan có thẩm quyền ban hành hoặc ban hành theo thẩm quyền văn bản quy phạm pháp luật, chương trình, kế hoạch về công tác người cao tuổi;

b) Chủ trì, phối hợp với bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ và Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương tổ chức thực hiện văn bản quy phạm pháp luật về người cao tuổi, chương trình, kế hoạch về công tác người cao tuổi;

c) Thanh tra, kiểm tra việc thực hiện pháp luật về người cao tuổi;

d) Thực hiện hợp tác quốc tế về người cao tuổi;

đ) Thực hiện công tác báo cáo về người cao tuổi;

e) Phối hợp với Bộ Kế hoạch và Đầu tư thống kê về người cao tuổi;

g) Chủ trì phối hợp với bộ, cơ quan ngang bộ ban hành và tổ chức thực hiện quy định về bồi dưỡng người làm công tác người cao tuổi;

h) Chủ trì phối hợp với Bộ Y tế quy định tiêu chuẩn nghiệp vụ và bồi dưỡng nhân viên chăm sóc người cao tuổi;

i) Chủ trì phối hợp với bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ và Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương quy hoạch các cơ sở chăm sóc người cao tuổi trong cả nước.

2. Bộ Y tế có trách nhiệm sau đây:

a) Hướng dẫn và tổ chức thực hiện chăm sóc sức khoẻ người cao tuổi tại cơ sở khám bệnh, chữa bệnh và cộng đồng; hướng dẫn việc quản lý bệnh mạn tính của người cao tuổi;

b) Xây dựng và tổ chức thực hiện chương trình phòng bệnh, khám bệnh, chữa bệnh tim mạch, tiểu đường, an-dây-mơ (alzheimer) và các bệnh mạn tính khác, bệnh về sức khoẻ sinh sản của người cao tuổi;

c) Đào tạo, bồi dưỡng thầy thuốc, nhân viên y tế chuyên ngành lão khoa.

3. Bộ Nội vụ chủ trì, phối hợp với bộ, cơ quan ngang bộ nghiên cứu, trình Chính phủ ban hành quy định về tổ chức, chế độ, chính sách đối với người làm công tác người cao tuổi.

4. Bộ Tài chính hướng dẫn việc bố trí ngân sách thực hiện chính sách chăm sóc, phát huy vai trò người cao tuổi và hỗ trợ kinh phí hoạt động của Hội người cao tuổi Việt Nam theo quy định của pháp luật về ngân sách nhà nước.

5. Bộ Kế hoạch và Đầu tư thẩm định, phê duyệt theo thẩm quyền các dự án nhà nước về chăm sóc, phát huy vai trò người cao tuổi; chủ trì phối hợp với Bộ Lao động - Thương binh và Xã hội thống kê về người cao tuổi.

6. Bộ Văn hoá - Thể thao và Du lịch chỉ đạo việc hỗ trợ người cao tuổi trong các hoạt động văn hoá, thể dục, thể thao, giải trí, du lịch; chăm sóc, phát huy vai trò của người cao tuổi trong gia đình.

7. Bộ Thông tin và Truyền thông chỉ đạo các cơ quan thông tin đại chúng tuyên truyền kịp thời, chính xác chính sách, pháp luật về người cao tuổi.

Chương VI

ĐIỀU KHOẢN THI HÀNH

Điều 30. Hiệu lực thi hành

1. Luật này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2010.

2. Chính sách bảo trợ xã hội đối với người cao tuổi quy định tại khoản 2 Điều 17 của Luật này thực hiện từ ngày 01 tháng 01 năm 2011.

3. Pháp lệnh Người cao tuổi số 23/2000/PL-UBTVQH10 hết hiệu lực kể từ ngày Luật này có hiệu lực.

Chính sách bảo trợ xã hội hiện hành đối với người từ 85 tuổi trở lên không có lương hưu hoặc trợ cấp bảo hiểm xã hội được tiếp tục thực hiện cho đến hết ngày 31 tháng 12 năm 2010.

Điều 31. Quy định chi tiết và hướng dẫn thi hành

Chính phủ quy định chi tiết, hướng dẫn thi hành các điều, khoản được giao trong Luật; hướng dẫn những nội dung cần thiết khác của Luật này để đáp ứng yêu cầu quản lý nhà nước.

Luật này đã được Quốc hội nước Cộng hoà xã hội chủ nghĩa Việt Nam khoá XII, kỳ họp thứ 6 thông qua ngày 23 tháng 11 năm 2009.

ON THE ELDERLY

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;
The National Assembly promulgates the Law on the Elderly.

Chapter I

GENERAL PROVISIONS

Article 1. This Law provides for the rights and obligations of the elderly; the responsibilities of families, the State and the society in taking care of. attending to. and bringing into full play the role of, the elderly; and the Vietnam Elderly Association.

Article 2. The elderly

The elderly defined in this Law are Vietnamese citizens aged full 60 or over.

1. The elderly have the following rights:

a/To be guaranteed with basic food, clothing, lodging, movement and healthcare needs;

b/ To decide to live with their children, grandchildren or to live separately at their own will;

c/To be given priority in the use of services under this Law and other relevant laws:

d/ To be provided with conditions to participate in cultural, educational, physical training, sports, entertainment, tourist and recreation activities;

e/ To be provided with conditions to work in suitability to their health and professions and other conditions in order to bring into full play their role;

f/ To be exempt from contributions to social activities, except voluntary contributions;

g/ To be given priority in the receipt of relief in cash or in kind, healthcare and lodgings with a view to overcoming initial difficulties when they meet with difficulties due to consequences of natural disasters or other force majeure circumstances;

h/ To join in the Vietnam Elderly Association under the Association's charter;

2. The elderly have the following obligations:

a/To set bright examples in moral quality and lifestyles: to educate young generations to preserve and promote the fine traditions of the nation; to be exemplary in observing and mobilizing families and communities to observe the Party's policies and line and the State's laws;

b/ To pass their precious experiences to younger generations;

c/ Other obligations defined by law.

Article 4. The State's policies towards the elderly

1. To allocate appropriate annual budgets for the realization of policies to take care of and bring into full play the role of the elderly.

2. To provide social patronage to the elderly under this Law and other relevant laws.

3. To incorporate policies for the elderly into policies on socio-economic development.

4. To develop gerontology so as to meet the elderly's medical examination and treatment needs; to train personnel to take care of the elderly.

6. To encourage and support agencies, organizations and individuals in carrying out propaganda on and education about the sense of respect for and gratitude to the elderly, taking care of and bringing into full play the role of the elderly.

7. To commend agencies, organizations and individuals that record outstanding achievements in taking care of and bringing into full play the role of the elderly.

8. To strictly handle agencies, organizations and individuals that commit acts of violating this Law and other relevant laws.

Article 5. Responsibilities of agencies, organizations, families and individuals

1. Agencies and organizations shall, within the ambit of their respective tasks and powers, take care of and protect the legitimate rights and interests of the elderly.

2. The Vietnam Fatherland Front and its member organizations and other organizations shall agitate and mobilize people to heighten the responsibility to take care of and bring into full play the role of the elderly: to participate in supervising the implementation of policies and laws on the elderly.

3. The elderly's families shall take the main responsibility in taking care of the elderly.

4. Individuals shall respect and help the elderly.

Article 7. Funds for taking care of and bringing into full play the role of the elderly

1. Funds for taking care of and bringing into full play the role of the elderly arc social and charity funds.

2. Funds for taking care of and bringing into full play the role of the elderly come from the following sources:

a/ Voluntary contributions and financial aid of domestic and foreign organizations and individuals:

b/ State budget supports;

c/ Other lawful revenue sources.

3. The establishment, operation and management of the funds for taking care of and bringing into full play the role of the elderly must comply with law.

Article 8. International cooperation for the elderly

1. International cooperation for the elderly shall be carried out on the basis of respect for independence, sovereignty, territorial integrity, equality and conformity with Vietnamese law and international laws.

a/ Formulation and materialization of programs and projects of international cooperation on the elderly;

b/ Participation in international organizations; conclusion, accession to and implementation of treaties and international agreements related to the elderly;

c/ Exchange of information and experiences on taking care of and promoting the role of the elderly.

Article 9. Prohibited acts

1. Insulting, ill-treating or hurting, persecuting, discriminating against the elderly.

2. Infringing upon or preventing the elderly from exercising their rights to marriage, property ownership and other lawful rights.

3. Failing to perform the obligations of taking care of the elderly.

4. Taking advantage of the looking after and taking care of the elderly for self-seeking interests.

5. Forcing the elderly to labor or do things contrary to law.

7. Retaliating and intimidating persons who help the elderly or who detect, report on or prevent illegal acts against the elderly.

Chapter II

TAKING CARE OF AND LOOKING AFTER THE ELDERLY

SECTION I. TAKING CARE OF THE ELDERLY

Article 10. Obligations and rights to take care of the elderly

1. Taking care of the elderly means caring for their spiritual and material lives, aiming to satisfy their basic food, clothing, lodging, travel and healthcare needs as well as entertainment, recreation, information, communication and learning needs.

2. Persons having the obligations and rights to take care of the elderly are their children and grandchildren and other persons obliged to take care of or provide financial supports under the law on marriage and family.

3. Persons having the obligations and rights to take care of the elderly shall, depending on their specific circumstances, arrange the elderly's lodgings suitable to their health and psychological conditions; provide financial assistance; pay hospitalization and healthcare costs and encourage the elderly when they fall sick: organize funerals when they die.

4. Persons having the obligations and rights to take care of the elderly shall cooperate with one another in looking after them.

Article 11. Entrusted care for the elderly

1. Persons having the obligations and rights to take care of the elderly but having no conditions to directly look after the elderly may entrust individuals or organizations providing services of taking care of the elderly to look after the elderly, but with the elderly's consent.

Entrustment to look after the elderly shall be effected under service contracts between persons having the obligations and rights to take care of the elderly and service providers.

2. Service providers entrusted to look after the elderly shall fulfill their commitments under service contracts signed with entrusters.

3. The elderly may request persons with care-taking obligations and rights to replace service providers entrusted to take care of them.

4. The Government shall detail this Article.

SECTION 2. CARING FOR THE ELDERLY'S HEALTH

Article 12. Medical examination and treatment

1. Prioritized medical examination and treatment for the elderly shall be carried out as follows:

b/ Elderly inpatients are arranged proper hospital beds.

2. Hospitals, except pediatrics hospitals, have the following responsibilities:

a/ To organize gerontologic departments or set aside a number of beds for treatment of elderly patients:

b/ To rehabilitate elderly patients' health after pernicious disease treatments at hospital and guide their further treatment and care at home;

c/ To combine traditional medicine with modern medicine in treatment and guide methods of non-medicine treatment at grassroots health establishments for elderly patients:

d/ The Stale encourages organizations and individuals to give free-of- charge medical examination and treatment to the elderly.

Article 13. Primary healthcare at places of residence

1. Commune, ward, township health stations have the following responsibilities:

a/To carry out propaganda and dissemination in different forms of common healthcare knowledge; guide the elderly in skills of disease prevention and treatment and self-healthcare;

c/ To give medical examination and treatment suitable to their specialization to the elderly;

d/ To coordinate with higher-level medical establishments in organizing periodical health checkups for the elderly.

2. Commune, ward or township health stations shall send health workers to conduct medical examination and treatment at places of residence of lonely and seriously ill elderly persons who cannot go to medical establishments for examination and treatment. Commune, ward or township People's Committees shall support the transport of patients defined in this Clause to medical establishments at the proposal of commune, ward or township health stations.

3. The State encourages organizations and individuals to give medical examination and treatment to the elderly at their places of residence.

4. Funds for the implementation of tasks defined at Points a, b and d. Clauses 1 and 2 of this Article shall be provided by the state budget.

SECTION 3. CARE FOR THE ELDERLY IN CULTURAL, EDUCATIONAL, PHYSICAL TRAINING SPORTS, RECREATION AND TOURIST ACTIVITIES, IN THE USE OF PUBLIC FACILITIES AND PARTICIPATION IN MASS TRANSIT

Article 14. Cultural, educational, physical training, sports, recreation and tourist activities

1. The State invests and encourages organizations and individuals to invest in the construction of cultural, educational, physical training, sports, recreation and tourist establishments to satisfy the elderly's demands for better spiritual fife and physical training.

2. The State and society shall create favorable conditions for the elderly to learn and research and participate in cultural, physical training, sports, recreation and tourist activities through the following measures:

b/ Providing support and guidance for the elderly to participate in cultural, recreation, tourist and deep-breathing practices as well as other physical training and sports activities suitable to their health and psychology;

c/ Providing supports in locations, tools, equipment and other material foundations suitable to the elderly's activities:

d/ Encouraging enterprises and individuals to produce and trade in products and commodities suitable to the elderly's needs.

3. The Government shall detail this Article.

Article 15. Public facilities, mass transit

1. The construction or renovation of condomi­niums and public facilities must take into account the elderly's characteristics and use needs.

2. When participating in mass transit, the elderly shall be assisted and arranged convenient seats.

3. The Government shall detail this Article.

Article 16. Discount of fares and service charges

SECTION 4. SOCIAL PATRONAGE FOR THE ELDERLY

Article 17. Persons entitled to social patronage policies

1. The elderly of poor households without persons having the care-taking obligations and rights or with persons having the care-taking obligations and rights who however, currently enjoy monthly social relief allowances.

2. Persons aged full 80 or over other than those defined in Clause 1 of this Article who have no pensions, monthly social insurance allowances or monthly social relief allowances.

Article 18. Social patronage policies

1. The elderly defined in Article 17 of this Law are entitled to health insurance, monthly social relief allowances and payment of funeral and burial costs upon their death, except cases specified in Clause 2 of this Article.

2. The elderly of poor families without persons having the care-taking obligations and rights, no conditions to live in the community, have the aspiration and are admitted into social patronage establishments, are entitled to the following benefits:

a/ Annual nurturing allowance;

b/ Supply of personal effects and articles for their daily activities;

d/ Provision of common medicines;

e/ Provision of tools and equipment for functional rehabilitation;

f/ Funeral and burial upon death.

3. The Government shall detail this Article.

Article 19. Looking after the elderly at community

The elderly defined in Clause 2 of Article 18 with someone undertaking to look after them at community are entitled to a monthly social relief allowance equal to the nurturing cost level at social patronage establishments, health insurance and payment of funeral and burial costs upon their death.

Article 20. Elderly-caretaking establishments

1. Elderly-caretaking establishments are places in which care, nurturing, counseling or other necessary conditions are provided for the elderly.

2. Elderly caring establishments include:

b/ Elderly care counseling and service-providing establishments;

c/ Other elderly caretaking establishments.

The Government shall specify the establishment and operation of elderly caretaking establishments defined in this Clause.

3. The State encourages organizations and individuals to invest in the construction of elderly caretaking establishments; invests in material foundations and provides financial supports for the operation of public elderly caretaking establishments and provides financial supports for non-public elderly caretaking establishments to nurture the elderly defined in Clause 2, Article 18 of this Law.

4. Organizations and individuals contributing or investing their own funds in the construction of elderly caretaking establishments are entitled to preferential policies under the law on policies to encourage socialization of activities in the fields of education, vocational training, healthcare, culture, sports and environment.

SECTION 5. LONGEVITY CONGRA TUL\ TION AND CELEBRATION, FUNERAL ORGANIZATION

Article 21. The elderly's longevity congratulations and celebrations

1. Persons aged 100 will be congratulated and given presents by the President of the Socialist Republic of Vietnam

2. Persons aged 90 will be congratulated and given presents by chairpersons of provincial-level People's Committees.

b/ The International Elderly Day;

c/ Lunar New Year Festival:

d/ The elderly’s birthdays.

4. Funds for the implementation of tasks defined in this Article shall be provided by the state budget and social contributions.

Article 22. Organization of funerals and burials for deceased elderly

1. When the elderly pass away, persons with care-taking obligations and rights shall assume the main responsibility for organizing their funerals and burials in a solemn and thrifty ceremony, ensuring cultured lifestyle, unless otherwise provided for by law. If the elderly have no persons with care-taking obligations and rights or have such persons who. however, do not have conditions to organize funerals and burials, commune, ward or township People's Committees or social patronage establish-ments where such the elderly live shall assume the prime responsibility for. and coordinate with local Elderly Associations and mass organizations in. organizing their funerals and burials.

2. When an elderly passes away, the agency or organization in which he/she works or last worked, the Elderly Association and the commune, ward or township People's Committee and local mass organizations shall coordinate with his/her family in organizing his/her funeral and burial.

Article 23. Activities of promoting the elderly's role

The State, society and families shall create conditions for the elderly to bring into full play their intellect, precious experiences and fine qualities in the following activities:

1. Education about the traditions of unity, patriotism and love for humans and nature;

2. Building of cultured life; preserving and promoting national cultural identities at establishments and communities; participating in movements for learning promotion, talent promotion, support of education and training of virtuous and talented persons and other campaigns in communities;

3. Impartation of skills, experiences and economic, cultural, social, scientific and technological knowledge and traditional crafts to young generations;

4. Research, education, training, scientific and technological application; and professional and technical consultancy;

5. Economic development, poverty reduction and getting rich in lawful ways;

6. Maintenance of political security, social order and safety; reconciliation of conflicts and disputes in communities;

7. Observance of the law on grassroots democracy; practice of thrift against waste: prevention and combat of corruption and bureaucracy; prevention and fighting of HIV/ AIDS and social vices:

9. Other social activities in the interest of organizations and the public.

Article 24. Responsibilities to promote the elderly's role

1. The State shall apply the following measures so that the elderly bring into full play their role suitable to their respective capabilities:

a/ Creating conditions for the elderly to express their views, aspirations and petitions to agencies or organizations on matters of the elderly's concern;

b/ Creating conditions for elderly scientists and artisans and other elderly with special skills and experiences and aspirations to continue making contributions:

c/ Providing preferential credit loans to the elderly who are directly involved in production and business activities in order to increase their incomes and alleviate poverty;

d/ Praising and commending the elderly who record outstanding achievements.

2. Agencies, Elderly Associations, other organizations, families and individuals shall create conditions for the elderly to carry out activities of promoting their role.

Article 25. The Vietnam Elderly Association

1. The Vietnam Elderly Association is a social organization representing the aspirations and legitimate rights and interests of Vietnamese elderly.

2. The Vietnam Elderly Association is organized on the principle of voluntariness and operates under the Constitution, laws and its Charter.

Article 26. Funds for operations of the Vietnam Elderly Association

1. Funds for the operations of the Vietnam Elderly Association come from the following sources:

a/ State budget support;

b/ Membership fee;

c/ Other lawful revenue sources.

2. The Vietnam Elderly Association shall manage and use its operation funds according to law.

1. To rally, unite and mobilize the elderly to participate in its activities, contributing to the implementation of socio-economic programs, the education of young generations, the building of civilized lifestyles, cultured families, the maintenance of political security, social order and safety, and the national construction and defense.

2. To act as the core in the movement to look after, take care of and promote the role of the elderly.

3. To protect the elderly's legitimate rights and interests.

4. To study the elderly's demands and aspirations for proposal to competent state agencies.

5. To represent the Vietnamese elderly in participating in international organizations and people's foreign relation activities in the interest of the elderly and the Fatherland.

Chapter V

STATE AGENCIES' RESPONIBILITIES FOR ELDERLY-RELATED WORK

Article 28. Agencies performing the state management of elderly-related work

1. The Government performs the unified state management of elderly-related work.

3. Ministries and ministerial-level agencies shall, within the ambit of their respective tasks and powers, coordinate with the Ministry of Labor, War Invalids and Social Affairs in performing the state management of elderly-related work.

4. People's Committees at all levels shall, within the ambit of their respective tasks and powers, perform the slate management of elderly-related work; incorporate elderly-related activities in local socio-economic development plans; and create conditions for agencies, organizations and individuals to participate in taking care of and promoting the role of the elderly.

Article 29. Responsibilities of ministries and ministerial-level agencies

1. The Ministry of Labor, War Invalids and Social Affairs shall:

a/ Formulate and submit to competent agencies for promulgation or promulgate according to its competence legal documents, programs and plans on elderly-related work;

b/ Assume the prime responsibility for, and coordinate with other ministries, ministerial-level agencies, government-attached agencies and provincial-level People's Committees in. implementing legal documents on the elderly and programs and plans on elderly-related work;

c/ Inspect and examine the enforcement of the law on the elderly;

d/ Implement international cooperation on the elderly;

e/ Make reports on the elderly:

g/ Assume the prime responsibility for. and coordinate with other ministries, ministerial-level agencies in. promulgating and organizing the implementation of regulations on training of officers in charge of elderly-related work;

h/ Assume the prime responsibility for. and coordinate with the Ministry of Health in, prescribing professional standards for and training caretakers of the elderly;

i/ Assume the prime responsibility for, and coordinate with other ministries, ministerial-level agencies, government- attached agencies and provincial-level People's Committees in, planning elderly-caretaking establishments nationwide.

2. The Ministry of Health shall:

a/ Guide and organize the care for the elderly's health at medical establishments and in communities; guide the management of the elderly's chronic diseases;

b/ Formulate, and organize the implementa­tion of. programs on prevention, examination and treatment of cardiovascular diseases, diabetes. Alzheimer and other chronic ailments and reproductive health-related diseases for the elderly;

c/ Train gerontological doctors and health workers.

3. The Ministry of Home Affairs shall assume the prime responsibility for. and coordinate with other ministries and ministerial-level agencies in. studying and submitting to the Government for promulgation regulations on organization of. regimes and policies towards, officers in charge of elderly-related work.

4. The Ministry of Finance shall guide the budget allocation for the realization of policies on care for. and promotion of the role of. the elderly and provide operation funds for the Vietnam Elderly Association under the law on the state budget.

6. The Ministry of Culture, Sports and Tourism shall direct the support of the elderly in cultural, physical training, sports, recreation and tourist activities; care for. and promote the role of. the elderly in families. 7. The Ministry of Information and Communications shall direct mass media agencies to promptly and accurately propagate policies and the law on the elderly.

Chapter VI

IMPLEMENTATION PROVISIONS

Article 30. Effect

1. This Law takes effect on July 1, 2010.

2. Social patronage policies for the elderly provided in Clause 2, Article 17 of this Law shall be implemented from January 1, 2011.

3. Ordinance No. 23/2000/PL-UBTVQH10 on the Elderly ceases to be valid on the effective date of this Law.

The current social patronage policies for persons aged 85 or over who have no pensions or social insurance allowances continue to be implemented through December 31, 2010.
