CIRCULAR
AMENDING
AND SUPPLEMENTING THE FINANCE MINISTRY'S CIRCULAR No. 110/2002/TT-BTC OF
DECEMBER 12, 2002, GUIDING THE REGIME OF COLLECTION, REMITTANCE, MANAGEMENT AND
USE OF FEES AND CHARGES IN BANKING, SECURITIES AND INSURANCE DOMAINS
Pursuant to
the Government's Decree No. 57/2002/ND-CP of June 3, 2002, detailing the implementation
of the Ordinance on Fees and Charges;
Pursuant to the Government's Decree No. 144/2003/ND-CP of November 28, 2003 on
securities and securities market;
In order to create a favorable environment for securities issuance and trading,
and assure that the securities market operates in an organized, safe and
efficient manner, the Finance Ministry hereby guides the amendments and
supplements to Circular No. 110/2002/TT-BTC of December 12, 2002, guiding the
regime of collection, remittance, management and use of fees and charges in
banking, securities and insurance domains (hereinafter referred to as Circular
No. 110/2002/TT-BTC for short):
1. To amend
and supplement Point 1, Section II of Circular No. 110/2002/TT-BTC as follows:
"Charges for services involving the use of securities equipment and
infrastructure and securities activities shall be collected at the rates
specified in Appendix 1: Table of charge rates in securities domain."
To promulgated
together with this Circular the table of charge rates in securities domain in
replacement of the detailed list of charges in Appendix 1 to Circular No. 110/2002/TT-BTC.
2. To amend
and supplement the fourth em rule, Point 3, Section II of Circular No.
110/2002/TT-BTC as follows: "Charges in securities domain shall be
collected, managed and used by the Securities Trading Center and the Securities
Custody Center (charge-collecting agencies) according to the current
regulations."
3. To amend
and supplement Point 2, Section II of Circular No. 110/2002/TT-BTC as follows:
"Charge-collecting agencies may use 100% of the collected charge amount to
cover expenses for service provision and charge collection."
4. To replace
the phrase "the detailed list of fees" at Point 2, Section II and
Appendix 2 to Circular No. 110/2002/TT-BTC with the phrase "the table of
fee rates in banking, securities and insurance domains."

6. Any
problems arising in the course of implementation should be promptly reported by
organizations and individuals to the Finance Ministry for study and additional
guidance.
