CIRCULAR

ON AMENDMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 09/2015/TT-BYT DATED MAY 25, 2015 OF THE MINISTER OF HEALTH ON THE APPROVAL FOR CONTENTS OF ADVERTISEMENTS FOR SPECIAL PRODUCTS, COMMODITIES AND SERVICES UNDER THE MANAGEMENT OF THE MINISTRY OF HEALTH.

Pursuant to the Law on Advertising dated June 21, 2012;

Pursuant to the Law on Chemicals dated November 22, 2007;

Pursuant to the Government’s Decree No. 181/2013/ND-CP dated November 14, 2013 elaborating certain articles of the Law on Advertising;

Pursuant to Decree No. 95/2022/ND-CP dated November 15, 2022 of the Government on functions, tasks, powers and organizational structure of the Ministry of Health of Vietnam;

At the request of the Director General of Health Environment Management Agency,

The Minister of Health hereby promulgates a Circular on amendments to certain Articles of Circular No. 09/2015/TT-BYT dated May 25, 2015 of the Minister of Health on the approval for contents of advertisements for special products, commodities and services under the management of the Ministry of Health.

1. Point dd Clause 1 of Article 12 shall be annulled.

2. Point c shall be added to after point b clause 2 of Article 12 as follows:

“c) Chemicals, insecticidal and bactericidal preparations for household and medical use of the applicant for approval for advertisement contents headquartered at the area under management of the Department of Health.”

Article 2. Entry into force

This Circular comes into force from November 28, 2024.

Article 3. Transitional provisions

1. Organizations and individuals that have been issued with certificates of approval for contents of advertising chemicals, insecticidal and bactericidal preparations for household and medical use before the effective date of this Circular may continue advertising according to regulations.

2. Organizations and individuals that have submitted applications for issuance of certificates of approval for contents of advertising chemicals, insecticidal and bactericidal preparations for household and medical use before the effective date of this Circular shall comply with the provisions of Circular No. 09/2015/TT-BYT.

3. The reissuance of certificates of approval for contents of advertising chemicals, insecticidal and bactericidal preparations for household and medical use that are issued by the Health Environment Management Agency of the Ministry of Health before the effective date of this Circular shall be as follows:

b) In case of applying for reissuance of a certificate of approval for contents of advertising chemicals, insecticidal and bactericidal preparations for household and medical use specified in clause 2, clause 3 and clause 4 Article 21 of Circular No. 09/2015/TT-BYT, the facility named on the certificate or the facility authorized under regulations shall follow procedures for reissuance at the Department of Health  of province or central-affiliated city where the facility named on the certificate is headquartered;

c) Procedures for reissuance of a certificate of approval for contents of advertising chemicals, insecticidal and bactericidal preparations for household and medical use shall comply with the provisions of Article 21 of Circular No. 09/2015/TT-BYT.

Article 4. Implementation responsibilities

The Director General of Health Environment Management Agency, Director of Department of Legal Affairs, Chief of the Ministry Office, Chief Inspector of the Ministry, Director Generals of Departments and Sub-Departments affiliated to the Ministry of Health, Directors of the Departments of Health of provinces and central-affiliated cities, relevant agencies, organizations and individuals are responsible for implementation of this Circular.

Agencies, organizations and individuals should report difficulties that arise during the implementation of this Circular to the Ministry of Health (via the Health Environment Management Agency) for consideration and settlement./.
