DECISION
ON
REVOCATION OF AUTHORITY TO ISSUE CERTIFICATE OF ORIGIN, ISSUE CERTIFICATE OF
NON-MANIPULATION, AND RECEIVE APPLICATIONS FOR REGISTERED EXPORTER NUMBER UNDER
GENERALISED SYSTEM OF PREFERENCES OF NORWAY AND SWITZERLAND
THE MINISTER OF INDUSTRY AND TRADE OF VIETNAM
Pursuant to the Law on Government Organization
dated February 18, 2025;
Pursuant to the Law on Foreign Trade Management
dated June 12, 2017;
Pursuant to the Government's Decree No.
40/2025/ND-CP dated February 26, 2025 defining the functions, tasks, powers and
organizational structure of the Ministry of Industry and Trade of Vietnam;
Pursuant to the Government’s Decree No.
31/2018/ND-CP dated March 08, 2018 providing guidelines for implementation of
the Law on Foreign Trade Management regarding origin of goods;
At the request of the Director of the Agency of
Foreign Trade;

Article 1. Contents of
revocation
The authority to issue certificate of origin (C/O)
and certificate of non-manipulation (CNM), and receive applications for
registered exporter number (REX number) under the Generalised System of
Preferences (GSP system) of Norway and Switzerland granted by the Minister of
Industry and Trade of Vietnam to Vietnam Chamber of Commerce and Industry
(VCCI) under the following Decisions is hereby revoked, including:
1. Decision No. 1234/QD-BCT dated April 12, 2018 of
the Minister of Industry and Trade of Vietnam granting authorization to issue
certificates of origin, including C/O Form A, C/O Form B, and non-preferential C/O
according to the domestic legislation of importing countries, and CNMs.
2. Decision No. 1076/QD-BCT dated April 03, 2020 of
the Minister of Industry and Trade of Vietnam granting authorization to issue
C/O Form GSTP.
3. Decision No. 2795/QD-BCT dated December 16, 2022
of the Minister of Industry and Trade of Vietnam granting authorization to
receive applications for registered exporter number under generalised system of
preferences of Norway and Switzerland.
Article 2. Responsibilities of
Ministry of Industry and Trade of Vietnam
1. The Agency of Foreign Trade shall:
a) Notify importing countries, relevant domestic
and foreign authorities, organizations and units of replacement of the
authority in charge of issuing C/O Form A, C/O Form B, non-preferential C/O as
prescribed in the domestic legislation of importing countries, CNMs, C/O Form
GSTP, and receiving applications for REX number from the effective date of this
Decision.
b) Organize the issuance of C/O Form A, C/O Form B,
non-preferential C/O as prescribed in the domestic legislation of importing
countries, CNMs, C/O Form GSTP, and processing of applications for REX number
in a thorough and uninterrupted manner that must facilitate traders.

2. Vietnam E-commerce and Digital Economy Agency
shall:
Ensure electronic data infrastructure of the
electronic certificates of origin system (eCoSys) of the Ministry of Industry
and Trade of Vietnam to serve:
a) the issuance of electronic C/O and collection of
fees therefor.
b) the receipt of applications for REX number.
Article 3. Responsibilities of
VCCI
1. Stop issuing all of the following types of C/O,
including C/O Form A, C/O Form B, non-preferential C/O as prescribed in the
domestic legislation of importing countries, CNMs, C/O Form GSTP and receiving
applications for REX number from the time specified in clause 2 Article 4 of
this Decision.
2. Assist traders in replacing authorities in
charge of issuing C/O Form A, C/O Form B, non-preferential C/O as prescribed in
the domestic legislation of importing countries, CNMs, C/O Form GSTP and
receiving applications for REX number as prescribed in Article 14 of the
Government’s Decree No. 31/2018/ND-CP dated March 08, 2018 elaborating the Law
on Foreign Trade Management regarding origin of goods.
3. Take charge of or cooperate with relevant
competent authorities in carrying out inspection, examination and verification
of origin of goods covered by C/O Form A, C/O Form B, non-preferential C/O as
prescribed in the domestic legislation of importing countries, CNMs, C/O Form
GSTP and REX numbers (if any) issued by VCCI during the period over which it is
authorized by the Minister of Industry and Trade of Vietnam.
4. Retain all documents and papers relating to its
issuance of C/O Form A, C/O Form B, non-preferential C/O as prescribed in the
domestic legislation of importing countries, CNMs, C/O Form GSTP and receipt of
applications for REX number as prescribed in Article 30 of the Government’s
Decree No. 31/2018/ND-CP dated March 08, 2018 elaborating the Law on Foreign
Trade Management regarding origin of goods.

Article 4. Effect
1. This Decision comes into force from April 21,
2025.
2. From April 21, 2025 to the end of May 04, 2025,
VCCI and the Ministry of Industry and Trade of Vietnam (via the Agency of
Foreign Trade) shall complete all procedures for handover of documents, papers
and all tasks concerning the issuance of C/O Form A, C/O Form B,
non-preferential C/O as prescribed in the domestic legislation of importing
countries, CNMs, C/O Form GSTP, and processing of applications for REX number.
From May 05, 2025, VCCI shall stop issuing all of
the following types of C/O, including C/O Form A, C/O Form B, non-preferential
C/O as prescribed in the domestic legislation of importing countries, CNMs, C/O
Form GSTP, and receiving applications for REX number.
3. The following Decisions are abrogated:
a) Decision No. 1234/QD-BCT dated April 12, 2018 of
the Minister of Industry and Trade of Vietnam granting authorization to issue
certificates of origin.
b) Decision No. 1076/QD-BCT dated April 03, 2020 of
the Minister of Industry and Trade of Vietnam granting authorization to issue
C/O Form GSTP.
c) Decision No. 2795/QD-BCT dated December 16, 2022
of the Minister of Industry and Trade of Vietnam granting authorization to
receive applications for registered exporter number under generalised system of
preferences of Norway and Switzerland.
