QUYẾT ĐỊNH
VỀ VIỆC ĐIỀU TRA, XÁC ĐỊNH NẠN NHÂN BỊ HẬU QUẢ CHẤT ĐỘC HOÁ HỌC DO MỸ SỬ DỤNG TRONG CHIẾN TRANH VIỆT NAM

Căn cứ Luật Tổ chức Chính phủ ngày 30 tháng 9 năm 1992; Để có cơ cở cho việc đề ra chủ trương và giải pháp cơ bản khắc phục hậu quả chất độc hoá học do Mỹ sử dụng trong chiến tranh Việt Nam đối với con người; Theo đề nghị của Bộ trưởng Bộ Lao động - Thương binh và Xã hội,
QUYẾT ĐỊNH:
Điều 1. Tiến hành điều tra, xác định nạn nhân bị hậu quả chất độc hoá học do Mỹ sử dụng trong chiến tranh Việt Nam trên phạm vi toàn quốc.
1. Đối tượng điều tra:
a) Cán bộ, chiến sĩ lực lượng vũ trang cách mạng, cán bộ dân chính đảng, thanh niên xung phong đã công tác, chiến đấu và phục vụ chiến đấu ở những vùng bị Mỹ rải chất độc hoá học trong chiến tranh có con dị dạng, dị tật hoặc bản thân đang bị mắc những căn bệnh hiểm nghèo do chất độc hoá học gây nên.
b) Các đối tượng khác đã hoạt động, sinh sống ở những vùng bị Mỹ rải chất độc hoá học trong chiến tranh có con dị dạng, dị tật hoặc bản thân đang bị mắc những căn bệnh hiểm nghèo do chất độc hoá học gây nên.
c) Trẻ dị dạng, dị tật là con đẻ của những đối tượng nêu ở điểm a, khoản 1 Điều 1 Quyết định này.
d) Trẻ dị dạng, dị tật là con đẻ của những đối tượng nêu ở điểm b, khoản 1 Điều 1 Quyết định này.
2. Nội dung điều tra gồm:
a) Số lượng người bị hậu quả chất độc hoá nêu trong khoản 1 Điều 1 Quyết định này.
b) Các dạng dị tật của trẻ em do hậu quả chất độc hoá học.
c) Xác định tình trạng sức khoẻ, bệnh tật và khả năng lao động của các đối tượng nêu trong khoản 1 Điều 1 Quyết định này.
d) Tình hình thu nhập, đời sống của các gia đình có người bị hậu quả chất độc hoá học.
đ) Những chính sách, giải pháp của Nhà nước, sự giúp đỡ của cộng đồng đối với nạn nhân bị hậu quả chất độc hoá học: thực trạng và phương hướng giải quyết.
3. Thời gian thực hiện cuộc điều tra: 2 năm (1998 - 1999).
Điều 2. Bộ Lao động - Thương binh và Xã hội chịu trách nhiệm xây dựng phương án và phối hợp với các cơ quan có liên quan, các địa phương tổ chức thực hiện việc điều tra, xác định nạn nhân bị hậu quả chất độc hoá học do Mỹ sử dụng trong chiến tranh Việt Nam và tổng hợp báo cáo kết quả.
Điều 3. Bộ Lao động - Thương binh và Xã hội thống nhất với Bộ Tài chính và Bộ Kế hoạch và Đầu tư về kinh phí cho cuộc điều tra.
Điều 4. Quyết định này có hiệu lực thi hành sau 15 ngày, kể từ ngày ký.
Điều 5. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Quyết định này.

DECISION ON THE SURVEY AND
DETERMINATION OF VICTIMS OF TOXIC CHEMICALS USED BY THE UNITED STATES DURING
THE VIETNAM WAR THE PRIME MINISTER Pursuant
to the Law on Organization of the Government of September 30, 1992;
In order to have grounds for devising policies and fundamental measures to
overcome the consequences of toxic chemicals used by the United States during
the Vietnam War on human being;
At the proposal of the Minister of Labor, War Invalids and Social Affairs, DECIDES: Article 1.-
To conduct a survey of and determine, the victims of toxic chemicals used by
the United States during the Vietnam War throughout the country. 1. Subjects of the survey: a/ Officers and men of the revolutionary armed
forces, cadres of the Party, State and mass organizations and young volunteers,
having previously worked, fought or served the combat in areas where the US
sprayed toxic chemicals during the war, who have their children born deformed
or defective, or have themselves been suffering from serious illness caused by

offsprings of the subjects defined in Point a, Clause 1, Article 1 of this
Decision. d/ Deformed or defective children who are
offsprings of the subjects defined in Point b, Clause 1, Article 1 of this
Decision. 2. The contents of the survey: a/ The number of people affected by toxic
chemicals as stated in Clause 1, Article 1 of this Decision. b/ The child deformities caused by toxic
chemicals. c/ The determination of the state of health,
illness and working capacity of the subjects defined in Clause 1, Article 1 of
this Decision. d/ The current incomes and living conditions of
families having people affected by toxic chemicals. e/ The State's policies and solutions, the
community's assistance to the victims of toxic chemicals: the real situation

3.- The Ministry of Labor, War Invalids and Social Affairs shall consult
with the Ministry of Finance and the Ministry of Planning and Investment on the
fund for the survey.. Article 4.-
This Decision takes effect 15 days after its signing. Article 5.-
The ministers, the heads of the ministerial-level agencies, the heads of the
agencies attached to the Government and the presidents of the People's Committees
of the provinces and cities directly under the Central Government shall have to
