CIRCULAR
ENERGY
CONSUMPTION NORMS IN BEER AND NON-ALCOHOLIC BEVERAGE INDUSTRY
Pursuant to the Law on Economical and Efficient
Use of Energy dated June 17, 2010;
Pursuant to Government’s Decree No.
96/2022/ND-CP dated November 29, 2022 on functions, tasks, powers and
organizational structure of the Ministry of Industry and Trade of Vietnam
Pursuant to Government’s Decree No.
105/2024/ND-CP dated August 01, 2022 on amendments to some Articles of
Government’s Decree No. 96/2022/ND-CP on functions, tasks, powers and
organizational structure of the Ministry of Industry and Trade of Vietnam; and
Decree No. 26/2018/ND-CP dated February 28, 2018 on Charter of organization and
operation of Vietnam Electricity;
At the request of the Director General of Energy
Efficiency and Sustainable Development Department;
The Minister of Industry and Trade promulgates
Circular on energy consumption norms in beer and non-alcoholic beverage
industry.

Article 1. Scope
This Circular provides methods for determining the
specific energy consumption, energy consumption norms, and report regime in
beer and non-alcoholic beverage industry.
Article 2. Regulated entities
1. Establishments and organizations engaging in beer
and non-alcoholic beverage manufacturing industry that fall under types and
capacity scales specified in Article 5 of this Circular.
2. Other relevant organizations and individuals.
Article 3. Interpretation of
terms
1. The beer and non-alcoholic beverage
manufacturing industry refers to the industry that manufactures various types
of beer and non-alcoholic beverages as defined by the Vietnam Standard
Industrial Classification.
2. Establishments and organizations engaging in
beer and non-alcoholic beverage manufacturing industry that fall within the
scope of this Circular (hereinafter referred to as “manufacturing
establishments”) refer to establishments having types and capacity scales
specified in Article 5 of this Circular.
3. Manufacturing establishments refer to
establishments that manufacture beer and non-alcoholic beverage according to
the 7-digit product code issued by the Prime Minister of Vietnam regarding the
Vietnam Standard Industrial Classification.

5. The Specific Energy Consumption (SEC) is the
total energy consumption used to produce one unit of product mass.
6. Energy consumption norm refers to the specific
energy consumption applicable to each specific type of product specified in
this Circular.
Chapter II
METHODS FOR DETERMINING
ENERGY CONSUMPTION NORMS IN BEER AND NON-ALCOHOLIC BEVERAGE INDUSTRY AND REPORT
REGIME
Article 4. Methods for
determining SEC
1. SEC in beer manufacture shall be determined
according to the method specified in Appendix I attached hereto.
2. SEC in non-alcoholic beverage manufacture shall
be determined according to the method specified in Appendix II attached hereto.
Article 5. Energy consumption
norms
Energy consumption norms shall apply to
establishments manufacturing beer and non-alcoholic beverages. To be specific

Article 6. Periodic reporting
regime
1. Before January 31st of each year, manufacturing
establishments specified in Clause 1 Article 2 of this Circular shall prepare a
report on the implementation of energy consumption norms in the previous year,
made using the Form in Appendix IV attached hereto, and submit it to the
Department of Industry and Trade in person, by post, or via website
https://dataenergy.vn. In case the report is submitted via the website
https://dataenergy.vn, manufacturing establishments shall contact the
Department of Industry and Trade to register an account.
Within 20 working days from receiving the report
from manufacturing establishments, the Department of Industry and Trade shall provide
feedback and request these establishments to provide additional information (if
any).
Within 5 working days from receiving the request
for additional information from the Department of Industry and Trade, the
manufacturing establishment shall provide additional information as requested.

Chapter III
IMPLEMENTATION
Article 7. Responsibilities of
the Department of Energy Efficiency and Sustainable Development
1. Direct, cooperate with relevant authorities to
disseminate, promote, and provide guidance to organizations and individuals
involved in implementing the provisions of this Circular.
2. Cooperate with Departments of Industry and Trade
to inspect the implementation of energy consumption norms according to plans to
ensure compliance with the energy consumption norms specified in this Circular.
3. Compile statistical reports on energy
consumption norms in beer and non-alcoholic beverage industry from reports
submitted by local authorities.
Article 8. Responsibilities of
the Department of Industry and Trade
1. Play the leading role in providing guidance,
urging, reminding, developing inspection plans, and inspecting compliance with
energy consumption norms of plastic manufacturing establishments subject to the
scope of this Circular in provinces; handle violations in accordance with the
law.
2. Cooperate with Department of Energy Efficiency
and Sustainable Development to provide guidance, urge, and inspect the
implementation of energy consumption norms as outlined in this Circular.

Article 9. Responsibilities of
manufacturing establishments
1. Manage and monitor the production process to
determine energy consumption.
2. Adhere to the energy consumption norms specified
in Article 5 of this Circular. In cases of changes or fluctuations during the
manufacturing process leading to failure in compliance with energy consumption
norms, the establishment shall compile a report on reasons and a compliance
plan on the basis of energy audit report and submit them to competent
authorities.
3. Implement the reporting regime as prescribed in
Article 6 of this Circular.
Article 10. Effect
1. This Circular shall come into force from April
1, 2025, replacing Circular No. 19/2016/TT-BCT December 28, 2016 of the
Minister of Industry and Trade on energy consumption norms in beer and beverage
industry.
2. Difficulties that arise during implementation of
this Circular should be reported to the Ministry of Industry and Trade./.
