ĐỊNH
CỦA CHÍNH PHỦ SỐ 35-CP NGÀY 25-4-1994 VỀ TỔ CHỨC LẠI CÔNG
TÁC CHỈ ĐẠO QUẢN LÝ THỊ TRƯỜNG, CHỐNG ĐẦU CƠ, BUÔN LẬU

Căn cứ Luật Tổ chức Chính phủ
ngày 30 tháng 9 năm 1992;
Căn cứ Nghị quyết của Chính phủ trong phiên họp của Chính phủ ngày 3 tháng 1
năm 1994;
Để tăng cường trách nhiệm quản lý Nhà nước của các Bộ, cơ quan ngang Bộ, cơ
quan thuộc Chính phủ trong công tác quản lý thị trường, chống đầu cơ, buôn lậu,
sản xuất và buôn bán hàng giả và các hành vi kinh doanh trái phép khác;
Theo đề nghị của Bộ trưởng, Trưởng ban Ban Tổ chức - cán bộ Chính phủ,
NGHỊ ĐỊNH :
Điều 1.-
Nay giao Bộ Thương mại, ngoài chức năng quản lý Nhà nước đối với các hoạt động
thương mại theo Nghị định số 95-CP ngày 4-12-1993, thống nhất chỉ đạo công tác
quản lý thị trường trong cả nước, bao gồm tổ chức phối hợp hoạt động giữa các
ngành, các địa phương trong việc chống đầu cơ, buôn lậu, sản xuất và buôn bán
hàng giả và các hành vi kinh doanh trái phép khác.
Điều 2.-
Các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Uỷ ban nhân dân các tỉnh,
thành phố trực thuộc Trung ương theo chức năng quản lý Nhà nước của mình có
trách nhiệm chỉ đạo công tác quản lý thị trường, chống đầu cơ, buôn lậu sản xuất
và buôn bán hàng giả và các hành vi kinh doanh trái phép khác trong phạm vi
ngành, lĩnh vực và địa phương mình phụ trách; phối hợp với Bộ Thương mại để bảo
đảm thực hiện thống nhất nhiệm vụ quản lý thị trường trong cả nước.
Bộ Thương mại, sau khi trao đổi
với các cơ quan có liên quan, trình Thủ tướng Chính phủ phê duyệt quy chế cụ thể
về trách nhiệm và mối quan hệ giữa Bộ Thương mại với Bộ, cơ quan ngang Bộ, cơ
quan thuộc Chính phủ, Uỷ ban nhân dân các cấp trong công tác quản lý thị trường,
chống đầu cơ, buôn lậu.
Điều 3.-
Chuyển giao bộ máy làm việc, tài liệu và tài sản thuộc Ban chỉ đạo quản lý thị
trường Trung ương (kể cả các Đội kiểm tra thị trường Trung ương) về Bộ Thương mại
quản lý và sử dụng để bảo đảm thực hiện nhiệm vụ được liên tục, không bị gián
đoạn.
Sau khi bàn giao cho Bộ Thương mại,
Ban chỉ đạo quản lý thị trường Trung ương chấm dứt hoạt động.
Bộ Thương mại có trách nhiệm
nghiên cứu trình Chính phủ quyết định tổ chức phù hợp ở Bộ và địa phương để đảm
bảo quản lý được thị trường và chống buôn lậu.
Điều 4.-
Trong lúc chờ có quyết định của Chính phủ về tổ chức quản lý thị trường mới:
- Uỷ ban nhân dân tỉnh, thành phố
trực thuộc Trung ương được duy trì tổ chức hiện có để giúp Uỷ ban nhân dân chỉ
đạo công tác quản lý thị trường chống đầu cơ, buôn lậu;
- Các đội kiểm tra thị trường ở
Trung ương và địa phương hiện có được duy trì để thực hiện nhiệm vụ kiểm tra,
kiểm soát thị trường theo các quy định trước đây của ban chỉ đạo quản lý thị
trường Trung ương ban hành; cán bộ, nhân viên làm việc trong các Đội này vẫn được
hưởng chế độ quy định tại Điều 8 Nghị định số 398-HĐBT ngày 6-12-1991 và các chế
độ khác hiện hành.
Điều 5.-
Nghị định này có hiệu lực thi hành từ ngày ban hành. Bãi bỏ Quyết định số
412-CT ngày 26-12-1991 của Chủ tịch Hội đồng Bộ trưởng và những qui định tại
Nghị định số 398-HĐBT ngày 6-12-1991 của Hội đồng Bộ trưởng trái Nghị định này.
Điều 6.-
Bộ trưởng, Chủ nhiệm Văn phòng Chính phủ, Bộ trưởng Bộ Thương mại, Trưởng ban
Ban chỉ đạo quản lý thị trường Trung ương, Bộ trưởng, Trưởng ban Ban Tổ chức -
Cán bộ Chính phủ, các Bộ trưởng và Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch
Uỷ ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi
hành Nghị định này.

DECREE REGARDING
THE REORGANIZATION OF THE STEERING OF THE MARKET MANAGEMENT AND THE FIGHT
AGAINST SPECULATION AND ILLICIT TRADE THE GOVERNMENT Proceeding from the Law on
Organization of the Government passed on the 30th of September 1992;
Pursuant to the Resolution adopted at the Government session on the 3rd of
January 1994;
With a view to promoting the State-management responsibility of the ministries,
the agencies at the ministerial level, and the agencies under the Government in
steering the market management and the fight against speculation, illicit
trade, production and trade of fake goods, and other unlawful business acts;
At the request of the Minister-Chairman of the Government Commission on
Organization and Personnel. DECREES: Article 1.- To assign to
the Ministry of Trade, in addition to its State-management function over trade
activities as provided for in Decree No. 95-CP of December 4, the unified
steering work of market management in the whole country, including the
organization of the coordination between branches and localities in the fight
against speculation, illicit trade, production and trade of fake goods and
other unlawful business acts. Article 2.-
The ministries, the agencies at the ministerial level, the agencies under the
Government and the People's Committees of the provinces and cities directly
attached to the Central Government, in accordance with their State-management
functions, shall be responsible for the steering of the work of market
management and the fight against speculation, illicit trade, production and
trade of fake goods and other unlawful business acts within their branches,
fields of operation and territories; and, in coordination with the Ministry of
Trade, shall ensure the unified implementation of the task of market management
in the whole country. The Ministry of Trade, upon
consulting with the concerned agencies, shall submit to the Prime Minister for
approval the detailed specification of the responsibility and relationship
between the Ministry of Trade and the other ministries, the agencies at the
ministerial level, the agencies under the Government and the People's
Committees at all levels in the work of market management and the fight against

Ministry of Trade, the Central Steering Commission for Market Management shall
cease to operate. The Ministry of Trade is
responsible for designing for Government approval an appropriate organization
at the Ministry and at localities to ensure the management of the market and
the fight against illicit trade. Article 4.-
Pending the Government decision on a new organization for the management of the
market - The People's Committees of
provinces and cities directly attached to the Central Government are allowed to
maintain the existing organizations to assist them in steering the work of
market management and the fight against speculation and illicit trade; - The existing Market Inspection
Teams at the central and local levels shall be maintained to carry out the
inspection and control of the market in line with the regulations already
effected by the Central Steering Commission for market Management; the staff of
these teams still are entitled to regimes provided for in Article 8 of Decree
No. 398-HDBT of December 6, 1991, and the other existing regimes. Article 5.-
This Decree shall take effect from the date of issuance. Decision No. 412-CT
issued on December 26, 1991 by the Chairman of the Council of Ministers and the
provisions contained in Decree No. 398-HDBT of December 6, 1991, which are
contrary to this Decree shall be annulled. Article 6.-
The Minister-Director of the Office of the Government, the Minister of Trade,
the Chairman of the Central Steering Commission for Market Management, the Minister-Chairman
of the Government Commission on Organization and Personnel, the Ministers and
Heads of the agencies under the Government, and the Chairmen of the People's
Committees of provinces and cities directly attached the Central Government,
