QUYẾT ĐỊNH

CỦA TỔNG CỤC TRƯỞNG TỔNG CỤC HẢI QUAN SỐ 1202/2001/QĐ-TCHQ NGÀY 23 THÁNG 11 NĂM 2001 VỀ VIỆC SỬA ĐỔI, BỔ SUNG GIÁ TỐI THIỂU CÁC MẶT HÀNG KHÔNG THUỘC DANH MỤC MẶT HÀNG NHÀ NƯỚC QUẢN LÝ GIÁ

Căn cứ thẩm quyền và nguyên tắc xác định giá tính thuế hàng xuất khẩu, hàng nhập khẩu quy định tại Điều 7 Nghị định số 54/CP ngày 28 tháng 8 năm 1993 của Chính phủ;
Căn cứ Thông tư 172/1998/TT/BTC ngày 22 tháng 12 năm 1998 của Bộ Tài chính hướng dẫn thi hành Nghị định số 54/CP ngày 28 tháng 8 năm 1993 của Chính phủ;
Căn cứ Thông tư số 82/1997/TT/BTC ngày 11 tháng 11 năm 1997; Thông tư số 92/1999/TT/BTC ngày 24 tháng 7 năm 1999 của Bộ Tài chính quy định thẩm quyền ấn định giá tính thuế của Tổng cục Hải quan;
Căn cứ Quyết định số 164/2001/QĐ-BTC ngày 10 tháng 10 năm 2000 của Bộ trưởng Bộ Tài chính;
Căn cứ Điều 3 Quyết định số 177/2001/QĐ-TCHQ ngày 14 tháng 3 năm 2001 của Tổng cục trưởng Tổng cục Hải quan;
Xét đề nghị của ông Cục trưởng Cục Kiểm tra thu thuế xuất nhập khẩu.

QUYẾT ĐỊNH

Điều 1: Điều chỉnh giá tối thiểu mặt hàng bộ linh kiện đồng bộ xe máy quy định tại bảng giá ban hành kèm theo Quyết định số 177/2001/QĐ-TCHQ ngày 14 tháng 3 năm 2001 của Tổng cục trưởng Tổng cục Hải quan cụ thể như sau:

* Bộ linh kiện đồng bộ xe máy do Trung Quốc sản xuất:

+ Loại 50cc : 320,00 USD/bộ

+ Loại 70cc, 90cc : 370,00 USD/bộ

+ Loại 100cc, 110cc : 450,00 USD/bộ

+ Loại 125cc trở lên : 650,00 USD/bộ

Điều 2: Giá tối thiểu mặt hàng bộ linh kiện xe máy nội địa hoá được tính trên cơ sở giá tối thiểu bộ linh kiện đồng bộ xác định tại Điều 1 Quyết định này trừ đi tỷ lệ nội địa hoá đã được Bộ Công nghiệp chấp nhận.

Điều 3: Giá tối thiểu mặt hàng bộ linh kiện xe máy điều chỉnh tại Quyết định này thay thế mặt hàng cùng loại quy định tại bảng giá ban hành kèm theo Quyết định số 177/2001/QĐ-TCHQ ngày 14 tháng 3 năm 2001 của Tổng cục trưởng Tổng cục Hải quan và có hiệu lực thi hành sau 10 ngày kể từ ngày ký. Không hồi tố các trường hợp đã áp dụng mức giá tính thuế trước khi Quyết định có hiệu lực thi hành.

Điều 4: Các Ông Cục trưởng Cục Kiểm tra - Thu thuế XNK, Cục trưởng Cục Hải quan các tỉnh, thành phố chịu trách nhiệm thi hành Quyết định này.

DECISION

AMENDING AND SUPPLEMENTING THE MINIMUM PRICES FOR ITEMS NOT FALLING UNDER THE LIST OF ITEMS SUBJECT TO THE STATE PRICE MANAGEMENT

THE GENERAL DIRECTOR OF CUSTOMS

Pursuant to the competence and the principles of price determination for calculation of taxes on import and export goods stipulated at Article 7 of Decree No. 54/CP of August 28, 1993 of the Government;
Pursuant to Circular No. 172/1998/TT/BTC of December 22, 1998 of the Ministry of Finance guiding the implementation of Decree no. 54/CP of August 28, 1993 of the government;
Pursuant to Circular No. 82/1997/TT-BTC of November 11, 1997, Circular No. 92/1999/TT-BTC of July 24, 1999 of the Ministry of Finance stipulating the competence of setting price for calculation of taxes of the General Department of Customs;
Pursuant to Decision No. 164/2001/QD-BTC of October 10, 2000 of the Minister of Finance;
Pursuant to Article 3 of Decision No. 177/2001/QD-TCHQ of March 14, 2001 of the General Director of Customs;
At the proposal of the Head of the Inspection and Import Export Tax Collection Department,

DECIDES:

Article 1: To adjust the minimum prices of synchronous components sets for motorbikes stipulated at the prices table issued together with Decision No. 177/2001/QD-TCHQ of March 14, 2001 of the General Director of Customs as follows:

. The synchronous components sets for motorbikes produced by China:

+ 50cc: US$320/set

+ 100cc and 110 cc: US$450/set

+ From 125cc upward: US$650/set

Article 2: The minimum prices for localized motorbike component sets shall be calculated on the basic of the minimum prices for synchronous component sets stipulated at Article 1 of this Decision excluded the localization rate accepted by the Ministry of Industry.

Article 3: The minimum prices for motorbike component sets adjusted in this Decision replace the items of same kind stipulated at the prices table issued together with Decision No. 177/2001/QD-TCHQ of March 14, 2001 of the General Director of Customs and takes effect 10 days after its signing. The cases applied the tax calculation price rates before the Decision takes effect are not be retroactive.

Article 4: The Head of the Inspection and Import Export Tax Collection Department, the Heads of the Departments of Customs of the provinces and cities shall have to implement this Decision.
