VỀ VIỆC THAY ĐỔI CƠ CHẾ ĐIỀU HÀNH LÃI SUẤT CHO VAY BẰNG ĐÔLA MỸ CỦA CÁC TỔ CHỨC
TÍN DỤNG ĐỐI VỚI KHÁCH HÀNG

Căn cứ Luật Ngân hàng Nhà nước
Việt Nam và Luật Các tổ chức tín dụng ngày 12 tháng 12 năm 1997.
Căn cứ Nghị định số 15/CP ngày 02/03/1993 của Chính phủ về nhiệm vụ, quyền hạn
và trách nhiệm quản lý Nhà nước của Bộ, cơ quan ngang Bộ;
Theo đề nghị của Vụ trưởng Vụ Chính sách tiền tệ,
QUYẾT ĐỊNH
Điều 1.
1. Tổ chức tín dụng ấn định lãi
suất cho vay bằng đôla Mỹ dựa trên cơ sở lãi suất thị trường quốc tế và cung -
cầu vốn tín dụng bằng ngoại tệ ở trong nước.
2. Bãi bỏ các
quy định tại Khoản 1 Điều 3 Quyết định số 241/2000/QĐ-NHNN1
ngày 02/08/2000 của Thống đốc Ngân hàng Nhà nước về việc
thay đổi cơ chế điều hành lãi suất cho vay của tổ chức tín dụng đối với khách
hàng và Quyết định số 243/2000/QĐ-NHNN1 ngày 02/08/2000 của Thống đốc Ngân hàng
Nhà nước về công bố biên độ lãi suất đôla Mỹ làm cơ sở cho tổ chức tín dụng ấn
định lãi suất cho vay đối với khách hàng.
Điều 2.
1. Tại thời điểm Quyết định này
có hiệu lực thi hành, đối với số dự nợ đã cho vay và các hợp đồng tín dụng đã
ký kết nhưng chưa giải ngân hết hoặc chưa giải ngân, thì được tiếp tục thực hiện
theo mức lãi suất đã ghi trên hợp đồng tín dụng. Việc điều chỉnh lãi suất cho
vay đối với các hợp đồng tín dụng này do tổ chức tín dụng và khách hàng xem xét
thoả thuận.
2. Lãi suất nợ quá hạn được thoả
thuận trong hợp đồng tín dụng giữa tổ chức tín dụng và khách hàng, nhưng không
vượt quá 150% lãi suất cho vay bằng đôla Mỹ ghi trên hợp đồng tín dụng.
Điều 3.
1. Quyết định này có hiệu lực kể
từ ngày 01 tháng 06 năm 2001.
2. Thủ trưởng các đơn vị thuộc
Ngân hàng Nhà nước, Giám đốc chi nhánh Ngân hàng Nhà nước tỉnh, thành phố; Hội đồng
quản trị và Tổng giám đốc (Giám đốc) các tổ chức tín dụng chịu trách nhiệm thi
hành Quyết định này.

DECISION ON
THE CHANGE OF OPERATIONAL MECHANISM OF LENDING INTEREST RATES IN US$ OF CREDIT
INSTITUTIONS FOR CUSTOMERS THE GOVERNOR OF THE STATE
BANK Pursuant to the Law on the
State Bank of Vietnam and the Law on the Credit Institutions dated 12 December,
1997;
Pursuant to the Decree No. 15/CP dated 02 March, 1993 of the Government on the
assignment, authority and responsibility for the State management of the
ministries and ministerial-level agencies;
Upon the proposal of the Director of the Monetary Policy Department, DECIDES Article 1. 1. Credit institutions shall
determine lending interest rates in US$ for customers on the basis of the
interest rate of international market and domestic demand, supply of credit
funds in foreign currency. 2. To repeal the provisions of
paragraph 1 Article 3 of the Decision No. 241/2000/QD-NHNN1 dated 2 August,
2000 of the Governor of the State Bank on the change of operational mechanism
of lending interest rates of credit institutions for customers and the Decision
No. 243/2000/QD-NHNN1 dated 2 August, 2000 of the Governor of the State Bank on
the announcement of the US$ interest rate bands as a basis for the
determination by credit institutions of lending interest rates for customers. ... ... ... At the effective time of this
Decision, the outstanding loans and credit contracts, which have been entered
into but not fully disbursed or not yet disbursed, shall continue to be subject
to the interest rate stated in respective credit contracts. The adjustment of
the lending rates for those credit contracts shall be considered and agreed
upon by credit institutions and customers. 2. The overdue interest rate
shall be agreed upon by credit institutions and customers in the credit
contract but shall not exceed 150% of the lending interest rate stated in the
credit contract. Article 3. 1. This Decision shall be
effective from 01 June, 2001. 2. Heads of units in the State
Bank, General Managers of the State Bank branches in provinces and cities,
Chairman of the Board of Directors and Directors General (Directors) of credit
institutions shall be responsible for the implementation of this Decision. THE
